which was read the first time</action-desc></action><action><action-date>January 18, 2022</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of funds to reduce the nuclear forces of the United States.</official-title></form><legis-body><section id="idd3181f850c8744139f42a10253b82aa4" section-type="section-one"><enum>1.</enum><header>Prohibition on the use of funds to reduce United States nuclear forces</header><subsection id="id9cb30514b8c345ae8637fbd60979de4e"><enum>(a)</enum><header>Prohibition</header><text>None of the funds authorized to be appropriated to the Department of Defense or the National Nuclear Security Administration for any of fiscal years 2022 through 2027 may be obligated or expended to reduce—</text><paragraph id="ide470c052d5e341698120649a4abcaccf"><enum>(1)</enum><text>the total quantity of strategic delivery systems below the quantity of such systems as of January 1, 2021; </text></paragraph><paragraph id="idbd8bf792bb2644c1a62ac1c6e7e4340c"><enum>(2)</enum><text>the quantity of deployed or non-deployed strategic delivery systems below the quantities described as the <quote>Final New START Treaty Force Structure</quote> in the plan on the implementation of the New START Treaty required by section 1042 of the National Defense Authorization Act for Fiscal Year 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/81">Public Law 112–81</external-xref>; 125 Stat. 1575); or</text></paragraph><paragraph id="id0e4522a537ab41f8ab452a60be66284f"><enum>(3)</enum><text>the size of the nuclear weapons stockpile below the size of the stockpile as of January 1, 2021.</text></paragraph></subsection><subsection id="ide6295b8f3e2f419289794bbe729363cd"><enum>(b)</enum><header>Exceptions</header><text>The prohibition under subsection (a) does not apply to—</text><paragraph id="id8125e6fccc9b400fba5587b6180417fb"><enum>(1)</enum><text>reductions made to ensure the safety, security, reliability, and credibility of the nuclear weapons stockpile and strategic delivery systems, including activities related to surveillance, assessment, certification, testing, and maintenance of nuclear weapons and strategic delivery systems; </text></paragraph><paragraph id="id628725d0104a4904bd19f01799f385cc"><enum>(2)</enum><text>temporary reductions in the quantity of nuclear weapons or deployed strategic delivery systems to facilitate the fielding of modernized replacements;</text></paragraph><paragraph id="id170456c71e7349b4a62f1a8956815b18"><enum>(3)</enum><text>nuclear weapons that are retired or awaiting dismantlement as of January 1, 2021; or</text></paragraph><paragraph id="ide404d65f5f544acda946ee9d82f95e70"><enum>(4)</enum><text>reductions made pursuant to a treaty with respect to which the Senate has provided its advice and consent pursuant to article II, section 2, clause 2 of the Constitution of the United States. </text></paragraph></subsection><subsection id="id998cd95f23c84349ab63dfb0d80929a0"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idee6c2c46b01b427fa04e650b99a5f42a"><enum>(1)</enum><header>New START Treaty</header><text>The term <term>New START Treaty</term> means the Treaty between the United States of America and the Russian Federation on Measures for the Further Reduction and Limitation of Strategic Offensive Arms, signed on April 8, 2010, and entered into force on February 5, 2011.</text></paragraph><paragraph id="id217600b77f974469b746c4009e516841"><enum>(2)</enum><header>Strategic delivery system</header><text>The term <term>strategic delivery system</term> means any of the following:</text><subparagraph id="idf250129dd7ff42e08dbd827e13e8675a"><enum>(A)</enum><text>LGM–30G Minuteman III intercontinental ballistic missiles and any associated reentry vehicles.</text></subparagraph><subparagraph id="id8c9582b2cad244559365fd86bf0fb250"><enum>(B)</enum><text>Launch facilities for LGM–30G Minuteman III intercontinental ballistic missiles, whether deployed or non-deployed. </text></subparagraph><subparagraph id="ida9c2e20fb2b34b61a191e007bc9da63e"><enum>(C)</enum><text>Ohio-class fleet ballistic missile submarines.</text></subparagraph><subparagraph id="idcef9a2c76c6946f1a9e921e19b16fb89"><enum>(D)</enum><text>UGM–133 Trident II submarine-launched ballistic missiles and any associated reentry vehicles.</text></subparagraph><subparagraph id="id331679470c6d43518236e92932c50f82"><enum>(E)</enum><text>B–52H Stratofortress long-range heavy bombers.</text></subparagraph><subparagraph id="id356e3d886b5d48e9899151a5ff0144ff"><enum>(F)</enum><text>B–2A Spirit stealth bombers.</text></subparagraph><subparagraph id="idb5e8a7fa18204aa99a1e847d080a297e"><enum>(G)</enum><text>AGM–86B air-launched cruise missiles.</text></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date>January 18, 2022</action-date><action-desc>Read the second time and placed on the calendar</action-desc></endorsement></bill>
