Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles II and XVIII of the Social Security Act to eliminate the disability insurance benefits waiting period for individuals with disabilities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop the Wait Act of 2022</short-title></quote>.</text></section><section id="HDAA7F8C523474C79AE9DEA2D2140989C"><enum>2.</enum><header>Elimination of disability waiting period for social security disability insurance benefits</header><subsection id="H5D9D36B914464B32BFA18743DD816A66"><enum>(a)</enum><header>Elimination of waiting period for disability insurance benefits</header><text display-inline="yes-display-inline">Section 223 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423</external-xref>) is amended—</text><paragraph id="HC344B853BE6446FAB5C8FF19ABF5665B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="HC69EE64A1CDE44B596F9104799090A6F"><enum>(A)</enum><text>in paragraph (1), in the matter following subparagraph (E)—</text><clause id="HCDEDD741153B404F8A51126B8E21D147"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>disability insurance benefit (i) for each month</quote> and all that follows through <quote>, or (iii)</quote> and inserting <quote>disability insurance benefit</quote>; and</text></clause><clause id="H2DA904DA453E4D649046CF7F1FD3D97E"><enum>(ii)</enum><text>by striking <quote>, but only if</quote> and all that follows through <quote>under such disability</quote>; and</text></clause></subparagraph><subparagraph id="H69753A224B274B53AC27252F9BD552A9"><enum>(B)</enum><text>in paragraph (2), by striking <quote>as though he had attained age 62 in—</quote> and all that follows through <quote>such disability insurance benefits,</quote> and inserting <quote>as though the individual had attained age 62 in the first month for which the individual becomes entitled to such disability insurance benefits,</quote>; and</text></subparagraph></paragraph><paragraph id="HD175FEA033E14DA980C9CC3C88B7451A"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H1D5D3004D4F048089F35C494619F0078"><enum>(A)</enum><text>in the subsection heading, by striking <quote>Definitions of Insured Status and Waiting Period</quote> and inserting <quote>Definition of Insured Status</quote>;</text></subparagraph><subparagraph id="HF6F1B53ACFAD454889FE894A405C9373"><enum>(B)</enum><text>by striking <quote>For purposes of this section</quote> and all that follows through <quote>in any month if—</quote> and inserting <quote>For purposes of this section, an individual shall be insured for disability insurance benefits in any month if—</quote>;</text></subparagraph><subparagraph id="HFF0E43D669C14D8DB4638C93402A10D5"><enum>(C)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="H9E8E71F83F4D472CB4AADA6839F11524"><enum>(D)</enum><text>by redesignating subparagraphs (A) and (B) as paragraphs (1) and (2), respectively (and adjusting the margins accordingly);</text></subparagraph><subparagraph id="H5CCD942C836E4330A97EE1ADC1D2F373"><enum>(E)</enum><text>in paragraph (2) (as so redesignated)—</text><clause id="H98B0BB37A5B542A7A92BF487FE7D5530"><enum>(i)</enum><text>by redesignating clauses (i), (ii), and (iii) as subparagraphs (A), (B), and (C), respectively; and</text></clause><clause id="H0B715A8020294324BC1AEC9DC566DF98"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C) (as so redesignated), by striking <quote>clause (i)</quote> and inserting <quote>subparagraph (A)</quote>; and</text></clause></subparagraph><subparagraph id="H6080A0FE936344EA950EDCE56F1B6E5A"><enum>(F)</enum><text>in the matter following subparagraph (C) (as so redesignated), by striking <quote>subparagraph (B) of this paragraph</quote> each place it appears and inserting <quote>this paragraph</quote>. </text></subparagraph></paragraph></subsection><subsection id="HBB405F996D584FA8B907D408F07274CE"><enum>(b)</enum><header>Phase-Down of waiting period for disability insurance benefits</header><text display-inline="yes-display-inline">For purposes of applications for disability insurance benefits filed on or after the date of enactment of this Act and before January 1, 2027, section 223(c)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(c)(2)</external-xref>) shall be applied by making the following substitutions:</text><paragraph id="H55E36BD50AF048E1AE2414F86A2E3B02"><enum>(1)</enum><text>For applications filed in calendar year 2022, 2023, or 2024, substitute <quote>three</quote> for <quote>five</quote> and <quote>fifteenth</quote> for <quote>seventeenth</quote> each place it appears.</text></paragraph><paragraph id="H5CE324A13C8342D39C149737A6A97CD6"><enum>(2)</enum><text>For applications filed in calendar year 2025, substitute <quote>two</quote> for <quote>five</quote> and <quote>fourteenth</quote> for <quote>seventeenth</quote> each place it appears.</text></paragraph><paragraph id="H57AD55CF22D44A8FB59EEE49B1912384"><enum>(3)</enum><text>For applications filed in calendar year 2026, substitute <quote>one</quote> for <quote>five</quote> and <quote>thirteenth</quote> for <quote>seventeenth</quote> each place it appears.</text></paragraph></subsection><subsection id="HB08EDE619046422DB624B4CA9DEF2AF7"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect on January 1, 2027, and apply with respect to applications for disability insurance benefits filed on or after January 1, 2027.</text></subsection><subsection id="HB60D8ACF368642E7A4ACD6811F3BD2F8"><enum>(d)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Effective January 1, 2027:</text><paragraph id="H4B98A69E1B0445669D0C144863DC8653"><enum>(1)</enum><text>Section 223(a)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(a)(1)(A)</external-xref>) is amended by striking <quote>(c)(1)</quote> and inserting <quote>(c)</quote>.