<official-title>To require the Commandant of the Coast Guard to establish an interim behavioral health policy for members of the Coast Guard that achieves parity with the behavioral health policy of the Department of Defense, and for other purposes.</official-title>

<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guarding Mental Health Act</short-title></quote>.</text></section> <section id="id11AAA3311BF942E7A53E000A1302C128"><enum>2.</enum><header>Coast Guard behavioral health policy</header> <subsection id="idBD9F55E84A684896B0E7D64D024537EC"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text>
<paragraph id="id5CAB89309C514F02860A5B1DC9159670"><enum>(1)</enum><text>members of the Coast Guard—</text> <subparagraph id="idF11CF13341CB491094418F681C4E738C"><enum>(A)</enum><text>are exposed to high-risk, and often stressful, duties; and</text></subparagraph>
<subparagraph id="id2B1F2D6FC1B5494387254C9F1F4F36C4"><enum>(B)</enum><text>should be encouraged to seek medical treatment and professional guidance; and</text></subparagraph></paragraph> <paragraph id="id721C1456C46D4796879506D60B1CD47B"><enum>(2)</enum><text>after treatment for behavioral health conditions, many members of the Coast Guard should be allowed to resume service in the Coast Guard if—</text>
<subparagraph id="id98618A8167FF4D7DA95818FD1128FD39"><enum>(A)</enum><text>they are able to do so without persistent duty modifications; and</text></subparagraph> <subparagraph id="idCC13D7F7335F46768A2ED7D0B6EE1586"><enum>(B)</enum><text>do not pose a risk to other members of the Coast Guard.</text></subparagraph></paragraph></subsection>
<subsection id="id3187F98F3EC84D51ACB0A3A12BEC2C24"><enum>(b)</enum><header>Interim behavioral health policy</header>
<paragraph id="id7A893E0843744695B05F0FF3FFA16189"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, the Commandant of the Coast Guard (referred to in this section as the <quote>Commandant</quote>) shall establish an interim behavioral health policy for members of the Coast Guard that is in parity with section 5.28 (relating to behavioral health) of Department of Defense Instruction 6130.03, volume 2, <quote>Medical Standards for Military Service: Retention</quote>. </text></paragraph> <paragraph commented="no" id="idDC2C1D92A30E46CCBF834C3F8C7845E5"><enum>(2)</enum><header>Termination</header><text>The interim policy established under paragraph (1) shall remain in effect until the date on which the Commandant issues a permanent behavioral health policy for members of the Coast Guard.</text></paragraph></subsection>
<subsection id="idF2808F0F288448998B4F5D4F09867C98"><enum>(c)</enum><header>Permanent policy</header><text>In developing a permanent policy with respect to retention and behavioral health, the Commandant shall ensure that the policy of the Coast Guard is in parity with section 5.28 (relating to behavioral health) of Department of Defense Instruction 6130.03, volume 2, <quote>Medical Standards for Military Service: Retention</quote>.</text></subsection></section> </legis-body> </bill>
