Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5173">42 U.S.C. 5173</external-xref>).</text></paragraph></subsection><subsection id="id4fd4f33a039b43f9a718e969753d4e9d"><enum>(b)</enum><header>Advisory working group</header><paragraph id="idd65ca40489d74ee8b48ebb82555c5fd2"><enum>(1)</enum><header>In general</header><text>The Administrator shall establish an advisory working group to encourage and foster collaborative efforts among individuals and entities engaged in disaster recovery relating to debris removal.</text></paragraph><paragraph id="idd20164253f234f4f83dbfc092f08703d"><enum>(2)</enum><header>Membership</header><text>The advisory working group established under paragraph (1) shall be comprised of—</text><subparagraph id="id0c343052356c4e26bcf9c6cb8a696506"><enum>(A)</enum><text>representatives from the Federal Emergency Management Agency;</text></subparagraph><subparagraph id="idc6b59a4f8ff64b72beb8d7cfc3340cfc"><enum>(B)</enum><text>representatives from the Army Corps of Engineers;</text></subparagraph><subparagraph id="id17dbd985cbdd49d0b365010d97f1c060"><enum>(C)</enum><text>representatives of States and units of local government; and</text></subparagraph><subparagraph id="id311a913d496b4137b29f0d1808cd0645"><enum>(D)</enum><text>subject matter experts in debris removal, including not less than 1 representative from the debris services contractor industry.</text></subparagraph></paragraph></subsection><subsection id="id5509be990d544d54a2cdd647c01d8008"><enum>(c)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the advisory working group established under subsection (b)(1), shall—</text><paragraph id="id2019977E0ECF467CA1BD496B718A60E5"><enum>(1)</enum><text>determine whether guidance and procedures in effect as of the date of enactment of this Act with respect to the oversight and cost of debris removal contracts entered into under the debris removal program are sufficient; and</text></paragraph><paragraph id="idA926BC66FBC148E58DE9E32699886331"><enum>(2)</enum><text>if the Administrator, in consultation with the advisory working group established under subsection (b)(1), determines that the guidance and procedures described in paragraph (1) are insufficient, develop and implement additional such guidance and procedures, including—</text><subparagraph id="idd9b867ee7c344e91bc733d5ef2f7ecd5"><enum>(A)</enum><text>a requirement that each State and unit of local government receiving a grant under the debris removal program take the primary role in the oversight function of debris removal;</text></subparagraph><subparagraph id="id1a326172e3454a7ca2ddb02ce689ffee"><enum>(B)</enum><text>guidance for State and local debris monitors relating to debris removal operations, debris operations oversight, and contractor oversight, including contractor monitoring;</text></subparagraph><subparagraph id="id0c7a2a08c2d14e00af4d452a2891755e"><enum>(C)</enum><text>checklists, job aids, eligibility requirements, contract requirements, debris management planning guidance, sample bids, and other items, as determined necessary by the Administrator, for State and local debris monitors;</text></subparagraph><subparagraph id="idc6cada358d2849f7a9afb68eaa7b7570"><enum>(D)</enum><text>a list of the specific debris removal monitoring responsibilities expected to be completed by a State that receives a grant under the debris removal grant program; </text></subparagraph><subparagraph id="idFB6E131C0E104F30BB64091688A3667E"><enum>(E)</enum><text>a list of the specific debris removal monitoring responsibilities expected to be completed by recipients of a grant under the debris removal grant program; and</text></subparagraph><subparagraph id="id6003dfa0a0ee477a96cd5bfc2afb2b84"><enum>(F)</enum><text>guidance for State and units of local government to reduce duplication and inefficiency in debris removal contracting across the Federal Government, State governments, and units of local government.</text></subparagraph></paragraph></subsection><subsection id="idc50045c9ccc14b7aaa572a909f45f8c7"><enum>(d)</enum><header>Training</header><text>The Administrator shall conduct outreach to States, Tribal governments, and units of local government with respect to any guidance or support materials developed under this section.