<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3566</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220203">February 2, 2022</action-date><action-desc><sponsor name-id="S259">Mr. Reed</sponsor> (for himself and <cosponsor name-id="S347">Mr. Moran</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act with respect to trauma care.</official-title></form><legis-body><section id="idC094B7ADE4DB445F93745D915F3C4036" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Trauma Systems and Emergency Care Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id3132B726BFE944408D58331E50D5F095"><enum>2.</enum><header>Trauma care reauthorization</header><subsection id="id2b730a0f97f54128acabce155393c38a"><enum>(a)</enum><header>In general</header><text>Section 1201 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300d">42 U.S.C. 300d</external-xref>) is amended—</text><paragraph id="id7f3777ddadd9471cbd325678b7b24631"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id2FF7DA552CDD4F9FAB0807693042998F"><enum>(A)</enum><text>in paragraph (3)—</text><clause id="id3F1BA017A28E48ADBA96B8D0C0AC1BD5"><enum>(i)</enum><text>by inserting <quote>analyze,</quote> after <quote>compile,</quote>; and </text></clause><clause id="idA48471F5BA8643FFBE9F8161044B35F8"><enum>(ii)</enum><text>by inserting <quote>and medically underserved areas</quote> before the semicolon;</text></clause></subparagraph><subparagraph id="id4F8D439F0C1C496097D3DAF1ED82E530"><enum>(B)</enum><text>in paragraph (4), by adding <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="id8033A266BB57494ABBD50898BA13120D"><enum>(C)</enum><text>by striking paragraph (5); and</text></subparagraph><subparagraph id="id2C7F8D3C395744EEAD47CC67D7DDAE17"><enum>(D)</enum><text>by redesignating paragraph (6) as paragraph (5);</text></subparagraph></paragraph><paragraph id="idA00295BE04A0429E892FD81A951B2F62"><enum>(2)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="id7F5E059D9F814F2E97283C5226DC1DE5"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbcfd1faa88e94345a3da4d522a0fbb13"><subsection id="id1cc3b3b31c9948e283011647e8a2234b"><enum>(b)</enum><header>Trauma care readiness and coordination</header><text>The Secretary, acting through the Assistant Secretary for Preparedness and Response, shall support the efforts of States and consortia of States to coordinate and improve emergency medical services and trauma care during a public health emergency declared by the Secretary pursuant to section 319 or a major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. Such support may include—</text><paragraph id="id1c9db8ab097b48fe85dfff8c23f8a136"><enum>(1)</enum><text>developing, issuing, and updating guidance, as appropriate, to support the coordinated medical triage and evacuation to appropriate medical institutions based on patient medical need, taking into account regionalized systems of care;</text></paragraph><paragraph id="ida90836b4c9924ea0a43e135cd79440cc"><enum>(2)</enum><text>disseminating, as appropriate, information on evidence-based or evidence-informed trauma care practices, taking into consideration emergency medical services and trauma care systems, including such practices identified through activities conducted under subsection (a) and which may include the identification and dissemination of performance metrics, as applicable and appropriate; and</text></paragraph><paragraph id="id5f47386d9d084419a311964b7eca5061"><enum>(3)</enum><text>other activities, as appropriate, to optimize a coordinated and flexible approach to the emergency response and medical surge capacity of hospitals, other health care facilities, critical care, and emergency medical systems.