which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to increase death gratuities and funeral allowances for Federal employees, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring Civil Servants Killed in the Line of Duty Act</short-title></quote>.</text></section><section id="id0185257CB40141FC9A49F7CF4920B065"><enum>2.</enum><header>Increasing death gratuity for Federal employees killed in the line of duty</header><subsection id="id6DB65009F9BF42F3A147418512E80DAC"><enum>(a)</enum><header>Amendments to title 5, United States Code</header><paragraph id="id691B73F76CEB4D34A221F756C1D674BC"><enum>(1)</enum><header>In general</header><text>Subchapter VII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block id="idDD771F1B6E3145499784C7AA47A24E3C" style="USC" act-name=""><section id="id94BE72AFC0D9496F996D19DA777C9A81" section-type="subsequent-section"><enum>5571.</enum><header>Employee death gratuity payments</header><subsection id="idAEF05FDED5C64255820B4480F967CA39"><enum>(a)</enum><header>Definition</header><paragraph id="id09FAF1F437D74D20A1558929FA7DB294"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 5561(2), in this section, the term <term>employee</term> means an individual who has been determined by the Secretary of Labor to be an employee within the meaning of section 8101(1).</text></paragraph><paragraph id="idF58C173D3DEF49968A6BD755A2190A36"><enum>(2)</enum><header>Exclusive authority</header><text>A determination described in paragraph (1) may be made only by the Secretary of Labor.</text></paragraph></subsection><subsection id="id463201A364D64CC6ADB4726A2A279FA3"><enum>(b)</enum><header>Gratuity</header><paragraph id="id15765DCB3D604D389EAC062FB5753DC4"><enum>(1)</enum><header>In general</header><text>With respect to the death of an employee occurring on or after the date of enactment of this section, notwithstanding section 8116, and in addition to any payment made under subchapter I of chapter 81, the head of the agency employing the employee shall pay from appropriations made available for salaries and expenses of that agency a death gratuity to the person identified under subsection (c)(2), if the death of the employee—</text><subparagraph id="idAFE9348004014ADBB3DFBDBD9C4A4552"><enum>(A)</enum><text>results from injury sustained while in the line of duty of the employee; and</text></subparagraph><subparagraph id="id376641D0412048A09CBDC2BCA42C083A"><enum>(B)</enum><text>is not—</text><clause id="idCD9F8FBC720C4DAC8ADBC849E19CB168"><enum>(i)</enum><text>caused by willful misconduct of the employee;</text></clause><clause id="id2E4850D80E394853B147ADC0EF34E924"><enum>(ii)</enum><text>caused by the intention of the employee to bring about the injury or death of the employee or another; or</text></clause><clause id="id79F201E4B1274BBD93918E3B4974B70E"><enum>(iii)</enum><text>proximately caused by the intoxication of the injured employee.</text></clause></subparagraph></paragraph><paragraph id="id8475C23399924F8AB7CDC22FC9725750"><enum>(2)</enum><header>Amount</header><subparagraph id="idD3398EBE16FA4A5CB6DFFC3045B27D91"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the amount of a death gratuity paid under paragraph (1) with respect to an employee shall be $100,000, as adjusted each March 1 by the amount determined by the Secretary of Labor to represent the percentage change in the Consumer Price Index for All Urban Consumers (all items; United States city average) published for December of the preceding year over that Index published for the December of the year prior to the preceding year, adjusted to the nearest <fraction>1/10</fraction> of 1 percent.</text></subparagraph><subparagraph id="idC70C98B5709847DBA4538C87FA33C786"><enum>(B)</enum><header>Local compensation plans</header><text>For an employee compensated under a local compensation plan established under section 408 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3968">22 U.S.C. 3968</external-xref>), the amount of a death gratuity paid under paragraph (1) with respect to the employee shall be in an amount determined in rules issued by the Secretary of State.</text></subparagraph></paragraph></subsection><subsection id="idDE8508127B6E4A6D8269C8F498AD27E5"><enum>(c)</enum><header>Recipient of payment</header><paragraph id="id50EE5A062BED4FAE87033E4FBD0193AD"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>child</term>—</text><subparagraph id="id9AFE88307CCA474BAA25AE8BE0492A2F"><enum>(A)</enum><text>includes—</text><clause id="idA179F4A09DCB42558B64AE61B9BB69E4"><enum>(i)</enum><text>a natural child; and</text></clause><clause id="id5A6AA39144C24A818D90ACB6E4D3C401"><enum>(ii)</enum><text>an adopted child; and</text></clause></subparagraph><subparagraph id="idEB956F69C2CF47CCB5E80C99BD8CCF44"><enum>(B)</enum><text>does not include a stepchild.