which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide additional funding for firefighter staffing and safety grants, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Firefighter Staffing and Support Act</short-title></quote>.</text></section><section id="idC19847D54C8E4138B3E3D99439881D37"><enum>2.</enum><header>Firefighter safety grants</header><text display-inline="no-display-inline">Section 33 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229">15 U.S.C. 2229</external-xref>) is amended—</text><paragraph id="id92A838CFA1DF4471A612B8FE0C9D2FE5"><enum>(1)</enum><text>in subsection (d), by striking paragraph (4);</text></paragraph><paragraph id="id23E3DC6127A8417C9D414572DC4CCFD5"><enum>(2)</enum><text>in subsection (q)(1)—</text><subparagraph id="id1282C40183F24759B507D77DF960C99A"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, and there is appropriated,</quote> after <quote>appropriated</quote>;</text></subparagraph><subparagraph id="id8790725080D5452985DEBAB9948FA27B"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id5D29D5A8C7FB4F32BBC8504A0434A96F"><enum>(C)</enum><text>in subparagraph (B)—</text><clause id="id523C4D6E370243398D498F44901D2142"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>2023</quote> and inserting <quote>2022</quote>; and</text></clause><clause id="idACCE04BC1F8641B694FCAC01089A53D9"><enum>(ii)</enum><text>in clause (ii), by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="idB7F9030E9F734A3A8A2E6005061C6246"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id40ADE21C96324B518BFE34962C4DA45C"><subparagraph id="idD9B00AAD3957432B8D5DD174061605F0" commented="no"><enum>(C)</enum><text>$913,000,000 for fiscal year 2023; and</text></subparagraph><subparagraph commented="no" id="id1AF48086CD3D4715BB3C190B9114C6BE"><enum>(D)</enum><text>for each of fiscal years 2024 through 2028, an amount equal to the amount authorized for the previous fiscal year increased by the percentage by which—</text><clause id="ID342B79D7814C49D7AB98F639DF580C68"><enum>(i)</enum><text>the Consumer Price Index (all items, United States city average) for the previous fiscal year, exceeds</text></clause><clause id="ID5EF1470786ED460CB0CB24A95C9D7E7B"><enum>(ii)</enum><text>the Consumer Price Index for the fiscal year preceding the fiscal year described in clause (i).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id69d1dde3c429475ebbb2c6f3ba48816f"><enum>(3)</enum><text>by striking subsection (r).</text></paragraph></section><section id="idabaacc5b8eb042b0a4f2548e2750156e"><enum>3.</enum><header>SAFER grants</header><text display-inline="no-display-inline">Section 34 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229a">15 U.S.C. 2229a</external-xref>) is amended—</text><paragraph id="idE192C28D773A48769AE4C09FDA6AD1CC"><enum>(1)</enum><text>in subsection (j)(1)—</text><subparagraph id="id5CB78843BA0F426B9B415FD910468C37"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, and there is appropriated,</quote> after <quote>appropriated</quote>;</text></subparagraph><subparagraph id="id013B6B52481B49848722ED1F43CE0323"><enum>(B)</enum><text>in subparagraph (H), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id562883ABD97B4B6FBE4FFF89C4833959"><enum>(C)</enum><text>in subparagraph (I)—</text><clause id="id24BD70D636EF4457A127FA20A963640F"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>2023</quote> and inserting <quote>2022</quote>; and </text></clause><clause id="id9766BDE2E8D64E37BEE8FBC41F21044D"><enum>(ii)</enum><text>in clause (ii), by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="idD031170479D24CA5B09983504979A2DF"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id735934F36DFE4E45B90460C1B8991ABB"><subparagraph id="idA837FBF2CDBC4B3BAB0E11D8D8993185" commented="no"><enum>(J)</enum><text>$913,000,000 for fiscal year 2023; and </text></subparagraph><subparagraph commented="no" id="idE2B51B7046C24DDC820B13C84F15918D"><enum>(K)</enum><text>for each of fiscal years 2024 through 2028, an amount equal to the amount authorized for the previous fiscal year increased by the percentage by which—</text><clause id="idC51C869442D14331ABAAC3EA1D86D054"><enum>(i)</enum><text>the Consumer Price Index (all items, United States city average) for the previous fiscal year, exceeds</text></clause><clause id="id4626F51312AD4872A9191F124C8225A9"><enum>(ii)</enum><text>the Consumer Price Index for the fiscal year preceding the fiscal year described in clause (i).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id83FA8708F94D467CB9F95625EA911856"><enum>(2)</enum><text>by striking subsection (k).</text></paragraph></section><section id="id7C2DD8735437454B8D4CA7EF36251070"><enum>4.</enum><header>Technical assistance</header><text display-inline="no-display-inline">The Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2201">15 U.S.C. 2201 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0EF12A96ADA049BA8255861559822365"><section id="idBE448A723DF14D769E97E5CC54AA04B7"><enum>38.