<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3430</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211216">December 16, 2021</action-date><action-desc><sponsor name-id="S344">Mr. Hoeven</sponsor> (for himself, <cosponsor name-id="S317">Mr. Barrasso</cosponsor>, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, and <cosponsor name-id="S410">Ms. Lummis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To maintain the National Coal Council in the Department of Energy to provide advice and recommendations to the Secretary of Energy on matters relating to coal and the coal industry, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4793C2DB1AC7401695A7E1A2753F5189"><section section-type="section-one" id="H9766478F5D9D4E2DBE0F3B771C56F5B0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coal Council Certainty Act of 2021</short-title></quote>.</text></section><section id="HE5A5D2494716441BBD69BD0EF94B1F21"><enum>2.</enum><header>National Coal Council</header><subsection id="H596CFFC2FAF646F8879940E6BC796AA8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Energy shall maintain the National Coal Council, in accordance with the charter for the National Coal Council (as filed with Congress on November 19, 2021).</text></subsection><subsection id="HBF7558E1CAF044CCAF92F8F1CF92714C"><enum>(b)</enum><header>Applicability of the Federal Advisory Committee Act</header><paragraph id="HC674C1140EEB4CD6AB1892FDBC21C494"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall apply to the National Coal Council. </text></paragraph><paragraph id="H62C3821A2CD84E62A84A5EDA9578DFD4"><enum>(2)</enum><header>Termination</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the National Coal Council.</text></paragraph></subsection></section></legis-body></bill>
