which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to modify the distribution of funds under the tribal transportation program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id6452F5A0C3594F1D8C916D9E5E947E75"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Transportation Equity and Transparency Improvement Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Tribal transportation program</header><subsection id="id9E9F6B3C0BB149999CE8F6827EE6B0DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202 of title 23, United States Code, is amended—</text><paragraph id="id2e1412ba30a640c0b0325994eed2f6e1"><enum>(1)</enum><text>in subsection (a)(9)(A), by striking <quote>construction and improvement</quote> and inserting <quote>construction, improvement, and highway safety</quote>;</text></paragraph><paragraph id="idE7C9FFFD26DD484EA680B7DBE3CD5824"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="idAA15AF2BF3404A7FA054AB1C7949BAFC"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id54FA3810E3DC4ED7B01584359A36A602"><enum>(i)</enum><text>by striking subparagraph (D) and inserting the following:</text><quoted-block style="OLC" id="idC63A18BDC94D4C5BB2B9AED0D5A94616" act-name=""><subparagraph id="id1B0ABEA902474F99ACA969CAD0316A47"><enum>(D)</enum><header>Additional facilities</header><clause id="id89BFB50690664531B82B3C53A63B5089"><enum>(i)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of the <short-title>Tribal Transportation Equity and Transparency Improvement Act of 2021</short-title>, and not less frequently than every 3 years thereafter, the Secretary of the Interior shall publish in the Federal Register a notice requesting proposals from Indian tribes to include additional transportation facilities that are eligible for funding under the tribal transportation program in the inventory described in subparagraph (A), if those proposed additional facilities are included in the inventory in a uniform and consistent manner nationally.</text></clause><clause id="id4F3C9E2377F849A7B9A1C461CFF86B35"><enum>(ii)</enum><header>Rule of construction</header><text>Nothing in this subparagraph—</text><subclause id="idA5538D8B288B4E848837C38421713ADA"><enum>(I)</enum><text>prohibits the Secretary of the Interior from including in the inventory under subparagraph (A) additional transportation facilities more frequently than required under clause (i), including, as necessary, in response to a proposal from an eligible Indian tribe submitted during a period not described in the notice under clause (i); or</text></subclause><subclause id="id2A052B3EE4C743FE98E90E7626ED7FA4"><enum>(II)</enum><text>requires Indian tribes to submit proposals to the Secretary of the Interior in response to the notice required under clause (i).</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id8EF95F11147E4917AA077F50CD1EF158"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="idE97D26AA99BE4221AA4690B4B753147D" act-name=""><subparagraph id="idAFE6AF873C3E428F8C502E76097AF5E4"><enum>(F)</enum><header>Public availability</header><text>The Secretary of the Interior shall ensure that all non-confidential information within the inventory described in subparagraph (A) is made available—</text><clause id="id187B8886D34A4D82BCE57000AA011FC2"><enum>(i)</enum><text>in a user-friendly manner on the public website of the Department of the Interior; and</text></clause><clause id="idB38D27080DE0418699C17ED534DD0B71"><enum>(ii)</enum><text>in a manner capable of being searched and downloaded by users of the public website of the Department of the Interior.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idC5FBBC1B48F04E5D8A52C5D88850F8AC"><enum>(B)</enum><text>in paragraph (3)(B), in the matter preceding clause (i), by striking <quote>fiscal year 2012</quote> and inserting <quote>the most recent fiscal year for which data is available</quote>;</text></subparagraph></paragraph><paragraph id="id6CA3A0CCD7324FB2ACA02FF4618970E6"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="id4C87289400774365A44E5500EDC813F7"><enum>(A)</enum><text>in paragraph (3)—</text><clause id="id96FEBAFF805E4011B68C8DB5EDBBF758"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>; and</quote> at the end and inserting a period;</text></clause><clause id="id6DADD26ED8E347B1AFC6BC7EC99F36B9"><enum>(ii)</enum><text>by striking subparagraph (B); and</text></clause><clause id="id571C98A82FE84994927F0B817DE06B1B"><enum>(iii)</enum><text>in the matter preceding subparagraph (A), by striking <quote>shall be—</quote> and all that follows through <quote>selected by</quote> in subparagraph (A), and inserting <quote>shall be selected by</quote>; and</text></clause></subparagraph><subparagraph id="idA9ED5E74081343FC8888824CBB788514"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" act-name="" id="id445DDD96B0544997AC02BD981B80F720"><paragraph id="idA53C025BE88B4F09829043C4C51F4EED"><enum>(4)</enum><header>Nationally significant Federal lands and Tribal projects program</header><text>Notwithstanding any other provision of this section, amounts made available to Indian tribes under subsection (b)(3) may be used for planning and design activities related to applications for grants under the nationally significant Federal lands and tribal projects program under section 1123 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/23/201">23 U.S.C. 201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id24C02F4314E24C01B1E4FC594665186C"><enum>(4)</enum><text>in subsection (e)(2), by striking <quote>as appropriate,</quote> and inserting <quote>subject to subsection (a)(9),</quote>.</text></paragraph></subsection><subsection id="id54E0D99D35434EEC9914AF1A394E387D"><enum>(b)</enum><header>Inspector general review</header><paragraph id="id211B9AFA3A304EA68EEEF36797AD98E6"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Inspector General of the Department of Transportation and the Inspector General of the Department of the Interior shall jointly begin an audit of the tribal transportation program under section 202 of title 23, United States Code (referred to in this section as the <quote>program</quote>).</text></paragraph><paragraph id="id621AB51358724F6499730164ED2E926C"><enum>(2)</enum><header>Review</header><text>The audit under paragraph (1) shall include—</text><subparagraph id="id223F1C8C87FE45D38FF065D052DD801B"><enum>(A)</enum><text>a review of the data collection and management processes used by the Secretary of the Interior in maintaining the national inventory of tribal transportation facilities under section 202(b)(1) of title 23, United States Code; and</text></subparagraph><subparagraph id="id030D297F355D4C6AAD22836B12410DBF"><enum>(B)</enum><text>a review of the administration of the program, including whether—</text><clause id="idBF01DA4865124E52AA25C2D23E3C0D20"><enum>(i)</enum><text>funding under the program is distributed in a timely manner that is consistent with statutory and regulatory requirements; and</text></clause><clause id="id35505A3313B44FF7AD5FB8E13ADDC5E9"><enum>(ii)</enum><text>the current procedures and practices used by the Secretary of the Interior to allocate funding for tribal transportation facilities (as defined in section 101(a) of title 23, United States Code) under the program are transparent and consistently applied.</text></clause></subparagraph></paragraph><paragraph id="idA48F75F3393C4CF0A6E581D9B51228E7"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Inspector General of the Department of Transportation and the Inspector General of the Department of the Interior shall jointly submit a report describing the results of the audit under paragraph (1) to—</text><subparagraph id="idB688E7ECA40B4E1D9A46BFE87FD96F43"><enum>(A)</enum><text>the Committee on Environment and Public Works of the Senate;</text></subparagraph><subparagraph id="idC02E40755D8E4675A4AA9461FF701539"><enum>(B)</enum><text>the Committee on Indian Affairs of the Senate;</text></subparagraph><subparagraph id="id1710FFB1C3384E2593CD6CBC0AD4A8C9"><enum>(C)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9C2BABB624E4B7C8E7685CAC9BDAE16"><enum>(D)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id43475D7EEB2446F2935E6D7C6369388D"><enum>(c)</enum><header>Comptroller General review</header><paragraph id="id10DC26AB254E47F58715286FAB05A4AC"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States (referred to in this subsection as the <quote>Comptroller General</quote>) shall initiate an audit of the program.