which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 51, United States Code, to modify the national space grant college and fellowship program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Space Grant Modernization Act of 2021</short-title></quote>.</text></section><section id="id4BB935E62A9147EFA4DC45D9034DEB22"><enum>2.</enum><header>National space grant college and fellowship program</header><subsection id="idDA71ED3DEFD64F6992318404644F50D7"><enum>(a)</enum><header>Purposes</header><text>Section 40301 of title 51, United States Code, is amended—</text><paragraph id="idF84285F2A45D44058E906512FB5FEC50"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph id="idA3411E356B974BA88307C979A57E65B3"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idCCD01727BA8040F6AA2182EF0075CD18"><enum>(B)</enum><text>in subparagraph (C), by adding <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph id="idFD44EFB924CE48E083607CF2A96B6B7B"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id65161376B9824E28BA9C9CFBD8A47F77"><subparagraph id="id7CE32C66CA904F42B4D6233A028376B2"><enum>(D)</enum><text>promote equally the State and regional STEM interests of each space grant consortium;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idAAE9ADE7DC8D4C9783132A1779E6C31F"><enum>(2)</enum><text>in paragraph (4), by striking <quote>made up of university and industry members, in order to advance</quote> and inserting <quote>comprised of members of universities in each State and other entities, such as 2-year colleges, industries, science learning centers, museums, and government entities, to advance</quote>.</text></paragraph></subsection><subsection id="idC2AB39EE0E46414AB7B0C93BD655038C"><enum>(b)</enum><header>Definitions</header><text>Section 40302 of title 51, United States Code, is amended—</text><paragraph id="id7BB35C93A6F047DC82D06C1C4F23614D"><enum>(1)</enum><text>by striking paragraph (3);</text></paragraph><paragraph id="id5D51E64557B0476BAE501A8D78744BE5"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5E9BF5DB4E13408897F893CE8F68A351"><paragraph id="idE41A2F688C024163B4766B3A1CF1B09A"><enum>(3)</enum><header>Lead institution</header><text>The term <term>lead institution</term> means an entity in a State that—</text><subparagraph id="id488BFF9C617F464782FD8733F28CD6C6"><enum>(A)</enum><text>was designated by the Administrator under section 40306, as in effect on the day before the date of the enactment of the <short-title>21st Century Space Grant Modernization Act of 2021</short-title>; or</text></subparagraph><subparagraph id="id8A2127B07F1B49378A6DA5C3690F8CB6"><enum>(B)</enum><text>is designated by the Administrator under section 40303(d)(3).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4EE8195419BB4B7ABB1402B80E50E60B"><enum>(3)</enum><text>in paragraph (4), by striking <quote>space grant college, space grant regional consortium, institution of higher education,</quote> and inserting <quote>lead institution, space grant consortium,</quote>;</text></paragraph><paragraph id="id552477B99B1F4832926468A4021B8778"><enum>(4)</enum><text>by striking paragraphs (6), (7), and (8);</text></paragraph><paragraph id="idD015B90B475644D5B76BA3E80D9A21E4"><enum>(5)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id48FEFD1FB5A64A45A06479CC27CBC37B"><paragraph id="idB030E1C369E8471E96DDE45605D00BBE"><enum>(6)</enum><header>Space grant consortium</header><text>The term <term>space grant consortium</term> means a statewide group, led by a lead institution, that has established partnerships with other academic institutions, industries, science learning centers, museums, and government entities to promote a strong educational base in the space and aeronautical sciences.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id8B14848EDED447DEA90562CB9DF29520"><enum>(6)</enum><text>by redesignating paragraph (9) as paragraph (7);</text></paragraph><paragraph id="id467C0B9ACB754729B830D247D0227613"><enum>(7)</enum><text>in paragraph (7)(B), as so redesignated, by inserting <quote>and aeronautics</quote> after <quote>space</quote>;</text></paragraph><paragraph id="id312C8FC4F729497D84EF36DAF46FE782"><enum>(8)</enum><text>by striking paragraph (10); and</text></paragraph><paragraph id="id2B8D602ECBF9454DA37355EA11B1A063"><enum>(9)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC4D9A4C7FC8D47AB80A6AEFD949AED2F"><paragraph id="idA410B1F93CCC4DCC83FBCDBEA9A6F101"><enum>(8)</enum><header>STEM</header><text>The term <term>STEM</term> means science, technology, engineering, and mathematics.