<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 450</calendar><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3502</legis-num><associated-doc role="report">[Report No. 117–133]</associated-doc><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220113" legis-day="20220110">January 13 (legislative day, January 10), 2022</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S413">Mr. Padilla</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>July 21, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish an Office of Civil Rights, Equity, and Community Inclusion at the Federal Emergency Management Agency, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title></quote>.</text></section><section id="id95c73313fc4e4ba8a00c1f394f4d1015" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Office of Civil Rights, Equity, and Community Inclusion</header><subsection id="id3f90c8258aaa4d519f3aeeff70a1d104"><enum>(a)</enum><header>In general</header><text>Title V of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id840bd635967f41c286ff5408dc985665" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><section id="iddaea5335dcef4ae893a866c1e24eaf0f"><enum>529.</enum><header>Office of Civil Rights, Equity, and Community Inclusion</header><subsection id="id81f0d766d5a443148ac9c1892846ef76"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idc4e2ffdf5c504a9c9ff36af61ba6e894"><enum>(1)</enum><text>the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id11797e37acbb4eb48350538b64b990ef"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id13667338b09f4772ad4a3595e70f93b7"><enum>(B)</enum><text>the Committee on Transportation and Infrastructure, the Committee on Oversight and Reform, and the Committee on Homeland Security of the House of Representatives;</text></subparagraph></paragraph><paragraph id="id59d27e00d19c4b0daaa2fab9ce607b3d"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Office of Civil Rights, Equity, and Community Inclusion;</text></paragraph><paragraph id="id68c4d33d747f4eb89b03f4bc185e1f57"><enum>(3)</enum><text>the term <term>disaster assistance</term> means assistance provided under titles IV and V of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170 et seq.</external-xref>);</text></paragraph><paragraph id="ida0969138b7fd4005b8f5a46d5bac2664"><enum>(4)</enum><text>the term <term>Office</term> means the Office of Civil Rights, Equity, and Community Inclusion; and</text></paragraph><paragraph id="ided4d98e802584889b472badfb3e768b8"><enum>(5)</enum><text>the term <term>underserved community</term> means—</text><subparagraph id="id28449635e02d45dc9794f3fc9015c840"><enum>(A)</enum><text>the Native American and Alaskan Native community;</text></subparagraph><subparagraph id="idea41908e0fcc45d2a934ae7fc35d88bb"><enum>(B)</enum><text>the African-American community;</text></subparagraph><subparagraph id="id04a1ceb774ff4abbaf740a7f2b3acdf4"><enum>(C)</enum><text>the Asian community;</text></subparagraph><subparagraph id="id277bd5efe6864ef7864c384e31117c3d"><enum>(D)</enum><text>the Hispanic (including persons of Mexican, Puerto Rican, Cuban, and Central or South American origin) community;</text></subparagraph><subparagraph id="id87a22303fadb4eecb47256bcc6313b0b"><enum>(E)</enum><text>the Pacific Islander community;</text></subparagraph><subparagraph id="idff73b108a93140e98b5f69a732e38de5"><enum>(F)</enum><text>the Middle Eastern and North African community;</text></subparagraph><subparagraph id="idc6215ee268e843e9a3be2e813b447b28"><enum>(G)</enum><text>a rural community;</text></subparagraph><subparagraph id="id355ca1b046e24b84a99775d72d3dcf64"><enum>(H)</enum><text>a low-income community;</text></subparagraph><subparagraph id="id6a043f90ce794633b6931cfde327749f"><enum>(I)</enum><text>the disability community; and</text></subparagraph><subparagraph id="id8527222e5a6d4f3fbbf29150b7d06046"><enum>(J)</enum><text>any other historically disadvantaged community, as determined by the Director.</text></subparagraph></paragraph></subsection><subsection id="id47bedfb407f34e67bf4c5be29533ef5a"><enum>(b)</enum><header>Office of Civil Rights, Equity, and Community Inclusion</header><paragraph id="id6e056e4b41f94b39a16d31907b15ec48"><enum>(1)</enum><header>In general</header><text>The Office of Equal Rights of the Agency shall, on and after the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, be known as the Office of Civil Rights, Equity, and Community Inclusion.</text></paragraph><paragraph id="id92bc65d0a57e4e94bc539cd0fccc9e9f"><enum>(2)</enum><header>References</header><text>Any reference to the Office of Equal Rights of the Agency in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Office of Civil Rights, Equity, and Community Inclusion.</text></paragraph></subsection><subsection id="idd60b4c0b01604f34b2d9e29689261f5f"><enum>(c)</enum><header>Director</header><paragraph id="idd97e1aace79f4b8fbbc919dee6792692"><enum>(1)</enum><header>In general</header><text>The Office shall be headed by a Director, who shall report to the Administrator.