</text></paragraph><paragraph id="HC403E09B8E044BFA86F41C10920EBE5B"><enum>(2)</enum><text display-inline="yes-display-inline">Section 7(d)(3) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231f">45 U.S.C. 231f(d)(3)</external-xref>) is amended by striking <quote>223(c)(1)</quote> and inserting <quote>223(c)</quote>. </text></paragraph></subsection></section><section id="H8102EEC6D14E46F6A2C2C629C464911D"><enum>3.</enum><header>Medicare eligibility for certain individuals during waiting period for Social Security Disability Insurance benefits</header><subsection id="H9022DADD666949CCB5783FD624DCF79D"><enum>(a)</enum><header>Elimination of waiting period for certain individuals without minimum essential coverage</header><paragraph id="HB36B3DB173BF44E3AC316135C2C8A2DB"><enum>(1)</enum><header>In general</header><text>Section 226 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/426">42 U.S.C. 426</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HC1F4CC56A2224E968612E62ACEE7219D" display-inline="no-display-inline"><subsection id="H77A76BAEA9AF418B8E7D4526B9C8407E"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H523078073B3A44DEA366AFD23504EDAC"><enum>(1)</enum><text>For purposes of applying this section in the case of an eligible individual described in paragraph (2), the following special rules shall apply:</text><subparagraph id="HC676C39A8E58457995805CF38148DDB4" indent="up1"><enum>(A)</enum><text>Subsection (b)(2) shall be applied as if there were no requirement for any entitlement to benefits, or status, for a period of 24 months prior to receiving such benefits or status.</text></subparagraph><subparagraph id="HFF70A36446614619B2E23663D138D497" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The entitlement under such subsection shall be available retroactively to the first day of the first month (rather than twenty-fifth month) of entitlement or status.</text></subparagraph><subparagraph id="HD2849256AD204024A0BF353A91965482" indent="up1"><enum>(C)</enum><text>Subsection (f) shall not be applied.</text></subparagraph></paragraph><paragraph id="H51BD08B0A4864D65B57E07BC56715CC3" indent="up1"><enum>(2)</enum><text>For purposes of applying this section, an <quote>eligible individual</quote> is an individual, with respect to a month—</text><subparagraph id="H3EA6EB65B5EC4721AF94783ED606EDAD"><enum>(A)</enum><text>who has not yet attained the age of 65;</text></subparagraph><subparagraph id="H71764975550C420F85445BDC53EBF4D7"><enum>(B)</enum><text>who is entitled to benefits described in subparagraph (A) of subsection (b)(2); and</text></subparagraph><subparagraph id="H57777601ADA44E129EC47214C361883B"><enum>(C)</enum><text>with respect to whom <external-xref legal-doc="usc" parsable-cite="usc/26/5000A">section 5000A(e)(1)(A)</external-xref> of the Internal Revenue Code of 1986 would apply if the reference to <quote>8 percent</quote> in such section were a reference to <quote>8.5 percent</quote>. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H91AE14EE8F0D449FA320A212ED98226A"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 1811 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref>) is amended—</text><subparagraph id="H2103E9A4CEF54442A574A1C1F34D353C"><enum>(A)</enum><text>at the end of paragraph (2), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="HD0999156A23F4E0B916A47A78E546061"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph id="H4DD41EB86C1F4A6C926DEB8E7E4DFBD9"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H4E8F0B4D3C694AED85661938CCAE7214" display-inline="no-display-inline"><paragraph id="HEB4601E42A164CF2ABAF9D66BE8B74C4"><enum>(4)</enum><text display-inline="yes-display-inline">eligible individuals (as described in section 226(j)(2)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H248AF274DE04471E8803317FE4D907B4"><enum>(b)</enum><header>Special enrollment period and coverage application for certain individuals without minimum essential coverage</header><text>Section 1837 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H6A78AE95997F48A28C5DE2369DB817D6" display-inline="no-display-inline" style="OLC"><subsection id="H0321E884FD8E41E49B05425227636567"><enum>(o)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H61BC364DC20349B5A669AE50B82E85E9"><enum>(1)</enum><text>In applying this section in the case of an eligible individual who is entitled to benefits under part A pursuant to the operation of section 226(j), the following special rules shall apply:</text><subparagraph id="H28BCB032BF7342299B7F974301B3CC33" indent="up1"><enum>(A)</enum><text>The initial enrollment period under subsection (d) shall begin on the first day of the first month in which the individual satisfies the requirement of section 1836(a)(1).</text></subparagraph><subparagraph id="H760F477D86D5498A8D5CD3C67D257F88" indent="up1"><enum>(B)</enum><text>In applying subsection (g)(1), the initial enrollment period shall begin on the first day of the first month of entitlement to disability insurance benefits referred to in such subsection.</text></subparagraph></paragraph><paragraph id="H07714F7AE72B4C7B955961C80C19E17E" commented="no" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In applying this section in the case of an individual who became entitled to benefits under part A, but had not been entitled to such benefits for a period of 24 calendar months as of the date of enactment of the <quote>Stop the Wait Act of 2022</quote>, and is entitled to such benefits pursuant to the application of section 226(j), the initial enrollment period under subsection (d) for such individual shall begin on the first day of the first month following the date of enactment of the <quote>Stop the Wait Act of 2022</quote> and shall end seven months later.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
