which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To implement merit-based reforms to the civil service hiring system that replace degree-based hiring with skills- and competency-based hiring.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chance to Compete Act of 2021</short-title></quote>.</text></section><section id="id6A7674221F034C8D85E5B432BC696CF7"><enum>2.</enum><header>Definitions</header><subsection id="id86E0CB4D3CF745B0B5F3C274BBC47C83"><enum>(a)</enum><header>Terms defined in section 3308 of title 5, United States Code</header><text display-inline="yes-display-inline">In this Act, the terms <term>agency</term>, <term>Director</term>, <term>examining agency</term>, <term>Office</term>, <term>subject matter expert</term>, and <term>technical assessment</term> have the meanings given those terms in subsection (a) of section 3308 of title 5, United States Code, as added by section 3(a).</text></subsection><subsection id="idE0FDE2CEC58F4C86A07A8D094E15CF73"><enum>(b)</enum><header>Other terms</header><text>In this Act, the term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code.</text></subsection></section><section id="id0a4869ec81f444f6a82d4572bc3c77b7"><enum>3.</enum><header>Defining the term <quote>examination</quote> for purposes of hiring in the competitive service</header><subsection id="id9B2B0154F61C498FB1A8E7B67ACB41D9"><enum>(a)</enum><header>In general</header><text>Section 3308 of title 5, United States Code, is amended—</text><paragraph id="idC3FE4CD0E4F54C3392A3CBEC989F68DF"><enum>(1)</enum><text>by striking <quote>The Office of Personnel Management</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2759F9199160467F8B438C5299541920"><subsection id="id6E6F640866A7458EACB4AD21D039CA32"><enum>(a)</enum><header>Definitions</header><paragraph id="idF42580170C0448059F6EAD4297B74B70"><enum>(1)</enum><header>Examination defined for purposes of chapter</header><text display-inline="yes-display-inline">For purposes of this chapter, the term <term>examination</term>, with respect to the competitive service—</text><subparagraph id="idD7D3DE9DC70241FF93E8D64605B9DBA6"><enum>(A)</enum><text display-inline="yes-display-inline">means an opportunity to directly demonstrate knowledge, skills, abilities, and competencies, through a passing score assessment (unless the examining agency determines that another method, not limited to the outcomes of pass or fail, makes meaningful and objective differentiations in rating candidates); and</text></subparagraph><subparagraph id="idAEF51728054A49729CEA5A3CEE0A3D50"><enum>(B)</enum><text>does not include a self-assessment from an automated examination, a résumé review (unless conducted by a subject matter expert in a structured manner), or any other method of determining the experience or level of educational attainment of an individual, alone.</text></subparagraph></paragraph><paragraph id="id863833BD1D42460C93F8E0A1EF5B1DA4"><enum>(2)</enum><header>Other terms</header><text>In this section—</text><subparagraph id="id6D7EB1368D074E51A9C0A4BFD76A80E3"><enum>(A)</enum><text>the term <term>agency</term> means an agency described in section 901(b) of title 31;</text></subparagraph><subparagraph id="id4B8A6B7CC72146D1AC01BEFE14988771"><enum>(B)</enum><text>the term <term>Director</term> means the Director of the Office;</text></subparagraph><subparagraph id="id9012D807F668446088CE89D4C8A94713"><enum>(C)</enum><text>the term <term>examining agency</term> means—</text><clause id="id5EDFC49C1A98411BAE152A502D55BD0F"><enum>(i)</enum><text>the Office; or</text></clause><clause id="idEB4C578706E04022A8D2006B42B3EC46"><enum>(ii)</enum><text>an agency to which the Director has delegated examining authority under section 1104(a)(2) of this title; </text></clause></subparagraph><subparagraph id="id760BE9E71FAD4ADAB50A8146C4AB9A3D"><enum>(D)</enum><text>the term <term>Office</term> means the Office of Personnel Management;</text></subparagraph><subparagraph id="idF10AB5D8934F46948203073F86ED16C2"><enum>(E)</enum><text>the term <term>passing score assessment</term> means an assessment that an individual can pass or fail;</text></subparagraph><subparagraph id="idFCF473EA095A42E3B9FE3F421916FCBF"><enum>(F)</enum><text>the term <term>subject matter expert</term> means an employee—</text><clause id="id0F7DCEED5CB74931A4BBF24F6BD0DD33"><enum>(i)</enum><text>who is determined by the employee's agency to be an expert in the subject and job field of a position in the competitive service; and</text></clause><clause id="id1816D49B795A4188864724C38AFB181E"><enum>(ii)</enum><text>whom the employee's agency designates to develop and conduct technical assessments; and</text></clause></subparagraph><subparagraph id="idC9D9E6A1689645D6BBB55A4016089300"><enum>(G)</enum><text>the term <term>technical assessment</term> means a position-specific assessment developed under subsection (b)(1)(A).