</text></paragraph><paragraph id="idb0e6324c765543499601beaea3c8d818"><enum>(2)</enum><header>Requirement</header><text>The Director shall have documented experience and expertise in civil rights, underserved community inclusion research, disaster preparedness, or resilience disparities elimination.</text></paragraph></subsection><subsection id="ide80996d82d014e9891e20012fa360980"><enum>(d)</enum><header>Purpose</header><text>The purpose of the Office is to—</text><paragraph id="id8dc704d246e84a2eb4cc20aef8aa5688"><enum>(1)</enum><text>improve underserved community access to disaster assistance;</text></paragraph><paragraph id="id451eb69392ea4d40abf5bc07270c44d8"><enum>(2)</enum><text>improve the quality of disaster assistance received by underserved communities;</text></paragraph><paragraph id="id56b1a59d4ea14c84aca60be0f01baa8f"><enum>(3)</enum><text>eliminate racial, ethnic, and other underserved community disparities in the delivery of disaster assistance; and</text></paragraph><paragraph id="id4b866afd573a4037916054e87b7d0923"><enum>(4)</enum><text>carry out such other responsibilities of the Office of Equal Rights as in effect on the day before the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, as determined appropriate by the Administrator.</text></paragraph></subsection><subsection id="id400a22611db74e299b17ad8b8b183cb3"><enum>(e)</enum><header>Authorities and duties</header><paragraph id="id6769ec33a36b440f935a3d3df7134513"><enum>(1)</enum><header>In general</header><text>The Director shall be responsible for—</text><subparagraph id="id0f36d8791db94dce9f96bae268eca657"><enum>(A)</enum><text>improving—</text><clause id="id1fa09ea8af8a4d018703bed7b0422e38"><enum>(i)</enum><text>underserved community access to disaster assistance before and after a disaster; and</text></clause><clause id="idab1b78edf3a14aa9805aca2cf70e9657"><enum>(ii)</enum><text>the quality of Agency assistance underserved communities receive;</text></clause></subparagraph><subparagraph id="idf357f29c23014d7081bb7cce7952de65"><enum>(B)</enum><text>reviewing preparedness, response, and recovery programs and activities of the Agency to ensure the elimination of underserved community disparities in the delivery of such programs and activities; and</text></subparagraph><subparagraph id="idb3a996f644ef4ec08a6f1b4e1a4fb368"><enum>(C)</enum><text>carrying out such other responsibilities of the Office of Equal Rights as in effect on the day before the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, as determined appropriate by the Administrator.</text></subparagraph></paragraph><paragraph id="idc6eb3c403c4c4fefa267b943be663e31"><enum>(2)</enum><header>Reducing disparities in preparedness, response, and recovery</header><subparagraph id="idfa024a17123b430aa5f3e396d0044f4d"><enum>(A)</enum><header>In general</header><text>The Director shall develop measures to evaluate the effectiveness of the activities of program offices in the Agency and the activities of recipients aimed at reducing disparities in the services provided to underserved communities.</text></subparagraph><subparagraph id="id80e87c18dbb446d29bbcfc4cf2223d10"><enum>(B)</enum><header>Requirement</header><text>The measures developed under subparagraph (A) shall—</text><clause id="id1c6d4ab6da0b4afeba5ff9a57e5eb6e2"><enum>(i)</enum><text>evaluate community outreach activities, language services, workforce cultural competence, historical assistance for grants and loans provided to individuals, State, local, tribal, and territorial governments, the effects of disaster declaration thresholds on underserved communities, the percentage of contracts awarded to underserved and minority-owned businesses, historical barriers to equitable assistance across race and class during and after disasters, and other areas, as determined by the Director; and</text></clause><clause id="id513ebe6fbc754b8db59f4416bbb80ad1"><enum>(ii)</enum><text>identify the communities implicated in the evaluations conducted under clause (i).</text></clause></subparagraph><subparagraph id="idd817a0878b3449459d5ab7a3a3deec2e"><enum>(C)</enum><header>Coordination with other offices</header><text>In carrying out this section, the Director shall—</text><clause id="id0f4fc0ecb94b4789ac7a2e398bbc27c9"><enum>(i)</enum><text>participate in scenario-based disaster response exercises at the Agency;</text></clause><clause id="iddb4b6b1be0ea49d1b24a0c016d036bea"><enum>(ii)</enum><text>coordinate with the Office of Minority Health of the Department of Health and Human Services;</text></clause><clause id="id8dca26c51910455fa28bdcd7ecda7de4"><enum>(iii)</enum><text>coordinate with the Office of Civil Rights of the Department of Agriculture;</text></clause><clause id="id2b60726474fb407aa10b542a4d60d94a"><enum>(iv)</enum><text>as appropriate, coordinate with other relevant offices across the Federal Government, including by leading a voluntary task force to address disaster response needs of underserved communities;</text></clause><clause id="idBEA867AECC9E48039E1913ACF614D05D"><enum>(v)</enum><text>coordinate with the Office for Civil Rights and Civil Liberties of the Department; and</text></clause><clause id="id075CF59E75E54741858547B18948CDE7"><enum>(vi)</enum><text>investigate allegations of unequal disaster assistance based on race or ethnic origin or refer those allegations to the appropriate office.