<official-title>To codify the temporary scheduling order for fentanyl-related substances by adding fentanyl-related substances to schedule I of the Controlled Substances Act.</official-title>

<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Americans from Fentanyl Trafficking Act of 2022</short-title></quote>.</text></section> <section id="idF1AB91100CE6431F9AB975D03FC30AFD"><enum>2.</enum><header>Placement of fentanyl-related substances in schedule I</header> <subsection id="idC7211EA1229643B59866272FAC8D1FCE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Schedule I of section 202(c) of the Controlled substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended by adding at the end the following:</text>

<subsection id="id2ff0881514a546a8a31fc6e3bdc1a133"><enum>(e)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="id7CC47DC075004EF8BECBBFC3D3841AEB"><enum>(1)</enum><text>Fentanyl-related substances, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers.</text></paragraph> <paragraph id="idfeb594975e7549c08dcda4e35e07cd3e" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the term <term>fentanyl-related substance</term> means any substance that—</text>
<subparagraph id="id3F42812524DD4C1AB910961E49E68938"><enum>(A)</enum><text>is not listed in another schedule;</text></subparagraph> <subparagraph id="id408C83BEA781475DB62248ADA1AAC85E"><enum>(B)</enum><text>has not been approved under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) or granted an exemption for investigational use under subsection (i) of such section 505; and</text></subparagraph>
<subparagraph id="idEC9CAE0A945445D5933F983A6255377D"><enum>(C)</enum><text>is structurally related to fentanyl by—</text> <clause id="id5475bd1971c34a0f8f3efbbf79b1e5a1"><enum>(i)</enum><text>replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted in or on the monocycle;</text></clause>
<clause id="ide047ebd3a92d4b0690d1a5196c79e754"><enum>(ii)</enum><text>substitution in or on the phenethyl group with alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino, or nitro groups;</text></clause> <clause id="idd27cd8ad71b342c599ec44caccc23d64"><enum>(iii)</enum><text>substitution in or on the piperidine ring with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl, amino, or nitro groups;</text></clause>
<clause id="id3b92de445514483faea5f3a8be03399a"><enum>(iv)</enum><text>replacement of the aniline ring with any aromatic monocycle, whether or not further substituted in or on the aromatic monocycle; or</text></clause> <clause id="id8d142e740883430f8bb388f27e6d6fa7"><enum>(v)</enum><text>replacement of the N-propionyl group by another acyl group.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="idEDA45F5A460243CFB5FB3017531AE9C3"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on January 28, 2022.</text></subsection></section> </legis-body> <endorsement> <action-date>January 18, 2022</action-date> <action-desc>Read the second time and placed on the calendar</action-desc></endorsement> </bill>
