which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide, manufacture, and distribute high quality N–95 respirator masks for every individual in the United States during the COVID–19 pandemic using the Defense Production Act and other means.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id93222BE4617040ED870C983A60302219"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Masks for All Act of 2022</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id3B825BDEC0054309974B0BD459DB1AB1"><enum>2.</enum><header>Requirement to eliminate mask shortages</header><text display-inline="no-display-inline">The President, acting through the Administrator, shall, as soon as practicable—</text><paragraph commented="no" display-inline="no-display-inline" id="idAAF01BDD89EB4337A52EC06C5B9A6821"><enum>(1)</enum><text display-inline="yes-display-inline">eliminate all shortages of N–95 respirator masks in the United States; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4937E710E65340B0A37B0F42E6B53748"><enum>(2)</enum><text display-inline="yes-display-inline">manufacture N–95 respirator masks, to the greatest extent practicable, in the United States; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC679555786BD48559854551B58845C88"><enum>(3)</enum><text>distribute N–95 respirator masks to the general public and the health care workforce in accordance with this Act. </text></paragraph></section><section id="idC05D896F97F444DBAFEE1A225C89592B"><enum>3.</enum><header>Providing high quality face masks to every individual in the United States</header><subsection id="id58CCFE1322334AEF853ED254F1CD7AFB"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall establish a program to provide a supply of 3 N–95 respirator masks to every individual in the United States, including individuals—</text><paragraph id="id6433894ac6af4957a0bfa542d40d1ee2"><enum>(1)</enum><text>experiencing homelessness; and</text></paragraph><paragraph id="idd58450e936e24b8ca3b7c228a66aa5ce"><enum>(2)</enum><text>living in group quarters, as defined by the Census Bureau for the purposes of the most recent decennial census. </text></paragraph></subsection><subsection id="id8E993043FEF44376B7B18E87718BDAB4"><enum>(b)</enum><header>No cost to individuals</header><text>An individual that receives a supply of N–95 respirator masks under this section shall not be charged for the N–95 respirator masks, for the delivery of the N–95 respirator masks, or for any other administrative cost relating to the N–95 respirator masks. </text></subsection><subsection id="id9BB142884758414AA8D9BDFF5B32DEAF"><enum>(c)</enum><header>Prohibition on identification requirement</header><text>An individual that receives a supply of N–95 respirator masks under this section shall not be required to provide identification or proof of citizenship in order to receive the N–95 respirator masks. </text></subsection><subsection id="id945D3C3CFDB44CB289B9922E4F424653"><enum>(d)</enum><header>Deliveries</header><text>To the greatest extent possible, N–95 respirator masks provided under this section shall be delivered using the United States Postal Service.</text></subsection><subsection commented="no" id="id54F4E7839F3243E28318445471D4C991"><enum>(e)</enum><header>Educational materials</header><paragraph commented="no" id="idD8EEE13222DE4B11B2CB39C6B4151BB2"><enum>(1)</enum><header>In general</header><text>N–95 respirator masks provided under this section shall be accompanied by a 1-page fact sheet on the importance of wearing N–95 respirator masks, the proper use of N–95 respirator masks, and the nearest N–95 respirator mask pickup sites designated under subsection (f). </text></paragraph><paragraph id="id1cb9c9cea26d447ab3b63211f6cccdd3"><enum>(2)</enum><header>Requirements</header><text>The information included in the fact sheet required under paragraph (1) shall be—</text><subparagraph id="idB1559CEEE4EC40B085F8264831D93455"><enum>(A)</enum><text>scientifically and medically accurate;</text></subparagraph><subparagraph id="id29EBB0DC4D40445FA17A1DAB892909A6"><enum>(B)</enum><text>written for a layperson;</text></subparagraph><subparagraph id="id13FC0DB1FD3A4116981B167541CFFCB6"><enum>(C)</enum><text>presented in a size and type of font that is easy to read; and</text></subparagraph><subparagraph id="id98E82714A0A14B5CA90EEFC44A19E777"><enum>(D)</enum><text>provided in the languages that are most appropriate for the community. </text></subparagraph></paragraph><paragraph