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9897A0AC0FE94A1D88613295ACB252FE"><enum>(c)</enum><header>Program objective</header><text>Section 40303 of title 51, United States Code, is amended—</text><paragraph id="id1F021BC593CE4A1381D07F4AA8EBD485"><enum>(1)</enum><text>by striking subsections (d) and (e);</text></paragraph><paragraph id="id0BCDBC5CF68F4C99B37F63CAD879E96D"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (e); and</text></paragraph><paragraph id="id4B1ECF8090F24CE3B47F4D9FED082B73"><enum>(3)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id100F99BE2A31403F949CD806A7DE81D3"><subsection id="idCE13EE5E661B4C239E0A639A867D5C37"><enum>(b)</enum><header>Program objective</header><paragraph id="id29DBEE837D5A4FFFB9454C96E703CEDD"><enum>(1)</enum><header>In general</header><text>The Administrator shall carry out the national space grant college and fellowship program with the objective of providing hands-on research, training, and education programs with measurable outcomes in each State, including programs to provide—</text><subparagraph id="idD911CF4F28BD4804ABF573929BE272B6"><enum>(A)</enum><text>internships, fellowships, and scholarships;</text></subparagraph><subparagraph id="idB81B32DAC79F4EA69C847FF07007651B"><enum>(B)</enum><text>interdisciplinary hands-on mission programs and design projects;</text></subparagraph><subparagraph id="idE2EB59FFF30242B9B3E8343FF38E8FCC"><enum>(C)</enum><text>student internships with industry or university researchers or at centers of the Administration;</text></subparagraph><subparagraph id="id627C94677AB847229676CBE755AD443A"><enum>(D)</enum><text>faculty and curriculum development initiatives;</text></subparagraph><subparagraph id="idD12D3A8A155A4BE98EFA0B075C478F61"><enum>(E)</enum><text>university-based research initiatives relating to the Administration and the STEM workforce needs of each State; or</text></subparagraph><subparagraph id="id12C99D5C8B1F41A28B4419E5130CE575"><enum>(F)</enum><text>STEM engagement programs for kindergarten through grade 12 teachers and students.</text></subparagraph></paragraph><paragraph id="idFCEDC6569FE449D1B0A21E9843C93594"><enum>(2)</enum><header>Program priorities</header><text>In carrying out the objective described in paragraph (1), the Administrator shall ensure that each program carried out by a space grant consortium under the national space grant college and fellowship program balances the following priorities:</text><subparagraph id="idF270144DDA6A43219339877BA8BA54D7"><enum>(A)</enum><text>The space and aeronautics research needs of the Administration, including the mission directorates.</text></subparagraph><subparagraph id="idF87346B432FC48888B467838B0DCD553"><enum>(B)</enum><text>The need to develop a national STEM workforce.</text></subparagraph><subparagraph id="id697B85D3D2A8429BBEA8B252E0675FAD"><enum>(C)</enum><text>The STEM workforce needs of the State.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id0FE2D53A734D48FAADBDB5399DC7D883"><enum>(c)</enum><header>Program administered through space grant consortia</header><text>The Administrator shall carry out the national space grant college and fellowship program through the space grant consortia.</text></subsection><subsection id="id7FA2E0E38D494765B44A352D20CDE207"><enum>(d)</enum><header>Suspension; termination; new competition</header><paragraph id="idC783758539034681AFFF0515017ED534"><enum>(1)</enum><header>Suspension</header><text>The Administrator may, for cause and after an opportunity for hearing, suspend a lead institution that was designated by the Administrator under section 40306, as in effect on the day before the date of the enactment of the <short-title>21st Century Space Grant Modernization Act of 2021</short-title>.</text></paragraph><paragraph id="id51D12E3C4E1B4A28B28707F470AA4758"><enum>(2)</enum><header>Termination</header><text>If the issue resulting in a suspension under paragraph (1) is not resolved within a period determined by the Administrator, the Administrator may terminate the designation of the entity as a lead institution.</text></paragraph><paragraph id="idA6D600360A934A2792EB6CA972AF2AB8"><enum>(3)</enum><header>New competition</header><text>If the Administrator terminates the designation of an entity as a lead institution, the Administrator may initiate a new competition in the applicable State for the designation of a lead institution.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8A4BEAB101E24D879278DB8C3B348D50"><enum>(d)</enum><header>Grants</header><text>Section 40304 of title 51, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="idA3B6015487D348A5A8235D6EF77711FE"><section id="id2C8173FC632A4CBC8D968927C90F3718"><enum>40304.</enum><header>Grants</header><subsection id="id66F4CCA790FC41799CB3E858920BD873"><enum>(a)</enum><header>Eligible space grant consortium defined</header><text>In this section, the term <term>eligible space grant consortium</term> means a space grant consortium that the Administrator has determined—</text><paragraph id="idD74F8EDCF388403D88A0C4C35607976C"><enum>(1)</enum><text>has the capability and objective to carry out not fewer than 3 of the 6 programs under section 40303(b)(1);</text></paragraph><paragraph id="idF66380CE74954FE588809D20F25B1E8E"><enum>(2)</enum><text>will carry out programs that balance the priorities described in section 40303(b)(2); and</text></paragraph><paragraph id="idF8A7990C2F7945D691E5B2346FE4EBF5"><enum>(3)</enum><text>is engaged in research, training, and education relating to space and aeronautics.