which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an advisory committee to provide independent advice and recommendations to the Secretary of Transportation regarding comprehensive, interdisciplinary issues relating to transportation from a variety of stakeholders in transportation planning, design, research, policy, and advocacy, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2A3ED75E1178404FA045663D8C406873"><section section-type="section-one" id="H4667939FE9D64D4DB0581E97CDC43038"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Equity Act</short-title></quote>. </text></section><section id="H85C8AE1FDA1D491C8401D4719221FDC7"><enum>2.</enum><header>Transportation Equity Committee</header><subsection id="id754C6B3EE34944D1B295402871D8B0D1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id85968ABCFB04421686028481E9E31B93"><enum>(1)</enum><header>Committee</header><text>The term <term>Committee</term> means the Transportation Equity Committee established under subsection (b). </text></paragraph><paragraph id="id1BA757F48BB549C2914A55F56AA509CA"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation. </text></paragraph></subsection><subsection id="id6E4B55B7A8354BC4AAE93F97F80C57FD"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary shall establish an advisory committee, to be known as the Transportation Equity Committee, to study and provide advice on comprehensive and interdisciplinary issues relating to transportation equity from a variety of stakeholders in transportation planning, design, research, policy, and advocacy.</text></subsection><subsection id="H03BEE381AC59495DAA613AAED03E99FF"><enum>(c)</enum><header>Purpose of Committee</header><text display-inline="yes-display-inline">The Committee shall provide independent advice and recommendations to the Secretary on transportation equity, including by developing a strategic plan that includes recommendations to the Secretary on national transportation metrics and the effect of transportation equity on such factors as economic development, connectivity, accessibility, and public engagement.</text></subsection><subsection id="H7EB4B8ABA5CE41C999E3A6F8D7868828"><enum>(d)</enum><header>Duties</header><text display-inline="yes-display-inline">The Committee shall evaluate the work of the Department of Transportation in—</text><paragraph id="id22DDBD938CCD46C7A276C7378DD8E44E"><enum>(1)</enum><text display-inline="yes-display-inline">connecting people to economic and related forms of opportunity; </text></paragraph><paragraph id="id5629520694DD4BE89C96BC73D521BFA3"><enum>(2)</enum><text display-inline="yes-display-inline">revitalizing communities in carrying out strategic, research, technological, regulatory, community engagement, and economic policy activities relating to transportation and opportunity; and</text></paragraph><paragraph id="id18A8677791D84590B446C33BE3E9AF38"><enum>(3)</enum><text>ensuring equal access to transportation for all residents, including those with disabilities and older adults. </text></paragraph></subsection><subsection id="H6A642816F6DA4A3EABE1917C90A5525C"><enum>(e)</enum><header>Membership</header><paragraph id="HA9B0DD5EE2CA48579A8220C37A736456"><enum>(1)</enum><header>In general</header><text>The Secretary shall appoint an odd number of not less than 9 but not more than 15 members to the Committee, which shall include balanced representation with varying points of view from academia, community groups, industry and business, nongovernmental organizations, State and local governments, federally recognized Indian Tribes, advocacy organizations, and indigenous groups.</text></paragraph><paragraph id="H3974525C4B5F4E76A020CA302FA1FBC5"><enum>(2)</enum><header>Broad representation</header><text display-inline="yes-display-inline">To the extent practicable, members of the Committee shall reflect—</text><subparagraph id="idF76DB00D50BB4AF9B3DDB7A15DC8F54B"><enum>(A)</enum><text display-inline="yes-display-inline">a variety of backgrounds and experiences;</text></subparagraph><subparagraph id="idA64351FEC2A343E188B6A0E3E0B4E8D6"><enum>(B)</enum><text display-inline="yes-display-inline">geographic diversity, including urban, rural, Tribal, territorial, and underserved and marginalized communities throughout the United States; and</text></subparagraph><subparagraph id="id797640CC9C574709AE964FD5CC4D5511"><enum>(C)</enum><text display-inline="yes-display-inline">individuals with expertise in related areas such as housing, health care, disability access, and the environment.</text></subparagraph></paragraph><paragraph id="HC02FC419E1B34735BDCFE24E4CEA1A1F"><enum>(3)</enum><header>Replacement for inactive members</header><text>If a member misses 3 consecutive meetings, the Secretary may—</text><subparagraph id="idADFA91C1FDDA4C17B98042D9247C6D8F"><enum>(A)</enum><text>remove the member; and</text></subparagraph><subparagraph id="id6FC07EF8A4BD4F6C8D890E76EEC40EFE"><enum>(B)</enum><text>appoint a replacement to serve for the remainder of the term as provided under subsection (i).