<official-title>To require a strategy to support nationals of Afghanistan who are applicants for special immigrant visas or for referral to the United States Refugee Admissions Program, and for other purposes.</official-title>

<section id="id131222E3F3214B07BCBD9EB874D42134" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honor Our Commitment Act of 2021</short-title></quote>.</text></section> <section id="id328C75B8F52B4F34A51CF006F557A3FF"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the United States should increase support for nationals of Afghanistan who aided the United States mission in Afghanistan during the past 20 years and are now under threat from the Taliban, specifically such nationals of Afghanistan, in Afghanistan or third countries, who are applicants for—</text>
<paragraph id="id67EDC22A4E3B46268E984C5C2150A7C3"><enum>(1)</enum><text>special immigrant visas under the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/8">Public Law 111–8</external-xref>) or section 1059 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>); or</text></paragraph> <paragraph id="idA4E387D091BD4905A2DF6A72A35431F9"><enum>(2)</enum><text>referral to the United States Refugee Admissions Program as refugees (as defined in section 101(a)(42) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(42)</external-xref>)), including as Priority 2 refugees.</text></paragraph></section>
<section commented="no" id="id0D5C5E78EF334EB6867D8FA96F239D04"><enum>3.</enum><header>Strategy to support certain nationals of Afghanistan</header>
<subsection commented="no" id="idC5C6B4B9B7F044C090D80BAABACF9DDE"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of State, in coordination with the Secretary of Homeland Security, the Director of the Federal Bureau of Investigation, and the heads of other relevant Federal departments and agencies, shall submit to the appropriate committees of Congress a strategy for the safe processing abroad of nationals of Afghanistan described in section 2. </text></subsection> <subsection commented="no" id="id0131B8F8CCBC4AF8AF85C9B68362FCA9"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall include a detailed plan—</text>
<paragraph commented="no" id="id654BD833744748A9816EF22B858583EC"><enum>(1)</enum><text>to prioritize for evacuation from Afghanistan nationals of Afghanistan described in section 2;</text></paragraph> <paragraph id="id416CB617ED1B498683084EEF2BB0DBCB"><enum>(2)</enum><text>to provide for security checks for such nationals of Afghanistan, which—</text>
<subparagraph id="idBAE4F762535443EF951D9DB93D918BD6"><enum>(A)</enum><text>shall be conducted remotely before departure from Afghanistan; and</text></subparagraph> <subparagraph id="id6C92440E811B45038BCE8F2FBEC475B6"><enum>(B)</enum><text>shall not take the place of post-departure security screening;</text></subparagraph></paragraph>
<paragraph id="id0B23D98927074DADA1C3DB2EB2CAFB23"><enum>(3)</enum><text>to facilitate, after such security checks, the rapid departure from Afghanistan by air charter and land passage of such nationals of Afghanistan who satisfy the requirements of such security checks;</text></paragraph> <paragraph id="id55F2258BF27D430294443A3913CD1B9A"><enum>(4)</enum><text>to provide letters of support, diplomatic notes, and other documentation, as appropriate, to ease transit for such nationals of Afghanistan;</text></paragraph>
<paragraph id="id666E80C1F7454872BBE25BA8480E333D"><enum>(5)</enum><text>to engage governments of relevant countries to better facilitate evacuation of such nationals of Afghanistan;</text></paragraph> <paragraph id="id0AF031BFA9084764954C80159752E64E"><enum>(6)</enum><text>to disseminate frequent updates to such nationals of Afghanistan and relevant nongovernmental organizations with respect to evacuation from Afghanistan;</text></paragraph>
<paragraph id="id6D9B497309E340F3B58CBA7AC3708464"><enum>(7)</enum><text>to identify and establish sufficient locations outside Afghanistan and the United States that will accept such nationals of Afghanistan during case processing (including during the processes of security checks and establishing the eligibility of such nationals of Afghanistan before their travel to the United States, which shall include any in-person interview required for full adjudication of a case and, in the case of a special immigrant visa, issuance of such visa) for—</text> <subparagraph id="id57931EE250174FDFBA6138D49F56297E"><enum>(A)</enum><text>the special immigrant visas described in paragraph (1) of section 2; or </text></subparagraph>
