<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3660</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220216">February 16, 2022</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> (for herself, <cosponsor name-id="S309">Mr. Casey</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, and <cosponsor name-id="S386">Ms. Duckworth</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to make diapers an allowable expense for purposes of health flexible spending arrangements and health savings accounts.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id3488046ABB794ADCAAD9ED8EE76A29E6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Diaper Inclusion in Accounts for Parental Expense Reduction Act</short-title></quote> or the <quote><short-title>DIAPER Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id9DA9DFFE797843BDB2894AA5F54C7628"><enum>2.</enum><header>Inclusion of diapers as qualified medical expenses</header><subsection id="id4468E17B06FE4CA7AD2BF41020497577"><enum>(a)</enum><header>HSAs</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="id02F87F0993CC49EEBEA2165204396F37"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>products</quote> in the second sentence and inserting <quote>products and diapers</quote>, and</text></paragraph><paragraph id="idE3185E032F6F4F6FB317FF9A5871B275"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDFB31A09C26A4ACE869E00E982D2D6DD"><subparagraph id="id417C1BA5E8D54C97856F0DF1CA980DE3"><enum>(E)</enum><header>Diaper</header><text>For purposes of this paragraph, the term <term>diaper</term> means a disposable absorbent garment for infants to be used for the purposes of maintaining the health of the infant by ensuring excreta is collected.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7C339DCCCF974002A65C868F6B77A103"><enum>(b)</enum><header>FSAs</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/106">Section 106(f)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="idD107FEBE6DEC49A68B0AAAF04D4DC3E5"><enum>(1)</enum><text>by striking <quote>shall be treated</quote> and inserting <quote>and diapers (as defined in section 223(d)(2)(E)) shall be treated</quote>, and</text></paragraph><paragraph id="id5547A1987B014B01BA3F92ACDDE482A0"><enum>(2)</enum><text>by inserting <quote><header-in-text level="subsection" style="OLC">and diapers</header-in-text></quote> in the heading after <quote><header-in-text level="subsection" style="OLC">products</header-in-text></quote>.</text></paragraph></subsection><subsection id="id8A0E3E9E81164C259CCA184F30F2484A"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
