<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3570</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220203">February 3, 2022</action-date><action-desc><sponsor name-id="S402">Ms. Rosen</sponsor> (for herself and <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program within the Department of Labor to support the creation, implementation, and expansion of registered apprenticeship programs in cybersecurity.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cyber Ready Workforce Act</short-title></quote>.</text></section><section id="id45ae7ebc11144777b4a39e452cc61c08"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id4d96d70659284d4ea4c2a36dc65e5407"><enum>(1)</enum><text>According to projections from Georgetown University’s Center on Education and the Workforce, the United States was already set to experience a shortage of 5,000,000 workers with postsecondary education or training, including training leading to vocational certificates and apprenticeship training, by 2020. The COVID–19 pandemic has only exacerbated this problem. </text></paragraph><paragraph id="iddc7a25befaf340448f9c9c44d5730dfa"><enum>(2)</enum><text>Registered apprenticeships strengthen the Nation's economy, create pathways to good-paying careers, and help meet the Nation's current workforce demands.</text></paragraph><paragraph id="id03681e3e0eba43e19105cde6ebe9061c"><enum>(3)</enum><text>Apprenticeships can help fill the Nation's workforce needs, including in fields not traditionally linked to apprenticeships, such as cybersecurity.</text></paragraph><paragraph id="id8e4d1de232154657a490ff450b1124ee"><enum>(4)</enum><text>The cybersecurity field has a severe shortage in talent, with over 597,000 job openings today, according to CyberSeek, an interactive cybersecurity jobs heat map funded by the Department of Commerce's National Institute of Standards and Technology (NIST).</text></paragraph><paragraph id="idc12682d3ac96456f8aeea09c9b50d96e"><enum>(5)</enum><text>Employers, especially in cybersecurity and information technology fields, may be unfamiliar with the apprenticeship model or do not have the capacity or resources to develop and implement their own training.</text></paragraph></section><section id="id4ed186f5ff54462fb5d9e42dc537faf1"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9cacd61835934ebea1683ef358b9b831"><enum>(1)</enum><header>Registered apprenticeship program</header><text>The term <term>registered apprenticeship program</term> means a program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph><paragraph id="id042ea39809ce4668a76d082d0a01e4dd"><enum>(2)</enum><header>Workforce intermediary</header><text>The term <term>workforce intermediary</term> means an entity that facilitates the establishment of registered apprenticeship programs, and may be a partnership that includes one or more of the following as partners:</text><subparagraph id="id850e8bd221954115b064de475ec1ca1a"><enum>(A)</enum><text>A business or industry organization.</text></subparagraph><subparagraph id="ide8b99e6cbf094ef6b6f62879c2138533"><enum>(B)</enum><text>A community-based organization, as defined in section 3201(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(5)</external-xref>).</text></subparagraph><subparagraph id="id9ce46baf30bb4320986888973f06210d"><enum>(C)</enum><text>A State or local workforce development board, as such terms are defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></subparagraph><subparagraph id="idf233a9f2e6694bd8975a824ad4fe80a3"><enum>(D)</enum><text>A postsecondary education institution with experience in developing and administering registered apprenticeship programs.</text></subparagraph><subparagraph id="id4edce50adf1440479a259bccb4496a9e"><enum>(E)</enum><text>A joint labor-management partnership.</text></subparagraph><subparagraph id="id57651644299c42c18da64c3d6a323a0b"><enum>(F)</enum><text>An institution of higher education, as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></subparagraph><subparagraph id="idf380aa88118143059c06234a41441a3d"><enum>(G)</enum><text>A nonprofit organization.</text></subparagraph></paragraph></section><section id="id5695c2d6241f45f3a0abb62e5121e720"><enum>4.</enum><header>Cybersecurity apprenticeship grant program</header><subsection id="idbdcc6101ba814f429be41f132ec4e1b6"><enum>(a)</enum><header>In general</header><text>The Secretary of Labor shall award grants, on a competitive basis, to workforce intermediaries, to support the establishment, implementation, and expansion of registered apprenticeship programs in cybersecurity.