which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide increased oversight of certain pardons, to clarify the applicability of bribery prohibitions to pardons and commutations, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abuse of the Pardon Prevention Act of 2022</short-title></quote>.</text></section><section id="id1609ad6b19844e22a0a379dcbb4b4726"><enum>2.</enum><header>Department of Justice oversight relating to certain pardons</header><subsection id="id5fb3e07d4fc54b31ad0c4c7d2baea7b3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idab06f933d2254fbab4bd3bbb2689dfc6"><enum>(1)</enum><header>Covered offense</header><text>The term <term>covered offense</term> means—</text><subparagraph id="id7b4d6d391d634156a8fb6e4825caf50a"><enum>(A)</enum><text>an offense against the United States that arises from an investigation in which the President, or a relative of the President, is a target, subject, or witness;</text></subparagraph><subparagraph id="id95604a6d8ff346f7bf1bcf11804fda3c"><enum>(B)</enum><text>an offense under section 192 of title 2, United States Code; or</text></subparagraph><subparagraph id="idf28d024c3c3c42b5bc3a2778d403e211"><enum>(C)</enum><text>an offense under section 1001, 1505, 1512, or 1621 of title 18, United States Code, provided that the offense occurred in relation to a Congressional proceeding or investigation.</text></subparagraph></paragraph><paragraph id="idA1F659B0B7A74097BAFC9A43175D4D96"><enum>(2)</enum><header>Inspector General</header><text>The term <term>Inspector General</term> means the Inspector General of the Department of Justice. </text></paragraph><paragraph id="id027308f2a984467e9dc3ba449da9bcfd"><enum>(3)</enum><header>Pardon</header><text>The term <term>pardon</term> includes a commutation of sentence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4df7e0e40e1447e2827ac85b0ffc18e7"><enum>(4)</enum><header>Relative</header><text>The term <term>relative</term> has the meaning given that term in section 3110(a) of title 5, United States Code. </text></paragraph></subsection><subsection id="id20e7e44c5052425dbbddf75cb426c38e"><enum>(b)</enum><header>Required investigation</header><text>In the event that the President grants an individual a pardon for a covered offense, as soon as practicable after the date of such pardon, the Inspector General of the Department of Justice shall begin an investigation of the pardon. </text></subsection><subsection id="id7B6AFDDD46E5416188A5CBB7BA948990"><enum>(c)</enum><header>Required information</header><paragraph id="idCF6DCB67F3234B8097581011403198B4"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which the President grants an individual a pardon for a covered offense, for purposes of an investigation under subsection (b)— </text><subparagraph id="idA022F77594A048FA847755E7591E6531"><enum>(A)</enum><text>the Attorney General shall submit to the Inspector General—</text><clause id="ida8f79c1b8e8f4568af849f6f308efadb"><enum>(i)</enum><text>all materials obtained or prepared by the prosecution team, including the Attorney General and any United States Attorney, and all materials obtained or prepared by any investigative agency of the United States government, relating to the offense for which the individual was so pardoned; and</text></clause><clause id="id3a25446d261c43bcb0001166c9c1b142"><enum>(ii)</enum><text>all materials obtained or produced by the Department of Justice in relation to the pardon; and</text></clause></subparagraph><subparagraph id="id6cb236ae705c468e8222d7361fd856b7"><enum>(B)</enum><text>the President shall submit to the Inspector General all materials obtained or produced within the Executive Office of the President in relation to the pardon.</text></subparagraph></paragraph><paragraph id="id49053CC45A44456EBB35082E904D9E17"><enum>(2)</enum><header>Report on noncompliance</header><text>Not later than 10 days after the date on which the Attorney General or President fails or refuses to comply with the requirement under paragraph (1), the Inspector General shall submit a report to Congress on the failure or refusal, which shall include a list of the documents or information that has not been submitted as required under paragraph (1). </text></paragraph></subsection><subsection id="id7b41024f42314bf5a1e5900fd7bd3f87"><enum>(d)</enum><header>Treatment of information</header><text>Rule 6(e) of the Federal Rules of Criminal Procedure may not be construed to prohibit the disclosure of information required by subsection (c) of this section.</text></subsection><subsection id="id0BFEA34AA5F44ECDAB3AF970C5E9A02E"><enum>(e)</enum><header>Report</header><paragraph id="id1253CFBD008A400789B9D059A7461BF8"><enum>(1)</enum><header>In general</header><text>The Inspector General shall submit to Congress and publish a report of the findings of each investigation conducted under this section. </text></paragraph><paragraph id="id0EFC2173987B42A0857E70B8A9C2787E"><enum>(2)</enum><header>Form of report</header><text>Each report submitted to Congress under this subsection shall be in unclassified form, but may, if necessary, contain a classified annex.</text></paragraph></subsection></section><section section-type="subsequent-section" id="H92754CFE0C6E4575A313DD2C0333C8BE"><enum>3.