which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a cap on costs for covered prescription drugs under Medicare parts B and D.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cutting Medicare Prescription Drug Prices in Half Act</short-title></quote>.</text></section><section id="idABFD8E1C10774FAF817306D08AD91810"><enum>2.</enum><header>Cap on costs for covered prescription drugs under Medicare parts B and D</header><subsection id="id5B4FFDE89A0B4E45A63B580C965E19CE"><enum>(a)</enum><header>In general</header><text>Title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4311C4B387FC4E37BBE965CCDFFA74CD"><section id="idD04475DBA1324D26A6E9454B7E0D515E"><enum>1899C.</enum><header>Cap on costs for covered prescription drugs under Medicare parts B and D</header><subsection id="id0231DDF399A94A29A7A523CAEBCDB40B"><enum>(a)</enum><header>In general</header><text>In no case may the amount of payment for a drug or biological under part B or a covered part D drug (as defined in section 1860D–2(e)) under a prescription drug plan under part D exceed the lower of the following:</text><paragraph id="id6E87A76C1397449C9BE077F6A127F3BA"><enum>(1)</enum><text>The amount paid by the Secretary of Veterans Affairs to procure the drug under the laws administered by the Secretary.</text></paragraph><paragraph id="id8B1FF67942AA41F685E62B76120789B9"><enum>(2)</enum><text>The amount paid to procure the drug through the Federal Supply Schedule of the General Services Administration.</text></paragraph></subsection><subsection id="id4A28AD66889F43D692E74872DD5543F9"><enum>(b)</enum><header>Manufacturer requirement</header><text>In order for coverage to be available under part B for a drug or biological of a manufacturer or under part D for a covered part D drug of a manufacturer, the manufacturer must agree to provide such drug or biological to providers of services and suppliers under part B or such covered part D drug to prescription drug plans under part D for an amount that does not exceed the maximum payment amount applicable under subsection (a).</text></subsection><subsection id="id4F15AF5AF2FB4D53A994483F8939BBB9"><enum>(c)</enum><header>Access to pricing information</header><text>The Secretary of Veterans Affairs and the Administrator of General Services shall provide to the Secretary of Health and Human Services the information described in paragraphs (1) and (2), respectively, of subsection (a) and such other information as the Secretary of Health and Human Services may request in order to carry out this section.</text></subsection><subsection id="id1A77FBA156E94332A523D58C7874FB0D"><enum>(d)</enum><header>Effective date</header><text>This section shall apply with respect to drugs furnished or dispensed on or after October 1, 2022.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5A8E00EF73AC49ABBA9C3761A70840CB"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id116D655A4E654D1097F6FA034010A6C1"><enum>(1)</enum><header>Application under part B</header><text>Section 1847A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3a">42 U.S.C. 1395w–3a</external-xref>) is amended—</text><subparagraph id="idD3F2A1F6B0F24ED8961E080A7B0CE07A"><enum>(A)</enum><text>in subsection (b)(1), by striking <quote>and (e)</quote> and inserting <quote>(e), and (i)</quote>;</text></subparagraph><subparagraph id="id3F34F4F16FFB4B118D35BE99A6CEABE9"><enum>(B)</enum><text>by redesignating subsection (i) as subsection (j); and</text></subparagraph><subparagraph id="idBF5772BF9C7540DBB66A91191FA39A84"><enum>(C)</enum><text>by inserting after subsection (h) the following subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id192ED031FD4843F3BADEC6F6F640CAC5"><subsection id="id7C2199F94EAB4BBC84D7AD09B53088C2"><enum>(i)</enum><header>Application of cap on costs for part B drugs</header><text>Notwithstanding the preceding provisions of this subsection, the amount of payment under this section for a drug or biological furnished on or after October 1, 2022, shall not exceed the maximum payment amount applicable to the drug or biological under section 1899C(a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H86353593EA194C9BA17FE48933D9730E"><enum>(2)</enum><header>Application as negotiated price under part D</header><text display-inline="yes-display-inline">Section 1860D–2(d)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(d)(1)(B)</external-xref>) is amended by adding at the end the following new sentence: <quote>Notwithstanding any other provision of this part, the negotiated price used for payment for a covered part D drug dispensed on or after October 1, 2022, shall not exceed the maximum payment amount applicable to the covered part D drug under section 1899C(a).</quote>.</text></paragraph></subsection></section></legis-body></bill>