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id80a58e6040e44d20bac048be5797a84b"><enum>(b)</enum><header>Grants To improve trauma care in rural areas</header><text>Section 1202 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300d-3">42 U.S.C. 300d–3</external-xref>) is amended—</text><paragraph id="id258dc8d290174fe9946d319df71b0f88"><enum>(1)</enum><text>by amending the section heading to read as follows: <quote><header-in-text style="OLC" level="section">Grants to improve trauma care in rural areas</header-in-text></quote>; </text></paragraph><paragraph id="ida4ac11b88ac44ead9bceb6484440d365"><enum>(2)</enum><text>by amending subsections (a) and (b) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2b0dc05529d9423ca1e952e6607e3acd"><subsection id="id7ba590c3729d418b8714f9e41db312f9"><enum>(a)</enum><header>In general</header><text>The Secretary shall award grants to eligible entities for the purpose of carrying out research and demonstration projects to support the improvement of emergency medical services and trauma care in rural areas through the development of innovative uses of technology, training and education, transportation of seriously injured patients for the purposes of receiving such emergency medical services, access to prehospital care, evaluation of protocols for the purposes of improvement of outcomes and dissemination of any related best practices, activities to facilitate clinical research, as applicable and appropriate, and increasing communication and coordination with applicable State or Tribal trauma systems.</text></subsection><subsection id="id15d4a9db92db40009457d82bb212b082"><enum>(b)</enum><header>Eligible entities</header><paragraph id="id6cce387aab934121bae6873088f64b4a"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, an entity shall be a public or private entity that provides trauma care in a rural area.</text></paragraph><paragraph id="id22decbce324a4e828bbfab89f4329292"><enum>(2)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities that will provide services under the grant in any rural area identified by a State under section 1214(d)(1).</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id1afce79547a24dff836985ae9609985f"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1991CC7674454E30961DCEB8ADD9CA63"><subsection id="ida17dcbfb3e634d7ca5b24151f8baa4c6"><enum>(d)</enum><header>Reports</header><text>An entity that receives a grant under this section shall submit to the Secretary such reports as the Secretary may require to inform administration of the program under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ide448d0045df540feaef522b71f982118"><enum>(c)</enum><header>Pilot grants for trauma centers</header><text>Section 1204 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300d-6">42 U.S.C. 300d–6</external-xref>) is amended—</text><paragraph id="idaa51fbcd67cb4bcd91c4a269d8b2b11b"><enum>(1)</enum><text>by amending the section heading to read as follows: <quote><header-in-text style="OLC" level="section">Pilot grants for trauma centers</header-in-text></quote>;</text></paragraph><paragraph id="idD3E5CCF0C70948249DBEA1F68B96569F"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id04A66EE8804F47928F0276E0A1F2E08D"><enum>(A)</enum><text>by striking <quote>not fewer than 4</quote> and inserting <quote>10</quote>;</text></subparagraph><subparagraph id="idF99CA1D62B4F4103A23B2AFEBE942AEF"><enum>(B)</enum><text>by striking <quote>that design, implement, and evaluate</quote> and inserting <quote>to design, implement, and evaluate new or existing</quote>; </text></subparagraph><subparagraph id="id12BF6FCF899645D0B3533AE1E9420FA7"><enum>(C)</enum><text>by striking <quote>emergency care</quote> and inserting <quote>emergency medical</quote>; and</text></subparagraph><subparagraph id="id60E0A1360B05415C81456B6196977754"><enum>(D)</enum><text>by inserting <quote>, and improve access to trauma care within such systems</quote> before the period;</text></subparagraph></paragraph><paragraph id="id3fcb467d837345079ecd06181e601779"><enum>(3)</enum><text>in subsection (b)(1), by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3abdf2db494146cda6ab5be06df9ca32"><subparagraph id="id0fd1b3d6c59940b496720d912550945f"><enum>(A)</enum><text>a State or consortia of States;</text></subparagraph><subparagraph id="id624ea895b6c74d679275289e70212c8b"><enum>(B)</enum><text>an Indian Tribe or Tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act);</text></subparagraph><subparagraph id="idd5e0d1859c2040c7be006577905b2cff"><enum>(C)</enum><text>a consortium of level I, II, or III trauma centers designated by applicable State or local agencies within an applicable State or region, and, as applicable, other emergency services providers; or</text></subparagraph><subparagraph id="id79d1fd017852413cb79a592366f52fce"><enum>(D)</enum><text>a consortium or partnership of nonprofit Indian Health Service, Indian Tribal, and urban Indian trauma centers.