</text></paragraph><paragraph id="id00596F0A5F6E4B02AFEE24AFE9203C21"><enum>(2)</enum><header>Review</header><text>The audit under paragraph (1) shall include an examination of—</text><subparagraph id="idC281505AA86442A7B2991E833BFA4A09"><enum>(A)</enum><text>the funding formula of the program under section 202(b)(3) of title 23, United States Code, including key decisions made over time that have affected the methods used to determine tribal shares of program funds;</text></subparagraph><subparagraph id="idA367E57E9A1C4C2ABACBF9C436880572"><enum>(B)</enum><text>whether, for purposes of allocating funding under section 202 of title 23, United States Code, the allocation methodology under subpart D of part 1000 of title 24, Code of Federal Regulations (as in effect on the date of enactment of this Act), provides an accurate and reliable estimate of tribal population;</text></subparagraph><subparagraph id="idEF22A11FD7424C1B95F1D013A9C83733"><enum>(C)</enum><text>potential alternatives to the methodology described in subparagraph (B) for purposes of allocating funding under section 202 of title 23, United States Code;</text></subparagraph><subparagraph id="id0E86D16A01E446D38345A303C0B0951C"><enum>(D)</enum><text>how the Secretary of the Interior ensures that—</text><clause id="idF33D8F9FA8604665AC884604CDFF7DE4"><enum>(i)</enum><text>the program is consistently administered; and</text></clause><clause id="idFB2A38E56E6644F1ABDB0C0FB38FCE90"><enum>(ii)</enum><text>program decisions are transparently and consistently made; and</text></clause></subparagraph><subparagraph id="idE7229E1A62DF42E683DFAB53A63A39DF"><enum>(E)</enum><text>the potential effects of having the program administered solely by the Secretary of the Interior or the Secretary of Transportation.</text></subparagraph></paragraph><paragraph id="id0C54033B8E0547D8948DFFB1B4758345"><enum>(3)</enum><header>Report</header><text>Not later than 540 days after the date of enactment of this Act, the Comptroller General shall submit a report describing the results of the audit under paragraph (1) to—</text><subparagraph id="id62DEAF4F5E1E411385D7EDC762BCCFAB"><enum>(A)</enum><text>the Committee on Environment and Public Works of the Senate;</text></subparagraph><subparagraph id="idDFB38A8CE0074424A4D9D4A1F4479AD3"><enum>(B)</enum><text>the Committee on Indian Affairs of the Senate;</text></subparagraph><subparagraph id="id3E58B085F0A14E41B77011D6E103C1ED"><enum>(C)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCF5E6CA237FD43718252D934C064B6B1"><enum>(D)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="id03DEA7B1B8C9437080CAFF0483E790B6"><enum>(d)</enum><header>Obligation limitations</header><text>Notwithstanding section 1102(a) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/23/104">23 U.S.C. 104</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>) or any other provision of law providing a limitation on obligations for Federal-aid highway and highway safety construction programs for a fiscal year, amounts made available to carry out the tribal transportation program under section 202 of title 23, United States Code, for a fiscal year shall not be subject to the obligation limitation for that fiscal year.</text></subsection></section><section id="id471E6CF7841F4FC78EEBAAB05FC8A65E"><enum>3.</enum><header>Transportation facility eligibility</header><subsection id="idF8FFFDDDAD24412ABDC22E7A8DE614BD"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7E74A0A7EEBB4122A21E543FD8D427B1"><enum>(1)</enum><header>Inventory</header><text>The term <term>inventory</term> means the national inventory of tribal transportation facilities under section 202(b) of title 23, United States Code.</text></paragraph><paragraph commented="no" id="id126C1607B02940A49DA9B44A014AD0C7"><enum>(2)</enum><header>Proposed road</header><text>The term <term>proposed road</term> means a proposed road or facility (as defined in section 170.5 of title 25, Code of Federal Regulations (as in effect on the date of enactment of this Act)) that is a road, including a primary access route (as defined in that section).</text></paragraph><paragraph id="id798CAA3C236D4421B94EA733BF26B55B"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="idFB3F6EC2AB5E491490F9CB6AB49DE55B"><enum>(b)</enum><header>Deadline</header><text>Not later than 180 days after the date of enactment of this Act, and not less frequently than every 3 years thereafter, the Secretary and the Secretary of Transportation shall require each Indian tribe that intends to include a proposed road in the inventory to complete and submit for approval the documentation and other information required under section 170.443(a) of title 25, Code of Federal Regulations (as in effect on November 6, 2019), for the proposed road.