which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for improvements in the reimbursement of eligible health care providers through the Provider Relief Fund, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3BA32230E9D14BB780E02DE6C1229BE9"><section section-type="section-one" id="HF9A0BC2D9A0045EE862A43A396AEAA7C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Provider Relief Fund Improvement Act</short-title></quote>. </text></section><section id="HCBA02A76F0284242855912F461C87092"><enum>2.</enum><header>COVID–19 provider relief fund improvements</header><subsection id="H268BA0D45FBE4F5183D35F48440DD0D7"><enum>(a)</enum><header>Extension of deadline for eligible health care providers To use certain funds received from the COVID–19 provider relief fund</header><paragraph id="H74905BE1F26A4F92845F8DC797C35F8A"><enum>(1)</enum><header>Payment received periods 1 and 2</header><text>Effective June 29, 2021, the deadline by which an eligible health care provider is required to use reimbursements from the Provider Relief Fund received by such eligible health care provider during a covered payment received period is extended until the end of the COVID–19 emergency period.</text></paragraph><paragraph id="H18FFBC47473C44BA997D71E03B026E6E"><enum>(2)</enum><header>Adjustment of reporting time period</header><text>The Secretary shall make appropriate adjustments to the reporting time period (as specified in the Provider Relief Fund guidance) that corresponds to a covered payment received period to reflect the extension of the applicable deadline under paragraph (1).</text></paragraph><paragraph id="H8211026E2D4944F7BB22CC7201C915F7"><enum>(3)</enum><header>Modification of deadline for period 3</header><text>The deadline by which an eligible health care provider is required to use reimbursements from the Provider Relief Fund received by such eligible health care provider during the Payment Received Period referred to in the Provider Relief Fund Guidance as the Period 3 specified in table 1 of such guidance (beginning on January 1, 2021, and ending on June 30, 2021) shall be the later of—</text><subparagraph id="H2F80483ADD6346CA879F5594C33F32EE"><enum>(A)</enum><text>the end of the COVID–19 emergency period; or</text></subparagraph><subparagraph id="HDE1ACFC314E848B1883978DAD9D291BC"><enum>(B)</enum><text>June 30, 2022.</text></subparagraph></paragraph></subsection><subsection id="H32B0F1A0B5E94D71A7784A805DC4C153"><enum>(b)</enum><header>Requirement To distribute remaining COVID–19 provider relief funds by March 31, 2022</header><paragraph id="H908DB33E9F0943D1B3D932A310EB905C"><enum>(1)</enum><header>Requirement for distributions</header><subparagraph id="H0C8C75567B0743B5963CE35F2B1BCDF3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than March 31, 2022, the Secretary shall distribute to eligible health care providers for health care related expenses or lost revenues that are attributable to coronavirus, any remaining funds appropriated to the Provider Relief Fund as of the date of the enactment of this section for reimbursements.</text></subparagraph><subparagraph id="HABBDC2EC67BB462A873E8164F52D9F0C"><enum>(B)</enum><header>Deadline to use funds</header><text>The deadline by which an eligible health care provider is required to use reimbursements received pursuant to subparagraph (A) is June 30, 2023.</text></subparagraph></paragraph><paragraph id="H5AE6EF808A084459AC951717C7CD1073"><enum>(2)</enum><header>Accounting for health care related expenses or lost revenues in the second, third, and fourth quarters of 2021</header><text>Notwithstanding any other provision of law, distributions made under paragraph (1) to eligible health care providers shall account for financial losses and changes in operating expenses occurring in the second, third, or fourth quarter of calendar year 2021, that are attributable to coronavirus.</text></paragraph><paragraph id="id6CEFBF97B8AF4B73B2DBE7DDB7C8064B"><enum>(3)</enum><header>Allocation of payments returned due to previous deadlines</header><subparagraph id="idFD40F3E0B5E04DC8AEBFB3C16C7CA824"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a process for eligible health care providers to apply to receive funds from the Secretary in amounts up to the amount each such provider returned to the Provider Relief Fund due to previous reporting and use of funds deadlines. </text></subparagraph><subparagraph id="id6C6645DE9F1342C1BA958290D1C8B4B7"><enum>(B)</enum><header>Clarifications</header><text>Funding under this paragraph shall be—</text><clause id="idAF48D0706EAE4F839E97EDE77C3FBB9E"><enum>(i)</enum><text>available with respect to amounts returned by eligible health care providers between June 30, 2021, and December 30, 2021; and</text></clause><clause id="idE8FE9088546D4A299FF9EDF2CAF79C01"><enum>(ii)</enum><text>in addition to amounts made available to such providers under paragraph (1).</text></clause></subparagraph></paragraph></subsection><subsection id="H45FDB7412AD94EBF80D91A31F6833942"><enum>(c)</enum><header>Clarification of use of funds for workplace safety and security</header><paragraph id="H73E3C2F3D28D4666BF40D54BDF4362C5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Funds appropriated to the Provider Relief Fund for eligible health care providers and funds appropriated under section 1150C of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-26">42 U.S.C. 1320b–26</external-xref>) for eligible health care providers (as defined in subsection (e)(1) of such section) before, on, or after the date of the enactment of this section may be used to reimburse an eligible health care provider for expenses incurred by the eligible health care provider for measures taken to establish or improve the security of the workplace of such eligible health care provider and improve the safety of personnel of such eligible health care provider present at such workplace.