</text></subparagraph></paragraph></subsection><subsection id="HA8B04E5594D543198E07EB01DDBDE68A"><enum>(f)</enum><header>Designated Federal officer</header><paragraph id="H6B76B3F4D45E42A5ACACAD9BBC58CEA3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall appoint a full-time Federal employee as the Designated Federal Officer for the Committee, who shall—</text><subparagraph id="id41259EADF8A54936A8B0C97C821E6F5B"><enum>(A)</enum><text display-inline="yes-display-inline">serve as the coordinator of the Committee; and</text></subparagraph><subparagraph id="id749E629494FE490894F44A99EF0BACFA"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that administrative support is provided for the Committee, including by carrying out the responsibilities described in paragraph (2).</text></subparagraph></paragraph><paragraph id="H6F805004EB464CA8AA59E2ED4ECD66B6"><enum>(2)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Designated Federal Officer shall—</text><subparagraph id="H58DAB934A05341629A3766A5EC401098"><enum>(A)</enum><text display-inline="yes-display-inline">call meetings of the Committee, and any subcommittees that the Committee designates, after consultation with the Chair;</text></subparagraph><subparagraph id="H1BAE66530B0E482480460754879B6889"><enum>(B)</enum><text>formulate and approve an agenda, in consultation with the Chair, for each meeting;</text></subparagraph><subparagraph id="H6DAA147E38B34D7C9A1C5BD0157C7142"><enum>(C)</enum><text>notify all Committee members of the time, place, and agenda for any meeting;</text></subparagraph><subparagraph id="H6BBC2B0EA24541BD9F50B6F1A392F292"><enum>(D)</enum><text>provide administrative support for all meetings of the Committee;</text></subparagraph><subparagraph id="H18A03CF967B44164BEE48157B6DFBDB3"><enum>(E)</enum><text>attend each Committee and subcommittee meeting;</text></subparagraph><subparagraph id="H592B365BCB6F43C49810767A35BB8882"><enum>(F)</enum><text>maintain all Committee files and records, including minutes from each meeting; </text></subparagraph><subparagraph id="H9EC18B67618A4EFBBA901BB31AFE4EDB"><enum>(G)</enum><text>adjourn any meeting when it is determined to be in the public interest;</text></subparagraph><subparagraph id="idA200F0AAF99D4819B0BE5275792326CD"><enum>(H)</enum><text>serve as the chair at a meeting, if directed to do so by the Secretary;</text></subparagraph><subparagraph id="HA9C8149650264254918CD0D424CEAD37"><enum>(I)</enum><text>make available to the public meeting notes and information; and</text></subparagraph><subparagraph id="HA442FC46DDBE4397BEB0DEC42F035E89"><enum>(J)</enum><text>publish in the Federal Register notice of any meeting of the Committee not less than 15 days before the meeting. </text></subparagraph></paragraph></subsection><subsection id="H9754460F85FE45A89A01D0FC0AF26B44"><enum>(g)</enum><header>Meetings</header><paragraph id="idE5EC3ED447CB4E1B85BADACE3741D9D3"><enum>(1)</enum><header>In general</header><text>The Committee shall meet not less than 2 times each year, with not more than 9 months between meetings.</text></paragraph><paragraph id="id16EE5638E31441E894B1AC637C82F82C"><enum>(2)</enum><header>Time and place</header><text>Meetings of the Committee shall be—</text><subparagraph id="idEC51622D038947259D399FDD1F7EAF17"><enum>(A)</enum><text>at a reasonable time; </text></subparagraph><subparagraph id="id31BC961A3D1A4C9FA58549023403B267"><enum>(B)</enum><text>in a place accessible to the public; </text></subparagraph><subparagraph id="idE2F04BB4471741F5A2AE233E3DB34421"><enum>(C)</enum><text>in a room—</text><clause id="id61E4730768284AF1A459DFBF424C6010"><enum>(i)</enum><text>large enough to accommodate at least 100 people, including the Committee members, staff, and a reasonable number of interested members of the public; and</text></clause><clause id="id20383DCAAB314239AC189DE21A9D3237"><enum>(ii)</enum><text>that is in compliance with the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>); and</text></clause></subparagraph><subparagraph id="idA017C44E5A8F4072B5AA7DB22C4356C3"><enum>(D)</enum><text>in compliance with section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="id8C0A003FFC49440A96D1B0F0D8CDD75F"><enum>(h)</enum><header>Quorum</header><text>A quorum shall be a majority of the members of the Committee, rounded up to the nearest odd number.</text></subsection><subsection id="HD67DE193071A4F628025C5AD8EBC5943"><enum>(i)</enum><header>Term</header><paragraph id="id3CDD5EC000174B6592D66E54FDE9357A"><enum>(1)</enum><header>In general</header><text>Each member of the Committee shall serve a 2-year term with not more than 2 consecutive term reappointments. </text></paragraph><paragraph id="idD7173BE981144DC290801749B170B368"><enum>(2)</enum><header>Delayed replacements</header><text>Notwithstanding paragraph (1), a member may continue service until a replacement member is appointed.</text></paragraph></subsection><subsection id="H3B1756CE70164AE7BE6A1CCFB42DF9C1"><enum>(j)</enum><header>Support</header><text>The Office of the Under Secretary for Policy of the Department of Transportation shall provide necessary funding, logistics, and administrative support for the Committee.</text></subsection><subsection id="HC2640DED596B4112A4B5B92F8B4D56DE"><enum>(k)</enum><header>Application of FACA</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Committee. </text></subsection></section></legis-body></bill>