</text></subparagraph></paragraph><paragraph id="id8839C3CB68DB4379A0B9DDD8AF760EC6"><enum>(2)</enum><header>Order of precedence</header><text>A death gratuity paid under subsection (b) with respect to an employee shall be paid in the following order of precedence:</text><subparagraph id="idC0C352295FEB46F9BEF2679DC4516A78"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id30B7DF3E71A34919ABFDC136E7C3F832"><enum>(i)</enum><text>To the beneficiary designated to receive the gratuity by the employee in a signed and witnessed writing that is received by the agency employing the employee before the date of the death of the employee.</text></clause><clause indent="up1" id="id73C6A5096DE547FF8A3732201E500DB2"><enum>(ii)</enum><text>A designation, change, or cancellation of beneficiary in a will, or another document not described in clause (i), shall have no force or effect for the purposes of that clause.</text></clause></subparagraph><subparagraph id="id907E94B006C541BA99BDD23F67E3BD41"><enum>(B)</enum><text>If there is no beneficiary described in subparagraph (A), to the surviving spouse of the employee.</text></subparagraph><subparagraph id="idE93E2F6007D74021A80F19BE6A501E93"><enum>(C)</enum><text>If neither subparagraph (A) nor (B) applies, to the children of the employee (including the descendant of any deceased child by representation) such that each such child receives an equal amount of the gratuity.</text></subparagraph><subparagraph id="id9B8DE69E140441EA976BCFD4B96AB771"><enum>(D)</enum><text>If none of subparagraph (A), (B), or (C) applies, to the surviving parents of the employee such that each such surviving parent receives an equal amount of the gratuity.</text></subparagraph><subparagraph id="idB685C65688CB4223A93109CC37ED18F9"><enum>(E)</enum><text>If none of subparagraphs (A) through (D) applies, to the duly appointed executor or administrator of the estate of the employee.</text></subparagraph><subparagraph id="id4ED61E6EAF0D49FEB7C60419C76D7933"><enum>(F)</enum><text>If none of subparagraphs (A) through (E) applies, to the person entitled, under the laws of the State in which the employee is domiciled, as of the date on which the employee dies, to receive the payment.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id78BF13F9D1B24CAEB6E8696F3DEF2372"><enum>(2)</enum><header>Repeal of death gratuity payment authority</header><text>Section 651 of the Treasury, Postal Service, and General Government Appropriations Act, 1997 (<external-xref legal-doc="usc" parsable-cite="usc/5/8133">5 U.S.C. 8133</external-xref> note) is repealed.</text></paragraph><paragraph id="idA524B741E18C4DCA89B4EE41B889BA28"><enum>(3)</enum><header>Technical and conforming amendments</header><subparagraph id="idFFD1BCBE204C40CC9C33F378B179DFA4"><enum>(A)</enum><header>Table of chapters</header><text>In the table of subchapters for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, the item relating to subchapter VII is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF0D7E97CBBCC4E158BB864648C51FD96"><toc><toc-entry level="subchapter" bold="off">SUBCHAPTER VII – PAYMENTS TO MISSING PERSONS AND PAYMENTS FOR DISABILITY OR DEATH</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="id96BA6CCB98944ECD858C86464824FB26"><enum>(B)</enum><header>Table of sections</header><text>The table of sections for subchapter VII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1636BF1298E844538D9101E7977F45B2"><toc><toc-entry level="section" bold="off">5571. Employee death gratuity payments.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id1de0984e47584f93b00aa1f02486d243"><enum>(b)</enum><header>Amendment to title 49</header><text>Section 40122(g)(2) of title 49, United States Code, is amended—</text><paragraph id="id15E144323F1246039A2952645BF1F56B"><enum>(1)</enum><text>in subparagraph (I)(iii), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idB1EED5C763EF439FB167891481398128"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idFA702943D49146C8ACB9DF98664DC67C"><enum>(3)</enum><text>by inserting after subparagraph (J), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9b99b3b1a91e459e8a0540da6d23854c"><subparagraph id="idc8cfb8a12147405c89733b1cd73dd4ea"><enum>(K)</enum><text>section 5571, relating to death gratuities resulting from an injury sustained in the line of duty.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id0E8B176773E5433584F8DA8525C59903"><enum>3.