</text></clause></subparagraph></paragraph></subsection><subsection id="id79919b6eea94437cb8139a00f9bdb8b7"><enum>(f)</enum><header>Grants and contracts</header><text>In carrying out this section, to further inclusion and engagement of underserved communities throughout preparedness, response, recovery, and mitigation and to eliminate racial, ethnic, and other underserved community disparities in the delivery of disaster assistance, as described in subsection (d), the Administrator shall—</text><paragraph id="id05bf99400b2044b991cc221e9e2f1149"><enum>(1)</enum><text>administer and evaluate Agency programs and activities, including the programs and activities of recipients of preparedness, response, recovery, and mitigation grants and contracts, to—</text><subparagraph id="id9012F5E3FD40457EAC6E18EDF50A577F"><enum>(A)</enum><text>further inclusion and engagement of underserved communities and underserved and minority-owned businesses; and</text></subparagraph><subparagraph id="id9ECB59ED471D4E3B9FEE4BA78175DA37"><enum>(B)</enum><text>improve outcomes for underserved communities tied to Agency programs and activities; and</text></subparagraph></paragraph><paragraph id="id654cfe1d6f9b480c9e422055c2353145"><enum>(2)</enum><text>establish an underserved community initiative to award grants to, and enter into cooperative agreements and contracts with, nonprofit entities. </text></paragraph></subsection><subsection id="id4fcdece2187c4261b4bd8be7e4178985"><enum>(g)</enum><header>Disability coordinator</header><paragraph id="idaad986693fa748aaaca1be7ed019dca5"><enum>(1)</enum><header>In general</header><text>There shall be within the Office a Disability Coordinator to ensure that the needs of individuals with disabilities are being properly addressed by proactively engaging with disability and underserved communities and State, local, and tribal governments in emergency preparedness and disaster relief.</text></paragraph><paragraph id="iddd13527dc1ca412cbc985d4a3e4aa3c4"><enum>(2)</enum><header>Responsibilities</header><text>The Disability Coordinator shall be responsible for—</text><subparagraph id="id02d73a9bb8114f09ae353e616d21c95b"><enum>(A)</enum><text>providing guidance and coordination on matters relating to individuals with disabilities in emergency planning requirements and relief efforts in the event of a natural disaster, act of terrorism, or other man-made disaster;</text></subparagraph><subparagraph id="id697fb7e2c5474a01b24e5d508e1fcd6d"><enum>(B)</enum><text>interacting with the staff of the Agency, the National Council on Disability, the Interagency Coordinating Council on Preparedness and Individuals with Disabilities established under Executive Order 13347 (<external-xref legal-doc="usc" parsable-cite="usc/6/314">6 U.S.C. 314</external-xref> note; relating to individuals with disabilities in emergency preparedness), other agencies of the Federal Government, and State, local, and tribal government authorities relating to the needs of individuals with disabilities in emergency planning requirements and relief efforts in the event of a natural disaster, act of terrorism, or other man-made disaster;</text></subparagraph><subparagraph id="id717d9e871f494ca9a7cd8c2bfc49f67d"><enum>(C)</enum><text>consulting with stakeholders that represent the interests and rights of individuals with disabilities about the needs of individuals with disabilities in emergency planning requirements and relief efforts in the event of a natural disaster, act of terrorism, or other man-made disaster;</text></subparagraph><subparagraph id="id43c2ffe63c6c467bbdd8f833e9b1aa1d"><enum>(D)</enum><text>ensuring the coordination and dissemination of best practices and model evacuation plans and sheltering for individuals with disabilities;</text></subparagraph><subparagraph id="ide1cb4b5fd32c48098118f6880cf41ee2"><enum>(E)</enum><text>ensuring the development of training materials and a curriculum for training emergency response providers, State, local, and tribal government officials, and others on the needs of individuals with disabilities;</text></subparagraph><subparagraph id="id946ac0fbc95540d0beead47c43bf7a8f"><enum>(F)</enum><text>promoting the accessibility of telephone hotlines and websites relating to emergency preparedness, evacuations, and disaster relief;</text></subparagraph><subparagraph