which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To extend Federal recognition to the MOWA Band of Choctaw Indians, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>MOWA Band of Choctaw Indians Recognition Act</short-title></quote>.</text></section><section id="id69798cbb33a84990b10a84521630ce6e"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id64615333326141f4b533c7f3e73ad732"><enum>(1)</enum><header>Member</header><text>The term <term>member</term> means—</text><subparagraph id="id21DA2E6C4D644C5EB75786CD18250530"><enum>(A)</enum><text>an individual who is an enrolled member of the Tribe as of the date of enactment of this Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id642E5599FDEE4EA597AB1BFC878509D4"><enum>(B)</enum><text>an individual who is included on the membership roll of the Tribe under section 4. </text></subparagraph></paragraph><paragraph id="id00d00704eee74246bd34bad9e5dd8a5b"><enum>(2)</enum><header>Reservation</header><text>The term <term>Reservation</term> means the boundaries of the reservation of the Tribe, which are the same as the boundaries of Washington County and Mobile County in the State of Alabama. </text></paragraph><paragraph id="id4a8a085def5342d0a33fb3928a98327f"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id24c256a22fde4bc2a2839b188380ebf4"><enum>(4)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the MOWA Band of Choctaw Indians.</text></paragraph></section><section id="id399713f06ebd4005a2715fedb7f12ac8"><enum>3.</enum><header>Federal recognition</header><subsection id="id2adc9bc034e8467fba4b368a1b5d98cb"><enum>(a)</enum><header>Federal recognition</header><paragraph id="id22e3cb3b541344bebbb6012053606f19"><enum>(1)</enum><header>In general</header><text>Federal recognition is extended to the Tribe.</text></paragraph><paragraph id="id440198969d3140be8125ff8d9a06b668"><enum>(2)</enum><header>Applicability of laws</header><text>All laws (including regulations) of the United States of general applicability to Indians or Indian Tribes, nations, or bands of Indians, including the Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>) (48 Stat. 984, chapter 576; <external-xref legal-doc="usc" parsable-cite="usc/25/5101">25 U.S.C. 5101 et seq.</external-xref>), that are not inconsistent with this Act shall be applicable to the Tribe and the members.</text></paragraph></subsection><subsection id="id305a6c1f15eb4575a329e67a52b9e058"><enum>(b)</enum><header>Federal services and benefits</header><paragraph id="idb7a96c08b60f4655a0e00b355f12db92"><enum>(1)</enum><header>In general</header><text>Beginning on the date of enactment of this Act, the Tribe and the members shall be eligible for all services and benefits provided by the Federal Government to federally recognized Indian Tribes and members of federally recognized Indian Tribes, without regard to—</text><subparagraph id="idB909306609124F2887EACF790A9EA095"><enum>(A)</enum><text>the existence of a reservation for the Tribe; or </text></subparagraph><subparagraph id="id92378006B3024267B496020BFD3216A8"><enum>(B)</enum><text>the location of the residence of any member, including whether the member resides on or near a reservation. </text></subparagraph></paragraph><paragraph id="id90e1520c2aa243498a1bb0168e41db24"><enum>(2)</enum><header>Service area</header><text>For the purpose of the delivery of Federal services and benefits to members, the service area of the Tribe shall be considered to be the area comprised of Washington County and Mobile County in the State of Alabama.</text></paragraph></subsection></section><section id="idd4780d58bda84feaa195bf11c113b4ab"><enum>4.</enum><header>Membership roll</header><subsection id="id040fbde25079478784f9a346f0059199"><enum>(a)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Tribe shall submit to the Secretary an initial membership roll consisting of the name of each individual enrolled as a member of the Tribe.</text></subsection><subsection id="id2863ad29ca0647b884c7517497af35ec"><enum>(b)</enum><header>Determination of membership</header><text>The qualifications for inclusion on the membership roll of the Tribe shall be determined in accordance with—</text><paragraph id="id134F41C4301A4DC8BCEC4C19A2C866A0"><enum>(1)</enum><text>the Constitution of the Mobile-Washington County Band of Choctaw Indians of South Alabama, enacted on June 15, 1991; and</text></paragraph><paragraph id="id141F9A14622149CD86F4BF3163E53CE0"><enum>(2)</enum><text>any amendments or changes to the Constitution. </text></paragraph></subsection><subsection id="ide4e1c42f9c2d494791e87196fe02cb91"><enum>(c)</enum><header>Maintenance of roll</header><text>The Tribe shall have the sole authority and responsibility to maintain the membership roll under this section. </text></subsection></section><section id="idd131e62aaf8441348704316be05e6d8c"><enum>5.</enum><header>Reservation of the Tribe</header><subsection id="ideeedf11898a84ab58d10d835fed4dad8"><enum>(a)</enum><header>In general</header><text>The Secretary shall acquire and take into trust for the benefit of the Tribe title to land identified by the Tribe, not to exceed 3,223 acres, within the Reservation.</text></subsection><subsection id="id1984E5F583714A7FBA25AAE35D89EC17"><enum>(b)</enum><header>Subsequent trust acquisitions</header><text>The Secretary may acquire and take into trust for the benefit of the Tribe additional land pursuant to section 5 of the Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/5108">25 U.S.C. 5108</external-xref>).</text></subsection></section></legis-body></bill>