</enum><header>Funeral expenses</header><subsection id="idDA5824652C374D118B2F8EFE831C3340"><enum>(a)</enum><header>In general</header><text>Section 8134(a) of title 5, United States Code, is amended—</text><paragraph id="id59CB626D71164310B7A7F46EA09147A0"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after <quote>(a)</quote>;</text></paragraph><paragraph id="id5884BBDEC66F49F2BFA6AE692AAAE4FC"><enum>(2)</enum><text>by striking <quote>$800</quote> and inserting <quote>$8,800</quote>; and</text></paragraph><paragraph id="id997EE4FDD80946DFB4CEF0D5BE0BC62C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="id25C082B655F541DE8C74F94FACB5E7AF" style="OLC" act-name=""><paragraph id="id7760486334CD43E3B53A4AFC1DD2D04F" indent="up1"><enum>(2)</enum><text>The amount described in paragraph (1) shall be adjusted on March 1 of each year by the percentage amount determined by the Secretary of Labor under section 8146a for that year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idB87DB485F9504D1690230B6C08B5044C"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a)(2) shall apply with respect to any death occurring on or after the date of enactment of this Act.</text></subsection></section><section id="id0FF912B60226492A9508EBA78F1818B2"><enum>4.</enum><header>Death gratuity for injuries incurred in connection with employee’s service with an Armed Force</header><text display-inline="no-display-inline">Section 8102a of title 5, United States Code, is amended—</text><paragraph id="idAD28E14DFCE34882A5075E35F6893CE2"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idCD7A48A0061043629AC173FD747F4C54"><enum>(A)</enum><text>by striking <quote>The United States</quote> and inserting the following:</text><quoted-block id="idB9C21DB6EEE14329AA5C19F972335A67" style="OLC" act-name=""><paragraph id="id16A8E95692E3484FB42AE1CDA8BBA76D"><enum>(1)</enum><header>In general</header><text>The United States</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="idA1696A03A27040B9B611622D325EFB7D"><enum>(B)</enum><text>in paragraph (1), as so designated, by striking <quote>up to</quote>; and</text></subparagraph><subparagraph id="id4B0F14E5995F45E4A7B725D787827B25"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id6C5CB0BEAAD9428A9E05EFE96C10C94A" style="OLC" act-name=""><paragraph id="id7B49DC51BBF34516B0A5B63E515A7C33"><enum>(2)</enum><header>Adjustment</header><text>The amount described in paragraph (1) shall be adjusted each March 1 by the amount determined by the Secretary of Labor to represent the percentage change in the Consumer Price Index for All Urban Consumers (all items; United States city average) published for December of the preceding year over that Index published for the December of the year prior to the preceding year, adjusted to the nearest <fraction>1/10</fraction> of 1 percent.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idE772AFDEF4424ECEB446CEA52B0320A6"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block id="id8C41A7B26FD34DE0A334882934456C63" style="OLC" act-name=""><subsection id="idBD46DE6CBD184D5B8F0D3A884155C71C"><enum>(c)</enum><header>Relationship to other benefits</header><text>With respect to a death occurring on or after the date of enactment of the <short-title>Honoring Civil Servants Killed in the Line of Duty Act</short-title>, the death gratuity payable under this section may not be reduced by the amount of any other death gratuity provided under any other provision of Federal law based on the same death.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id8204D3F503FB4E23B89514E4D9653521"><enum>(3)</enum><text>in subsection (d), by adding at the end the following:</text><quoted-block id="id1C34AD26B0D24007ACA61B22DB68698A" style="OLC" act-name=""><paragraph id="id5D7BE7A0A58F43529E1D6076252F8E5F"><enum>(7)</enum><text>If a person covered by this section does not have any eligible survivors, as described in this subsection, and that person has not designated an alternate person to receive a payment under this section, the payment shall be paid to the personal representative of the person’s estate.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id0de565eb4c6c49ad97f7c82ab0c411f9"><enum>5.</enum><header>Agency gratuity for deaths sustained in the line of duty abroad</header><text display-inline="no-display-inline">Section 413 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3973">22 U.S.C. 3973</external-xref>) is amended—</text><paragraph id="ideb2d251267384e13868d373591e65c76"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id044ab2e46d2b43688fcb7462fed5ee24"><enum>(A)</enum><text>in the first sentence, by striking <quote>dependents</quote> and inserting <quote>beneficiaries</quote>; and</text></subparagraph><subparagraph id="idfe67c9e2a0b44ae1bfebeec3c8cd130b"><enum>(B)</enum><text>in the second sentence, by inserting <quote>, except as provided in subsection (e)</quote> after <quote>payable from any source</quote>;</text></subparagraph></paragraph><paragraph id="idac066066cf33448aa0975846c5ee90c2"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id376e0d1fcf3b48069aade73974fd1bc3"><subsection id="id534700a7390641308257f64b339e364b"><enum>(b)</enum><header>Executive agencies</header><text>The head of an executive agency shall, pursuant to guidance issued under subsection (c), make a death gratuity payment authorized by this section to the surviving beneficiaries of—</text><paragraph id="idee04e930e989437bbb89bfe40c87f83a"><enum>(1)</enum><text>any employee of that agency who dies as a result of injuries sustained in the performance of duty abroad while subject to the authority of the chief of mission pursuant to section 207; or</text></paragraph><paragraph id="id358affc3d8574675a38ffa3a17920cc4"><enum>(2)</enum><text>an individual in a special category serving in an uncompensated capacity for that agency abroad in support of a diplomatic mission, as identified in guidance issued under subsection (c), who dies as a result of injuries sustained in the performance of duty abroad.