id="id38792dbd991e45fb84eceda01c03c8a2"><enum>(G)</enum><text>working to ensure that video programming distributors, including broadcasters, cable operators, and satellite television services, make emergency information accessible to individuals with hearing and vision disabilities;</text></subparagraph><subparagraph id="idf9837b21f3c64def9e007913dba6e373"><enum>(H)</enum><text>providing guidance to State, local, and tribal government officials and other individuals, and implementing policies, relating to the availability of accessible transportation options for individuals with disabilities in the event of an evacuation;</text></subparagraph><subparagraph id="id16e1760db6ee49a9a7deec0077798835"><enum>(I)</enum><text>providing guidance and implementing policies to external stakeholders to ensure that the rights and wishes of individuals with disabilities regarding post-evacuation residency and relocation are respected;</text></subparagraph><subparagraph id="id95e9bd21e7d644bfa532d40d39594a8f"><enum>(J)</enum><text>ensuring that meeting the needs of individuals with disabilities is a component of the national preparedness system established under section 644 of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/744">6 U.S.C. 744</external-xref>);</text></subparagraph><subparagraph id="id6bf318a8b00c48baae4b5672a1e0e9a6"><enum>(K)</enum><text>coordinate technical assistance for Agency programs based on input from underserved communities through a designee of the Director; and</text></subparagraph><subparagraph id="idd3a798921ca84265a10eeea7bd83aea0"><enum>(L)</enum><text>any other duties assigned by the Director.</text></subparagraph></paragraph></subsection><subsection id="id8f7cf425732f4413bdfd8dd72814b6d5"><enum>(h)</enum><header>Reports</header><paragraph id="id60fd22807fe94db69eb290c4065cfefc"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, and biennially thereafter, the Administrator shall submit to the appropriate committees of Congress a report describing the activities carried out under this section during the period for which the report is being prepared.</text></paragraph><paragraph id="idb5b6bb2b0d8b46968f7cd43871494869"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include—</text><subparagraph id="idf19d1cdd96be4bb7876ecbe0f230fe09"><enum>(A)</enum><text>a narrative on activities conducted by the Office, including a description of outreach and consultation efforts with advocacy organizations and human resource providers;</text></subparagraph><subparagraph id="id18f7c7820bcb40b09b9292424bdd5470"><enum>(B)</enum><text>the results of the measures developed to evaluate the effectiveness of activities aimed at reducing preparedness, response, and recovery disparities; and</text></subparagraph><subparagraph id="iddc310487edf64e639e0f63781d19721a"><enum>(C)</enum><text>the number and types of allegations of unequal disaster assistance investigated by the Director or referred to other appropriate offices.</text></subparagraph></paragraph></subsection><subsection id="id83a394925fe54dc8bbed06163f5269b5"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5AC2514897E74412A819DE46FDBB956F"><enum>(b)</enum><header>Office of Disability Coordinator</header><text>Title V of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>) is amended by striking section 513 (<external-xref legal-doc="usc" parsable-cite="usc/6/321b">6 U.S.C. 321b</external-xref>).</text></subsection><subsection commented="no" id="id3ec869bfc84441e888b5d59d4a21fda4"><enum>(c)</enum><header>Technical and conforming amendments</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended—</text><paragraph commented="no" id="id8ABD7E80C6FA41C590F4367E73800006"><enum>(1)</enum><text>by striking the item relating to section 513 (<external-xref legal-doc="usc" parsable-cite="usc/6/321b">6 U.S.C. 321b</external-xref>); and</text></paragraph><paragraph commented="no" id="id90014B05ED72416E907B35C0C595C263"><enum>(2)</enum><text>by inserting after the item relating to section 528 the following:</text><quoted-block style="OLC" id="ida01ceff4-c0ef-40fe-9ca3-be53cc1c25c7" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><toc changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><toc-entry level="section" idref="iddaea5335dcef4ae893a866c1e24eaf0f">Sec. 529. Office of Civil Rights, Equity, and Community Inclusion.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id964ea8942efd4828a88cca26b45a2ad2"><enum>(d)</enum><header>COVID–19 response</header><paragraph id="idb5049b0f17b845008b56e41e4dd076e0"><enum>(1)</enum><header>In general</header><text>During the period of time for which there is a major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) declared with respect to COVID–19, the Director of the Office of Civil Rights, Equity, and Community Inclusion shall regularly consult with State, local, territorial, and Tribal government officials and community-based organizations from underserved communities the Office of Civil Rights, Equity, and Community Inclusion identifies as disproportionately impacted by COVID–19.