</text></paragraph></subsection><subsection id="idF19D9CF876F248B69A7DD79C0F796F0D"><enum>(b)</enum><header>Grants</header><paragraph commented="no" id="id8095C6B78F554D98884C7DD88FC44A97"><enum>(1)</enum><header>In general</header><text>The Administrator shall award grants to the lead institutions of eligible space grant consortia to carry out the programs under section 40303(b)(1).</text></paragraph><paragraph id="idCB13F4605F384C7A85391035CF91F642"><enum>(2)</enum><header>Request for proposals</header><subparagraph id="idCBA00807FA7E440988ADF97DFF2870CE"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of the <short-title>21st Century Space Grant Modernization Act of 2021</short-title>, the Administrator shall issue a request for proposals from space grant consortia for the award of grants under this section.</text></subparagraph><subparagraph id="id890BFAA4C8CD444ABBA10636D87EE438"><enum>(B)</enum><header>Applications</header><text>A lead institution of a space grant consortium that seeks a grant under this section shall submit, on behalf of such space grant consortium, an application to the Administrator at such time, in such manner, and accompanied by such information as the Administrator may require.</text></subparagraph></paragraph><paragraph id="id57CC6E5AEAF44368A2650C502E63138A"><enum>(3)</enum><header>Grant awards</header><text>The Administrator shall award 1 or more 5-year grants, disbursed in annual installments, to the lead institution of the eligible space grant consortium of—</text><subparagraph id="id29CFA447F98C42FF8D1D38F15893473F"><enum>(A)</enum><text>each State;</text></subparagraph><subparagraph id="id2D643449E9914280B5C00869D10B17E4"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="idD6DDCF89D2F0460BAD8AC6F099EA7D84"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph commented="no" id="idC199041D59CC4C32A98648A967FBBA88"><enum>(4)</enum><header>Use of funds</header><text>A grant awarded under this section shall be used by an eligible space grant consortium to carry out not fewer than 3 of the 6 programs under section 40303(b)(1).</text></paragraph></subsection><subsection id="id2EA80F6A6AFB4E7C820A36863AC29C9B"><enum>(c)</enum><header>Allocation of funding</header><paragraph id="id38E7F547666C4042A3B9916C2AC463F3"><enum>(1)</enum><header>Program implementation</header><subparagraph id="idB662AD96B88D4D189AAE037E7EDDA090"><enum>(A)</enum><header>In general</header><text>To carry out the objective described in section 40303(b)(1), of the funds made available under section 40306 each fiscal year for the national space grant college and fellowship program, the Administrator shall allocate not less than 85 percent as follows:</text><clause id="idD5E8ED27557B44D280EBB4D22D9558F2"><enum>(i)</enum><text>The 52 eligible space grant consortia shall each receive an equal share.</text></clause><clause id="id2EAF4341DCC046B89EECB8D3425A151B"><enum>(ii)</enum><text>The territories of Guam and the United States Virgin Islands shall each receive funds equal to approximately <fraction>1/5</fraction> of the share for each eligible space grant consortia.</text></clause></subparagraph><subparagraph id="idAA5BB8779AC341058F77D02E709FDDE1"><enum>(B)</enum><header>Matching requirement</header><text>Each eligible space grant consortium shall match the funds allocated under subparagraph (A)(i) on a basis of not less than 1 non-Federal dollar for every 1 Federal dollar, except that any program funded under paragraph (3) or any program to carry out 1 or more internships or fellowships shall not be subject to that matching requirement.</text></subparagraph></paragraph><paragraph id="id493E091F9047401F9F565B282852F495"><enum>(2)</enum><header>Program administration</header><subparagraph id="id24DB8B53E6EB4CA59AAA5864510BD06C"><enum>(A)</enum><header>In general</header><text>Of the funds made available under section 40306 each fiscal year for the national space grant college and fellowship program, the Administrator shall allocate not more than 10 percent for the administration of the program.</text></subparagraph><subparagraph id="id818E81FC6601435A881B61E54682BA4B"><enum>(B)</enum><header>Costs covered</header><text>The funds allocated under subparagraph (A) shall cover all costs of the Administration associated with the administration of the national space grant college and fellowship program, including—</text><clause id="id2E94CE08E9894383ADE26996F43EF112"><enum>(i)</enum><text>direct costs of the program, including costs relating to support services and civil service salaries and benefits;</text></clause><clause id="id8E0E74D2C9C544FDB448EBBF5BAFB8CB"><enum>(ii)</enum><text>indirect general and administrative costs of centers and facilities of the Administration; and</text></clause><clause id="id58FE315590CC494BA3AE4EDAF69D0E03"><enum>(iii)</enum><text>indirect general and administrative costs of the Administration headquarters.