which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Office of National Drug Control Policy Reauthorization Act of 2006 to modify the authority of the Office of National Drug Control Policy and the United States Anti-Doping Agency, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Confidence to the World Anti-Doping Agency Act of 2022</short-title></quote>.</text></section><section id="idEA5683D6B7E745128B75A20D855174AA"><enum>2.</enum><header>Authority of the United States Anti-Doping Agency with respect to the World Anti-Doping Agency</header><text display-inline="no-display-inline">Section 701 of the Office of National Drug Control Policy Reauthorization Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/21/2001">21 U.S.C. 2001</external-xref>) is amended—</text><paragraph id="id839457AD6A4E403981EF57EF1EB848D5"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id0437333E9B5F443D85DA14B59A97B90C"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA005E732BCB94BA49C79EAAA7F0392A5"><paragraph id="id3F68B292B2084E6B9EC4FB0C68FCD031"><enum>(1)</enum><header>United States Olympic and Paralympic Committee</header><text>The term <term>United States Olympic and Paralympic Committee</term> means the organization established by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id1C2FDE5D9BCE42E2A8CDFEFC83F7E4F4"><enum>(B)</enum><text>by redesignating paragraphs (1) and (3) as paragraphs (4) and (1), respectively, and moving the paragraphs so as to appear in numeric order; and</text></subparagraph><subparagraph id="id6C6946FB7EA34801B1BE1BC4C3877D2B"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF2EE0763B7FF436DA68549C3B0E47C78"><paragraph id="id0623E69DE77142B6AF53AD0BAC3A7F68"><enum>(3)</enum><header>Independent athlete</header><text>The term <term>independent athlete</term> means an amateur athlete who does not serve, in any capacity, in—</text><subparagraph id="idADA4FEE1622F4E9EBAD5985D9A2C7B5A"><enum>(A)</enum><text>the International Olympic Committee;</text></subparagraph><subparagraph id="id491F9E74C81041D79BD173BF36BE18F8"><enum>(B)</enum><text>the International Paralympic Committee;</text></subparagraph><subparagraph id="idC3E8007F7A51467CBBE79D521BE2C010"><enum>(C)</enum><text>an international sports federation recognized by the International Olympic Committee or the International Paralympic Committee;</text></subparagraph><subparagraph id="idCAD0A5DDF7854442964A2B7929F7403C"><enum>(D)</enum><text>the United States Olympic and Paralympic Committee; or</text></subparagraph><subparagraph id="id2BF98D34872549FB9168EE555D4B0D75"><enum>(E)</enum><text>the World Anti-Doping Agency.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idB80CECC806034893BC911C130E68B147"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id0247AE474212445093E8CF251ADD0296"><enum>(A)</enum><text>by striking <quote>United States Olympic Committee</quote> each place it appears and inserting <quote>United States Olympic and Paralympic Committee</quote>;</text></subparagraph><subparagraph id="id9160849749DB45C681C2E43C3A3E52DD" commented="no"><enum>(B)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id9869DF1104174939B4F1CB40F2121503"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1239AB291BFE419BA8699DF0F55A3040"><paragraph id="idE327B76A650548358FE0E4B8A489C262"><enum>(5)</enum><text>carry out responsibilities with respect to the World Anti-Doping Agency, as described in subsection (c).</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idFF4C3D38DC7041A7948B9BE1D5956289"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3719BBA283E1418F8D5112A9DA915D79"><subsection id="id6a59118591cb438bb7206ad0c8edd112"><enum>(c)</enum><header>Authority with respect to the World Anti-Doping Agency</header><paragraph id="id3e3c9b54a6ef48d4893c86d5749a4ade"><enum>(1)</enum><header>In general</header><text>The Office of National Drug Control Policy, in conjunction with the United States Anti-Doping Agency, shall—</text><subparagraph id="id663bb7045c4b4ccba25247a50002fc9d"><enum>(A)</enum><text>use all available tools to ensure that—</text><clause id="id764C159062CE4F4199BC3D17F785822E"><enum>(i)</enum><text>the World Anti-Doping Agency maintains a proper conflict-of-interest policy that prohibits an individual from serving as a member of the Executive Committee of the World Anti-Doping Agency if, during the preceding 2-year period, the individual served in any capacity for a sports federation that is or was under the jurisdiction of the World Anti-Doping Agency; and</text></clause><clause id="id4D6C19B748BF48A098ECC1CAC6D73FE9"><enum>(ii)</enum><text>independent athletes from the United States and other democratic countries, or representatives of such athletes, have voting positions on the Executive Committee and governing bodies of the World Anti-Doping Agency, including the foundation board and all standing committees and working groups;</text></clause></subparagraph><subparagraph id="id61b09105b36146399f0a1cc33f5a9d08"><enum>(B)</enum><text>demonstrate leadership within the global community;</text></subparagraph><subparagraph id="ide8982cefb96743a8a0937bfee14cb6d3"><enum>(C)</enum><text>have strict standards that work toward countering the state-sponsored doping system of the Russian Federation and other state-sponsored, systemic fraud through doping; and</text></subparagraph><subparagraph id="idd5342dd0914e43d7ae9fcb72e02b4a1e"><enum>(D)</enum><text>work collaboratively with democratic countries.