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id01ec9469d26546178d45738101cd35b7"><enum>(3)</enum><text>by amending subsection (d) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1f4634a68b6641068b8c1fee073cdcfa"><subsection id="id9fdae3b14db24c0d85dc989b48f5b0c4"><enum>(d)</enum><header>Eligibility under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code</header><text>A death gratuity payment shall be made under this section only if the death is determined by the Secretary of Labor to have resulted from an injury (excluding a disease proximately caused by the employment) sustained in the performance of duty under section 8102 of title 5, United States Code.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idb5ad879fe1494a07acfac6e415de776b"><enum>(4)</enum><text>by redesignating subsection (e) as subsection (f);</text></paragraph><paragraph id="id68faea4a7f75447d95c0ffce3146e965"><enum>(5)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7f7c4a724211465aafa6e15b82c4f4e6"><subsection id="id02831e4c269c4ec39f2a6561fdfb13f1"><enum>(e)</enum><header>Offset</header><text>For deaths occurring on or after the date of enactment of this subsection, the death gratuity payable under this section shall be reduced by the amount of any death gratuity provided under section 5571 of title 5, United States Code, based on the same death.</text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="id527ed437e2fd45428f61f49d8fdd6678"><enum>(6)</enum><text>in subsection (f), as so redesignated by paragraph (4), by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2dc097744e5e4fd8aacf735e766ff033"><paragraph id="id6c00808d8635430cadeba43586e063ce"><enum>(2)</enum><text>the term <term>surviving beneficiaries</term> means the person or persons identified pursuant to the order of precedence established under section 5571(c)(2) of title 5, United States Code.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="id392C73ECBD7A4CF5A036174E8DCC673F"><enum>6.</enum><header>Emergency supplemental authorization</header><subsection id="id2492801F72E043FFB619D3B66D20C68C"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id809DD7A5AA304CD6BBE06E95357845E1"><enum>(1)</enum><text>the term <term>agency</term> means an agency that is authorized or required to make a payment under a covered provision; and</text></paragraph><paragraph id="idB2F268B4C0E84262A2AF0EE2A676938C"><enum>(2)</enum><text>the term <term>covered provision</term> means—</text><subparagraph id="id6F735552DA7447C48E2E485373896AB5"><enum>(A)</enum><text>section 5571 of title 5, United States Code, as added by section 2 of this Act;</text></subparagraph><subparagraph id="idD3C48F23008241D48FE64D0EB98DA174"><enum>(B)</enum><text>section 8102a of title 5, United States Code, as amended by section 4 of this Act; or</text></subparagraph><subparagraph id="idC78D8650B47F40B9BF5AACA90B37C032"><enum>(C)</enum><text>section 413 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3973">22 U.S.C. 3973</external-xref>), as amended by section 5 of this Act.</text></subparagraph></paragraph></subsection><subsection id="id006DBD4E57834D42BE4CF336264E2CB5"><enum>(b)</enum><header>Authorization</header><text>If the head of an agency determines, with the concurrence of the Director of the Office of Management and Budget, that a natural disaster, act of terrorism, or other incident results in the inability of the agency to make additional payments under a covered provision— </text><paragraph id="id1577E54060C8441397A6DBD349DC3453"><enum>(1)</enum><text>there are authorized to be appropriated to the agency such sums as may be necessary to make those additional payments; and</text></paragraph><paragraph id="idB60C91E0D9CF4B14B6EC6D3FEF585FD7"><enum>(2)</enum><text>the head of the agency may make those additional payments only to the extent additional amounts are made available for those purposes.</text></paragraph></subsection><subsection id="idA5F99789311644FCB8878F8DC1CDA768"><enum>(c)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, not later than 30 days after the date on which the head of an agency submits to Congress a request for supplemental appropriations for the purposes described in subsection (b), Congress should take action with respect to that request.</text></subsection></section></legis-body></bill>