id="id5E3A1CE9B865485193566571ED1FF471"><enum>(3)</enum><header>Publication of information</header><text>The information included in the fact sheet required under paragraph (1) shall be published on the public website of the Federal Emergency Management Agency and the Department of Health and Human Services in multiple languages and in a manner that is in compliance with the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) for reading by the visually impaired. </text></paragraph></subsection><subsection id="id68660b4b74ff45e4acc918eafb7aa661"><enum>(f)</enum><header>Mask pickup sites</header><paragraph id="id0420BCF9FFF744BCADCDF1FB063E1831"><enum>(1)</enum><header>In general</header><text>The Administrator shall designate N–95 respirator mask pickup sites in each community and shall provide N–95 respirator masks to each site, allocated according to population, to be distributed to the general public at no cost to the public. </text></paragraph><paragraph id="idDEFD2DD29A1A48D49003BDD27980D60E"><enum>(2)</enum><header>Requirements for designation of sites</header><text>In designating sites as N–95 respirator mask pickup sites under paragraph (1), the Administrator shall choose—</text><subparagraph id="id4B23534100B043A2A86CDBDCF5477AE9"><enum>(A)</enum><text>a location of a public entity, organization, or business that provides essential services to communities, such as a post office, community pharmacy, Federally-qualified health center, senior center, congregate meal site, and COVID–19 testing or vaccination site; </text></subparagraph><subparagraph id="idED0E07C3FF03435C9C01C9C3881E183B"><enum>(B)</enum><text>a location that is easily accessible and appropriate to maximize the public health response to COVID–19; and</text></subparagraph><subparagraph id="id2584505FC44C45C9B066B353E3E052D3"><enum>(C)</enum><text>when possible, a location that is federally operated or is a recipient of Federal funds. </text></subparagraph></paragraph><paragraph id="id3FD9C2DA07374827A8C11D8D1F209266"><enum>(3)</enum><header>Requirement for pickup sites</header><text>If a site is designated as an N–95 respirator mask pickup site under paragraph (1)—</text><subparagraph id="idD8B3F0FA9076498BA796A4C56FE3F491"><enum>(A)</enum><text>no individual shall be required to make a purchase in order to pick up N–95 respirator masks at such location; and</text></subparagraph><subparagraph id="id1C896F3C3A1048D78D6649DACA597A27"><enum>(B)</enum><text>the site shall agree to display information, supplied by the Administrator, in a prominent location that—</text><clause id="idF2D7EA1FAB0740AF9B3DC20C93D9F806"><enum>(i)</enum><text>advertises the availability of free N–95 respirator masks provided by the Federal Government; and</text></clause><clause id="id6489378954374910B06162512D3EC505"><enum>(ii)</enum><text>meets the requirements described in subsection (e)(2).</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="id9c2be35a0eaa47f991855c60a15d031b"><enum>(g)</enum><header>Developments in N–95 respirator masks</header><paragraph commented="no" id="id283B5D0E3BC64A1C918A7831F3694DE6"><enum>(1)</enum><header>In general</header><text>For purposes of delivering and providing the best available N–95 respirator masks under this section, the Administrator shall consider new designs to create the most comfortable, well-fitting, and effective N–95 respirator masks that—</text><subparagraph commented="no" id="idA98446D023674C80AA5E25D3596DA84C"><enum>(A)</enum><text>have adjustable sizing; or</text></subparagraph><subparagraph commented="no" id="idD27146642FFC46B8AC21CCE420A9A1E2"><enum>(B)</enum><text>are available in different sizes, including sizes for children.</text></subparagraph></paragraph><paragraph commented="no" id="id6F5F9E64D51E427E8F06B03A0B6D3298"><enum>(2)</enum><header>Flexibility</header><text>For the purpose of fulfilling the requirements of this section, the Administrator may distribute respirator masks that—</text><subparagraph commented="no" id="id393B536F9F7342A8B4587985E1F11227"><enum>(A)</enum><text>are equivalent to N–95 respirator masks; and</text></subparagraph><subparagraph id="idB7A5F6BD58534CCC8A4242E70B24080E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>have been tested by the Federal Government. </text></subparagraph></paragraph><paragraph commented="no" id="id112EDD4F178144468D881D4415A7371E"><enum>(3)</enum><header>Strategic national stockpile</header><text>If significant improvements in N–95 respirator mask technology are made available, the Administrator, in coordination with the Secretary, shall ensure that such N–95 respirator masks are included in the strategic national stockpile.