which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to establish a program to provide Federal financial assistance to support advanced nuclear reactors and associated supply chain infrastructure, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fission for the Future Act of 2021</short-title></quote>.</text></section><section id="idbb65b37ee3294bdc9433c1525f9e25a1"><enum>2.</enum><header>Advanced Nuclear Technologies Federal Financial Assistance Program</header><subsection id="id4cb31d009be14c919ae0d35a3fd0097b"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id22e41595c2dc46b5bdf5754ac618ca50"><enum>(1)</enum><header>Advanced nuclear reactor</header><text>The term <term>advanced nuclear reactor</term> has the meaning given the term in section 951(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271(b)</external-xref>).</text></paragraph><paragraph id="id05b9dbdf690b40c38a714238da596b0e"><enum>(2)</enum><header>Electric utility</header><text>The term <term>electric utility</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="id021c07939ad848a281578e34ca22f814"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means each of—</text><subparagraph id="idf3565e48892f42959922b075e561d671"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="id0589c6e650a04c96be20ada80abd7a07"><enum>(B)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></subparagraph><subparagraph id="idF4EDDAB63CF94FF98B69B9639AE334A2"><enum>(C)</enum><text>a Tribal Organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); </text></subparagraph><subparagraph id="ide80b3c23650a4eb78431e49aac7ae753"><enum>(D)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="ida72b143bdc1d43fa974c6513c9e41cc7"><enum>(E)</enum><text>an electric utility;</text></subparagraph><subparagraph id="idefe7d0eae8a64cb6b84b40c97f4b26a9"><enum>(F)</enum><text>a National Laboratory;</text></subparagraph><subparagraph id="id8746198F32954630B2452769691A4D11"><enum>(G)</enum><text>an institution of higher education; and</text></subparagraph><subparagraph id="id36da2dbb012c41369bed548f015d08d7" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text>a private entity specializing in—</text><clause commented="no" display-inline="no-display-inline" id="idD10E34468A8B4D50AE1FC2AF82B6D102"><enum>(i)</enum><text>advanced nuclear technology development;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7175F93BC8CD40A9B64E7CBD4857288E"><enum>(ii)</enum><text>nuclear supply chains; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5E5AB91E2D0B4C188795B3ED945F835A"><enum>(iii)</enum><text>with respect to nuclear technologies and nonelectric applications of nuclear technologies, construction, project financing, contract structuring and risk allocation, or regulatory and licensing processes. </text></clause></subparagraph></paragraph><paragraph id="id8c6fa787f53d415ca056b041c64c73cf"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="id9d60dbca198247c3af5e0055f19bd7d2"><enum>(5)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="ide0038e05b59a463084c5a6042f3543bd"><enum>(6)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text></paragraph><paragraph id="id4ecd2662a81e42eb91facc485b2472d1"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="id370aa96532f949a095cedb51afc8ac98"><enum>(b)</enum><header>Establishment of program</header><paragraph id="idE63E39F20BA14ED3982750F76A63A45E"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to provide Federal financial assistance to eligible entities to support the commercial planning, licensing, development, and construction, and construction planning, of—</text><subparagraph id="idee3770e30dd945089c36d2e97e0ed295"><enum>(A)</enum><text>advanced nuclear reactors for the purpose of enhancing grid resilience, reliability, and security while also seeking to reduce emissions; or</text></subparagraph><subparagraph id="idb70902719a6f407e88a404e7491ea24c"><enum>(B)</enum><text>supply chain infrastructure associated with advanced nuclear reactors or related technologies.</text></subparagraph></paragraph><paragraph id="ida6b8d799ec244b67bf8b5ee7786b24a2"><enum>(2)</enum><header>Competitive procedures</header><text>To the maximum extent practicable, the Secretary shall carry out the program using a competitive, merit-based review process that is consistent with section 989 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16353">42 U.S.C. 16353</external-xref>).