<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 235</calendar><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3455</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>January 10, 2022</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> introduced the following bill; which was read the first time</action-desc></action><action><action-date>January 18, 2022</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the implementation of new requirements to report bank account deposits and withdrawals.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H22864D1EE8F1492FB930793C00DFF21B"><section section-type="section-one" id="H56A696CBD0234B3885EFC8D90BF5CF2E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting IRS Financial Surveillance Act</short-title></quote>.</text></section><section id="HB13129D792444E6EB16B6D08B24B6B71"><enum>2.</enum><header>Prohibition on new requirements to report bank account deposits and withdrawals</header><subsection id="id13F562D9E9284347BE89FB3F119E7683"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury (including any delegate of the Secretary) may not require any financial institution to report—</text><paragraph id="id0C583FEE22C64493ADF0FF0F923BD2A5"><enum>(1)</enum><text display-inline="yes-display-inline">the inflows or outflows of any account maintained by such institution, or</text></paragraph><paragraph id="idDDD4F7932FB74C1DA6D3B45347345B37"><enum>(2)</enum><text>any balances, transactions, transfers, or similar information with respect to any such account,</text></paragraph><continuation-text continuation-text-level="subsection">except to the extent that such reporting is required under any program, or other provision of law, as in effect on the date of the enactment of this Act.</continuation-text></subsection><subsection id="idAA3E7D9B99344BE7BBFF987449C017E3"><enum>(b)</enum><header>Effective date</header><text>The provisions of this section shall take effect on the day after the date of enactment of this Act.</text></subsection></section></legis-body><endorsement><action-date>January 18, 2022</action-date><action-desc>Read the second time and placed on the calendar</action-desc></endorsement></bill>
