<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3550</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220201">February 1, 2022</action-date><action-desc><sponsor name-id="S382">Mr. Sasse</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Members of Congress from buying or selling individual securities and lobbying for compensation after leaving Congress, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ethics Reform Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idCB460625728745D0B53E0AE03CDDF2D4"><enum>2.</enum><header>Prohibition on buying or selling individual securities</header><subsection id="id51522132D9F94584BF3FCDDD2F6D8EC2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No Member of Congress may buy or sell any individual security.</text></subsection><subsection id="id41D2E6F5E6224F8AB28E512A5A579056"><enum>(b)</enum><header>Widely held investment funds</header><text>Subsection (a) shall not apply to the buying or selling of any widely held investment fund described in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /102">section 102(f)(8)</external-xref> of the Ethics in Government Act of 1978 (5 U.S.C. App.).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idE925496B3C224C4B9D92017DE6F57D7E"><enum>(c)</enum><header>Penalty</header><text>Whoever violates this section shall be fined not more than $1,000,000, imprisoned for not more than 5 years, or both. </text></subsection></section><section section-type="subsequent-section" id="idB78734B934614049928715E722A280F1"><enum>3.</enum><header>Lobbying for compensation ban</header><subsection id="idE97D6A1999F7458F9B012CEA8B9496A4"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to prohibit Members of Congress from lobbying for compensation after leaving Congress.</text></subsection><subsection id="idB86BC76113C843EF977CBF00DAADCB88"><enum>(b)</enum><header>Prohibition</header><text>No individual serving as a Member of Congress on or after the date of enactment of this Act shall, upon the completion of the term of office of the Member of Congress, accept compensation for offering any advice or engaging in written or oral communication with regard to—</text><paragraph id="id51DA0EA66D4B4015AD2D6E1A0ED886DD"><enum>(1)</enum><text>the formulation, modification, or adoption of Federal legislation (including legislative proposals);</text></paragraph><paragraph id="idDB837833BC03490185F316F8EF77F19D"><enum>(2)</enum><text>the formulation, modification, or adoption of a Federal rule, regulation, Executive order, or any other program, policy, or position of the United States Government;</text></paragraph><paragraph id="idB8BA1282C95C4111A17F660BE4D9BC9C"><enum>(3)</enum><text>the administration or execution of a Federal program or policy (including the negotiation, award, or administration of a Federal contract, grant, loan, permit, or license);</text></paragraph><paragraph id="id85E6492D2F4D4F88AAFE4E98134B50DF"><enum>(4)</enum><text>the nomination or confirmation of an individual for a position subject to confirmation by the Senate; or</text></paragraph><paragraph id="id5265F9B4157443F08054F31FD7B452D5"><enum>(5)</enum><text>the representation of any party in a pending matter involving the Federal Government before a Federal court or in a Federal administrative proceeding.</text></paragraph></subsection><subsection id="idB8196A9D852B431A9D312D51CF944EDB"><enum>(c)</enum><header>Exception</header><text>Subsection (b) shall not apply to full-time employment by or elected service in Federal, State, or local government, unless the activities described in that subsection constitute a primary responsibility of employment.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5D3964CB28FB4A6EB512A59C9557C14B"><enum>(d)</enum><header>Penalty</header><text>Whoever violates this section shall be fined the greater of not greater than $1,000,000 or the value of the compensation received by the individual, imprisoned for not more than 5 years, or both. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id902A8A092E9B4CFB9ACD1F48A256225A"><enum>4.</enum><header>Prohibition on immediate family members of certain covered officials soliciting or otherwise raising funds from certain foreign entities</header><subsection id="id9146D193FFF442A49E084A342DA4AA28"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id924BBB932EA24D2B9A451EE1EF967319"><enum>(1)</enum><header>Close associate</header><text>The term <quote>close associate</quote> means, with respect to a senior foreign political figure, an individual who is widely and publicly known to maintain a close relationship with the senior foreign political figure, unless it is established that such individual is a citizen of and domiciled within the United States.</text></paragraph><paragraph id="id8F131B9E90EA407A8D2EC330058D923E"><enum>(2)</enum><header>Covered foreign entity</header><text>The term <quote>covered foreign entity</quote> means—</text><subparagraph id="idDF362B90F87A4E858DFF17F3EFFFDE0E"><enum>(A)</enum><text>a government of a foreign country;</text></subparagraph><subparagraph id="idFBA3658317EC4278B08B7AF85D6CE782"><enum>(B)</enum><text>a foreign political party; or</text></subparagraph><subparagraph id="id6ACED4BB182E4E0EAD96BAA13E6DBBAF"><enum>(C)</enum><text>any entity that is owned or controlled by a government of a foreign country or a foreign political party.</text></subparagraph></paragraph><paragraph id="idA159DFEECCA74FFFBAFC9BB5AF84FBBF"><enum>(3)</enum><header>Covered official</header><text>The term <quote>covered official</quote> means—</text><subparagraph id="idF65698C13A44408282EB6026C18F2E59"><enum>(A)</enum><text>the President;</text></subparagraph><subparagraph id="id75FC81D025944D03982ABD2E9F3ABBF8"><enum>(B)</enum><text>the Vice President; and</text></subparagraph><subparagraph id="id7F431403482141EEBDD630012AA43060"><enum>(C)</enum><text>the head of a relevant agency or department.</text></subparagraph></paragraph><paragraph id="id5AB6A2F83F5347F5A648DF1976DA7433"><enum>(4)</enum><header>Foreign political party; government of a foreign country</header><text>The terms <quote>foreign political party</quote> and <quote>government of a foreign country</quote> have the meanings given those terms in section 1 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref>).