</text></paragraph></subsection><subsection id="id7aeb9a465ef74a9d972decc9d5d94560"><enum>(c)</enum><header>Applications</header><text>An eligible entity desiring Federal financial assistance under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="idba959ae4f0a4406fb2eb3b285d918655"><enum>(d)</enum><header>Selection</header><paragraph id="id6f61a839b74c4e299561fd3b22b96660"><enum>(1)</enum><header>In general</header><text>In selecting eligible entities to receive Federal financial assistance under the program, the Secretary shall give special consideration to projects—</text><subparagraph id="idc9ec191a416348d58fc0ca493dcb7cb9"><enum>(A)</enum><text>to develop or provide services to support—</text><clause id="idd29ad09a86614454b55def77361353b1"><enum>(i)</enum><text>market analysis;</text></clause><clause id="id9bbed973f8fc467caef553e31606dcc8"><enum>(ii)</enum><text>project structure models;</text></clause><clause id="id42c04174183e4885822407ccb4848ee4"><enum>(iii)</enum><text>models for electricity market analysis;</text></clause><clause id="idbbe9ac25dad54b29a6fcd63f32d2e895"><enum>(iv)</enum><text>nonelectric applications;</text></clause><clause id="id9768f508b73c4b9ba38ff027d0ee75e6"><enum>(v)</enum><text>financial models;</text></clause><clause id="id755190d2b27b4b298d4324b0b3a3df84"><enum>(vi)</enum><text>analysis, planning, and, as appropriate, management of environmental issues at fossil fuel electric generation facilities that are retired or scheduled to retire; and</text></clause><clause id="idc0ab9a48e6f149e68c572e6d6767d557"><enum>(vii)</enum><text>site planning, review, testing, analysis, and preparation;</text></clause></subparagraph><subparagraph id="id2e5a5bd3e4d0483587a0c25b59c243f2"><enum>(B)</enum><text>to support licensing activities, permitting, and environmental impact studies; and</text></subparagraph><subparagraph id="id1c4ab249cb85435ebd8cd0c0b1498368"><enum>(C)</enum><text>for—</text><clause id="id11442ca609624486afa1ce5e3871314d"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idCDD4F10C38AB4B7FA98693D11328751D"><enum>(I)</enum><text>the construction planning of advanced nuclear reactors; and</text></subclause><subclause indent="up1" id="idBD720ED72E8C4867BBB457EEE0511C76"><enum>(II)</enum><text>related—</text><item id="id4624DE00A96C48C689574A2B361D21F1"><enum>(aa)</enum><text>planning and construction of transmission and distribution systems;</text></item><item id="idF38B459D29E54FE599B613DFF8A803F7"><enum>(bb)</enum><text>modernization of generation facilities;</text></item><item id="idBAE0F5FED9AF476EAB819553E71B82DF"><enum>(cc)</enum><text>development of microgrids; and</text></item><item id="idFA501CC31C9E4A1BB2E958D4DD213DA1"><enum>(dd)</enum><text>supply chain infrastructure;</text></item></subclause></clause><clause id="ideec20df93697411a83ff3360de94df39"><enum>(ii)</enum><text>infrastructure for nonelectric applications; and</text></clause><clause id="ide8c6635906434876831d2d9fa33ce7dd"><enum>(iii)</enum><text>acquisition of relevant rights-of-way.</text></clause></subparagraph></paragraph><paragraph id="id953d9d854b414f1e8ab938ce23399cdb"><enum>(2)</enum><header>Priority</header><text>In selecting eligible entities to receive Federal financial assistance under the program, the Secretary shall give priority to eligible entities that—</text><subparagraph id="id8d502f72ec094922a2423af277d2f7bf"><enum>(A)</enum><text>plan to carry out projects at or near the site of 1 or more fossil fuel electric generation facilities that are retired or scheduled to retire, including multi-unit facilities that are partially shut down—</text><clause id="id8ebca792f9a74954ad05f4b4a2345618"><enum>(i)</enum><text>to reduce the cost of—</text><subclause id="iddb2f5a46d16946d7bcf32d89e6805ee7"><enum>(I)</enum><text>infrastructure requirements;</text></subclause><subclause id="idc6b53e6a85dc4beab397ecd2505ac894"><enum>(II)</enum><text>transmission requirements; and</text></subclause><subclause id="id7809183c0be94516ad576047c3c5b4f5"><enum>(III)</enum><text>licensing and permitting requirements;</text></subclause></clause><clause id="idedc770ce3720483b81098743df664545"><enum>(ii)</enum><text>to support the productive reuse of fossil fuel electric generation facilities that are retired or scheduled to retire; and</text></clause><clause