which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Director of the Office of Management and Budget to require the disclosure of violations of Federal law with respect to human trafficking or alien smuggling, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBA05731F8B5948798631512D2840BFFA"><section section-type="section-one" id="HBFC6C21138D94578848BA556B75EC06B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Federal Funds from Human Trafficking and Smuggling Act of 2022</short-title></quote>.</text></section><section id="H62765A9941B04B82A19A67CEAFA7F9FE"><enum>2.</enum><header>Mandatory disclosures of human trafficking and alien smuggling</header><subsection id="HCC81A1BBCC2A4BCC811BECEBCEB4D025"><enum>(a)</enum><header>Limitation on award of Federal funds</header><paragraph id="H248A9D4A466940C1A0DA9EBB895AE68D"><enum>(1)</enum><header>Future recipients</header><text>Beginning not later than 120 days after the date of the enactment of this Act, no Federal funds may be awarded to a nonprofit entity unless such entity submits to the Director of the Office of Management and Budget a certification that the entity—</text><subparagraph id="id6F970B5142BC4E41913C250843208E72"><enum>(A)</enum><text>is in compliance with Federal law with respect to human trafficking, alien smuggling, fraud, bribery, and gratuity; and </text></subparagraph><subparagraph id="id71322B66460242248D1E42449A36034D"><enum>(B)</enum><text>has not been convicted of an offense under section 274 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>).</text></subparagraph></paragraph><paragraph id="H6A804123A4044FBD80E388F917789809"><enum>(2)</enum><header>Current and prior recipients</header><subparagraph id="id8ED88803162A45F580AEB650FFFFBA95"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, each nonprofit entity that is in receipt of awarded Federal funds as of the date of the enactment of this Act, or was awarded Federal funds before January 1, 2021, and remains engaged in the activities for which such Federal funds were awarded, shall submit to the Director of the Office of Management and Budget a certification that the entity—</text><clause id="id53121E1C2D3042F39EA76E2F5AD99A39"><enum>(i)</enum><text display-inline="yes-display-inline">is in compliance with Federal law with respect to human trafficking, alien smuggling, fraud, bribery, and gratuity; and </text></clause><clause id="id9862669E8D76408290E4D90444666137"><enum>(ii)</enum><text display-inline="yes-display-inline">has not been convicted of an offense under section 274 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>). </text></clause></subparagraph><subparagraph id="id4B3F2E70A72146CABDA9E9B20123F512"><enum>(B)</enum><header>Effect of noncompliance</header><text display-inline="yes-display-inline">If an entity referred to in subparagraph (A) does not submit the certification required under such subparagraph before the date referred to in such subparagraph, or the Director of the Office of Management and Budget determines that the entity has violated section 274(a)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(A)</external-xref>), the entity shall reimburse the Federal Government for any Federal funds the entity received for the fiscal year in which such noncompliance occurred.</text></subparagraph></paragraph></subsection><subsection id="id7063D4B4219A4DDFA5B0B98C5154CC1D"><enum>(b)</enum><header>Denial of tax exemption</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/503">Section 503</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id236C5A42BD60420B98FF4911A74A724B"><subsection id="idFA5E2B87403049FFB2961723E0E4848A"><enum>(g)</enum><header>Denial of exemption for not meeting certain certification requirement</header><paragraph id="id5E5896BFFBD047E4B1E26539A1FD76DC"><enum>(1)</enum><header>In general</header><text>An organization described in section 501(c) shall not be exempt from taxation under section 501(a) if—</text><subparagraph id="id6637208D4CF54493B2AC00A51D8CFAB8"><enum>(A)</enum><text>such organization does not submit the certification required under section 2(a) of the <short-title>Protecting Federal Funds from Human Trafficking and Smuggling Act of 2022</short-title>; or</text></subparagraph><subparagraph id="id1CF5A8527AA64E7FA110E7EDC5EBDC51"><enum>(B)</enum><text>the Director of the Office of Management and Budget determines that such organization has violated section 274 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>).</text></subparagraph></paragraph><paragraph id="id4A8850527B934C19ACFDF0EE6C65186F"><enum>(2)</enum><header>Re-application for exemption</header><text>Beginning on the date that is one year after the date on which an organization described in section 501(c) is determined not to be exempt under paragraph (1), such organization may reapply to be exempt from taxation under section 501(a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCB1274337CC3481495AC48E9F0355D4E"><enum>(c)</enum><header>Reporting requirement</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall—</text><paragraph id="HF79CC576C4CE4DF7A9D0681446F71564"><enum>(1)</enum><text display-inline="yes-display-inline">develop a written strategy and best practices guide for nonprofit entities to ensure the entities comply with Federal law, including how to detect, deter, and report human trafficking and alien smuggling; </text></paragraph><paragraph id="HAEA2B687EF1043C28732A8F8F4CE9A43"><enum>(2)</enum><text display-inline="yes-display-inline">publish, on an internet website of the Department of Homeland Security, information regarding violations of any nonprofit entity that pertains to compliance with Federal and State laws involving human trafficking and alien smuggling; and</text></paragraph><paragraph id="H2CC7CFF011A146CD9CBE937D7F754264"><enum>(3)</enum><text display-inline="yes-display-inline">develop a written strategy to improve cooperation with nonprofit entities and Federal and State law enforcement agencies with respect to improving cooperation on deterring, detecting, reporting, and removing aliens.</text></paragraph></subsection><subsection id="H792D4E0020664AC483D95AD914A3CED7"><enum>(d)</enum><header>Report by Comptroller General</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Comptroller General of the United States shall submit a report to Congress that identifies each failure by a nonprofit entity to comply with the certification requirement under subsection (a) during the reporting period.</text></subsection><subsection id="H874476A92B144628A40FCBE980F0F6DC"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">The requirement under subsection (a) shall apply to any nonprofit entity awarded Federal funding, including any nonprofit entity that has an agreement, contract, award, or relationship with the Federal Government on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
