<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3481</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220112" legis-day="20220110">January 12 (legislative day, January 10), 2022</action-date><action-desc><sponsor name-id="S374">Mr. Cotton</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To secure the dignity and safety of incarcerated women.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id45aa2d93478141bf838e7ffe2cf2c96f"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Violence Against Female Inmates Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="id69BB1C574C044033996A02C0B4ED712C"><enum>2.</enum><header>Housing prisoners based on sex</header><subsection id="idC921D8856B564F1B8758897646BAB802"><enum>(a)</enum><header>Federal prisons</header><paragraph id="id1C73EAF6ED5B46F48BB16D7768A1F738"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/303">Chapter 303</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idCDD3543B84854164979F491400D8271E"><section id="idD4A08801853540FBB4980125157B66BA"><enum>4051.</enum><header>Bar on housing together prisoners of different sexes</header><subsection id="id999AE737B0EE45519CFE04F816BF9431"><enum>(a)</enum><header>Definitions</header><text>In this section: </text><paragraph id="idead364c688764ced85924e447eed0ad9"><enum>(1)</enum><header>Biological sex</header><text>The term <term>biological sex</term> means the biological classification of male and female in the context of reproductive potential or capacity, as indicated by sex chromosomes, naturally occurring sex hormones, gonads, and nonambiguous internal and external genitalia present at birth, without regard to a person’s psychological, chosen, or subjectively experienced sense of identity or gender.</text></paragraph><paragraph id="idb3b84ed334084f9caefe1868c6e42353"><enum>(2)</enum><header>Gender identity</header><text>The term <term>gender identity</term> means a person’s self-perceived identity, self-concept, or asserted gender, regardless of the person’s biological sex.</text></paragraph></subsection><subsection id="idFB2C34222DFA4A9CBB2CD01BB4DD83A8"><enum>(b)</enum><header>Bar</header><text>The Bureau of Prisons—</text><paragraph id="id0920451a831643368168c9eb5409e614"><enum>(1)</enum><text>shall use the biological sex of persons charged with or convicted of offenses against the United States in making determinations regarding housing such persons; and</text></paragraph><paragraph id="id3296452149524e90986de207f514929b"><enum>(2)</enum><text>shall not co-locate in detention facilities persons charged with or convicted of offenses against the United States if those persons are not of the same biological sex, unless the Bureau of Prisons co-locates such persons without regard to their purported gender identity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idE2867726D525400386C5151E45CF9FB8"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/303">chapter 303</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="id6f869ebb-1447-4023-ae5a-4f6e54518938"><toc><toc-entry level="section" idref="idD4A08801853540FBB4980125157B66BA">4051. Bar on housing together prisoners of different sexes.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1D6EE91BB830458CBCD3266D1A56D5A1"><enum>(b)</enum><header>State prisons</header><text>Section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9a5eba4c57042409b87d23770bc4960"><subsection id="idc6d2ddd67c4d4085aa9b0b6430102df1"><enum>(h)</enum><header>Bar on housing together prisoners of different sexes</header><paragraph id="idf112e748abc74019b2bed19a0eeeaf74"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the terms <term>biological sex</term> and <term>gender identity</term> have the meanings given such terms in section 4051 of title 18, United States Code.</text></paragraph><paragraph id="id1ba3e69c35a7493daa934dcbe3f60d10"><enum>(2)</enum><header>Limitation on eligibility for funds</header><text>Beginning in the first fiscal year beginning after the date of enactment of this subsection, a State may not receive funds under this subpart for a fiscal year if the State does not submit to the Attorney General a certification that the State—</text><subparagraph id="id299B773DD4994312A9DBC328D47BED64"><enum>(A)</enum><text>prohibits co-locating in detention facilities persons charged with or convicted of offenses under the law of the State if those persons are not of the same biological sex, unless the State co-locates such persons without regard to their purported gender identity; and</text></subparagraph><subparagraph id="idBFFC879222FE418EB0AD92A3BECABA9A"><enum>(B)</enum><text>requires the use of the biological sex of persons charged with or convicted of offenses under the law of the State in making determinations regarding housing such persons.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
