<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3559</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220202">February 2, 2022</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> (for himself and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to prohibit institutions of higher education participating in Federal student assistance programs from giving preferential treatment in the admissions process to legacy students or donors. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair College Admissions for Students Act</short-title></quote>.</text></section><section id="idD1B45B8A681D4E0EB94A10279AE05AE5"><enum>2.</enum><header>Ban on legacy or donor preferences in admissions</header><subsection id="id5F06253C05A74C0097B047B81B9EC321"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB14EF2C6F0754869BE0DB77A5507F9DE"><paragraph id="id763531004989492ca8d29f5a24302bf4"><enum>(30)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id109486C5923C497783B49B03A6744CCD"><enum>(A)</enum><text>The institution will not provide any manner of preferential treatment in the admission process to applicants on the basis of their relationships to—</text><clause id="idAD06B48612394A2DB1C22C275168F96C" indent="up1"><enum>(i)</enum><text>donors to the institution; or </text></clause><clause indent="up1" id="id5C4948568B1E47898A9C3FB55A156574"><enum>(ii)</enum><text>except as provided in subparagraph (B), alumni of the institution.</text></clause></subparagraph><subparagraph indent="up1" id="id27DA89FC65094A429481D5C9730A39B5"><enum>(B)</enum><text>The Secretary may waive the limitation described in subparagraph (A)(ii) for an award year for an eligible institution described in section 371(a) if such institution demonstrates to the satisfaction of the Secretary that preferential treatment in the admission process to applicants on the basis of their relationships to alumni of the institution is in the best interest of students who have been historically underrepresented in higher education.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9a40a1238faf4809b8549cb39dcda9f1"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the first day of the second award year (as defined in section 481(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088(a)</external-xref>)) that begins after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