id="id4badbf6e86e34f1eb590fb78ed98ae83"><enum>(iii)</enum><text>to sustain and revitalize communities impacted by the closure of fossil fuel electric generation facilities;</text></clause></subparagraph><subparagraph id="id2a756a6266a241c8a39ef28061b5d8e7"><enum>(B)</enum><text>plan to support nonelectric applications, including supplying heat for—</text><clause id="idfa667b15f7cb4a7b8945882049afe6ad"><enum>(i)</enum><text>energy storage;</text></clause><clause id="id0ddc9321e6a14a63b264e0d101535b9d"><enum>(ii)</enum><text>hydrogen or other liquid and gaseous fuel or chemical production;</text></clause><clause id="id06ca8d313dd542869981526b6cc6fe20"><enum>(iii)</enum><text>industrial processes;</text></clause><clause id="ide6ba2c74fece416483531fcca19412a8"><enum>(iv)</enum><text>desalination technologies and processes;</text></clause><clause id="id6c6cf670835a4f9b97706304e8857148"><enum>(v)</enum><text>isotope production;</text></clause><clause id="id24ef034c72d84c91b9bff95c8275c061"><enum>(vi)</enum><text>district heating; and</text></clause><clause id="idc6ec9d9d391548a694ccaa5d724d2771"><enum>(vii)</enum><text>other applications, as the Secretary determines to be appropriate;</text></clause></subparagraph><subparagraph id="idaa57aa8e2b444fada97f4a5b9e22b706"><enum>(C)</enum><text>plan to support supply chain infrastructure, including manufacturing, associated with advanced nuclear reactors or related technologies;</text></subparagraph><subparagraph id="id76df4dad937c459cb52c45bab2d5964d"><enum>(D)</enum><text>have implemented or demonstrated the ability to successfully implement workforce training or retraining programs to train workers to perform activities described in this section; and</text></subparagraph><subparagraph id="id9fa4255f51624438936a75a8f5f1dcf1"><enum>(E)</enum><text>plan to be cost competitive.</text></subparagraph></paragraph></subsection><subsection id="id7c74a9b1b41d4b2593b8951e2f79b28e"><enum>(e)</enum><header>Cost share</header><text>Section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>) shall apply to Federal financial assistance provided under the program.</text></subsection></section><section id="idd28496dd18d64a799cd759875f5d4eaa"><enum>3.</enum><header>Workforce capacity building</header><text display-inline="no-display-inline">Section 954(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16274">42 U.S.C. 16274(b)</external-xref>) is amended—</text><paragraph id="idb8acc8a121e4469ca8744d3debd2a9e7"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Graduate</header-in-text></quote>;</text></paragraph><paragraph id="id9143160fae7845bfa45bb6414e6e8576"><enum>(2)</enum><text>by striking <quote>graduate</quote> each place it appears;</text></paragraph><paragraph id="id0ea17d121e214657a424185ae3f60c4f"><enum>(3)</enum><text>in paragraph (2)(A), by inserting <quote>community colleges, trade schools, registered apprenticeship programs, pre-apprenticeship programs</quote> after <quote>universities,</quote>;</text></paragraph><paragraph id="id6e54bfdac7f74f318702cfdd8972aa7c"><enum>(4)</enum><text>in paragraph (3), by striking <quote>2021 through 2025</quote> and inserting <quote>2022 through 2026</quote>;</text></paragraph><paragraph id="id529ff9455f664a31a0a0549d43a80946"><enum>(5)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph id="id79105aeaab724e599b095b25c959db1e"><enum>(6)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idae6dcf51f24b4682950d69be23b63598"><paragraph id="id64d523d8a5a7404cb00fd189fb976961"><enum>(3)</enum><header>Focus areas</header><text>In carrying out the subprogram under this subsection, the Secretary may implement traineeships in focus areas that, in the determination of the Secretary, are necessary to support the nuclear energy sector in the United States, including—</text><subparagraph id="id306216fd622d47b1ab0f0667e0133253"><enum>(A)</enum><text>research and development;</text></subparagraph><subparagraph id="id440b46d40e8149ab9ec1c916366fbbc1"><enum>(B)</enum><text>construction and operation;</text></subparagraph><subparagraph id="id8b11d2f896ab40278677b9b350db44c8"><enum>(C)</enum><text>associated supply chains; and</text></subparagraph><subparagraph id="id84c96baada314a239a82f5ef9dd7962e"><enum>(D)</enum><text>workforce training and retraining to support transitioning workforces.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