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id7c6b2dc73f8641d6a4f0e58c288f3872"><enum>(4)</enum><text>in subsection (c)—</text><subparagraph id="id133FE6A71F974C93AC27BC05361DAC97"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="id114DAE72C22D4B5391F33F6AEA7B3844"><enum>(i)</enum><text>by striking <quote>that proposes a pilot project</quote>; and</text></clause><clause id="id9EB466FDDB784F5D83F14DDA2EF9BE83"><enum>(ii)</enum><text>by striking <quote>an emergency medical and trauma system that—</quote> and inserting <quote>a new or existing emergency medical and trauma system. Such eligible entity shall use amounts awarded under this subsection to carry out 2 or more of the following activities:</quote>;</text></clause></subparagraph><subparagraph id="id5e9d249a3aa94c95931b6aec91126801"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="iddf830fcf5bd640e8a370744a0ba53401"><enum>(i)</enum><text>by striking <quote>coordinates</quote> and inserting <quote>Strengthening coordination and communication</quote>; and</text></clause><clause id="idD4201A9606944D13AD76ECAC667552E8"><enum>(ii)</enum><text>by striking <quote>an approach to emergency medical and trauma system access throughout the region, including 9–1–1 Public Safety Answering Points and emergency medical dispatch;</quote> and inserting <quote>approaches to improve situational awareness and emergency medical and trauma system access, including distribution of patients during a mass casualty incident, throughout the region.</quote>;</text></clause></subparagraph><subparagraph id="id2D2DD038FF0243539FC949513415062C"><enum>(C)</enum><text>in paragraph (2)—</text><clause id="id656E47C7D0C84971A4F8F38FD4237AA1"><enum>(i)</enum><text>by striking <quote>includes</quote> and inserting <quote>Providing</quote>;</text></clause><clause id="id40F410FC99B2472990AE29D12B9E16E4"><enum>(ii)</enum><text>by inserting <quote>support patient movement to</quote> after <quote>region to</quote>; and</text></clause><clause id="id336623AA2D984BEAA77C4AA792D04515"><enum>(iii)</enum><text>by striking the semicolon and inserting a period;</text></clause></subparagraph><subparagraph id="idee58d54e161642b48eedaac30c939f01"><enum>(D)</enum><text>in paragraph (3)—</text><clause id="id504A5435A90449CBAD228D1855276FEA"><enum>(i)</enum><text>by striking <quote>allows for</quote> and inserting <quote>Improving</quote>; and</text></clause><clause id="idF9A73A07E838403BA6C54F80FC57A92C"><enum>(ii)</enum><text>by striking <quote>; and</quote> and inserting a period;</text></clause></subparagraph><subparagraph id="idBCF2B7F63A84445CB03EA3A5E6E31B20"><enum>(E)</enum><text>in paragraph (4), by striking <quote>includes a consistent</quote> and inserting <quote>Supporting a consistent</quote>; and</text></subparagraph><subparagraph id="id9DA16DE02A534581861EEDE7121BEC29"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1f5439a23c3f46d2a2b226ce68b73d0e"><paragraph id="id8752dfed77564998b5f678146fcdb483"><enum>(5)</enum><text>Establishing, implementing, and disseminating, or utilizing existing, as applicable, evidence-based or evidence-informed practices across facilities within such emergency medical and trauma system to improve health outcomes, including such practices related to management of injuries, and the ability of such facilities to surge.</text></paragraph><paragraph id="id6a900f2965aa41328782f2e845ea3d2c"><enum>(6)</enum><text>Conducting activities to facilitate clinical research, as applicable and appropriate.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id6B7C34B56508404B8BFD9BBC321F53C1"><enum>(5)</enum><text>in subsection (d)(2)—</text><subparagraph id="iddbba98730b2745bab63a158a79f277b0"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id4380A3133BB24FC7873D5C99A358159A"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>the proposed</quote> and inserting <quote>the applicable emergency medical and trauma system</quote>; </text></clause><clause id="id3E87666246F248CC9498245AD5765F28"><enum>(ii)</enum><text>in clause (i), by inserting <quote>or Tribal entity</quote> after <quote>equivalent State office</quote>; and</text></clause><clause id="id3ED41636A3CF49A487C83DBA5F3536EE"><enum>(iii)</enum><text>in clause (vi), by striking <quote>; and</quote> and inserting a semicolon;</text></clause></subparagraph><subparagraph