</text></paragraph></subsection><subsection id="idACB8F531F3E24C3A9DF607A686B80911"><enum>(h)</enum><header>Required coordination and consultation</header><paragraph id="id54F041516EF94605BEF8D270AA727755"><enum>(1)</enum><header>Coordination</header><text>In carrying out this section, the Administrator shall coordinate with the Secretary, the Assistant Secretary, the Postmaster General, and the heads of any other appropriate Federal departments or agencies. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC3CFC4AAF22C42B9AA9FB9FA76D6F2F9"><enum>(2)</enum><header>Consultation</header><text>In carrying out this section, the Administrator shall consult with States, units of local government, pickup sites, and appropriate labor unions, including labor organizations representing employees of the United States Postal Service. </text></paragraph></subsection><subsection id="id271C2B05F785490C82BDE9E5A505FD7D"><enum>(i)</enum><header>Effect on requests for personal protective equipment</header><text>Any N–95 respirator mask provided under this section shall not be taken into account for purposes of the Federal Government responding to State or health care provider requests for surgical masks, N–95 respirator masks, personal protective equipment, or other supplies related to COVID–19. </text></subsection></section><section id="id65B096F0659C47AE977AC6DEF2BDFC53"><enum>4.</enum><header>Health care workforce</header><subsection id="idAFC6B181A86B4DF1B4687AA8207D52EA"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall provide N–95 respirator masks to all individuals working in health care settings in the United States that are experiencing a shortage of such masks, including settings that have a short-term supply of such masks and settings that are practicing extended use and re-use of such masks, if such masks are single-use masks. </text></subsection><subsection id="id2C2A152F21EC418E8F329B7DD9E77082"><enum>(b)</enum><header>No cost to persons or States</header><text>A person or State that receives N–95 respirator masks under this section shall not be charged for the masks, for the delivery of the masks, or for any other administrative cost related to the masks. </text></subsection><subsection id="id6D81836FE30A47E2883FA6D3058CDE99"><enum>(c)</enum><header>Required coordination</header><text>In carrying out this section, the Administrator shall coordinate—</text><paragraph id="id71729B0855E042B5A0009B125C0EF412"><enum>(1)</enum><text>with the Secretary, the Assistant Secretary, the Postmaster General, and the heads of any other appropriate Federal departments or agencies; and</text></paragraph><paragraph id="idB2B40D4E1BCA402AAF0C3DDA1DA901B9"><enum>(2)</enum><text>to the greatest extent practicable, with other Federal programs that provide masks or other personal protective equipment to individuals working in health care settings.</text></paragraph></subsection><subsection id="idfd5254ad26164352acb5c7d27ec30139"><enum>(d)</enum><header>Required consultation</header><text>In carrying out this section, the Administrator shall consult with health care providers and labor organizations representing health professionals and other individuals working in health care settings. </text></subsection></section><section id="id9A81189E39F146118E0AB43D61278CC2"><enum>5.</enum><header>Use of authorities</header><subsection id="idCC1D8E67D39947ACBF6CED171E957B57"><enum>(a)</enum><header>In general</header><text>In carrying out this Act—</text><paragraph id="idE04F52E26B0E41579B7276C424F7FB43"><enum>(1)</enum><text>the President shall make use of any and all available authorities at the disposal of the Federal Government to procure and domestically manufacture N–95 respirator masks and support the domestic manufacturing of N–95 respirator masks, including emergency authorities, such as the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4501">50 U.S.C. 4501 et seq.</external-xref>), the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>), and the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); and</text></paragraph><paragraph commented="no" id="idD2F8F47EAC3B46589CED6CF9FC9E95EC"><enum>(2)</enum><text>the Administrator shall make use of authorities delegated to the Administrator under title I and title III of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511 et seq.