</text></subsection><subsection id="idA09E4718FBE049718A494439B7154D82"><enum>(c)</enum><header>Report</header><paragraph id="id89B0E52B179E44F2B94B1770B8AFFF9B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after each deadline described in subsection (b), the Secretary shall submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the proposed roads approved to be included in the inventory.</text></paragraph><paragraph id="id1E3013AE72284684B16A36D668CE98E3"><enum>(2)</enum><header>Requirements</header><text>Each report under paragraph (1) shall include, for each Indian reservation, Alaska Native village, or other recognized Indian community (including former Indian reservations in the State of Oklahoma)—</text><subparagraph id="idD0EC5497B04C4B3890D3B0FE46B0E28F"><enum>(A)</enum><text>the mileage of proposed roads included in the inventory before the deadline described in subsection (b);</text></subparagraph><subparagraph id="id8E6B5FB526294E06B5DF8EC2BFD67E5C"><enum>(B)</enum><text>the mileage of proposed roads approved to be included in the inventory on the basis of the documentation and other information submitted under subsection (b); and</text></subparagraph><subparagraph id="idCA8D8A53497045BEBD6D2A4EDC902289"><enum>(C)</enum><text>an estimate, based on the documentation and other information submitted under subsection (b), of the construction and maintenance costs of the proposed roads described in subparagraph (B).</text></subparagraph></paragraph></subsection></section><section id="idF013E6725CED4AF7AF9FB47D07FC8F96"><enum>4.</enum><header>Tribal highway safety partnerships</header><text display-inline="no-display-inline">Section 402 of title 23, United States Code, is amended—</text><paragraph id="id727CEA3738C048BF9B315CDC00C93B85"><enum>(1)</enum><text>in subsection (b)(1)(C), by striking <quote>by</quote> and inserting <quote>by, or on behalf of,</quote>; and</text></paragraph><paragraph id="idBAC662C52262405C8E9F70B877819E7D"><enum>(2)</enum><text>in subsection (h)(2)—</text><subparagraph id="id3E4859A838D7433587DBAF1393CA0FA0"><enum>(A)</enum><text>by striking <quote>Notwithstanding</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1F17D75E563D412FA4E68C55B7BC024C"><subparagraph id="id19D2882EF34645F082CDD2C8506375C4"><enum>(A)</enum><header>In general</header><text>Notwithstanding</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id7B55CC96AB334B00A60C4F46F26B8E71"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5026C2CD094C44E3A03298FE595D76B7"><subparagraph id="idFA5C4A5466B94011AD7A0ECA19291C3F"><enum>(B)</enum><header>Cooperation</header><text>In accordance with section 202(a)(9)(A), an Indian tribe may use amounts described in subparagraph (A) in cooperation with States, counties, and other local subdivisions for highway safety purposes.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id861F4ED81F8F4066A83A1949199666B8"><enum>5.</enum><header>Nationally significant Federal lands and tribal projects program</header><text display-inline="no-display-inline">Section 1123 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/23/201">23 U.S.C. 201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>) is amended—</text><paragraph id="id1FA336C7C96645F5BD9277707BBBA90A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(3), by inserting <quote>for a project that is to be carried out by an eligible entity that is not an Indian tribe,</quote> before <quote>having an</quote>; and</text></paragraph><paragraph id="id057F5173470F4F20B9E4E5EFCBA21097"><enum>(2)</enum><text>in subsection (g)(1)—</text><subparagraph id="idF83A771B7FE648969994D89F841CA8A5"><enum>(A)</enum><text>by striking <quote>shall be up to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" act-name="" id="id6D6695F019B64A7095C8CB141DE49DBF"><text>shall be—</text><subparagraph id="idE2492C788F124F29ADB19EEC1F573F13"><enum>(A)</enum><text>for a project carried out by an Indian tribe, up to 100 percent; and</text></subparagraph><subparagraph id="idC89832B5DB2541BCA60772630F26D415"><enum>(B)</enum><text>for a project not described in subparagraph (A), up to</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id724d640d67254f2eb177632ea194422e"><enum>6.