which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To conserve global bear populations by prohibiting the importation, exportation, and interstate trade of bear viscera and items, products, or substances containing, or labeled or advertised as containing, bear viscera, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAD5777A91F204A7FBA11B72A5F495C63"><section display-inline="no-display-inline" section-type="section-one" id="H4D9A698313F0478DA2FB6877A679FB9F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bear Poaching Elimination Act of 2022</short-title></quote>.</text></section><section id="HFEDF461C4D99499FB3E9976E8CB58566"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HC09BEBD317E841C7B25DD48071450DE6"><enum>(1)</enum><text>all 8 extant species of bear—Asian black bear, brown bear, polar bear, American black bear, spectacled bear, giant panda, sun bear, and sloth bear—are listed on appendix I or II of CITES;</text></paragraph><paragraph id="H5C0A27491D344F4BA62DBF189DDA2B61"><enum>(2)</enum><text>Article XIV of CITES provides that Parties to CITES may adopt stricter domestic measures regarding the conditions for trade, taking, possession, or transport of species listed on appendix I or II of CITES, and the Parties to CITES adopted a resolution in 1997 (Conf. 10.8) urging the Parties to take immediate action to demonstrably reduce the illegal trade in bear parts;</text></paragraph><paragraph id="HE7C60089AEBE4B248043E269F0386998"><enum>(3)</enum><text>thousands of bears in Asia are cruelly confined in small cages to be milked for their bile, and the wild Asian bear population has declined significantly in recent years as a result of habitat loss and poaching due to a strong demand for bear viscera used in traditional medicines and cosmetics;</text></paragraph><paragraph id="H19B3A622E9B54D64A149396E7A02F49F"><enum>(4)</enum><text>Federal and State undercover operations have revealed that American bears have been poached for their viscera;</text></paragraph><paragraph id="H97A75D2455A94FA3B7CF4973CBF9DB9F"><enum>(5)</enum><text>while most American black bear populations are generally stable or increasing, commercial trade could stimulate poaching and threaten certain populations if the demand for bear viscera increases; and</text></paragraph><paragraph id="H27E669F8651148159E5C7C0E210B7614"><enum>(6)</enum><text>prohibitions against the importation into the United States and exportation from the United States, as well as prohibitions against the interstate trade, of bear viscera and products containing, or labeled or advertised as containing, bear viscera will assist in ensuring that the United States does not contribute to the decline of any bear population as a result of the commercial trade in bear viscera.</text></paragraph></section><section id="H60D6ED4C957348E3BE5EA8DED56AA46B"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this Act is to ensure the long-term viability of the 8 bear species of the world by—</text><paragraph id="H130F3856B1F943569AB43192FB02F9C0"><enum>(1)</enum><text>prohibiting interstate and international trade in bear viscera and products containing, or labeled or advertised as containing, bear viscera;</text></paragraph><paragraph id="HD8C928C0B8D14BB39DCECD61B93ED31C"><enum>(2)</enum><text>encouraging bilateral and multilateral efforts to eliminate that trade; and</text></paragraph><paragraph id="H0C9FAAE6E53F412AB65ECB7B1EAC32C6"><enum>(3)</enum><text>ensuring that adequate Federal legislation exists with respect to domestic trade in bear viscera and products containing, or labeled or advertised as containing, bear viscera.</text></paragraph></section><section id="HE6FB70FA0ED64215A486D159C4262195"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H216968D592614558AF15668C5A83F2D7"><enum>(1)</enum><header>Bear viscera</header><text>The term <term>bear viscera</term> means the body fluids or internal organs, including the gallbladder and the contents of the gallbladder, but not including the blood or brains, of a species of bear.