</enum><header>Technical assistance</header><text display-inline="no-display-inline">In addition to amounts made available under sections 33(q)(2) and 34(j)(2), there is authorized to be appropriated, and there is appropriated, to provide technical assistance to qualified entities described in sections 33(c)(1) and 34(a) to prepare and submit an application for a grant under section 33(e) or 34(b)—</text><paragraph id="id1784F93627634CC09EC70906C8ED7A59"><enum>(1)</enum><text>$10,000,000 for fiscal year 2023; and</text></paragraph><paragraph commented="no" id="id5EBBF4EAB942431E9A360267C1C21882"><enum>(2)</enum><text>for each of fiscal years 2024 through 2028, an amount equal to the amount authorized for the previous fiscal year increased by the percentage by which—</text><subparagraph id="id5EFC537DA3DA4B0CA0E0D25C58CF78CC"><enum>(A)</enum><text>the Consumer Price Index (all items, United States city average) for the previous fiscal year, exceeds</text></subparagraph><subparagraph id="id1BAE73F56FBD4E5481DFC1D4FD110049"><enum>(B)</enum><text>the Consumer Price Index for the fiscal year preceding the fiscal year described in clause (i).</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idfd6c321159b34347b8a7b4f05d788142"><enum>5.</enum><header>Reports from FEMA and United States Fire Administration</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency and the Administrator of the United States Fire Administration shall submit to Congress and make publicly available—</text><paragraph id="idA13AC92B5F434511954419AD35E138E1"><enum>(1)</enum><text display-inline="yes-display-inline">a report on plans to improve the application process for grants under sections 33 and 34 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229">15 U.S.C. 2229</external-xref>, 2229a) to ease access to those grant funds; and</text></paragraph><paragraph id="idee1e5771488445dfb4dd68d819a3fbe9"><enum>(2)</enum><text>a report on the challenges specific to rural and volunteer fire departments, as defined in section 33 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229">15 U.S.C. 2229</external-xref>), which shall include an action plan to address these challenges through the grants described in paragraph (1) and other administrative action.</text></paragraph></section><section id="id9bb6ad9dd79346e7ab3bb6846e7d4af6"><enum>6.</enum><header>Protections for volunteers from employer discrimination</header><text display-inline="no-display-inline">The Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2201">15 U.S.C. 2201 et seq.</external-xref>), as amended by section 4 of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf7b830e4a1a84f33be8794b19aed4877"><section id="id7cd58e12136f4de6b4faed2c136104e7"><enum>39.</enum><header>Volunteer firefighter and EMS personnel job protection</header><subsection id="ided0a1228775d4cb5b59b295a5f01cbcf"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id29bbb8e5c5054685b1871914e2cb8878"><enum>(1)</enum><header>Emergency; major disaster</header><text>The terms <term>emergency</term> and <term>major disaster</term> have the meanings given those terms in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></paragraph><paragraph id="id4749A575DA394A9792FB55B5E54780E0"><enum>(2)</enum><header>Qualified volunteer fire department</header><text>The term <term>qualified volunteer fire department</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/150">section 150(e)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="id377a9000e95f44358a56c49745106178"><enum>(3)</enum><header>Volunteer emergency medical services</header><text>The term <term>volunteer emergency medical services</term> means emergency medical services performed on a voluntary basis for a fire department or other emergency organization.</text></paragraph><paragraph id="id5f8cef3f0d4c44ce923cce3275ea9960"><enum>(4)</enum><header>Volunteer firefighter</header><text>The term <term>volunteer firefighter</term> means an individual who is a member in good standing of a qualified volunteer fire department.</text></paragraph></subsection><subsection id="id62914a6b1c104b37b51844597d78558e"><enum>(b)</enum><header>Termination of employment of volunteer firefighters and emergency medical personnel prohibited</header><paragraph id="idfee5f2d476d04b799f7f2f5067488c4a"><enum>(1)</enum><header>Termination prohibited</header><text>No employee may be terminated, demoted, or in any other manner discriminated against in the terms and conditions of employment because such employee is absent from or late to the employee's employment for the purpose of serving as a volunteer firefighter or providing volunteer emergency medical services as part of a response to an emergency or major disaster.