id="id3C2A251D3BAD47EC855B90C8AE186947"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph><subparagraph id="idE5535C727E8440BEA5698C90750AA677"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id15ca6d3044f242569bc2db5e4e993f27"><subparagraph id="id026c066154cf45d8b5a9180f9646d1ec"><enum>(B)</enum><text>for eligible entities described in subparagraph (C) or (D) of subsection (b)(1), a description of, and evidence of, coordination with the applicable State Office of Emergency Medical Services (or equivalent State Office) or applicable such office for a Tribe or Tribal organization; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id97125c77095846dd816e89e44cfc9ae1"><enum>(6)</enum><text>in subsection (e)—</text><subparagraph id="id44AB3E152364485CA1F3A61B596B2639"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$1 for each $3</quote> and inserting <quote>$1 for each $5</quote>; and</text></subparagraph><subparagraph id="id8C2D4F55B0184686865C19B54DF918EC"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1e5351b7220d4c81bb612ffc5bcb1842"><paragraph id="iddc9542d6c41647d0aea178a4a053da00" commented="no"><enum>(3)</enum><header>Waiver</header><text>The Secretary may waive all or part of the matching requirement described in paragraph (1) for any fiscal year for a State, consortia of States, Indian Tribe or Tribal organization, or trauma center, if the Secretary determines that applying such matching requirement would result in serious hardship or an inability to carry out the purposes of the pilot program.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id8BF4D1150A044073BBC162382936BBF3"><enum>(7)</enum><text>in subsection (f), by striking <quote>population in a medically underserved area</quote> and inserting <quote>medically underserved population</quote>;</text></paragraph><paragraph id="idc098a8b0af784c8ebd9de1643ff2c9a2"><enum>(8)</enum><text>in subsection (g)—</text><subparagraph id="idbe2ff18949a54afb857becc2ec20d280"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>described in</quote>;</text></subparagraph><subparagraph id="idC00EBEB9DAAD44AF94D1176613461461"><enum>(B)</enum><text>in paragraph (2), by striking <quote>the system characteristics that contribute to</quote> and inserting <quote>opportunities for improvement, including recommendations for how to improve</quote>;</text></subparagraph><subparagraph id="id0C4D8C3200ED404194F08F4C9BFC8740"><enum>(C)</enum><text>by striking paragraph (4);</text></subparagraph><subparagraph id="id645ACD3123294AABB2EA5316E36EDE7A"><enum>(D)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively;</text></subparagraph><subparagraph id="id01FB4370F9C9486C81E8F74AF2585F8E"><enum>(E)</enum><text>in paragraph (4), as so redesignated, by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id7ED86D60BCC4446DABB1F502BAB2EA13"><enum>(F)</enum><text>in paragraph (5), as so redesignated, by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id10924D5E33814AD1BD4B12B461B3E397"><enum>(G)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddac79d2dd21749c49844844dee0b0579"><paragraph id="idf76f6f1ebc024c7787e45414838dff96"><enum>(6)</enum><text>any evidence-based or evidence-informed strategies developed or utilized pursuant to subsection (c)(5).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1519e525d0ba41e4a028eab31aee5710"><enum>(9)</enum><text>by amending subsection (h) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id012ed3300363455eb0c8e86ecb8b25b3"><subsection id="id51c15d9ea81e4bb493467088f760193e"><enum>(h)</enum><header>Dissemination of findings</header><text>Not later than 1 year after the completion of the final project under subsection (a), the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the information contained in each report submitted pursuant to subsection (g) and any additional actions planned by the Secretary related to regionalized emergency care and trauma systems.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4cd239bd77ba4919aa522660f6a407a1"><enum>(d)</enum><header>Program funding</header><text>Section 1232(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300d-32">42 U.S.C. 300d–32(a)</external-xref>) is amended by striking <quote>2010 through 2014</quote> and inserting <quote>2023 through 2027</quote>.</text></subsection></section></legis-body></bill>