</text></paragraph><paragraph id="id6134f24094b84cbc9d383b43383a2c57"><enum>(2)</enum><header>FACA applicability</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to any consultation conducted under paragraph (1).</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id0d5e5a07-6e11-4b82-ae8e-d7204696846e" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title></quote>.</text></section><section id="id59543a75-2c94-4564-9590-8ceb46042187" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Office of Civil Rights, Equity, and Community Inclusion</header><subsection id="idcb8f6659-302e-4b18-9821-eea27f57be68"><enum>(a)</enum><header>In general</header><text>Section 513 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/321b">6 U.S.C. 321b</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb777f5c5-6a72-4b7c-a20f-d4b4943761f8" changed="added" reported-display-style="italic" committee-id="SSGA00"><section id="id0761b6ab-1cb8-4332-806b-f69416d52450"><enum>513.</enum><header>Office of Civil Rights, Equity, and Community Inclusion</header><subsection id="idb861108b-4fe6-476d-a1e9-8e4540d65ba7"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id43777418-cffc-4ef0-90a7-0d7281ec14ca"><enum>(1)</enum><text>the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idc06fe258-70fa-43cc-a8ea-4dcecc6be196"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id680c21f3-339e-478d-ac79-0db31802cc0e"><enum>(B)</enum><text>the Committee on Transportation and Infrastructure, the Committee on Oversight and Reform, and the Committee on Homeland Security of the House of Representatives;</text></subparagraph></paragraph><paragraph id="id5b48f369-41b4-4b09-99aa-df4ae2a70a96"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Office of Civil Rights, Equity, and Community Inclusion;</text></paragraph><paragraph id="id7e4e37ad-9049-4aee-bbfe-a1a59b24a688"><enum>(3)</enum><text>the term <term>disaster assistance</term> means assistance provided under titles IV and V of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170 et seq.</external-xref>);</text></paragraph><paragraph id="id20871604-4fcf-4b6d-8b74-672bcdbd8a62"><enum>(4)</enum><text>the term <term>Office</term> means the Office of Civil Rights, Equity, and Community Inclusion; and</text></paragraph><paragraph id="id42634aae-a309-4894-81ba-c66be839e874"><enum>(5)</enum><text>the term <term>underserved community</term> means—</text><subparagraph id="id8d890f7d-638e-4a98-be90-f769d61b3369"><enum>(A)</enum><text>the Native American and Alaskan Native community;</text></subparagraph><subparagraph id="id11e91888-997f-48c8-8cdc-39ed993c5dbe"><enum>(B)</enum><text>the African-American community;</text></subparagraph><subparagraph id="id2d533d29-23bc-462a-988c-d9f440bf2221"><enum>(C)</enum><text>the Asian community;</text></subparagraph><subparagraph id="id62f38178-cb5d-4810-9c2f-a23c3677b849"><enum>(D)</enum><text>the Hispanic (including persons of Mexican, Puerto Rican, Cuban, and Central or South American origin) community;</text></subparagraph><subparagraph id="id0671a306-3e14-4310-a8a3-f14c710c2f70"><enum>(E)</enum><text>the Pacific Islander community;</text></subparagraph><subparagraph id="idda6ba693-bcaa-4c32-869b-617934b0d616"><enum>(F)</enum><text>the Middle Eastern and North African community;</text></subparagraph><subparagraph id="id6f2d2f5c-0af0-44c9-b7c3-dd0b2dddcf13"><enum>(G)</enum><text>a rural community;</text></subparagraph><subparagraph id="id034efd85-e226-4334-bdb4-b778fd1d3f24"><enum>(H)</enum><text>a low-income community;</text></subparagraph><subparagraph id="idd2b959a5-1082-47b8-8f39-f202b318d624"><enum>(I)</enum><text>the disability community; and</text></subparagraph><subparagraph id="idd8ca3679-2bf1-487d-a999-cd987e39b289"><enum>(J)</enum><text>any other historically disadvantaged community, as determined by the Director.</text></subparagraph></paragraph></subsection><subsection id="id22458a43-a286-4a74-bd17-86948bfac245"><enum>(b)</enum><header>Office of Civil Rights, Equity, and Community Inclusion</header><paragraph id="id4cd099b9-664b-4762-91a0-be385f888d1a"><enum>(1)</enum><header>In general</header><text>The Office of Equal Rights of the Agency shall, on and after the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, be known as the Office of Civil Rights, Equity, and Community Inclusion.</text></paragraph><paragraph id="idd61e6c5f-163d-460f-a169-1f66609c0bfa"><enum>(2)</enum><header>References</header><text>Any reference to the Office of Equal Rights of the Agency in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Office of Civil Rights, Equity, and Community Inclusion.</text></paragraph></subsection><subsection id="id2c38c078-bac3-448e-a64d-ff375e231b7d"><enum>(c)</enum><header>Director</header><paragraph id="ide0b3b019-d6ad-4b16-93e3-a5e77e91e72e"><enum>(1)</enum><header>In general</header><text>The Office shall be headed by a Director, who shall report to the Administrator.