which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Health and Human Services to establish a grant program to promote comprehensive mental health and suicide prevention efforts in schools, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9A248CC277654338877934065D743F9F"><section section-type="section-one" id="H038849B8E3824A3E8C5AD879224B6B84"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Youth Mental Health and Suicide Prevention Act</short-title></quote>.</text></section><section id="H141F4F507F0743DBB56C2A04F8E73910"><enum>2.</enum><header>Coordinated promotion of school comprehensive mental health and suicide prevention plans</header><subsection id="H22821CC4488E45E2A18EBE78DC2ACFCD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Center for Mental Health Services of the Substance Abuse and Mental Health Services Administration, may carry out a program to award grants, on a competitive basis, to eligible entities to enhance services for school-age youth with mental health and behavioral health issues that can lead to low academic proficiency, low rates of school attendance and graduation, and other negative outcomes, including depression, substance abuse, and suicide attempts. </text></subsection><subsection id="H73370CB8D05845FAAFCD1DE9A6286ED9"><enum>(b)</enum><header>Application</header><text>To be eligible for a grant under this section, an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including, at a minimum—</text><paragraph id="HAA57D82D54B743DF984911A67D6393C9"><enum>(1)</enum><text display-inline="yes-display-inline">a description of identified mental health and behavioral health needs of school-age youth served by such eligible entity;</text></paragraph><paragraph id="HF7BB8427ADD541C285191F6D141244C9"><enum>(2)</enum><text display-inline="yes-display-inline">a description of revenue from Federal, State, local, private, and institutional sources the eligible entity has available to address the needs described in paragraph (1);</text></paragraph><paragraph id="HDDBB34063F4444D4B434DEE4F2414C44"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the eligible entity's proposed plan for using the grant funds to increase access to evidence-based mental and behavioral health services;</text></paragraph><paragraph id="idA0AF018ED02B459DAA236F41372C3172"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the eligible entity's proposed plan for improving mental health equity and assisting school-age youth most in need of mental health services;</text></paragraph><paragraph id="H67F784E8A1504750A0BF29009F640777"><enum>(5)</enum><text display-inline="yes-display-inline">a description of how such eligible entity will involve, as appropriate, school-age youth and peer representatives in the planning, implementation, and evaluation processes related to the use of grant funds and for purposes of achieving mental health equity;</text></paragraph><paragraph id="H425AA70ED42747D4924EC2EB92595056"><enum>(6)</enum><text display-inline="yes-display-inline">a description of how such eligible entity will support other school-age youth and the school community if a school-age youth attempts suicide or dies by suicide; </text></paragraph><paragraph id="HBB9D1B1C237541F1A85F1FA1FDF8C0B3"><enum>(7)</enum><text display-inline="yes-display-inline">a plan to—</text><subparagraph id="H93FC812C6D394D92A9A695C55CEC8BFA"><enum>(A)</enum><text>implement the activities described in subsection (c); and</text></subparagraph><subparagraph id="HDDDEB7BCF50745ADAD75A4D76339A2B2"><enum>(B)</enum><text>evaluate the outcomes of such activities; and</text></subparagraph></paragraph><paragraph id="HDC1B86C590EC45EA89BAFAC665F22A38"><enum>(8)</enum><text display-inline="yes-display-inline">an assurance that such eligible entity will submit to the Secretary, for each fiscal year in which grant funds are used, a report with respect to—</text><subparagraph id="H24FF64A0F9C040EA90B393D17E235493"><enum>(A)</enum><text>the activities carried out under subsection (c); and</text></subparagraph><subparagraph id="HEA4D1CFB601A4B4584117D102F77F74B"><enum>(B)</enum><text>the outcomes of such activities, reported in accordance with the requirements of section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>).</text></subparagraph></paragraph></subsection><subsection id="HA2274E9BFDA942C1A8188BA1F4FDA28A"><enum>(c)</enum><header>Allowable uses of grant funds</header><text>A grant awarded under this section may be used by an eligible entity for—</text><paragraph id="H20CF8873E27444989186FEC67B18F374"><enum>(1)</enum><text display-inline="yes-display-inline">evaluating existing program activities and prevention strategies;</text></paragraph><paragraph id="H288ECDBE6C364F66804F0D2CEDE45758"><enum>(2)</enum><text display-inline="yes-display-inline">educational seminars;</text></paragraph><paragraph id="H8C801FC5B2B4418CB7980D983568B30D"><enum>(3)</enum><text display-inline="yes-display-inline">educational awareness campaign materials for school-age youth, families of school-age youth, and school staff to increase the awareness of potential mental and behavioral health issues of school-age youth;</text></paragraph><paragraph id="HA9567027BEB54E7BA2BB8FBE912B767E"><enum>(4)</enum><text display-inline="yes-display-inline">peer-to-peer program support;</text></paragraph><paragraph id="H8E87BAB21086447B8A5075F4B1B8DA14"><enum>(5)</enum><text display-inline="yes-display-inline">programs that assist schools in adopting a public health approach to mental