which was read twice and ordered placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To require the imposition of sanctions with respect to entities responsible for the planning, construction, or operation of the Nord Stream 2 pipeline and their corporate officers and to apply congressional review under the Countering America’s Adversaries Through Sanctions Act to the removal of sanctions relating to Nord Stream 2, and for other purposes.</official-title></form><legis-body><section id="id717421194D7C4A8A8E50AAA2A3E1CC06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Europe's Energy Security Implementation Act </short-title></quote>.</text></section><section id="id5824BF892A8A46F78FD06D1F7869BA6B"><enum>2.</enum><header>Imposition of sanctions with respect to Nord Stream 2</header><subsection id="id043376243FE541B8B69427A3E472045B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 15 days after the date of the enactment of this Act, the President shall—</text><paragraph id="idB5309108AB6D4946806C1F5A223DDA25"><enum>(1)</enum><text display-inline="yes-display-inline">impose sanctions under subsection (b) with respect to any corporate officer of an entity established for or responsible for the planning, construction, or operation of the Nord Stream 2 pipeline or a successor entity; and</text></paragraph><paragraph id="id9CAFA0D09BD14D72BA331405BAD79F8D"><enum>(2)</enum><text>impose sanctions under subsection (c) with respect to any entity described in paragraph (1).</text></paragraph></subsection><subsection id="id4cc137634d454f47aa2dd44d1eca6247"><enum>(b)</enum><header>Ineligibility for visas, admission, or parole of identified persons and corporate officers</header><paragraph id="idf1ccae32bab642789cb4df05ad8c8433"><enum>(1)</enum><header>In general</header><subparagraph id="id623cf8f33cf84d19b1b1370c644bf9a1"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien described in subsection (a)(1) is—</text><clause id="id3b6763e793f94a11ae4a5b46058e0978"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="ida0f67b69a3ad428b9f17546ad07c767f"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="id96cdbe7a8330401c951a1e57c5ec9bb2"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="idffa3729b5616463690b5ad1f34afa429"><enum>(B)</enum><header>Current visas revoked</header><clause id="ide4fe992b06a24173a679f93178a3cb9c"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in subsection (a)(1) shall be revoked, regardless of when such visa or other entry documentation is or was issued.</text></clause><clause id="id2cb5fffca4c9481aa01b61728876886a"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="idb4b2392822e8499cbf49e0de9deb7519"><enum>(I)</enum><text>take effect immediately; and</text></subclause><subclause id="id2694669a9f5248ffbcf5f90a8e53a341"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien's possession.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idf1bd7ad785d940039abddac8113a9fd1"><enum>(c)</enum><header>Blocking of property of identified persons</header><text>The President shall exercise all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of an entity described in subsection (a)(1) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subsection><subsection id="id4B295AE66D8E4C728793423CBE680106"><enum>(d)</enum><header>Conditions for removal of sanctions</header><text>Subject to review by Congress under section 216 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9511">22 U.S.C. 9511</external-xref>), the President may waive the application of sanctions under this section if the President—</text><paragraph id="id55B57A8E880B4A3C98E3AFEF964B9971"><enum>(1)</enum><text>determines that the waiver is in the national security interest of the United States; and </text></paragraph><paragraph id="id4F8690A90C614EDA83BBD128D8442D26"><enum>(2)</enum><text>submits to the appropriate congressional committees a report on the waiver and the reason for the waiver.</text></paragraph></subsection><subsection id="id89251b0e94fb4e6abd8cbe2dd891f783"><enum>(e)</enum><header>Implementation; penalties</header><paragraph id="idee87eda3a170486da4663562af4675b8"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section.</text></paragraph><paragraph id="id76aea0a28aa848008c4536b5696fb51a"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></paragraph></subsection><subsection id="idF4B7EA10C2844EE7B528532E6529AD75"><enum>(f)</enum><header>Exceptions</header><paragraph id="id0a349a37f540475f9297d7beb963ed8d"><enum>(1)</enum><header>Exception for intelligence, law enforcement, and national security activities</header><text>Sanctions under this section shall not apply to any authorized intelligence, law enforcement, or national security activities of the United States.