</text></subparagraph></paragraph></subsection><subsection id="id057B4483BB924971B4F096F649F03BD9"><enum>(b)</enum><header>Technical assessments</header><paragraph id="id1E10EEDA7CB54CDEA38915E4AB8675AF"><enum>(1)</enum><header>In general</header><text>For the purpose of conducting an examination for a position in the competitive service, a subject matter expert who is determined by the subject matter expert's agency to be an expert in the subject and job field of the position, as affirmed and audited by the Chief Human Capital Officer or Human Resources Director (as applicable) of that agency, may—</text><subparagraph id="idEF5730C326F1423487DD34CDECDA1631"><enum>(A)</enum><text>develop, in partnership with human resources employees of the examining agency, a position-specific assessment that is relevant to the position; and</text></subparagraph><subparagraph id="idD8087C8F3554474BA09B41F27CCE89D3"><enum>(B)</enum><text>conduct the assessment developed under subparagraph (A) to—</text><clause id="idD0E88D7E534C4357A868BCCA906A39D3"><enum>(i)</enum><text>determine whether an applicant for the position has a passing score to be qualified for the position; or</text></clause><clause id="id21E64C9220354581BE32A6A2035501CC"><enum>(ii)</enum><text>rank applicants for the position as <quote>most qualified</quote> or <quote>qualified</quote> for category rating purposes under section 3319.</text></clause></subparagraph></paragraph><paragraph id="id23EF3BE4B11F4A918910C96300CC10F5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Types of assessments</header><text>A technical assessment developed under paragraph (1) may include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5BF03404506B447EBB439803A8CAF808"><enum>(A)</enum><text>a structured interview;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFD998C4F0774360BD183E6359E7B838"><enum>(B)</enum><text>a work-related sample;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D1FDD5415EA47B4A85483407540F82C"><enum>(C)</enum><text>a custom or generic behavioral assessment (which, if generic, may be customized as needed); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id080829EE7A5F44BDAC190E6FC17867D5"><enum>(D)</enum><text>another assessment.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idF2917A23389440B8BF139E7C365AD1D6"><enum>(3)</enum><header>Sharing and customization of assessments</header><subparagraph display-inline="no-display-inline" commented="no" id="id0D4A0372591B43AD98F6BBB7C53B85BB"><enum>(A)</enum><header>Sharing</header><text>An examining agency may share a technical assessment developed under paragraph (1) with another examining agency.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id3D471E798B8940B7917D24F0D7285244"><enum>(B)</enum><header>Customization</header><text>An examining agency with which a technical assessment is shared under subparagraph (A) may customize the assessment as appropriate.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id2DAFA382DFE14812B25D47A48AF03B96"><enum>(C)</enum><header>Platform for sharing and customization</header><text>The Director shall establish and operate a platform on which examining agencies can share and customize technical assessments under this paragraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ABD173BDC744602A1778E6EB61897DA"><enum>(4)</enum><header>Adoption of determinations by other agencies</header><text>For purposes of sections 3318(b) and 3319(c), an appointing authority, other than the appointing authority requesting a certificate of eligibles, that selects an individual from that certificate in accordance with such section 3318(b) or 3319(c) may adopt the determination described in paragraph (1) of this subsection of a subject matter expert employed by the requesting appointing authority instead of conducting an additional technical assessment of the individual.