<subparagraph id="id388703F3F1C34C1C90BC03F18ED30CF3"><enum>(B)</enum><text>referral to, and acceptance for resettlement in the United States by, the United States Refugee Admissions Program described in paragraph (2) of that section; </text></subparagraph></paragraph> <paragraph id="id2AE3F7E0A2874A78880AE9915309CD94"><enum>(8)</enum><text>to identify necessary resource, personnel, and equipment requirements to increase capacity to better support such nationals of Afghanistan and reduce their application processing times, while ensuring strict and necessary security checks, including, to the extent practicable, by allowing such nationals of Afghanistan to receive referrals to the United States Refugee Admissions Program while they are still in Afghanistan so as to initiate application processing more expeditiously; and</text></paragraph>
<paragraph id="idFC0ECEC5D64C48FCBC4D60CAD8B9E67E"><enum>(9)</enum><text>to provide for relocation outside Afghanistan to third countries for nationals of Afghanistan described in section 2 who are unable to successfully complete security checks and application processing to establish eligibility to travel to the United States.</text></paragraph></subsection> <subsection commented="no" id="id1BA9E9A0DA7E4186969C57D3C9344BEA"><enum>(c)</enum><header>Form</header><text>The strategy required by subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection></section>
<section commented="no" id="id0F5B8A73642742919B885D4DC1DF064A"><enum>4.</enum><header>Monthly report</header>
<subsection commented="no" id="id0F603F54C87E4675B6B60EAE2431D32F"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, and monthly thereafter until December 31, 2022, the Secretary of State, in coordination with the Secretary of Homeland Security and the heads of other relevant Federal departments and agencies, shall submit to the appropriate committees of Congress a report on efforts to support nationals of Afghanistan described in section 2. </text></subsection> <subsection commented="no" id="id7803CABDBCE941B7AF0951B3B620A2C1"><enum>(b)</enum><header>Elements</header><text>Each report required by subsection (a) shall include the following:</text>
<paragraph id="id0102C8E306D84E9BB45F4672B7EF5E4E"><enum>(1)</enum><text>The number of nationals of Afghanistan referred to the United States Refugee Admissions Program as Priority 1 and Priority 2 refugees since August 29, 2021. </text></paragraph> <paragraph id="idB18ED1FA70814A95995E95C63E0F87CC"><enum>(2)</enum><text>An assessment of whether each such refugee—</text>
<subparagraph id="id20AFD5F811A8442B88FFEC376DFBD86F"><enum>(A)</enum><text>remains in Afghanistan; or </text></subparagraph> <subparagraph id="id5BDBEE3DEC9E49619D9268CCF131FA9E"><enum>(B)</enum><text>is outside Afghanistan.</text></subparagraph></paragraph>
<paragraph id="idFC1094BED7184CEE9C3B17696D9E6A1C"><enum>(3)</enum><text>With respect to nationals of Afghanistan who have applied for referral to the United States Refugee Program, the number of applications that—</text> <subparagraph id="idF54E8DE53497444FBFF2B2917FD4E87A"><enum>(A)</enum><text>have been approved;</text></subparagraph>
<subparagraph id="idA6226CC59C2F4306A3678CF84C89C84A"><enum>(B)</enum><text>have been denied; and </text></subparagraph> <subparagraph id="id95546FDA30924090AD22C84F8CA55D18"><enum>(C)</enum><text>are pending adjudication.</text></subparagraph></paragraph>
<paragraph id="id17F81419E4264A91B477D404215AD037"><enum>(4)</enum><text>The number of nationals of Afghanistan who have pending applications for special immigrant visas described in section 2(1), disaggregated by the special immigrant visa processing steps completed with respect to such individuals.</text></paragraph> <paragraph id="id9FFA1FB7EBED446A9F3957C3129398F0"><enum>(5)</enum><text>A description of the measures taken to implement the strategy under section 3.</text></paragraph></subsection></section>
<section id="idEBFF19C845084BEB9CA3FC84B95E5286"><enum>5.</enum><header>Definition of appropriate committees of Congress</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate committees of Congress</term> means—</text> <paragraph id="idD0BA3951B6C74BCAA0001C0F42C7C83E"><enum>(1)</enum><text>the Committee on Foreign Relations, the Committee on the Judiciary, the Committee on Homeland Security and Governmental Affairs; and the Committee on Armed Services of the Senate; and </text></paragraph>
<paragraph id="id17586B78643E4F65AA10F901D1ABC68A"><enum>(2)</enum><text>the Committee on Foreign Affairs, the Committee on the Judiciary, the Committee on Homeland Security, and the Committee on Armed Services of the House of Representatives.</text></paragraph></section> </legis-body> </bill>