</text></paragraph><paragraph id="idB2A81C9159224EFC90A0193E56AD1263"><enum>(5)</enum><header>Immediate family member of a covered official</header><text>The term <quote>immediate family member of a covered official</quote> means, with respect to a covered official, a sibling, spouse, or child of the covered official.</text></paragraph><paragraph id="id3906E0C310E945ADAD9F6DF1076D455B"><enum>(6)</enum><header>Immediate family member of a senior foreign political figure</header><text>The term <quote>immediate family member of a senior foreign political figure</quote> means, with respect to a senior foreign political figure, a sibling, spouse, or child of the senior foreign political figure, unless it is established that such sibling, spouse, or child is a citizen of and domiciled within the United States.</text></paragraph><paragraph id="id1394A8A7C2E34F70A8EDE1E7C1688B67"><enum>(7)</enum><header>Relevant agency or department</header><text>The term <quote>relevant agency or department</quote> means—</text><subparagraph id="id1B5FEFF3B0FF4879837D059B0BBA1D36"><enum>(A)</enum><text>the Environmental Protection Agency; or</text></subparagraph><subparagraph id="id4C87B22A56C34FC59919F94C90F71D6C"><enum>(B)</enum><text>an <quote>Executive department</quote>, as defined in section 101 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="idED6485F2447E4EAC9534C4BD3CF01C40"><enum>(8)</enum><header>Senior foreign political figure</header><text>The term <quote>senior foreign political figure</quote> means—</text><subparagraph commented="no" id="id4BE6097566A747539676C43AA46E4493"><enum>(A)</enum><text>a senior official in any branch of the government of a foreign country; or</text></subparagraph><subparagraph commented="no" id="id5280261195AF4483A7CA35C75CBA1D07"><enum>(B)</enum><text>a senior official of a foreign political party.</text></subparagraph></paragraph></subsection><subsection id="idFBEAFA1B3448450EB12E2E3E07D110E2"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">During the period in which an individual is serving as a covered official, the covered official or the immediate family member of the covered official may not solicit or otherwise raise funds for any purpose from any—</text><paragraph id="id64C4A9E3702844CEBEA5692CDD7CE640"><enum>(1)</enum><text display-inline="yes-display-inline">covered foreign entity;</text></paragraph><paragraph id="id12A2FC3A14784B92BBFB7595B8ACEACA"><enum>(2)</enum><text>senior foreign political figure;</text></paragraph><paragraph id="id5A59EC8D05704E87A80D3583BC0309BB"><enum>(3)</enum><text>immediate family member of a senior foreign political figure;</text></paragraph><paragraph id="id3AD9C9E533B5461CA44482516688303A"><enum>(4)</enum><text>close associate of a senior foreign political figure; or</text></paragraph><paragraph id="idBD9F9738013341BFA29937E1365227BE"><enum>(5)</enum><text>entity that is owned or controlled by an individual described in paragraph (2), (3), or (4).</text></paragraph></subsection><subsection commented="no" id="id64D4C07379C84EA69B3655F3F15D7824"><enum>(c)</enum><header>Penalties</header><text display-inline="yes-display-inline">Whoever knowingly fails to comply with this section shall be fined not more than $1,000,000, imprisoned not more than 5 years, or both.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9e830a0547af47028c13dbf22448a178"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on the date that is 30 days after the date of enactment of this Act. </text></subsection></section><section section-type="subsequent-section" id="id90CC7BE39B674243B5C3F93C8C14AA8E"><enum>5.</enum><header>Disclosure of returns and return information of candidates for President and Vice President of the United States</header><subsection id="idB38CE2E4CC144E74A3DC54E1BD65D16E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (k) of <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2306190AD6254A1E90E323656B96C72E"><paragraph id="id04F32AFA4DBF41E5BD66C1E8BF7CD550"><enum>(16)</enum><header>Disclosure of returns and return information of candidates for President and Vice President of the United States</header><subparagraph id="idF154BA2CB30A44049D40156508A315AF"><enum>(A)</enum><header>In general</header><text>The Secretary shall disclose and make publicly available returns and return information, except as provided in subparagraphs (B) and (C), of any candidate (as defined in section 9002(2)).</text></subparagraph><subparagraph id="idCBD2B1CED8B44F598187D98FC9578DE3"><enum>(B)</enum><header>Exceptions</header><text>The information disclosed under subparagraph (A) shall not include the social security number of any individual, any financial account number, the name of any individual under age 18, or any home address of any individual (other than the city and State in which such address is located).</text></subparagraph><subparagraph id="id080934ACEC1A49A6B4DE856C716258B8"><enum>(C)</enum><header>Scope</header><text>Subparagraph (A) shall apply to any return, and return information included on any return, which is filed within the 10 taxable years preceding the year in which the individual becomes a candidate (as so defined).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id725CEAF07786430BBEFC51045EF2D9DD"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to individuals becoming a candidate (within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/26/9002">section 9002(2)</external-xref> of the Internal Revenue Code of 1986) after the date of enactment of this Act. </text></subsection></section><section section-type="subsequent-section" id="H69C8744F7FA24D3DAD51ACEB45223181"><enum>6.</enum><header>Prohibition on contributions and donations by foreign nationals in connection with ballot initiatives and referenda</header><subsection id="H7388EDAF6BC242F693CD2E4204CB708A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319(a)(1)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(a)(1)(A)</external-xref>) is amended by striking <quote>election;</quote> and inserting <quote>election, including a State or local ballot initiative or referendum;</quote>. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4898FA07E6F441A58015C1F0885E3283"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply with respect to elections held in 2023 or any succeeding year.</text></subsection></section></legis-body></bill>