</enum><header>Tribal transportation advisory committee</header><subsection id="id3bc16890f59f4edba9de49d0d7e86fd1"><enum>(a)</enum><header>Establishment</header><text>Subject to the availability of appropriations, not later than 180 days after the date of enactment of this Act, the Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) shall establish within the Bureau of Indian Affairs a committee, to be known as the <quote>Tribal Transportation Advisory Committee</quote> (referred to in this section as the <quote>Committee</quote>), which shall replace the Tribal Transportation Program Coordinating Committee established under sections 170.135 through 170.137 of title 25, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></subsection><subsection id="id05d36322cec7402bab836b9a54d9a6e7"><enum>(b)</enum><header>Membership</header><paragraph id="id82b42954c864487e94bdd1183995fd37"><enum>(1)</enum><header>In general</header><text>The Committee shall be composed of—</text><subparagraph id="id6DDF103C20CA48AA9CDE4C3EA9267DFF"><enum>(A)</enum><text>the Secretary (or a designee);</text></subparagraph><subparagraph id="id646e8e5de0794f08a23a7c47aafcbcda"><enum>(B)</enum><text>representatives of a diverse group of Indian tribes, including—</text><clause id="id6990EF787F584376B83D49D4F7146D77"><enum>(i)</enum><text>not fewer than 1 tribal representative from each region of the Bureau of Indian Affairs; and</text></clause><clause id="id9779621A0E7047B5A6AE2F4993E31A6D"><enum>(ii)</enum><text>not more than 3 tribal representatives from any 1 region of the Bureau of Indian Affairs;</text></clause></subparagraph><subparagraph id="idaef32ddb3754455f8605b43dd4b7a1c1"><enum>(C)</enum><text>State and local representatives;</text></subparagraph><subparagraph id="idb39f7e8c0dbf46de816788ecf725b6c7"><enum>(D)</enum><text>not fewer than 1 representative of the Bureau of Indian Affairs;</text></subparagraph><subparagraph id="id6479086adf2a45d6a318dcedcbc9badd"><enum>(E)</enum><text>not fewer than 1 representative of the Department of Transportation; and</text></subparagraph><subparagraph id="id2586939b12ac4177a1961047e2b66097"><enum>(F)</enum><text>other members, as determined to be appropriate by the Secretary in consultation with the Committee.</text></subparagraph></paragraph><paragraph id="id22f203d637b54addbf21c0a0bbda6025"><enum>(2)</enum><header>Appointment</header><text>The Secretary shall appoint each member of the Committee.</text></paragraph><paragraph commented="no" id="idB17D18CC687C4C5FA7021C250224C1B5"><enum>(3)</enum><header>Chairperson</header><text>The Secretary (or a designee) shall serve as chairperson of the Committee.</text></paragraph></subsection><subsection id="id5ddfac1afdbf4701b1bf124f285e3ba5"><enum>(c)</enum><header>Terms</header><text>Except for the Secretary, each member of the Committee shall serve for a term of 3 years.</text></subsection><subsection id="idf9b04b9bef3a4335981f89617238f249"><enum>(d)</enum><header>Vacancies</header><text>Any vacancy occurring in the membership of the Committee—</text><paragraph id="id783ea8c65ec642cc8d407522060766b0"><enum>(1)</enum><text>shall be filled in the same manner as the original appointment was made; and</text></paragraph><paragraph id="id03ea890f94f64caa8ef993335a4d8b79"><enum>(2)</enum><text>shall not affect the power of the remaining members to carry out the duties of the Committee.</text></paragraph></subsection><subsection id="idee051c2e3fb048aa9a6f2db2963b41ba"><enum>(e)</enum><header>Duties</header><paragraph id="id6799e885a6114e9ebdf2377150e9bbf8"><enum>(1)</enum><header>In general</header><text>The Committee shall—</text><subparagraph id="id55D42AF0036F4600BC5F1AC835FEDAAF"><enum>(A)</enum><text>regularly provide advice to the Secretary on and, subject to the discretion of the Committee, study issues relating to tribal transportation, including—</text><clause id="id4c4843533a5445c6b1f0999ed6aebe27"><enum>(i)</enum><text>the tribal transportation program under section 202 of title 23, United States Code, including—</text><subclause id="idfcedba23c4c84663bbf254dc4347c79d"><enum>(I)</enum><text>the funding formula used to determine tribal shares under the tribal transportation program; and</text></subclause><subclause id="id3f1f43bc8d3e483d9da63a06d3bbf211"><enum>(II)</enum><text>the national tribal transportation facility inventory established under subsection (b)(1) of