</text></paragraph><paragraph id="id79afbb19c2bf41409c12b3b067ef3a90"><enum>(2)</enum><header>Deployment</header><text>The prohibition in paragraph (1) shall apply to an employee serving as a volunteer firefighter or providing volunteer emergency medical services if such employee—</text><subparagraph id="id0b13df6dda8244e4b577cafed6474dc0"><enum>(A)</enum><text>is specifically deployed to respond to the emergency or major disaster in accordance with a coordinated national deployment system such as the Emergency Management Assistance Compact or a pre-existing mutual aid agreement; or</text></subparagraph><subparagraph id="ida22b287bf8b84aaab1e7e6311e0a1a26"><enum>(B)</enum><text>is a volunteer firefighter who—</text><clause id="idf9896410d21a40439f6ab7f6b9c472ce"><enum>(i)</enum><text>is a member of a qualified volunteer fire department that is located in the State in which the emergency or major disaster occurred;</text></clause><clause id="id3e1eb34180214d8aa6601bac2a802619"><enum>(ii)</enum><text>is a member of a qualified fire department that has a mutual aid agreement with a community affected by such emergency or major disaster; and</text></clause><clause id="id5d645a6ee47b49f6abed9d70083c89b6"><enum>(iii)</enum><text>has been deployed by the emergency management agency of such State to respond to such emergency or major disaster.</text></clause></subparagraph></paragraph><paragraph id="id4dc8e2fd99924771b3f3d3d53f389dfc"><enum>(3)</enum><header>Limitations</header><text>The prohibition in paragraph (1) shall not apply to an employee who—</text><subparagraph id="id4a676f4d50fd4844989874470369cd5e"><enum>(A)</enum><text>is absent from the employee’s employment for the purpose described in paragraph (1) for more than 14 days per calendar year;</text></subparagraph><subparagraph id="id0fd82958983149c8af22d006e4267423"><enum>(B)</enum><text>responds to the emergency or major disaster without being officially deployed as described in paragraph (2); or</text></subparagraph><subparagraph id="id7a0a9a03aa214d3ea269c697aeb46d3f"><enum>(C)</enum><text>fails to provide the written verification described in paragraph (5) within a reasonable period of time.</text></subparagraph></paragraph><paragraph id="id41f538f155ae49cb9e689fa7e158667c"><enum>(4)</enum><header>Withholding of pay</header><text>An employer may reduce an employee’s regular pay for any time that the employee is absent from the employee's employment for the purpose described in paragraph (1).</text></paragraph><paragraph id="id52e0670731a549c09b660cf67eedb30f"><enum>(5)</enum><header>Verification</header><text>An employer may require an employee to provide a written verification from the official of the Federal Emergency Management Agency supervising the Federal response to the emergency or major disaster or a local or State official managing the local or State response to the emergency or major disaster that states—</text><subparagraph id="idbda52dd9e5124b38acbde022ff07738a"><enum>(A)</enum><text>the employee responded to the emergency or major disaster in an official capacity; and</text></subparagraph><subparagraph id="id231674d510c1423bab2178334c3e807c"><enum>(B)</enum><text>the schedule and dates of the employee's participation in such response.</text></subparagraph></paragraph><paragraph id="id48dbca1e1b97430dbaa45286ddbda571"><enum>(6)</enum><header>Reasonable notice required</header><text>An employee who may be absent from or late to the employee’s employment for the purpose described in paragraph (1) shall—</text><subparagraph id="idad948c9b69f54622a069432ab0581575"><enum>(A)</enum><text>make a reasonable effort to notify the employee’s employer of such absence; and</text></subparagraph><subparagraph id="iddc8e111ee41c47a9ae40e6c14cdc646a"><enum>(B)</enum><text>continue to provide reasonable notifications over the course of such absence.</text></subparagraph></paragraph></subsection><subsection id="id8ad0de17141e4e6fbe0e7cee70dbbef7"><enum>(c)</enum><header>Right of action</header><paragraph id="ide160f144f4fe4268b3f1130e5a9fda08"><enum>(1)</enum><header>Right of action</header><text>An individual who has been terminated, demoted, or in any other manner discriminated against in the terms and conditions of employment in violation of the prohibition described in subsection (b) may bring, in a district court of the United States of appropriate jurisdiction, a civil action against the employer of the individual seeking—</text><subparagraph id="idc404ca772c2145c488a6ef9398cf59ec"><enum>(A)</enum><text>reinstatement of the individual’s former employment;</text></subparagraph><subparagraph id="iddee98d114c7e4c8cb7da71c5e7151329"><enum>(B)</enum><text>payment of back wages;</text></subparagraph><subparagraph id="idb16c1082a40c4de7944ab7315b335f69"><enum>(C)</enum><text>reinstatement of fringe benefits; and</text></subparagraph><subparagraph id="id30c48454497f48ceba62f78866e63164"><enum>(D)</enum><text>if the employment granted seniority rights, reinstatement of seniority rights.</text></subparagraph></paragraph><paragraph id="id4fa79eb0974a4125a146a0553e2da614"><enum>(2)</enum><header>Limitation</header><text>The individual shall commence a civil action under this subsection not later than 1 year after the date of the violation of the prohibition described in subsection (b).</text></paragraph></subsection><subsection id="id3560FF571A504257897BBD6CFD57E6FE"><enum>(d)</enum><header>Enforcement</header><text>The Administrator of FEMA, in coordination with the Secretary of Labor, shall have the authority to issue rules to enforce this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