</text></paragraph></subsection><subsection id="id0888FCE05F954851B61891B3C379B695"><enum>(c)</enum><header>Educational requirements</header><text>The Office</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id19DF963B862B4B83A9A42E8F9C3AE366"><enum>(2)</enum><text>in subsection (c), as so designated, in the second sentence, by striking <quote>this section</quote> and inserting <quote>this subsection</quote>.</text></paragraph></subsection><subsection id="id5b2bd5c360004b53969ae2c5767f2090"><enum>(b)</enum><header>Implementation of passing score assessment requirement</header><text>Not later than 1 year after the date of enactment of this Act, the Director and the head of any other examining agency shall eliminate the use of any examination for the competitive service that does not satisfy the definition of the term <term>examination</term> in subsection (a) of section 3308 of title 5, United States Code, as added by subsection (a) of this section.</text></subsection><subsection id="id26fc7dc5f13e4fceb576a344dc0e2c86"><enum>(c)</enum><header>OPM reporting</header><paragraph id="idE223FD31F7804650A8C806287F86547D"><enum>(1)</enum><header>Public dashboard</header><subparagraph id="idC768B02D09CA4D39A0611547ACA77D13"><enum>(A)</enum><header>In general</header><text>The Director shall maintain and periodically update a publicly available dashboard that, with respect to each position in the competitive service for which an examining agency examined applicants during the applicable period, includes—</text><clause id="idab88aeb278e34d9d9aa0e76c7c476327"><enum>(i)</enum><text>the type of assessment used, such as—</text><subclause id="id504D3A4F32EE49278F2403AF817F0AA4"><enum>(I)</enum><text>a behavioral off-the-shelf assessment;</text></subclause><subclause id="id4E2F506E0E5E4D358812FD4E08F587C6"><enum>(II)</enum><text>a résumé review conducted by a subject matter expert;</text></subclause><subclause id="id76237E3D684A458FB7BBE59F2F5973B1"><enum>(III)</enum><text>an interview conducted by a subject matter expert;</text></subclause><subclause id="idAE644137CD0E491A8D91B0BD355CCA36"><enum>(IV)</enum><text>a technical off-the-shelf assessment; or</text></subclause><subclause id="id976FDFEB86DE4A9C85ADA462258C76BC"><enum>(V)</enum><text>a cognitive ability test;</text></subclause></clause><clause id="id3E05FE280D934BFA8D82782A06D7F580"><enum>(ii)</enum><text>whether or not the agency selected a candidate for the position; and</text></clause><clause id="idF2710A8E1D2245D9AD0E524A9096A209"><enum>(iii)</enum><text>the hiring authority used to fill the position.</text></clause></subparagraph><subparagraph id="idE784C001853B40CB8F886278DC777E1F"><enum>(B)</enum><header>Timing</header><clause id="id3CC9AB1D16E440CF9666A9888DFA38AE"><enum>(i)</enum><header>Initial data</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall update the dashboard described in subparagraph (A) with data for positions in the competitive service for which an examining agency examined applicants during the period beginning on the date of enactment of this Act and ending on the date of submission of the report.</text></clause><clause id="id0FAB86A6833B449CA532AAEB31115CE8"><enum>(ii)</enum><header>Subsequent updates</header><text>Not later than October 1 of each fiscal year beginning after the date on which the dashboard is initially updated under clause (i), the Director shall update the dashboard described in subparagraph (A) with data for positions in the competitive service for which an examining agency examined applicants during the preceding fiscal year.</text></clause></subparagraph></paragraph><paragraph id="id7C660E1DCD344FE581FA6F045281A763"><enum>(2)</enum><header>Annual progress report</header><text>Each year, the Director shall make publicly available and submit to Congress an overall progress report that includes summary data of the use of examinations (as defined in subsection (a) of section 3308 of title 5, United States Code, as added by subsection (a) of this section) for the competitive service, including technical assessments, broken down by applicant demographic indicator, including veteran status, race, gender, disability, and any other measure the Director determines appropriate, using the data available as of October 1, 2020, as a baseline.