</text></paragraph><paragraph id="id6f54349b-678d-4e8e-9d89-9c0d113156b2"><enum>(2)</enum><header>Requirement</header><text>The Director shall have documented experience and expertise in civil rights, underserved community inclusion research, disaster preparedness, or resilience disparities elimination.</text></paragraph></subsection><subsection id="ide57665f3-9e44-4d33-a542-98305273ce26"><enum>(d)</enum><header>Purpose</header><text>The purpose of the Office is to—</text><paragraph id="id078e8585-aeb8-411e-9965-a4910a4e0313"><enum>(1)</enum><text>improve underserved community access to disaster assistance;</text></paragraph><paragraph id="idb7484eb3-a2d3-49b8-a508-2fc756ffb1ed"><enum>(2)</enum><text>improve the quality of disaster assistance received by underserved communities;</text></paragraph><paragraph id="ida0cd09f3-b669-4ed7-a399-94d66740c876"><enum>(3)</enum><text>eliminate racial, ethnic, and other underserved community disparities in the delivery of disaster assistance; and</text></paragraph><paragraph id="id0dab68a5-98f6-4dfd-a6d3-5d0b1d8a0456"><enum>(4)</enum><text>carry out such other responsibilities of the Office of Equal Rights as in effect on the day before the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, as determined appropriate by the Administrator.</text></paragraph></subsection><subsection id="idb826598c-0670-42b1-9896-9148d7581614"><enum>(e)</enum><header>Authorities and duties</header><paragraph id="idac638aa8-27e5-4ea5-b519-25addd6f2931"><enum>(1)</enum><header>In general</header><text>The Director shall be responsible for—</text><subparagraph id="id96e67c80-8e55-4486-b9db-6b8e5b4af866"><enum>(A)</enum><text>improving—</text><clause id="idf5ca2af2-1a19-4e20-aae5-c08d413c0ad1"><enum>(i)</enum><text>underserved community access to disaster assistance before and after a disaster; and</text></clause><clause id="ida811d0ab-ed73-4c62-943f-0c44f15c0d02"><enum>(ii)</enum><text>the quality of Agency assistance underserved communities receive;</text></clause></subparagraph><subparagraph id="id180a5413-c29a-4de4-bda5-b161f48791e5"><enum>(B)</enum><text>reviewing preparedness, response, and recovery programs and activities of the Agency to ensure the elimination of underserved community disparities in the delivery of such programs and activities; and</text></subparagraph><subparagraph id="id6a340525-6154-4473-85e1-fe8ca1cc7e26"><enum>(C)</enum><text>carrying out such other responsibilities of the Office of Equal Rights as in effect on the day before the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, as determined appropriate by the Administrator.</text></subparagraph></paragraph><paragraph id="idc2d2ccdb-a275-4509-b8c9-62e22009ce89"><enum>(2)</enum><header>Reducing disparities in preparedness, response, and recovery</header><subparagraph id="idb0c95ee8-05a5-4928-875e-6c1a04821ec7"><enum>(A)</enum><header>In general</header><text>The Director shall develop measures to evaluate the effectiveness of the activities of program offices in the Agency and the activities of recipients aimed at reducing disparities in the services provided to underserved communities.</text></subparagraph><subparagraph id="id15255963-fa5f-4af4-87a2-6e4a8db96e3b"><enum>(B)</enum><header>Requirement</header><text>The measures developed under subparagraph (A) shall—</text><clause id="id98f039c2-14d8-40d2-8853-dc49f1e424db"><enum>(i)</enum><text>evaluate community outreach activities, language services, workforce cultural competence, historical assistance for grants and loans provided to individuals and State, local, tribal, and territorial governments, the effects of disaster declaration thresholds on underserved communities, the percentage of contracts awarded to underserved and minority-owned businesses, historical barriers to equitable assistance across race and class during and after disasters, and other areas, as determined by the Director; and</text></clause><clause id="idc297642a-8ea4-42b1-8085-ac1e04654603"><enum>(ii)</enum><text>identify the communities implicated in the evaluations conducted under clause (i).</text></clause></subparagraph><subparagraph id="id98148d38-14fd-45e2-8feb-3d3065bd4ab4"><enum>(C)</enum><header>Coordination with other offices</header><text>In carrying out this section, the Director shall—</text><clause id="id2b3da26a-daaa-453f-aa6c-1118c480c721"><enum>(i)</enum><text>participate in scenario-based disaster response exercises at the Agency;</text></clause><clause id="idad356a6f-17fd-43c4-a849-339825b8934e"><enum>(ii)</enum><text>coordinate with the Office of Minority Health of the Department of Health and Human Services;</text></clause><clause id="id3ff2695a-a179-4082-b999-9cf331b40163"><enum>(iii)</enum><text>coordinate with the Office of Civil Rights of the Department of Agriculture;</text></clause><clause id="id71aeec8a-3827-467d-91a7-126fbd591c46"><enum>(iv)</enum><text>as appropriate, coordinate with other relevant offices across the Federal Government, including by leading a voluntary task force to address disaster response needs of underserved communities;</text></clause><clause id="id3e212995-f589-4519-9753-fb83445997ca"><enum>(v)</enum><text>coordinate with the Office for Civil Rights and Civil Liberties of the Department; and</text></clause><clause id="idbb0dbd74-05f7-4822-9a34-ada7e955af91"><enum>(vi)</enum><text>investigate allegations of unequal disaster assistance based on race or ethnic origin or refer those allegations to the appropriate office.