</text></paragraph><paragraph id="id8345C4FC06B9441685DD4E7F6DE557D5"><enum>(2)</enum><header>CITES</header><text>The term <term>CITES</term> means the Convention on International Trade in Endangered Species of Wild Fauna and Flora (27 UST 1087; TIAS 8249).</text></paragraph><paragraph id="H01767D57A5AA4F288175C11CB721EC62"><enum>(3)</enum><header>Import</header><text>The term <term>import</term> means to land on, bring into, or introduce into any place subject to the jurisdiction of the United States, whether or not the landing, bringing, or introduction constitutes an importation within the meaning of the customs laws of the United States.</text></paragraph><paragraph id="HE49493C2729145D4AC7F33D82AEF55A5"><enum>(4)</enum><header>Person</header><text>The term <term>person</term> means—</text><subparagraph id="HB5D1D4C0D1F740048C2BC916AD679626"><enum>(A)</enum><text>an individual, corporation, partnership, trust, association, or other private entity;</text></subparagraph><subparagraph id="H45452030D7154B0A880A4DB881941B21"><enum>(B)</enum><text>an officer, employee, agent, department, or instrumentality of—</text><clause id="HB47784F510D54CF890D2891751A9E5EF"><enum>(i)</enum><text>the Federal Government;</text></clause><clause id="HFDA4AFC0E8904701B4E455B4D12F6AD0"><enum>(ii)</enum><text>any State, municipality, or political subdivision of a State; or</text></clause><clause id="H00DF5564B38F45658F494D7C7396B8ED"><enum>(iii)</enum><text>any foreign government; and</text></clause></subparagraph><subparagraph id="HE850BB240D6E4A868108EE07943C33CD"><enum>(C)</enum><text>any other entity subject to the jurisdiction of the United States.</text></subparagraph></paragraph><paragraph id="H5678060AA9B94C80A85AE1F416B1AE55"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="HD501A2EC9543419483978A94C8983A76"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, and any other territory, commonwealth, or possession of the United States.</text></paragraph><paragraph id="HBE0AEDA9AE6F4E6A96267B06362E6919"><enum>(7)</enum><header>Transport</header><text>The term <term>transport</term> means—</text><subparagraph id="id736875A3AB1B403BB89E38B686773B24"><enum>(A)</enum><text>to move, convey, carry, or ship by any means; and</text></subparagraph><subparagraph id="id1C6CF03649EB41279E2C81DBD53C2992"><enum>(B)</enum><text>to deliver or receive for the purpose of movement, conveyance, carriage, or shipment.</text></subparagraph></paragraph></section><section id="H98BC40A19773406EA7F929A0D530F6FE"><enum>5.</enum><header>Prohibited acts</header><subsection id="HE1869ABBAF52444888FCB55F4E7E48C4"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), it shall be unlawful for a person to knowingly—</text><paragraph id="H6D737D51E77C49ADA4D5A7225E535675"><enum>(1)</enum><text>import into, or export from, the United States bear viscera or any product, item, or substance containing, or labeled or advertised as containing, bear viscera; or</text></paragraph><paragraph id="HD7B6A4CED4BB45139C9F8C3ACAA83A4A"><enum>(2)</enum><text>sell or barter, offer to sell or barter, purchase, possess, transport, deliver, or receive, in interstate or foreign commerce, bear viscera or any product, item, or substance containing, or labeled or advertised as containing, bear viscera.</text></paragraph></subsection><subsection id="HE7CFD209AA9B4F6499D45415DA62668B"><enum>(b)</enum><header>Exception for wildlife law enforcement purposes</header><text>A person described in section 4(4)(B) may import into, or export from, the United States, or transport between States, bear viscera or any product, item, or substance containing, or labeled or advertised as containing, bear viscera if the importation, exportation, or transportation—</text><paragraph id="H2D2078CC6F92427FA0DF92C7903BDBBB"><enum>(1)</enum><text>is solely for purposes of enforcing laws relating to the protection of wildlife; and</text></paragraph><paragraph id="H47939BBE2D8D4BB7BA2800980A649DC9"><enum>(2)</enum><text>is authorized by a valid permit issued under appendix I or II of CITES, in any case in which such a permit is required under CITES.