health; </text></paragraph><paragraph id="HEBF3ABA7F0FD426AB2B904237B270538"><enum>(6)</enum><text display-inline="yes-display-inline">social media applications used for mental and behavioral health purposes, such as suicide risk and mental health screenings;</text></paragraph><paragraph id="H45E998D57CB949309157B84E4BFBD31C"><enum>(7)</enum><text display-inline="yes-display-inline">providing mental health services for school-age youth through telehealth;</text></paragraph><paragraph id="H7CDC5997B2C045D4A2095BB1E754C7BF"><enum>(8)</enum><text display-inline="yes-display-inline">training programs for school-age youth and teachers, school leaders, and other school personnel to learn to respond effectively to school-age youth with mental health and behavioral health issues that can lead to low academic proficiency, low rates of school attendance and graduation, and other negative outcomes, including depression, substance abuse, and suicide attempts; and</text></paragraph><paragraph id="id3ED893E97219447DA83E6A36007B4859"><enum>(9)</enum><text>providing culturally specific mental health and substance use education and prevention programs for school-age youth.</text></paragraph></subsection><subsection id="id941c6aaac9854d7890bd14c57ef34a1d"><enum>(d)</enum><header>Geographical representation</header><text>In awarding grants under this section, the Secretary shall ensure that grant funds are distributed with the greatest possible geographical representation, including to State and local educational agencies that serve rural areas. </text></subsection><subsection id="id70E91362CA45442C89864934516915B2"><enum>(e)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to grantees in carrying out this section.</text></subsection><subsection id="HC9B240ACC6CD449D92FC09E3F9F5E7DD"><enum>(f)</enum><header>Study and report</header><paragraph id="H58ED7F9351FE49A6B8C7B106CAC47BCC"><enum>(1)</enum><header>Study</header><text>For each fiscal year during which grants are awarded under this section, the Secretary shall conduct a study on the results of the grant program.</text></paragraph><paragraph id="H525C20788EA34DF9B6192F5FEAE0A2FF"><enum>(2)</enum><header>Report</header><text>For each study conducted under paragraph (1), the Secretary shall submit to Congress a report on the results of such study, including—</text><subparagraph id="H89FF5ED7188B4AA58FB6238A4292C7D1"><enum>(A)</enum><text>an evaluation of the outcomes of the grant program, including a summary of activities carried out by eligible entities and the results of such activities; and</text></subparagraph><subparagraph id="H7928918B405443D3A6C247974BBF32F9"><enum>(B)</enum><text>recommendations with respect to improving access to mental health and behavioral heath services at schools, including efforts to reduce the occurrence of suicide and substance abuse.</text></subparagraph></paragraph></subsection><subsection id="H1BD918D14CCA4A8D9C8ECE73CE520BD9"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB9D115F339F648D7AE5EBFED4A50D9A0"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="idE332D4836254467B80A8C886724761B4"><enum>(A)</enum><text display-inline="yes-display-inline">a local educational agency;</text></subparagraph><subparagraph id="id99F3A8D8593D40FBBD5B8E30A07F3E3C"><enum>(B)</enum><text display-inline="yes-display-inline">a State educational agency; or</text></subparagraph><subparagraph id="id250D0A71E43940F3A8B6430562AAC12D"><enum>(C)</enum><text>an Indian Tribe or Tribal organization.</text></subparagraph></paragraph><paragraph id="H32897D84497D4825AAFD6FF26648D18B"><enum>(2)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>local educational agency</term> and <term>State educational agency</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="id01E1BF8D8BC74665B994C7D9B3E24E54"><enum>(3)</enum><header>Indian Tribe; Tribal organization</header><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given the terms <quote>Indian tribe</quote> and <quote>tribal organization</quote>, respectively, in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id93FF382DCE354BA79ACC0ADDB2B66B7A"><enum>(4)</enum><header>School-age youth</header><text>The term <term>school-age youth</term> means—</text><subparagraph id="id476d55e1452e46d79fe07b4ab80c1dff"><enum>(A)</enum><text>individuals between the ages of 5 and 17, inclusive; and</text></subparagraph><subparagraph id="id8efa94ab049f45f7856c34a4bb73aa6e"><enum>(B)</enum><text>children with disabilities, as defined in section 602(3) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)</external-xref>), who receive services under part B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1411">20 U.S.C. 1411 et seq.</external-xref>). </text></subparagraph></paragraph><paragraph id="H18BCEC95C7854F71A656E5FEE2E48CDC"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, in consultation with the Secretary of Education and the heads of other appropriate agencies.</text></paragraph></subsection><subsection id="id4E0AAA882E7D45F79813256878813016"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="idD8412295CC9440A0A484B769033A6B2A"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></paragraph><paragraph id="id6C759A6E94D24B8EA871A6F00E6813F3"><enum>(2)</enum><header>Set-aside</header><text>Of the amount appropriated to carry out this section for a fiscal year, 10 percent shall be reserved for grants to eligible entities that serve Indian Tribes or Tribal organizations. </text></paragraph></subsection></section></legis-body></bill>