</external-xref>) to increase domestic production of N–95 respirator masks.</text></paragraph></subsection><subsection id="idB771C5D0832149F88FDECBCFBEB9CB99"><enum>(b)</enum><header>Requirement</header><text>Any N–95 respirator masks procured or manufactured for purposes of carrying out this Act shall be purchased in accordance with Federal Acquisition Regulation guidance on fair and reasonable pricing. </text></subsection><subsection id="id286A85F57C4648A4BDC7A196EA1C122E"><enum>(c)</enum><header>Excess masks</header><text>Any N–95 respirator masks in the possession of the Federal Emergency Management Agency or the Department of Health and Human Services for purposes of carrying out this Act that have not been distributed as of the date described in section 6(d) shall be added to the strategic national stockpile. </text></subsection></section><section id="id9EA37F60991A4EFB8123C8AD6BD1BB30"><enum>6.</enum><header>Appropriation; limitations</header><subsection id="id78EFA8A0294E448E854CF229F16B5E2C"><enum>(a)</enum><header>Appropriation</header><text>There is appropriated, out of amounts in the Treasury not otherwise appropriated, $5,000,000,000, to remain available until the date described in subsection (d), to the Administrator to carry out this Act, provided that the Administrator uses such amounts as are necessary to reimburse the United States Postal Service for the delivery of N–95 respirator masks under this Act. </text></subsection><subsection id="idA43D97178CCA49BBB03A6870E7A1D3AF"><enum>(b)</enum><header>Limitation</header><text>No funds made available under this section shall be provided to—</text><paragraph id="id3cb7f172cbad40ed8c0ecce629a7c1ec"><enum>(1)</enum><text>any person who is a Federal elected official or serving in a Senior Executive Service position; or</text></paragraph><paragraph id="idb1df483095414768b198256449a86f01"><enum>(2)</enum><text>any entity that is controlled in whole or in part by a Federal elected official or serving in a Senior Executive Service position. </text></paragraph></subsection><subsection id="id501E9180F8D24E5EB917EACE26588806"><enum>(c)</enum><header>Emergency designation</header><paragraph id="id030efa9d173e4e15b282fc9b0af108d5"><enum>(1)</enum><header>In general</header><text>The amounts provided under this section are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></paragraph><paragraph id="id5bdc555b83bd45df8e5f03ccc3b4b1e6"><enum>(2)</enum><header>Designation in House and Senate</header><text>This section is designated as an emergency requirement pursuant to subsections (a) and (b) of section 4001 of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022. </text></paragraph></subsection><subsection id="idaaf73ef57ba44a9b9b5208e0c3fd985f"><enum>(d)</enum><header>Date described</header><text>The date described in this subsection is the date on which no new cases of COVID–19 are reported in the United States for a period of not less than 14 consecutive days. </text></subsection></section><section id="idD292B56CD3DC42A0901EA0D9524CFD3D"><enum>7.</enum><header>Reports to Congress</header><subsection id="idB9FAB51F7F5F4FFF8CA8202E4551A099"><enum>(a)</enum><header>Submission of plan</header><text display-inline="yes-display-inline">Not later than 14 days after the date of enactment of this Act, the Administrator shall submit to Congress a strategic plan that includes monthly, measurable targets, to, as soon as practicable—</text><paragraph id="id5BBCFB1D735B4777B06EBE14D83E65F5"><enum>(1)</enum><text display-inline="yes-display-inline"> eliminate all shortages of N–95 respirator masks; </text></paragraph><paragraph id="idD6A27B947223405DB4DA71024E69A081"><enum>(2)</enum><text display-inline="yes-display-inline">increase domestic production of N–95 respirator masks to the greatest extent possible; </text></paragraph><paragraph id="idFB90DAA663674AFB920602A825145E48"><enum>(3)</enum><text>provide the greatest number possible of N–95 respirator masks manufactured in the United States; </text></paragraph><paragraph id="id18049DCCAAD24860BCEB0CF6C3D9A90F"><enum>(4)</enum><text display-inline="yes-display-inline">distribute N–95 respirator masks to the general public and the health care workforce in accordance with this Act; and </text></paragraph><paragraph id="idBB37E0BD6F0B4DC584C7A5489041C234"><enum>(5)</enum><text display-inline="yes-display-inline">fulfill all other requirements of this Act. </text></paragraph></subsection><subsection