</text></clause></subparagraph></paragraph><paragraph id="id1CDBEC5CE82A40E98D9C12D891550D0F"><enum>(3)</enum><header>Special programs</header><text>Of the funds made available under section 40306 each fiscal year for the national space grant college and fellowship program, the Administrator shall allocate not more than 5 percent to the lead institutions of space grant consortia established as of the date of the enactment of the <short-title>21st Century Space Grant Modernization Act of 2021</short-title> for grants to carry out innovative approaches and programs to further science and education relating to the missions of the Administration and STEM disciplines.</text></paragraph></subsection><subsection id="id0928B67100174842A8FA9CBFF743F9C1"><enum>(d)</enum><header>Terms and conditions</header><paragraph id="idF8B41461895840F1928297F6F8F3BF99"><enum>(1)</enum><header>Limitations</header><text>Amounts made available through a grant under this section may not be applied to—</text><subparagraph id="id4E143B1B827F4EB99D651F5454558506"><enum>(A)</enum><text>the purchase of land;</text></subparagraph><subparagraph id="idFDD3920D16E24525B7ABCEFE86316899"><enum>(B)</enum><text>the purchase, construction, preservation, or repair of a building; or</text></subparagraph><subparagraph id="id7FC8A840BC74413CB0AEACB587AFF060"><enum>(C)</enum><text>the purchase or construction of a launch facility or launch vehicle.</text></subparagraph></paragraph><paragraph id="id3AA668362D104ADCB1DCCBF4142D533D"><enum>(2)</enum><header>Leases</header><text>Notwithstanding paragraph (1), land, buildings, launch facilities, and launch vehicles may be leased under a grant on written approval by the Administrator.</text></paragraph><paragraph id="idAF36DFBFE1274E9DBF36426F4CAC89D8"><enum>(3)</enum><header>Records</header><subparagraph id="id39DB8292EA3E42888298C4F791B802BD"><enum>(A)</enum><header>In general</header><text>Any person that receives or uses the proceeds of a grant under this section shall keep such records as the Administrator shall by regulation prescribe as being necessary and appropriate to facilitate effective audit and evaluation, including records that fully disclose the amount and disposition by a recipient of such proceeds, the total cost of the program or project in connection with which such proceeds were used, and the amount, if any, of such cost that was provided through other sources.</text></subparagraph><subparagraph id="id119A9BC9E9E84D318226B3ABD8C28822"><enum>(B)</enum><header>Maintenance of records</header><text>Records under subparagraph (A) shall be maintained for not less than 3 years after the date of completion of such a program or project.</text></subparagraph><subparagraph id="id9208F8DC2A0F453DA518EF2240CEAA27"><enum>(C)</enum><header>Access</header><text>For the purpose of audit and evaluation, the Administrator and the Comptroller General of the United States shall have access to any books, documents, papers, and records of receipts relating to a grant under this section, as determined by the Administrator or Comptroller General.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idB8754EDD86134925B635A081252AF3F5"><enum>(e)</enum><header>Program streamlining</header><text>Title 51, United States Code, is amended—</text><paragraph id="id6247941DFFBC4787825523C21C8E3263"><enum>(1)</enum><text>by striking sections 40305 through 40308, 40310, and 40311; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF56B045BF90646EEBCFD6E2A107A4AA5"><enum>(2)</enum><text>by redesignating section 40309 as section 40305.</text></paragraph></subsection><subsection id="idD5F049C78404494DA7BDEE8683524860"><enum>(f)</enum><header>Authorization of appropriations</header><text>Title 51, United States Code, is amended by adding after section 40305, as redesignated by subsection (e)(2), the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id16E777E2189146E49148DC1384D50451"><section id="id7E55E032351D4112B5FF8E6AD12044C4"><enum>40306.</enum><header>Authorization of appropriations</header><subsection id="id17CB20514BB1495B8CAD2396D6466F95"><enum/><text>There are authorized to be appropriated such sums as may be necessary to carry out the national space grant college and fellowship program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id504DE8DA61AC4D93BF5CBB86FAEC5E77"><enum>(g)</enum><header>Conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/51/403">chapter 403</external-xref> of title 51, United States Code, is amended by striking the items relating to sections 40304 through 40311 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0CAB3CF718E54E1F9EB102457D6034DA"><toc><toc-entry bold="off" level="section">40304. Grants. </toc-entry><toc-entry bold="off" level="section">40305. Availability of other Federal personnel and data.</toc-entry><toc-entry bold="off" level="section">40306.