</text></clause></subparagraph></paragraph></subsection><subsection id="id37b6a388-2378-4e1c-804d-803b18a5bff1"><enum>(f)</enum><header>Grants and contracts</header><text>In carrying out this section, to further inclusion and engagement of underserved communities throughout preparedness, response, recovery, and mitigation and to eliminate racial, ethnic, and other underserved community disparities in the delivery of disaster assistance, as described in subsection (d), the Administrator shall—</text><paragraph id="idef44b38a-a797-4095-a642-65bf941d1867"><enum>(1)</enum><text>administer and evaluate Agency programs and activities, including the programs and activities of recipients of preparedness, response, recovery, and mitigation grants and contracts, to—</text><subparagraph id="idce0b3495-7bd4-47e4-ba50-f57eccc98a38"><enum>(A)</enum><text>further inclusion and engagement of underserved communities and underserved and minority-owned businesses; and</text></subparagraph><subparagraph id="id79fd3143-e570-46d5-826b-ed5434d7d9ed"><enum>(B)</enum><text>improve outcomes for underserved communities tied to Agency programs and activities; and</text></subparagraph></paragraph><paragraph id="idef07904a-c995-43d8-b2ef-b7aded0569c8"><enum>(2)</enum><text>establish an underserved community initiative to award grants to, and enter into cooperative agreements and contracts with, nonprofit entities. </text></paragraph></subsection><subsection id="id02271e0c-0863-49c4-8a7b-90fe0dc973a2"><enum>(g)</enum><header>Disability coordinator</header><paragraph id="id5d6d0a6f-8c63-4e2d-a398-e60bf2fce061"><enum>(1)</enum><header>In general</header><text>There shall be within the Office a Disability Coordinator to ensure that the needs of individuals with disabilities are being properly addressed by proactively engaging with disability and underserved communities and State, local, and tribal governments in emergency preparedness and disaster relief.</text></paragraph><paragraph id="id46250b3f-9a23-4c06-b6ec-e73df5a3dc7d"><enum>(2)</enum><header>Responsibilities</header><text>The Disability Coordinator shall be responsible for—</text><subparagraph id="id4e1ccc0f-c2a5-4c2a-898f-16fdd455572e"><enum>(A)</enum><text>providing guidance and coordination on matters relating to individuals with disabilities in emergency planning requirements and relief efforts in the event of a natural disaster, act of terrorism, or other man-made disaster;</text></subparagraph><subparagraph id="id732c0922-c665-4f59-b10d-037c352f6bf3"><enum>(B)</enum><text>interacting with the staff of the Agency, the National Council on Disability, the Interagency Coordinating Council on Preparedness and Individuals with Disabilities established under Executive Order 13347 (<external-xref legal-doc="usc" parsable-cite="usc/6/314">6 U.S.C. 314</external-xref> note; relating to individuals with disabilities in emergency preparedness), other agencies of the Federal Government, and State, local, and tribal government authorities relating to the needs of individuals with disabilities in emergency planning requirements and relief efforts in the event of a natural disaster, act of terrorism, or other man-made disaster;</text></subparagraph><subparagraph id="ide1ce16ec-f70d-48ee-b727-a6f77ad74232"><enum>(C)</enum><text>consulting with stakeholders that represent the interests and rights of individuals with disabilities about the needs of individuals with disabilities in emergency planning requirements and relief efforts in the event of a natural disaster, act of terrorism, or other man-made disaster;</text></subparagraph><subparagraph id="id5f8211bb-9217-41f2-94d7-ed9dceab34c6"><enum>(D)</enum><text>ensuring the coordination and dissemination of best practices and model evacuation plans and sheltering for individuals with disabilities;</text></subparagraph><subparagraph id="ida7f54cbc-bb60-446c-8cd1-32a2905e3e4b"><enum>(E)</enum><text>ensuring the development of training materials and a curriculum for training emergency response providers, State, local, and tribal government officials, and others on the needs of individuals with disabilities;</text></subparagraph><subparagraph id="id4a9c73f7-f1fe-4f14-ad66-319de70591b7"><enum>(F)</enum><text>promoting the