</enum><header>Congressional oversight relating to certain pardons</header><subsection id="HDDF753A0B6F94E57AB4F4215D5B50A22"><enum>(a)</enum><header>Submission of information</header><text display-inline="yes-display-inline">In the event that the President grants an individual a pardon for a covered offense, not later than 30 days after the date of such pardon—</text><paragraph id="H0BB33A211EE5430D9B9610C0982273AC"><enum>(1)</enum><text>the Attorney General shall submit to the chairmen and ranking members of the appropriate congressional committees—</text><subparagraph id="HFDE3FBC0DD0346B09C820BEFF886E897"><enum>(A)</enum><text display-inline="yes-display-inline">all materials obtained or prepared by the prosecution team, including the Attorney General and any United States Attorney, and all materials obtained or prepared by any investigative agency of the United States government, relating to the offense for which the individual was so pardoned; and</text></subparagraph><subparagraph id="HBD725E4EFCAC4C0B80EB3A7E0A0DE22A"><enum>(B)</enum><text>all materials obtained or produced by the Department of Justice in relation to the pardon; and</text></subparagraph></paragraph><paragraph id="H6D05A7A968D240E2A7D7287C26FBF3D8"><enum>(2)</enum><text display-inline="yes-display-inline">the President shall submit to the chairmen and ranking members of the appropriate congressional committees all materials obtained or produced within the Executive Office of the President in relation to the pardon.</text></paragraph></subsection><subsection commented="no" id="HF71508EAB203410198BDE5C9CFCECB4D"><enum>(b)</enum><header>Treatment of information</header><text>Rule 6(e) of the Federal Rules of Criminal Procedure may not be construed to prohibit the disclosure of information required by subsection (a) of this section.</text></subsection><subsection id="H74944A56F9054900B8054DA7B5CEF835"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H76235E1559F242258FAE08F01DEFC191"><enum>(1)</enum><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H4A8DCC9AC2AE42CB8FC1EF236337A85A"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate; and</text></subparagraph><subparagraph id="HDCE57106A1D0444A88C56DE101E9EEC6"><enum>(B)</enum><text display-inline="yes-display-inline">if an investigation relates to intelligence or counterintelligence matters, the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph><paragraph id="HFACFCFC543FF4336B3E7A5E82691B7D6"><enum>(2)</enum><text>The term <term>covered offense</term> means—</text><subparagraph id="HE050C312EA4B44BAA0FAF84F9886B8D8"><enum>(A)</enum><text display-inline="yes-display-inline">an offense against the United States that arises from an investigation in which the President, or a relative of the President, is a target, subject, or witness;</text></subparagraph><subparagraph id="H37B2EA846D734F83844AF27966FFD2C6"><enum>(B)</enum><text>an offense under section 192 of title 2, United States Code; or</text></subparagraph><subparagraph id="HE3FA5C083F9649EE8C939C2B6585CE46"><enum>(C)</enum><text display-inline="yes-display-inline">an offense under section 1001, 1505, 1512, or 1621 of title 18, United States Code, provided that the offense occurred in relation to a Congressional proceeding or investigation.</text></subparagraph></paragraph><paragraph id="H5CB46EC3EB814F42B859A30CABE0BE7B"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>pardon</term> includes a commutation of sentence.</text></paragraph><paragraph id="HA9A2FEF7B52A412EBA9C388A0E42B51F"><enum>(4)</enum><text>The term <term>relative</term> has the meaning given that term in section 3110(a) of title 5, United States Code. </text></paragraph></subsection></section><section id="H83676A387C964033813F9B99A3E65FAD"><enum>4.</enum><header>Bribery in connection with pardons and commutations</header><text display-inline="no-display-inline">Section 201 of title 18, United States Code, is amended—</text><paragraph id="HF0B99D1DB6E8484AAB2650A2801859A1"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HD8B63935BED04391A4AC2C5DD42F1D67"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, including the President and the Vice President of the United States,</quote> after <quote>or an officer or employee or person</quote>; and </text></subparagraph><subparagraph id="H9CB0292F3FBF4E14A23D1D4D998B2507"><enum>(B)</enum><text>in paragraph (3), by inserting before the period at the end the following: <quote>, including any pardon, commutation, or reprieve, or offer any such pardon, commutation, or reprieve</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H928D81F952F644838C38A991C88145A9"><enum>(2)</enum><text>in subsection (b)(3), by inserting <quote>(including, for purposes of this paragraph, any pardon, commutation, or reprieve, or offer any such pardon, commutation, or reprieve)</quote> after <quote>corruptly gives, offers, or promises anything of value</quote>. </text></paragraph></section><section id="H3114EDD58DA14085BCC593B4B4823E2C"><enum>5.</enum><header>Prohibition on Presidential self-pardon</header><text display-inline="no-display-inline">The President’s grant of a pardon to himself or herself is void and of no effect, and shall not deprive the courts of jurisdiction, or operate to confer on the President any legal immunity from investigation or prosecution. </text></section><section id="idb16914e420e74e939f0f613f3e3e94f4"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of such provision or amendment to any person or circumstance shall not be affected thereby. </text></section></legis-body></bill>