</text></paragraph></subsection><subsection id="id2A85FE25F5A447D7AFDEF45D0BDC68CF"><enum>(d)</enum><header>GAO report</header><text>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text><paragraph id="idb237d58ebfac41c599c290b07d0547e2"><enum>(1)</enum><text>assesses the implementation of this section and the amendments made by this section;</text></paragraph><paragraph id="ida318d5b6f7a8442a8a7a937646b655b5"><enum>(2)</enum><text>assesses the impact and modifications to the hiring process for the competitive service made by this section and the amendments made by this section; and</text></paragraph><paragraph id="ida056e82309ab4a26ae38c0c00c84d489"><enum>(3)</enum><text>makes recommendations for the improvement of the hiring process for the competitive service.</text></paragraph></subsection></section><section id="idC342BCADC73E49E991F044095F33F84B"><enum>4.</enum><header>Amendments to Competitive Service Act of 2015</header><subsection id="id8666C95F47354B6D806E5B43DF7D0757"><enum>(a)</enum><header>Platforms for sharing certificates of eligibles</header><text>Section 3318(b) of title 5, United States Code, is amended—</text><paragraph id="id4AF58DF2F28C4C718AF88E8104839BAF"><enum>(1)</enum><text>in paragraph (1), by striking <quote>240-day</quote> and inserting <quote>1-year</quote>;</text></paragraph><paragraph id="idCA9F97EEFA82419F90251A16978F0123"><enum>(2)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></paragraph><paragraph id="idA634F45D15AE4EAD95EE3A1A851A6557"><enum>(3)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE48D5F8E978471D86EF5E7367B9A518"><paragraph id="idBEF856279CC44FA9ACF7CB59A658E763"><enum>(5)</enum><header>Platform for sharing résumés of individuals on certificates of eligibles</header><text>The Director of the Office shall establish and operate a platform on which an appointing authority can share, with other appointing authorities and the Chief Human Capital Officers Council established under section 1303 of the Chief Human Capital Officers Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/1401">5 U.S.C. 1401</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>), the résumés of individuals who are on a certificate of eligibles requested by the appointing authority. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD8691C719A604FE5A12C276BE22BDF80"><enum>(b)</enum><header>Maximizing sharing of applicant information</header><text>Section 2 of the Competitive Service Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/137">Public Law 114–137</external-xref>; 130 Stat. 310) is amended—</text><paragraph id="id4863BEBB15C5450C889F371E337F64FD"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="id6B03548068F14E8E87C5059DC48D3C96"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03C3B45301464F0DAADF9C8F4D2AC67A"><subsection id="idE5559A91E64149D4BF29ED81590DA610"><enum>(c)</enum><header>Maximizing sharing of applicant information</header><paragraph id="id5E41AF1503F54C2AB78159BA96AA6033"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="idECD6622749244575A7AA7D4BB1957136"><enum>(A)</enum><text>the terms <term>agency</term>, <term>Director</term>, and <term>Office</term> have the meanings given those terms in section 3308(a) of title 5, United States Code; and</text></subparagraph><subparagraph id="id4122747D113B42A89BC13693882AF994"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="idA6E9AFE99889426CBA4A694CCB60E3AC"><enum>(2)</enum><header>Maximizing sharing</header><text>The Director shall maximize the sharing of information among agencies regarding qualified applicants for positions in the competitive service, including by—</text><subparagraph id="id1CE4A8754880442FAD193810C5C457E9"><enum>(A)</enum><text>providing for the delegation to other agencies of the authority of the Office to host multi-agency hiring actions to increase the return on investment on high-quality pooled announcements; and</text></subparagraph><subparagraph id="idec54a464c65a423b8f01461480a6ea77" commented="no"><enum>(B)</enum><text>sharing certificates of eligibles for appointment.