</text></subsection><subsection id="id8fbcf767b3414b0f97aab907523e5c5e"><enum>(b)</enum><header>Description of programs eligible</header><text>For purposes of subsection (a), registered apprenticeship programs in cybersecurity shall include technical instruction, workplace training, and industry-recognized certification in cybersecurity. Programs shall—</text><paragraph id="idf04419f6fbfb458cb9fb35dd60b79650"><enum>(1)</enum><text>include certifications in CompTIA Network+, CompTIA A+, CompTIA Security+, Microsoft Windows 10 Technician, Microsoft Certified System Administrator, Certified Network Defender, Certified Ethical Hacker, ISACA Cybersecurity Nexus (CSX), (ISC)<superscript>2</superscript>'s Certified Information Systems Security Professional (CISSP), or other industry-recognized certification in cybersecurity;</text></paragraph><paragraph id="id457c95e7884449aaacf395ad037fc099"><enum>(2)</enum><text>encourage stackable and portable credentials; and</text></paragraph><paragraph id="ida49dbeaac205410fbde607b111351f40"><enum>(3)</enum><text>lead to occupations such as computer support specialists, cybersecurity support technicians, cloud computing architects, computer programmers, computer systems analysts, or security specialists.</text></paragraph></subsection></section><section id="idcacfb49da45b46c192c6604802364c6a"><enum>5.</enum><header>Use of funds</header><subsection id="id70f0c47c749d45a3a719af3cc466b4b7"><enum>(a)</enum><header>Required activities</header><text>A workforce intermediary shall use at least 85 percent of the amount of grant funds received under this Act for the following:</text><paragraph id="id23c6eaaf001346f1a76a4d613f1b3d63"><enum>(1)</enum><header>Development and technical support</header><text>Complete the apprenticeship registration process with the Department of Labor, and assist employers with other logistical and technical issues.</text></paragraph><paragraph id="ida1f1814c17a445109c9ca1029cc3bf20"><enum>(2)</enum><header>Employer partnership</header><subparagraph id="id26e949bf3a6646fba1bac9a1d51094dd"><enum>(A)</enum><header>In general</header><text>Develop curricula and technical instruction for the registered apprenticeship program in cooperation with local businesses, organizations, and employer-partners, referencing the work roles and tasks outlined in the National Initiative for Cybersecurity Education (NICE) Cybersecurity Workforce Framework Special Publication 800–181 to develop skills and standards for the program.</text></subparagraph><subparagraph id="id01ead0291e704b9aaa174763443f05bf"><enum>(B)</enum><header>Offsite training</header><text>Assist employers in paying for the cost of offsite training and acquiring course materials provided to apprentices.</text></subparagraph><subparagraph id="idcf565b0b6eed4032a89fafffb68d6821"><enum>(C)</enum><header>Connecting employers</header><text>Connect employers with education and training providers to complement on-the-job learning.</text></subparagraph></paragraph><paragraph id="id26ab06d9db1b4016a5fb5f1452b8ba43"><enum>(3)</enum><header>Support services for apprentices</header><text>Provide support services to apprentices to assist with their success in the registered apprenticeship program, which may include the following:</text><subparagraph id="idbd6d5920169e449684506f6723ed6ceb"><enum>(A)</enum><text>Career counseling.</text></subparagraph><subparagraph id="id713e7a6ccc77467bb26419ac19efde18"><enum>(B)</enum><text>Mentorship.</text></subparagraph><subparagraph id="idd73cefa145c54826a770b0779d47bda4"><enum>(C)</enum><text>Assisting with costs of transportation, housing, and child care services.</text></subparagraph></paragraph></subsection><subsection id="id62a5a0fa1b224dd9b3a442c19585399e"><enum>(b)</enum><header>Allowable activities</header><text>A workforce intermediary may use up to 15 percent of the amount of grant funds received under this Act for the following outreach and marketing activities:</text><paragraph id="id54b2544b5dad483e9106cdd04917bba2"><enum>(1)</enum><text>Market apprenticeships and the apprenticeship model to employers, secondary school administrators, and counselors.</text></paragraph><paragraph id="idd124141d8f9143f6ae7f7f148f2314aa"><enum>(2)</enum><text>Recruit and conduct outreach to potential apprentices, including secondary school students, underrepresented populations (such as women and minorities), youth, and veterans.</text></paragraph></subsection></section><section id="idBB264892AA1E4330B008CF1C4B1B812E"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated, such sums as may be necessary to carry out this Act.</text></section></legis-body></bill>
