<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3662</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To temporarily increase the cost share authority for aqueous film forming foam input-based testing equipment, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idb7fdc68c1a8b4a28b235905c1e604700" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing PFAS Runoff at Airports Act</short-title></quote>.</text></section><section id="id15d6c043bebc42bfb2388bec983bacfd" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Temporary increased cost share authority for aqueous film forming foam input-based testing equipment</header><subsection id="id602b394714444f67bbfcdbfe21589a3d" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 47109 of title 49, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida18825ce2aa34c949aa355af0b4b998a" changed="not-changed"><subsection id="id0147006bfb2641c2ac35d323ce40d459" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(g)</enum><header display-inline="yes-display-inline">Special rule for covered equipment</header><paragraph id="idbc29e9a30d62460fa6b178e0721d5dc5" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Government’s share of allowable project costs for covered equipment and its installation shall be 100 percent.</text></paragraph><paragraph id="idd7260e8fe3c540aa95f34959cb0b6ea7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Definition of covered equipment</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>covered equipment</term> means aqueous film forming foam input-based testing equipment that is eligible for Airport Improvement Program funding based on Federal Aviation Administration PGL 21–01, titled <quote>Extension of Eligibility for stand-alone acquisition of input-based testing equipment and truck modification</quote>, dated October 5, 2021 (or any other successor program guidance letter).</text></paragraph><paragraph id="id13CB550F07164D408919EB802152CAA3" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The higher cost share authority established in this subsection shall terminate on the earlier of—</text><subparagraph id="id225EC9374C16475B8712A866B4D3561B" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">180 days after the date on which the eligibility of covered equipment for Airport Improvement Program funding under the authority described in paragraph (2) terminates or is discontinued by the Administrator; or</text></subparagraph><subparagraph id="id0209FEEDF2A34C6AAAEA416B8552B437" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">5 years after the date of enactment of this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="idc8a64f7f141846d4ba6e8d2b49782be4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Outreach efforts</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall conduct an outreach effort to make airports aware of the higher cost share authority established in section 47109(g) of title 49, United States Code, as added by subsection (a).</text></subsection><subsection id="ide84104c0bf294032a12ff38667124fd3" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Forward-looking airport reimbursements</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall provide a briefing to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives that reviews—</text><paragraph id="id22dbc18e094e49b9bd757e04d8af6a97" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">potential options for Congress to reimburse airports that—</text><subparagraph id="ida2babbaa85f44775a648f687048f1422" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">are certificated under part 139 of title 14, Code of Federal Regulations; and</text></subparagraph><subparagraph id="idcf9bcabfa8d64cf6a9a03c67522ad11e" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">acquired covered equipment (as defined in section 47109(g) of title 49, United States Code) as added by subsection (a)—</text><clause id="id064C2155DE354C5F8B347724833B9181" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">with Federal funding but with a Government’s share less than 100 percent; or</text></clause><clause id="id51852fac31ee4c4c92d3318ca7067a10" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">without Federal funding;</text></clause></subparagraph></paragraph><paragraph id="id722a3a3cc4e8482db09e2ad8a6ecfaee" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">information relevant to estimating the potential cost of providing such reimbursement;</text></paragraph><paragraph id="id5b2151f5c2cd4a9f9d19dfb563443296" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">the status of the Federal Aviation Administration’s outreach efforts as required under subsection (b); and</text></paragraph><paragraph id="id5f65ccdf5faf45f7ba9931185837f412" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">any additional information the Administrator of the Federal Aviation Administration considers appropriate.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220906" chamber="Senate">Passed the Senate September 6, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
