<distribution-code display="yes">VI</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3442</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220105">January 5, 2022</action-date><action-desc><sponsor name-id="S415">Mr. Warnock</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>For the relief of Michael Janssen and Steven Passantino.</official-title></form><legis-body><section id="idb6c360551c0c4f7680bc05e862f44301" section-type="section-one"><enum>1.</enum><header>Law enforcement officer retirement benefits for Michael Janssen and Steven Passantino</header><subsection id="id23F8AF46283F4DEDBF7EC21C33C48A5B"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>law enforcement officer</term> has the meaning given the term in section 8401 of title 5, United States Code.</text></subsection><subsection id="idEAE463F9317A43908D7D2C5F3919F4E8"><enum>(b)</enum><header>Deeming of service</header><text>Notwithstanding any other provision of law, and subject to subsection (c), Michael Janssen and Steven Passantino shall, during any period in which the applicable individual is employed as a series 1895 officer of the U.S. Customs and Border Protection before, on, or after the date of enactment of this Act, be deemed to be performing service as a law enforcement officer under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, and shall be subject to the terms and conditions applicable to a law enforcement officer under that chapter.</text></subsection><subsection id="id4FF9EDEC2E07460CBB981D65792DFCD3"><enum>(c)</enum><header>Creditable service; deposit</header><text>Any creditable service performed before the date of enactment of this Act by Michael Janssen or Steven Passantino under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, as a series 1895 officer of the U.S. Customs and Border Protection shall be deemed to be service as a law enforcement officer only if the applicable individual meets the deposit requirements of section 8411(f) of title 5, United States Code, with respect to that service.</text></subsection></section></legis-body></bill>