</text></paragraph></subsection></section><section id="HE1372DF08EAC4DC0898D562276D6ABBA"><enum>6.</enum><header>Penalties and enforcement</header><subsection id="H280C89418ACF4FA09B0788022230F895"><enum>(a)</enum><header>Criminal penalties</header><text>A person that violates section 5 shall be fined under title 18, United States Code, imprisoned not more than 1 year, or both.</text></subsection><subsection id="H69498EAAD462424FA9A780AB1CCC85DB"><enum>(b)</enum><header>Civil penalties</header><paragraph id="H27FA1D7C84F349B98361230FDF3D42FD"><enum>(1)</enum><header>Amount</header><text>A person that violates section 5 may be assessed a civil penalty by the Secretary of not more than $25,000 for each violation.</text></paragraph><paragraph id="HFF840BEC85C6428E8DD6CE0C642031CB"><enum>(2)</enum><header>Manner of assessment and collection</header><text>A civil penalty under this subsection shall be assessed, and may be collected, in the manner in which a civil penalty under the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) may be assessed and collected under section 11(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1540">16 U.S.C. 1540(a)</external-xref>).</text></paragraph></subsection><subsection id="H8A86875FAD6C485BA8E3887C42A28A4D"><enum>(c)</enum><header>Seizure and forfeiture</header><text>Any bear viscera or any product, item, or substance exported, imported, sold, bartered, attempted to be exported, imported, sold, or bartered, offered for sale or barter, purchased, possessed, transported, delivered, or received in violation of this section (including any regulation issued under this section) shall be seized and forfeited to the United States.</text></subsection><subsection id="H06094DEAB2AC4242BEAE27B62C7D59E5"><enum>(d)</enum><header>Regulations</header><text>After consultation with the Secretary of the Treasury and the United States Trade Representative, the Secretary shall issue such regulations as are necessary to carry out this section.</text></subsection><subsection id="H506C4E9CF26E433EB2047F76D7ED2719"><enum>(e)</enum><header>Enforcement</header><text>The Secretary, the Secretary of the Treasury, and the Secretary of the department in which the Coast Guard is operating shall enforce this section in the manner in which the Secretaries carry out enforcement activities under section 11(e) of the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1540">16 U.S.C. 1540(e)</external-xref>).</text></subsection><subsection id="HD3BBD7D62A064998B6FB8925B70FC3E1"><enum>(f)</enum><header>Use of penalty amounts</header><text>Amounts received as penalties, fines, or forfeiture of property under this section shall be used in accordance with section 6(d) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3375">16 U.S.C. 3375(d)</external-xref>).</text></subsection></section><section id="HDBF94E9B63F346CDB376A426BA74BD88"><enum>7.</enum><header>Discussions concerning bear conservation and the bear parts trade</header><text display-inline="no-display-inline">The Secretary shall continue discussions concerning trade in bear viscera with the appropriate representatives of Parties to CITES and representatives of countries that are not party to CITES that are determined by the Secretary and the United States Trade Representative to be the leading importers, exporters, or consumers of bear viscera, to seek to establish coordinated efforts with those countries to protect bears.</text></section><section id="H55F9BC03DE4443A6B5E09213FD8DC589"><enum>8.</enum><header>Certain rights not affected</header><text display-inline="no-display-inline">Except as provided in section 5, nothing in this Act affects—</text><paragraph id="id5D91998A022A410BAEC38730361B4EEA"><enum>(1)</enum><text display-inline="yes-display-inline">the regulation by any State of the bear population of that State; or</text></paragraph><paragraph id="id9EDDC4FF5CEE4742985D1AEC17E3C0EA"><enum>(2)</enum><text display-inline="yes-display-inline">the hunting of bears that is lawful under applicable State laws (including regulations).</text></paragraph></section></legis-body></bill>