</text></subsection><subsection id="ide831da89695042dda41f32dc52fee861"><enum>(e)</enum><header>GAO study</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study that—</text><paragraph id="idCFEB9B17AE69410B809713B92571E559"><enum>(1)</enum><text>studies the use and adoption rate of advance contracts for debris removal by States and units of local government;</text></paragraph><paragraph id="id1E2E9FD4A552469DB6C4C2C1B85DA2DB"><enum>(2)</enum><text>identifies the benefits of advance contracts for debris removal;</text></paragraph><paragraph id="idD953E34370144F529FABE9EE95926838"><enum>(3)</enum><text>with respect to the reporting and information sharing processes, as of the date of enactment of this Act, for advance contracts for debris removal between States and units of local government and Federal partners—</text><subparagraph id="id1BDC5E4776E6463C8779BAB9A8B4ABBF"><enum>(A)</enum><text>assesses those processes; and</text></subparagraph><subparagraph id="idCE8B0F9A559D4A5C9889F5AA20914780"><enum>(B)</enum><text>makes any necessary recommendations for those processes;</text></subparagraph></paragraph><paragraph id="idD8523D3D92924DC4B292E0C89CAA405F"><enum>(4)</enum><text>studies—</text><subparagraph id="id917D7F1F89A14921B9DAF47854B69B68"><enum>(A)</enum><text>the process for setting Federal reimbursement rates for the debris removal program;</text></subparagraph><subparagraph id="idD76C85A5C4AC4663893664E130ED39F1"><enum>(B)</enum><text>the use of penalties, as of the date of enactment of this Act, for violations of law and regulations relating to debris removal; and</text></subparagraph><subparagraph id="id3DC7F6786FAD45E4BC58B34D1996D693"><enum>(C)</enum><text>fraud, waste, and abuse relating to the debris removal program, including case studies; and</text></subparagraph></paragraph><paragraph id="idD0154CC2C4E2467DBC90D1697926E075"><enum>(5)</enum><text>recommends improvements to oversight and fraud prevention across the debris removal program.</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id2875ddcc-cb15-41d6-83fa-23003355c262" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Contract Improvement Act</short-title></quote>.</text></section><section id="ida0138d1a-f160-4c03-bb4e-63adead24786" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Oversight on debris removal</header><subsection id="id240afb0b-aed9-4ec7-b17c-1c12da2554e0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ide8e96e7a-4e8f-44b4-b8bb-9a768d7bf780"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="id971e3d0a-85ff-426c-91ca-d5f9ba30b644"><enum>(2)</enum><header>Debris removal program</header><text>The term <term>debris removal program</term> means the program established under section 407 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5173">42 U.S.C. 5173</external-xref>).</text></paragraph></subsection><subsection id="idd906cddd-bf95-42e0-b568-4e9fb99a7337"><enum>(b)</enum><header>Advisory working group</header><paragraph id="id5f349d33-b83c-442b-a3b9-529d3198fbe2"><enum>(1)</enum><header>In general</header><text>The Administrator shall establish an advisory working group to encourage and foster collaborative efforts among individuals and entities engaged in disaster recovery relating to debris removal.</text></paragraph><paragraph id="id64029b12-790a-4d13-a9a0-42965b9ee50c"><enum>(2)</enum><header>Membership</header><text>The advisory working group established under paragraph (1) shall be comprised of—</text><subparagraph id="idb5df19c5-471e-4eb5-b8ed-17e4b6cdd31d"><enum>(A)</enum><text>representatives from the Federal Emergency Management Agency;</text></subparagraph><subparagraph id="idcc878740-8702-41ef-877e-8ac1209013d6"><enum>(B)</enum><text>representatives from the Army Corps of Engineers;</text></subparagraph><subparagraph id="idAE0C340C417B44E3BEE19A6B036D5E2D"><enum>(C)</enum><text>representatives from the Natural Resources Conservation Service of the Department of Agriculture;</text></subparagraph><subparagraph id="idcd9ead5c-9828-4f8b-97f7-77f1b7380c87"><enum>(D)</enum><text>representatives of States, Tribal governments, and units of local government; and</text></subparagraph><subparagraph id="idd8fb4cdf-2719-4ad5-b654-38aa6fc0fb70"><enum>(E)</enum><text>subject matter experts in debris removal, including not less than 1 representative from the debris services contractor industry.