that section;</text></subclause></clause><clause id="idf56e54441f0142fa98f2609fab2ebb78"><enum>(ii)</enum><text>the road maintenance program managed by the Bureau of Indian Affairs;</text></clause><clause id="id6BB3CE5BA1554FDE9FB3BCE4ACAEC575"><enum>(iii)</enum><text>grants awarded to Indian tribes for public transportation using amounts made available under section 5311(c)(1) of title 49, United States Code;</text></clause><clause id="idbf3fc4e4637045ec91a72d1b238411a0"><enum>(iv)</enum><text>transportation safety within tribal reservations, including—</text><subclause id="id4b11175efa39443f99e37964b4018f66"><enum>(I)</enum><text>traffic safety; and</text></subclause><subclause id="id706f4037a75740fe87b169ed77adb5b2"><enum>(II)</enum><text>safety partnerships with Federal, State, and local authorities;</text></subclause></clause><clause id="id2ccf07ea19204dcfafccb0b272178326"><enum>(v)</enum><text>the availability of transportation funding in the event of a natural disaster; and</text></clause><clause id="id5BB992C909514E98B7D74E5BA58907EB"><enum>(vi)</enum><text>any other policies or procedures related to tribal transportation, as determined by the Committee; and</text></clause></subparagraph><subparagraph id="idC9977BAC8D204FD690382FC83F3701BA"><enum>(B)</enum><text>carry out the duties of the Tribal Transportation Program Coordinating Committee established under sections 170.135 through 170.137 of title 25, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></subparagraph></paragraph><paragraph id="id56739d9b77914df589de1ef83d44ef13"><enum>(2)</enum><header>Best practices and recommendations</header><text>The Committee may, on a periodic basis, develop and present to the Secretary best practices and recommendations regarding the issues described in clauses (i) through (vi) of paragraph (1)(A).</text></paragraph><paragraph commented="no" id="id6C7E829F553F413F93E200B36BD9F421"><enum>(3)</enum><header>Subcommittees</header><text>The Committee may establish any subcommittees necessary to carry out the duties of the Committee.</text></paragraph></subsection><subsection id="ide2820f4bc7684703b512f76037ae68ae"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 180 days after receiving any recommendations from the Committee under subsection (e)(2), the Secretary shall submit to the relevant committees of Congress a report describing those recommendations.</text></subsection><subsection id="idf80556bfb0ce4b7c96893de3cba25abd"><enum>(g)</enum><header>Federal Advisory Committee Act</header><text>Except as otherwise provided in this section, the Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the Committee and each subcommittee of the Committee.</text></subsection><subsection id="id52a114c5f0154814bff70543fecd59f7"><enum>(h)</enum><header>Detail of Federal employees</header><paragraph id="idfdc6c2d9f2de4437b8cb295cc700bc04"><enum>(1)</enum><header>In general</header><text>On request of the Committee, the Secretary may detail, with or without reimbursement, any of the personnel of the Department of the Interior or, in consultation with the Secretary of Transportation, the Department of Transportation, to the Committee to assist the Committee in carrying out the duties of the Committee.</text></paragraph><paragraph id="id7435ce2544914889b3bad96620c5b9b8"><enum>(2)</enum><header>Civil service status</header><text>Any detail of a Federal employee under paragraph (1) shall not interrupt or otherwise affect the civil service status or privileges of the Federal employee being detailed.</text></paragraph></subsection><subsection id="id3833e8ef3700429fb7a6e1b1bd0c6e6e"><enum>(i)</enum><header>Payment and expenses</header><paragraph id="id1d95c08bea7a40e683e1d6343ce134b2"><enum>(1)</enum><header>Compensation</header><text>Members of the Committee shall serve without pay.</text></paragraph><paragraph id="id4035ce3f15de4b38ae011d6a7a298f41"><enum>(2)</enum><header>Travel expenses</header><text>Each member of the Committee shall receive, for a meeting called by the Secretary, travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code.</text></paragraph></subsection><subsection id="id05264745e4624c45874dfb5a6488839c"><enum>(j)</enum><header>Termination</header><text>The Committee, including subcommittees of the Committee, shall terminate on the date that is 10 years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