</text></paragraph><paragraph id="id1275b66f929f4ae7831febd8af6166cd"><enum>(2)</enum><header>Exception to comply with united nations headquarters agreement</header><text>Sanctions under this section shall not apply with respect to the admission of an alien to the United States if the admission of the alien is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or other applicable international obligations.</text></paragraph><paragraph id="idb062b2c1954346f78cd70d8cc7c7124a"><enum>(3)</enum><header>Exception relating to importation of goods</header><subparagraph id="id80d5b3a8224942fcb7840f86663db544"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this section, the authorities and requirements to impose sanctions under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id578849c323fa4a0fb04507e95df7e912"><enum>(B)</enum><header>Good defined</header><text>In this paragraph, the term <term>good</term> means any article, natural or man-made substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data. </text></subparagraph></paragraph></subsection><subsection id="id27d99583528441b28d61a08034f4faeb"><enum>(g)</enum><header>Sunset</header><text>The authority to impose sanctions under this section shall terminate on the date that is 5 years after the date of the enactment of this Act. </text></subsection><subsection id="id9599bb8a43884158bb760ba0f8ee491d"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id75249347f0df4137836e035ac555bb1e"><enum>(1)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term> , <term>admitted</term> , and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="id501c9debd18048069471b0a524679445"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id8569a0cdcf9d437083a5efedd02e05fd"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></subparagraph><subparagraph id="id9509d564e31c40e3a9f291f781c96dfd"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives. </text></subparagraph></paragraph><paragraph id="id4586ac88cc0b4c32818aa139e9f32176"><enum>(3)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id434110dc49264fea935b2f1da89d17a9"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="ide41fd08311b2467d8288b8884582e0a6"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="id93d7cd1292214f95a042530cdfbf120c" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>any person within the United States.</text></subparagraph></paragraph></subsection></section><section id="id50C6414BA3C345069FA197EC203112C0"><enum>3.</enum><header>Congressional review of waiver under Protecting Europe’s Energy Security Act of 2019</header><text display-inline="no-display-inline">Section 7503(f) of the Protecting Europe’s Energy Security Act of 2019 (title LXXV of <external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/9526">22 U.S.C. 9526</external-xref> note) is amended, in the matter preceding paragraph (1), by striking <quote>The President</quote> and inserting <quote>Subject to review by Congress under section 216 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9511">22 U.S.C. 9511</external-xref>), the President</quote>.</text></section><section id="idF0BB4CCF2F374EAF8F0CBB323751180A"><enum>4.</enum><header>Application of congressional review under Countering America’s Adversaries Through Sanctions Act</header><text display-inline="no-display-inline">Section 216(a)(2) of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9511">22 U.S.C. 9511(a)(2)</external-xref>) is amended—</text><paragraph id="id1DC2945D4F98430DBF6BAD81B07BAFF1"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="idCA9D8D283DA245FFB7D0E20C6EB65A4F"><enum>(A)</enum><text>in clause (i), by inserting <quote>(other than sanctions described in clause (i)(IV) of that subparagraph)</quote> after <quote>subparagraph (B)</quote>; and</text></subparagraph><subparagraph id="idE34B214C29C14AA6B5FA100D1B9DBBF2"><enum>(B)</enum><text>in clause (ii), by inserting <quote>or otherwise remove</quote> after <quote>waive</quote>; and</text></subparagraph></paragraph><paragraph id="idFD0E3C0C0FC44A00BB9D6C2FBD1AC855"><enum>(2)</enum><text>in subparagraph (B)(i)—</text><subparagraph id="id4A18426025DA495AAD3EF891292CCD22"><enum>(A)</enum><text>in subclause (II), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id6B8E1BF6B4CB459B813EBB6126047A0A"><enum>(B)</enum><text>in subclause (III), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="id57FD944B698245DFA7772F0F5887A2E1"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id304A53601CE646C4A0A622CAD3954168"><subclause id="id1241DCD5C34D4D558D530AFFAB478DCE"><enum>(IV)</enum><text>section 7503 of the Protecting Europe’s Energy Security Act of 2019 (title LXXV of <external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/9526">22 U.S.C. 9526</external-xref> note); or</text></subclause><subclause id="idD83CEA36A26B4B479B4F69780C1ED624"><enum>(V)</enum><text>section 2 of the <short-title>Protecting Europe's Energy Security Implementation Act</short-title>; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id1ac7e0b3fcd3444dae7636897bb5a8d8"><enum>5.