</text></subparagraph></paragraph><paragraph id="idfe2361f636ad479da01c9dccef72c2b0"><enum>(2)</enum><header>Determination</header><subparagraph id="id10D51A871F914E3A95DF5673FFF41DE5"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this subsection, the Office of National Drug Control Policy, in conjunction with the United States Anti-Doping Agency, shall make a determination as to whether the World Anti-Doping Agency—</text><clause id="idE1EAF9D7856D4512B2B95DBA6DDE47A2"><enum>(i)</enum><text>has a credible and independent governance model that provides for fair representation of the United States;</text></clause><clause id="idE9D4A059118B4276A235751F032C6808"><enum>(ii)</enum><text>maintains a conflict-of-interest policy described in paragraph (1)(A)(i); and</text></clause><clause id="id4B7A9A8ADDB849CF8EE74A5ABA85626A"><enum>(iii)</enum><text>allows independent athletes from the United States and other democratic countries, or representatives of such athletes, to have voting positions on the Executive Committee and governing bodies of the World Anti-Doping Agency, including the foundation board and all standing committees and working groups.</text></clause></subparagraph><subparagraph id="id404CE311FD784DD28E9F495E5541F232"><enum>(B)</enum><header>Accountability</header><text>In the case of a determination under subparagraph (A) that the World Anti-Doping Agency does not have such a governance model, maintain such a conflict-of-interest policy, or allow such voting positions, the Office of National Drug Control Policy, in conjunction with the United States Anti-Doping Agency, shall— </text><clause id="id1368094c288a491bb88d086b19788685"><enum>(i)</enum><text>submit a request to the Government Accountability Office to indicate the amount of United States taxpayer dollars used to pay dues to the World Anti-Doping Agency;</text></clause><clause id="id59ccee13aee54b23962d7675469fbbac"><enum>(ii)</enum><text>demand that the United States have fair representation in World Anti-Doping Agency, including not fewer than one representative on each of—</text><subclause id="idBD7508910C1C430F8C82A6C7120B398E"><enum>(I)</enum><text>the Executive Committee of the World Anti-Doping Agency; and</text></subclause><subclause id="id5E663B4D090B4EFF990A0AD04AB8B8B4"><enum>(II)</enum><text>any other governing body of the World Anti-Doping Agency for which the United States pays dues; and</text></subclause></clause><clause id="id494c90ea027f415d9774619cec6ff448"><enum>(iii)</enum><text>issue a report that describes the justifications, and the countries responsible, for blocking the United States from the Executive Committee of the World Anti-Doping Agency.</text></clause></subparagraph></paragraph><paragraph id="iddfbf6d9acf37496d853a0d03d082a96c"><enum>(3)</enum><header>United States participation in Executive Committee of the World Anti-Doping Agency</header><subparagraph id="id8f664799680e4f3b938fe2d3acff2928"><enum>(A)</enum><header>In general</header><text>As a condition of United States participation in the World Anti-Doping Agency—</text><clause id="id1a68220ad8064a4d96ca4b2567e5f93b"><enum>(i)</enum><text>the United States shall be allotted not fewer than one seat on the Executive Committee of the World Anti-Doping Agency for as long as such Executive Committee is a representative body as structured on the date of the enactment of this subsection; and</text></clause><clause id="id2281a93a0ec04321bc573e01b3281ac1"><enum>(ii)</enum><text>the World Anti-Doping Agency shall make a legal commitment to the Office of National Drug Control Policy and the United States Anti-Doping Agency that states there will be not fewer than one representative of the United States on such Executive Committee at all times. </text></clause></subparagraph><subparagraph id="id03fba3b5f8484c949e918865b8f830b4"><enum>(B)</enum><header>Refund of dues</header><text>If such Executive Committee appoints not fewer than one representative of the United States during the one-year period beginning on the date of the enactment of this subsection, the Office of National Drug Control Policy or the United States Anti-Doping Agency may not appeal to the World Anti-Doping Agency for a refund of dues paid during the period in which the United States did not have a representative on such Executive Committee.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