</text></paragraph><paragraph id="H39670A16E0564B4E9A1083507481533D"><enum>(2)</enum><header>Additional clarification of permissible expenses</header><text>Expenses for workplace security and safety of personnel of an eligible health care provider described in paragraph (1) shall include the following:</text><subparagraph id="H48BFD14AFDB540FCB2899213A008F7E6"><enum>(A)</enum><text>Mitigation of risk of violence at the workplace of such eligible health care provider, including the employment of additional security personnel, conduct of risk assessment activities, implementation of response plans, implementation of small-scale changes to physical plant (such as the addition of more secure locks, the use of key card access, altering ingress and egress points, and the installation of additional security cameras), and staff education and training.</text></subparagraph><subparagraph id="H10D152A8A9B443078CEDC7F654825AB9"><enum>(B)</enum><text>Measures to prevent violence at the workplace and against personnel of such eligible health care provider, including education and training of personnel on de-escalation protocols and installation of panic buttons and other similar, required equipment.</text></subparagraph><subparagraph id="HA62D5786DA5D42A6BD486B23223FC211"><enum>(C)</enum><text>Trauma support for personnel with respect to violence in the workplace, such as counseling and other supports in the event of significant workplace safety episodes, which may include events that do not result in violence but may have significant impacts on personnel and the operations of the eligible health care provider (commonly referred to as near-misses).</text></subparagraph></paragraph></subsection><subsection id="H9953A87B69114D51B242636150AB8B0F"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H90397E11D1BF43F78E09765FA88A65C4"><enum>(1)</enum><header>Coronavirus</header><text display-inline="yes-display-inline">The term <term>coronavirus</term> means severe acute respiratory syndrome coronavirus 2 (SARS–CoV–2) or another coronavirus with pandemic potential. <italic></italic></text></paragraph><paragraph id="HEAE2790D6F5B4A5D9DC14A6B0ECE0ECA"><enum>(2)</enum><header>Covered payment received period</header><text>The term <term>covered payment received period</term> means, with respect to Payment Received Periods referred to in the Provider Relief Fund Guidance—</text><subparagraph id="H3256388A609E49A1B7F3E058A2C40DAD"><enum>(A)</enum><text>the <quote>Period 1</quote> specified in table 1 of such guidance (beginning on April 10, 2020, and ending on June 30, 2020); and</text></subparagraph><subparagraph id="H442B31E021124DEFB907E3E32835CD51"><enum>(B)</enum><text>the <quote>Period 2</quote> specified in such table (beginning on July 1, 2020, and ending on December 31, 2020).</text></subparagraph></paragraph><paragraph id="HD7ACEA9981954B16A67523EF5F16AD39"><enum>(3)</enum><header>COVID–19 emergency period</header><text>The term <term>COVID–19 emergency period</term> means the emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>).</text></paragraph><paragraph id="HBAE43ADC190D403E872296534CB39146"><enum>(4)</enum><header>Eligible health care provider</header><text>The term <term>eligible health care provider</term> has the meaning given such term in the third proviso of the third paragraph under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> in division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></paragraph><paragraph id="HBCD75C32679A4D748353F12599152730"><enum>(5)</enum><header>Provider relief fund</header><text>The term <term>Provider Relief Fund</term> means the funding appropriated to prevent, prepare for, and respond to coronavirus, domestically or internationally, for necessary expenses to reimburse, through grants or other mechanisms, eligible health care providers for health care related expenses or lost revenues that are attributable to coronavirus for which appropriations are made under—</text><subparagraph id="HCF8C39B8E678432283789D2EA49927FD"><enum>(A)</enum><text>the third paragraph under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> in division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>);</text></subparagraph><subparagraph id="HB2C1767E05464448B04C924B291E1D42"><enum>(B)</enum><text>the first paragraph under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> in division B of the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>); and</text></subparagraph><subparagraph id="H903AE731D72E4029BDC02A9FF98374CD"><enum>(C)</enum><text>the third paragraph under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> of the Coronavirus Response and Relief Supplemental Appropriations Act, 2021 (division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)).</text></subparagraph></paragraph><paragraph id="HCC4A93BED489426CA56F9690EC1D4D27"><enum>(6)</enum><header>Provider relief fund guidance</header><text>The term <term>Provider Relief Fund Guidance</term> refers to the guidance entitled <quote>Provider Relief Fund General and Targeted Distribution Post-Payment Notice of Reporting Requirements</quote> issued by the Secretary of Health and Human Services on June 11, 2021.</text></paragraph><paragraph id="H73882F64F07C4E1FAEBF3C024866EA3D"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration.</text></paragraph></subsection></section></legis-body></bill>