</text></subparagraph></paragraph></subsection><subsection id="id9c4b18a3-3392-4791-865d-6ec8479e7eb6"><enum>(c)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the advisory working group established under subsection (b)(1), shall—</text><paragraph id="id108d6cca-aa6d-4f23-85a0-6de2d509de04"><enum>(1)</enum><text>determine whether guidance and procedures in effect as of the date of enactment of this Act with respect to the oversight and cost of debris removal contracts entered into under the debris removal program are sufficient; and</text></paragraph><paragraph id="idc6bce042-ec6f-4ce1-bf22-8c32a10eb6ac"><enum>(2)</enum><text>if the Administrator, in consultation with the advisory working group established under subsection (b)(1), determines that the guidance and procedures described in paragraph (1) are insufficient, develop and implement additional such guidance and procedures, including—</text><subparagraph id="ida98efa84-e46c-4aff-b5dd-7559a3564df8"><enum>(A)</enum><text>a requirement that each State, Tribal government, and unit of local government receiving a grant under the debris removal program take the primary role in the oversight function of debris removal;</text></subparagraph><subparagraph id="id5d4416ee-f077-47cb-8a97-88aaa14d0fff"><enum>(B)</enum><text>guidance for State, Tribal, and local debris monitors relating to debris removal operations, debris operations oversight, and contractor oversight, including contractor monitoring;</text></subparagraph><subparagraph id="id549893E705D846119076F2623C50C90E"><enum>(C)</enum><text>guidance for streamlining the reimbursement of debris costs overall, including debris management planning and support for resilience in debris removal operations;</text></subparagraph><subparagraph id="id1b61cfc1-8a80-4823-8751-5a97f66d139f"><enum>(D)</enum><text>checklists, job aids, eligibility requirements, contract requirements, debris management planning guidance, sample bids, and other items, as determined necessary by the Administrator, for State and local debris monitors;</text></subparagraph><subparagraph id="ide40890e3-3477-4db7-ae39-845e9d919fce"><enum>(E)</enum><text>a list of the specific debris removal monitoring responsibilities expected to be completed by a State that receives a grant under the debris removal program; </text></subparagraph><subparagraph id="id01b2f14d-a36d-4f20-b72b-883316091a57"><enum>(F)</enum><text>a list of the specific debris removal monitoring responsibilities expected to be completed by recipients of a grant under the debris removal program; and</text></subparagraph><subparagraph id="id66136571-de2f-455d-a178-8238a374b552"><enum>(G)</enum><text>guidance for State and Tribal governments and units of local government to reduce duplication and inefficiency in debris removal contracting across the Federal Government, State and Tribal governments, and units of local government.</text></subparagraph></paragraph></subsection><subsection id="idf8c6a8bd-46fb-4ce7-ad92-5cdbe02a2fc0"><enum>(d)</enum><header>Training</header><text>The Administrator shall conduct outreach to States, Tribal governments, and units of local government with respect to any guidance or support materials developed under this section.</text></subsection><subsection id="id66a57ba6-3841-42f0-b6b2-9a2c0a427f2e"><enum>(e)</enum><header>GAO study</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study that—</text><paragraph id="id11c2ddd5-4f1d-42b9-8568-b478fb80a782"><enum>(1)</enum><text>studies the use and adoption rate of advance contracts for debris removal by selected States, Tribal governments, and units of local government;</text></paragraph><paragraph id="idc823c423-d5c1-4953-81ea-2a0449a3c9f9"><enum>(2)</enum><text>identifies the benefits and challenges of advance contracts for debris removal;</text></paragraph><paragraph id="id396c4264-af00-4515-8e74-29e92860467c"><enum>(3)</enum><text>with respect to the reporting and information sharing processes, as of the date of enactment of this Act, for advance contracts for debris removal between States and units of local government and Federal partners—</text><subparagraph id="id299c1522-0cca-45f6-8757-20413be25f91"><enum>(A)</enum><text>assesses those processes; and</text></subparagraph><subparagraph id="idbec31e04-ebbd-4792-bd41-83b921af004f"><enum>(B)</enum><text>makes any necessary recommendations for those processes;</text></subparagraph></paragraph><paragraph id="id93fef623-ec5c-4e83-a5f9-bd4239d1a42b"><enum>(4)</enum><text>studies—</text><subparagraph id="id3f1e23c2-b5cb-4853-aaa1-03d1f6b0061e"><enum>(A)</enum><text>the process for setting Federal reimbursement rates for the debris removal program;</text></subparagraph><subparagraph id="id516118d4-1b55-425b-9407-8126b7a04fb8"><enum>(B)</enum><text>the use of penalties, as of the date of enactment of this Act, for violations of law and regulations relating to debris removal;
