<section id="S1" section-type="section-one"><enum>1.</enum><header>Prohibition on promulgating any rule or guidance that bans hydraulic fracturing in the United States</header>
<subsection id="id76CABB76AC8D449BA3F4EDAFBF8BB173"><enum>(a)</enum><header>Definition of hydraulic fracturing</header><text>In this section, the term <term>hydraulic fracturing</term> means a process that—</text> <paragraph id="idBFA685DDEFC948D3A2C99EFD37E4E0D2"><enum>(1)</enum><text>stimulates or increases the production and ultimate recovery of oil or natural gas from a well by pumping a fluid and a proppant (such as sand or similar material) at high pressure into a well to create fractures in the reservoir that the proppant holds open; and</text></paragraph>
<paragraph id="idCA549D33C5524F2599E9168B8B12F962"><enum>(2)</enum><text>increases the surface of the formation available for oil and natural gas to flow into the wellbore. </text></paragraph></subsection> <subsection id="id2626B67CB09A489B80621D965DDEB711"><enum>(b)</enum><header>Prohibition</header><text>No Federal agency may propose, implement, or finalize a rule or guidance that bans hydraulic fracturing in the United States.</text></subsection></section>