accessibility of telephone hotlines and websites relating to emergency preparedness, evacuations, and disaster relief;</text></subparagraph><subparagraph id="idf2705001-0e52-4c2e-8827-acf7c6b7e0b9"><enum>(G)</enum><text>working to ensure that video programming distributors, including broadcasters, cable operators, and satellite television services, make emergency information accessible to individuals with hearing and vision disabilities;</text></subparagraph><subparagraph id="ide0443bd7-4151-46a0-b8e9-8861ce7c6e56"><enum>(H)</enum><text>providing guidance to State, local, and tribal government officials and other individuals, and implementing policies, relating to the availability of accessible transportation options for individuals with disabilities in the event of an evacuation;</text></subparagraph><subparagraph id="id7859ee02-3b2d-4de9-8330-001ea6951d53"><enum>(I)</enum><text>providing guidance and implementing policies to external stakeholders to ensure that the rights and wishes of individuals with disabilities regarding post-evacuation residency and relocation are respected;</text></subparagraph><subparagraph id="idb5f54f55-80a4-4bef-bb71-08e139f0f623"><enum>(J)</enum><text>ensuring that meeting the needs of individuals with disabilities is a component of the national preparedness system established under section 644 of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/744">6 U.S.C. 744</external-xref>);</text></subparagraph><subparagraph id="idf17d4ea4-949e-4081-a719-0a34a9eb3aab"><enum>(K)</enum><text>coordinate technical assistance for Agency programs based on input from underserved communities through a designee of the Director; and</text></subparagraph><subparagraph id="id31411051-72e1-4991-a3c8-e35175259520"><enum>(L)</enum><text>any other duties assigned by the Director.</text></subparagraph></paragraph></subsection><subsection id="id746a5da4-5791-4145-be69-04217b76f8aa"><enum>(h)</enum><header>Reports</header><paragraph id="id49e02db5-e1b6-4e59-a17a-0cd17ecaf5af"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Achieving Equity in Disaster Response, Recovery, and Resilience Act of 2022</short-title>, and biennially thereafter, the Administrator shall submit to the appropriate committees of Congress a report describing the activities carried out under this section during the period for which the report is being prepared.</text></paragraph><paragraph id="idcd8a734d-edda-47c2-8063-cb651ed33d88"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include—</text><subparagraph id="id9daaa8bf-86d6-429d-8d1b-c9824273f4ff"><enum>(A)</enum><text>a narrative on activities conducted by the Office, including a description of outreach and consultation efforts with advocacy organizations and human resource providers;</text></subparagraph><subparagraph id="id1d97e8e0-1a58-4f55-994a-b1a9ac08d2e6"><enum>(B)</enum><text>the results of the measures developed to evaluate the effectiveness of activities aimed at reducing preparedness, response, and recovery disparities; and</text></subparagraph><subparagraph id="idf62f7040-08c1-4f6c-94a7-7fa36de7e39f"><enum>(C)</enum><text>the number and types of allegations of unequal disaster assistance investigated by the Director or referred to other appropriate offices.</text></subparagraph></paragraph></subsection><subsection id="id92ba7b14-3b15-4cf3-b438-6c87c2973903"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="idff3efb1b-4ddf-4125-9357-47371112fd3c"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended by striking the item relating to section 513 (<external-xref legal-doc="usc" parsable-cite="usc/6/321b">6 U.S.C. 321b</external-xref>) and inserting the following:</text><quoted-block style="OLC" id="id6a72b597-056e-475a-8db9-7bb201934a46" changed="added" reported-display-style="italic" committee-id="SSGA00"><toc changed="added" reported-display-style="italic" committee-id="SSGA00"><toc-entry level="section" idref="iddaea5335dcef4ae893a866c1e24eaf0f">Sec. 513. Office of Civil Rights, Equity, and Community Inclusion.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida9e91184-a09d-448b-869a-4852cfe0c591"><enum>(c)</enum><header>COVID–19 response</header><paragraph id="id34b6b479-59d8-4595-bc3e-2a2dc6346514"><enum>(1)</enum><header>In general</header><text>During the period of time for which there is a major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) declared with respect to COVID–19, the Director of the Office of Civil Rights, Equity, and Community Inclusion shall regularly consult with State, local, territorial, and Tribal government officials and community-based organizations from underserved communities the Office of Civil Rights, Equity, and Community Inclusion identifies as disproportionately impacted by COVID–19.</text></paragraph><paragraph id="idc83cdc74-f5a1-40f8-81e4-ef45c3d7a60b"><enum>(2)</enum><header>FACA applicability</header><text>The Federal Advisory Committee Act (5 U.S.C.