</enum><header>Inclusion of matter relating to Nord Stream 2 in report under Countering America’s Adversaries Through Sanctions Act</header><text display-inline="no-display-inline">Each report submitted under section 216(a)(1) of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9511">22 U.S.C. 9511(a)(1)</external-xref>) relating to sanctions under section 2 of this Act or section 7503 of the Protecting Europe’s Energy Security Act of 2019 (title LXXV of <external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/9526">22 U.S.C. 9526</external-xref> note) shall include—</text><paragraph id="idedc4ed09623e44cb987bdb8e9f9b063c"><enum>(1)</enum><text>an assessment of the security risks posed by Nord Stream 2, including—</text><subparagraph id="iddbbee3b78ac54880a24448b5f0bc01eb"><enum>(A)</enum><text>the presence along Nord Stream 2 or Nord Stream 1 infrastructure or pipeline corridors of undersea surveillance systems and sensors, fiber optic terminals, or other systems that are capable of conducting military or intelligence activities unrelated to civilian energy transmission, including those designed to enhance Russian Federation anti-submarine warfare, surveillance, espionage, or sabotage capabilities;</text></subparagraph><subparagraph id="id7a23015b41fd403b84d540bde9c6a2b6"><enum>(B)</enum><text>the use of Nord Stream-affiliated infrastructure, equipment, personnel, vessels, financing, or other assets—</text><clause id="id5600482e0c074cd791676dff0eee91ae"><enum>(i)</enum><text>to facilitate, carry out, or conceal Russian Federation maritime surveillance, espionage, or sabotage activities;</text></clause><clause id="id6f20abf6f9d44882add68bae19e03a31"><enum>(ii)</enum><text>to justify the presence of Russian Federation naval vessels or military personnel or equipment in international waters or near North Atlantic Treaty Organization or partner countries;</text></clause><clause id="id3694f0d9b14e4a56a01e222215f928cc"><enum>(iii)</enum><text>to disrupt freedom of navigation; or</text></clause><clause id="idea2a064b94cc420d8e77c6fb17c240b0"><enum>(iv)</enum><text>to pressure or intimidate countries in the Baltic Sea;</text></clause></subparagraph><subparagraph id="id3dab26a33897459983e7a9f810c493c4"><enum>(C)</enum><text>the involvement in the Nord Stream 2 pipeline or its affiliated entities of current or former Russian, Soviet, or Warsaw Pact intelligence and military personnel and any business dealings between Nord Stream 2 and entities affiliated with the intelligence or defense sector of the Russian Federation; and</text></subparagraph><subparagraph id="id6a984a98d4fa465cbc3aed38d7263298"><enum>(D)</enum><text>malign influence activities of the Government of the Russian Federation, including strategic corruption and efforts to influence European decision-makers, supported or financed through the Nord Stream 2 pipeline;</text></subparagraph></paragraph><paragraph id="ided63566b0c364d83aeb4a55f18ab9417"><enum>(2)</enum><text>an assessment of whether the Russian Federation maintains gas transit through Ukraine at levels consistent with the volumes set forth in the Ukraine-Russian Federation gas transit agreement of December 2019 and continues to pay the transit fees specified in that agreement;</text></paragraph><paragraph id="idaa67b89d5e9340cf907b43f888a1d0bc"><enum>(3)</enum><text>an assessment of the status of negotiations between the Russian Federation and Ukraine to secure an agreement to extend gas transit through Ukraine beyond the expiration of the agreement described in paragraph (2); and</text></paragraph><paragraph id="id2822d7697e3d42c9ab67d74bd39ea630"><enum>(4)</enum><text>an assessment of whether the United States and Germany have agreed on a common definition for energy <quote>weaponization</quote> and the associated triggers for sanctions and other enforcement actions, pursuant to the Joint Statement of the United States and Germany on support for Ukraine, European energy security, and our climate goals, dated July 21, 2021; and</text></paragraph><paragraph id="ideb8f33a2309048848308a88cdf57d12d"><enum>(5)</enum><text>a description of the consultations with United States allies and partners in Europe, including Ukraine, Poland, and the countries in Central and Eastern Europe most impacted by the Nord Stream 2 pipeline concerning the matters agreed to as described in paragraph (4). </text></paragraph></section></legis-body><endorsement><action-date date="20211218" legis-day="20211217">December 18 (legislative day, December 17), 2021</action-date><action-desc>Read twice and ordered placed on the calendar</action-desc></endorsement></bill>
