<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 3510</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Director of the Office of Management and Budget to issue guidance with respect to natural disaster resilience, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="idd323b9ba-c30e-45dc-a321-c14e48fa7e95" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Resiliency Planning Act</short-title></quote>.</text></section><section id="id8c5649d7-8dbe-4924-9921-6cf3f895f1b8" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id889cc190-c4be-49d2-877e-44d7210423e8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id7118a204-db7b-4ee2-92f9-89e9db80d4e4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id1567846e-2d86-4c80-8684-3289ebbb8c81" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Reform of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idd29956fe-96bf-4aa1-b5fa-215996a8ba87" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term in section 306 of title 5, United States Code. </text></paragraph><paragraph id="id9a38fe62-d41c-4fdc-907c-11c90b0eb97a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="idC4D8A1DD5B8346FFAF3F3BB56EF60E6D" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Real property</header><text display-inline="yes-display-inline">The term <term>real property</term> has the meaning given the term in section 1.856–10 of title 26, Code of Federal Regulations, or any successor thereto.</text></paragraph></section><section id="id2644562b-c05e-494d-8f4d-b7c47e20c84d" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Guidance</header><subsection id="id8aaaef85-04fd-436f-895d-aa3d7eaa67f6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director shall establish guidance requiring the head of each agency to incorporate natural disaster resilience into real property asset management and investment decisions made by the agency.</text></subsection><subsection id="idc548cc93-018f-4f1e-a5db-672661f0ccff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The guidance required under subsection (a) shall direct each head of an agency to incorporate assessments of natural disaster risk information conducted by the agency, such as from vulnerability and other risk assessments, into real property asset management investment decisions made by the agency.</text></subsection><subsection id="id6615866d-5f31-4f5d-8fbb-38292a4d6bc5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Modification</header><text display-inline="yes-display-inline">The Director may periodically update the guidance required under subsection (a) as the Director may determine necessary for the purpose of further enhancing natural disaster resilience.</text></subsection><subsection id="id39b3ba61-5ef9-485f-9684-cec355e8a22a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In developing the guidance required under subsection (a), the Director may consult with appropriate entities, including—</text><paragraph id="idca038c2c-c097-442d-8076-5ba206320a0a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the Comptroller General of the United States; </text></paragraph><paragraph id="ida1114589-0546-4f0d-8195-62365c5b38bd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator of the Federal Emergency Management Agency; and</text></paragraph><paragraph id="id5447aa63-c509-4ead-a824-efb6f68dd636" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">any other relevant entities, as determined by the Director.</text></paragraph></subsection><subsection id="iddd7da476-bf5f-44f7-a586-c57ca1b9c7ce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Report</header><paragraph id="id7a034b37-40d1-4285-afe0-60c8ffba5401" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Director shall submit to the appropriate congressional committees a report that describes the guidance required under subsection (a). </text></paragraph><paragraph id="id33b663fc-fa6d-47be-94d5-eaf3bfd4e5ed" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Director shall brief the appropriate congressional committees on the implementation of the guidance required under subsection (a) across agencies. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