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id486AF13C03044A69BCE9D8E3D838CB5C"><enum>(c)</enum><header>Amendment of implementing regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall promulgate regulations to carry out the amendments made by this section.</text></subsection></section><section id="idc56197f105d34f40aa78c3ba820759fd"><enum>5.</enum><header>Modernizing and reforming the assessment and hiring of Federal job candidates</header><subsection id="id70d4808fc86f4b338e8b2de4fd191927"><enum>(a)</enum><header>In general</header><text>Subsection (c) of section 3308 of title 5, United States Code, as so designated by section 3(a), is amended—</text><paragraph id="id8ac75baf8229449889cbb0d2c2cdc235"><enum>(1)</enum><text>by striking <quote>scientific, technical, or professional</quote>;</text></paragraph><paragraph id="id36b1917ec6ec418586f96ee51e53baf6"><enum>(2)</enum><text>by inserting <quote>legally</quote> before <quote>performed</quote>; and</text></paragraph><paragraph id="idccb1d4695bbe4d93817677c6ea4822c3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>by inserting <quote>in a jurisdiction in which the duties of the position are to be performed</quote> after <quote>a prescribed minimum education</quote>.</text></paragraph></subsection><subsection id="id94b854e42510422bb5a576ab5e87832f"><enum>(b)</enum><header>Implementation</header><paragraph id="id8AF9DD4E2A634114A395430AABBA3DE8"><enum>(1)</enum><header>Regulations and guidance documents</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall amend all regulations and guidance documents as necessary to implement the amendments made by subsection (a).</text></paragraph><paragraph id="id9e20fa1f84304687aa204e3d6fbde630" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Hiring practices</header><text>Not later than 1 year after the date of enactment of this Act, the Director and the head of any other examining agency shall amend the hiring practices of the Office or the other examining agency, respectively, in accordance with the amendments made by subsection (a).</text></paragraph></subsection></section><section id="id9adb66927f55404da4cbe8e66941b0fb"><enum>6.</enum><header>Talent teams</header><subsection id="id59748CFB742E4DCEAB45A8EAF15BABE4"><enum>(a)</enum><header>Federal agency talent teams</header><paragraph id="idE4DA3BA7397E4FBCB5BA7FC17A52AC68"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An agency may establish 1 or more talent teams (referred to in this section as <term>agency talent teams</term>), including at the component level.</text></paragraph><paragraph id="id7A2C9CB8657446FAB5831B03ABDB01AE"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">An agency talent team shall provide hiring support to the agency and other agencies, including by—</text><subparagraph id="id0077B8A6F05742A597B24BA2E4992FB8"><enum>(A)</enum><text display-inline="yes-display-inline">improving examinations (as defined in subsection (a) of section 3308 of title 5, United States Code, as added by section 3(a));</text></subparagraph><subparagraph id="id3208C7CE469E402C9F36F48D98E57AA8"><enum>(B)</enum><text>facilitating writing job announcements for the competitive service;</text></subparagraph><subparagraph id="id07D2917D064249FC9CF0A2E2F1637F24"><enum>(C)</enum><text>sharing high-quality certificates of eligibles; and</text></subparagraph><subparagraph id="idDDA95DDCE51C488884E82F6D0F3A25CE"><enum>(D)</enum><text>facilitating hiring for the competitive service using examinations (as defined in such subsection (a)) and subject matter experts.</text></subparagraph></paragraph></subsection><subsection id="idb5216df8c450445ab371174d3148ad1d"><enum>(b)</enum><header>Office of Personnel Management</header><text>The Director may establish a Federal talent team to support agency talent teams in facilitating pooled hiring actions across the Federal Government, providing training, and creating technology platforms to facilitate hiring for the competitive service, including—</text><paragraph id="idEE5A7564355E43BAB43C443C1765371C"><enum>(1)</enum><text>the development of technical assessments; and</text></paragraph><paragraph id="id1F301D0E887545D2A6578C60CD9E1903"><enum>(2)</enum><text>the sharing of certificates of eligibles under sections 3318(b) and 3319(c) of title 5, United States Code.</text></paragraph></subsection></section></legis-body></bill>