id="id2E4329381F24451297D279A884F10256"><enum>(b)</enum><header>Weekly progress reports</header><text display-inline="yes-display-inline">Beginning 7 days after the date on which the strategic plan is submitted under subsection (a), and every 7 days thereafter until the requirements of this Act are met, the Administrator shall submit to Congress a detailed report on the activities undertaken to fulfill the requirements of this Act and a timeline for when such requirements will be fulfilled, which shall include—</text><paragraph id="id3CBFED63348740F89D0E0F2A52F666C8"><enum>(1)</enum><text display-inline="yes-display-inline">information on—</text><subparagraph id="id97ae1c2e970147ee8198939367b43067"><enum>(A)</enum><text>the use of funds under this Act, provided in an itemized list;</text></subparagraph><subparagraph id="idc47d85408b3544ecafad99f9fc1a553b"><enum>(B)</enum><text>the current and projected supply of N–95 respirator masks; </text></subparagraph><subparagraph id="idA0AD0CF589F44CA2A5B4218640514E3F"><enum>(C)</enum><text>the sources of N–95 respirator masks; </text></subparagraph><subparagraph id="id311c11a23e0446e7bf9eea164b360ae1"><enum>(D)</enum><text>the distribution of N–95 respirator masks by State, geographic area, and need; and</text></subparagraph><subparagraph id="id5d7a6c14552f4388847d325ad6ee8bf9"><enum>(E)</enum><text>the prices paid by the Federal Government and to which suppliers such amounts were paid; and</text></subparagraph></paragraph><paragraph id="id6DC36FED7C56494E90EB4DC2EB6178D4"><enum>(2)</enum><text>any other information requested by Congress. </text></paragraph></subsection><subsection id="id84FB76BD55984E9ABA757297DCFEF545"><enum>(c)</enum><header>Inspector General Oversight</header><paragraph id="id11486192BF384488B10288B4E542CBD0"><enum>(1)</enum><header>In general</header><text>The Inspector General of the Department of Homeland Security shall conduct monitoring and oversight of the receipt, disbursement, and use of funds made available under this Act.</text></paragraph><paragraph id="idD47150729AE44EEEB5BA55097BB673BB"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date described in section 6(d), the Inspector General of the Department of Homeland Security shall conduct an audit of the program established under this Act and submit to Congress a report on the findings of such audit. </text></paragraph></subsection></section><section id="idBA58C9259BCF4C859BC036119640EBA5"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id64126BD9A42B489287CFEE138C5408D8"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="id61E799C486744262932215460C93D561"><enum>(2)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary for Preparedness and Response of the Department of Health and Human Services. </text></paragraph><paragraph id="idCF4CDB180A5E4FDABD5BD6AE3F5924CA"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text></paragraph><paragraph id="id5ADC52E5BE2A4E24AEB6ABE63F53ECE4"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph id="id81CE2F5F553845F791D20220D839531A"><enum>(5)</enum><header>Senior Executive Service position</header><text>The term <term>Senior Executive Service position</term> has the meaning given that term in section 3132(a) of title 5, United States Code.</text></paragraph><paragraph id="idC00596CDC17F44A0A23756DF919E1E28"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="idD0388BDA14B74C89A805E1489F8B9C25"><enum>(A)</enum><text>any State of the United States;</text></subparagraph><subparagraph id="id19E2D4D06F5C4C22B45762E11C190EE3"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="id23A5B16BE2F04741A75263DC3E8D51B9"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="id0A2797D1365645D38BAEAAF556DBE2A2"><enum>(D)</enum><text>Guam;</text></subparagraph><subparagraph id="id15D1FDBA0A324A9184B2FAD543772AFC"><enum>(E)</enum><text>American Samoa;</text></subparagraph><subparagraph id="idC5726A2CAE2D42A8BD90300A9AD34A19"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph id="idA0566A4F730640F5A986DC61FC98FF4F"><enum>(G)</enum><text>the Federated States of Micronesia;</text></subparagraph><subparagraph id="id9A990ECF9FBE48EAA27A93B00080348F"><enum>(H)</enum><text>the Republic of the Marshall Islands;</text></subparagraph><subparagraph id="id0307BE5159914A9CA2BCF0DF7BBA0222"><enum>(I)</enum><text>the Republic of Palau;</text></subparagraph><subparagraph id="id4A89728960B84A16A4133DEB52C1E008"><enum>(J)</enum><text>the United States Virgin Islands;
