which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Housing and Urban Development to reform policies and issue guidance related to health and safety accountability, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HUD Health and Safety Accountability Act</short-title></quote>.</text></section><section id="idD43712FD08B14A4298DE1232EBAFD501"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idA4A44EAD844E4A97BD10AB06DAAEDB5F"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph><paragraph id="id4B7860A76D4F4F63BF6158C8744D1113"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></section><section id="id16BC2C7DBCC94C669C1A40E052F48703"><enum>3.</enum><header>Reforms to management and occupancy reviews</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall make the following reforms to management and occupancy reviews conducted by the Office of Multifamily Housing Programs:</text><paragraph id="idD09631648C22426B8F11CF16B061CBC7"><enum>(1)</enum><text>Form 9843 shall be restructured to include the following as graded factors:</text><subparagraph id="id89a396291a464b19a860f311f6a0d3ac"><enum>(A)</enum><text>Responsiveness of local code violations.</text></subparagraph><subparagraph id="id9fee3717bf1d4006ba68a71ff960638f"><enum>(B)</enum><text>Remediation of health and sanitation and structural integrity issues outlined in uniform physical condition standards inspections.</text></subparagraph><subparagraph id="id68c2f2da2269414dbe04af0ade115ce7"><enum>(C)</enum><text>Remediation of deficiencies outlined in any demand for corrective actions.</text></subparagraph><subparagraph id="ide8de17463f5f451992227a69a851e072"><enum>(D)</enum><text>Restoration of the resident satisfaction section and inclusion of feedback from tenants to contribute to the grading.</text></subparagraph></paragraph><paragraph id="id7c11263ef0a944f38d64d2e0deee9a99"><enum>(2)</enum><text>Rebalance existing grading methodology to prioritize—</text><subparagraph id="id008fca17780e4542b49665a087c28eec"><enum>(A)</enum><text>health, safety, and sanitation conditions;</text></subparagraph><subparagraph id="id1c5167e1688f4324a6c0c46b7940db3e"><enum>(B)</enum><text>general physical condition is compliant with contractual standards; and</text></subparagraph><subparagraph id="idb0d11af50a634d9ea0170f6dbd574162"><enum>(C)</enum><text>remediation of tenant concerns regarding unit conditions, particularly health, safety, and sanitation.</text></subparagraph></paragraph><paragraph id="id34139dbfb1b94252a31f03c55c26b87d"><enum>(3)</enum><text>The Performance Based Contract Administrator may formally recommend abatement or cure period for properties and resident units that do not meet contractual or Federal, State, or local standards.</text></paragraph><paragraph id="id057cae9b3b164014adee880dd11adadd"><enum>(4)</enum><text>Owner-reported notices of local code violations, security and incident reports, and uniform physical condition standards inspection reports from the Department shall be included in the review for the category for overall assessment and score results.</text></paragraph><paragraph id="id4759ba50376a44789d0d1577bc1141f7"><enum>(5)</enum><text>During the review, Performance Based Contract Administrators may assess conditions of both occupied (with resident consent) and unoccupied units.</text></paragraph><paragraph id="id40d041be1225433989907587ad3a509c"><enum>(6)</enum><text>If a property that has not received a uniform physical condition standards inspection within 1 year receives an <quote>unsatisfactory</quote> rating on a review, a uniform physical condition standards inspection shall be automatically required within 120 days.</text></paragraph><paragraph id="idb809c85896f941a68981a06a00146db4"><enum>(7)</enum><text>Allows the Secretary to allocate revenue from civil money penalties on owners as a result of housing assistance payment contract violations to fund the reviews and uniform physical condition standards inspections.</text></paragraph></section><section id="id694f0c515aba4d8c8f1309489cbb57b2"><enum>4.</enum><header>Reforms to local code enforcement</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall issue guidance to reform local code enforcement by the Department, including by requiring owners, or designated property managers, of properties receiving project-based rental assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) to—</text><paragraph id="idEC6125BC6EDB41C6A236E60BDA668EE8"><enum>(1)</enum><text>report to the appropriate Performance Based Contract Administrator and regional office of the Department within 14 days of receiving official notice—</text><subparagraph id="idf2cb4596313540749d81f29954fd0e91"><enum>(A)</enum><text>local code enforcement findings of deficient conditions at properties both generally and at resident units, including—</text><clause id="id1ae5ca2fa18044229b063fb098cfa411"><enum>(i)</enum><text>a copy of the official notice; </text></clause><clause id="id320bfe622a884289b2e255365fb3f927"><enum>(ii)</enum><text>a summary of the deficiency findings; and</text></clause><clause id="id63f4cea6fe5d4471be68b017d1432444"><enum>(iii)</enum><text>a priority summary of health and safety conditions cited and compliance requirements; and</text></clause></subparagraph></paragraph><paragraph id="id8bbb15dd200645ba9b2fa68f208baeb3"><enum>(2)</enum><text>report to the local code enforcement entity that the owner or designated property manager, as applicable, has submitted the information under paragraph (1).</text></paragraph></section><section id="id3e89730a61fa4bf78f70e16142434f2b"><enum>5.</enum><header>Reforms to HUD oversight</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall issue guidance to—</text><paragraph id="idBC5682ABA1544D5F9B756147D4ED4D66"><enum>(1)</enum><text display-inline="yes-display-inline">reform the scoring methodology for uniform physical condition standards inspections to prioritize health and safety conditions, including interior unit conditions;</text></paragraph><paragraph id="id927d4f2aa0154ccbb40cce7fd5af3a26"><enum>(2)</enum><text>require the Secretary to verify in person that owners have taken action to address health and safety deficiencies outlined in a demand for corrective action;</text></paragraph><paragraph id="id9877b5d7d1b441d4a720c0a193db7b21"><enum>(3)</enum><text>requires property owners to report all deficiencies listed in a demand for corrective action to the applicable Performance Based Contract Administrator; and </text></paragraph><paragraph id="id6e8e4fd62601456a8d2df7a3007dce3e"><enum>(4)</enum><text>allow for the Department to abate individual units assisted under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) from contractual financial payments for exigent health and safety reasons, provided that tenants of such units shall not be required to pay contributions toward rent for during the abatement periods.</text></paragraph></section><section id="idF628E60C61214DA6B2F80F79FC1045D6"><enum>6.</enum><header>Reforms to tenant surveys</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall develop a process by which a Performance Based Contract Administrator shall issue tenant surveys, as follows: </text><paragraph id="ida262c5ff7c164d278d62ffb42a516fde"><enum>(1)</enum><text>For properties receiving a uniform physical condition standards inspection score of not less than 60/100 and not more than 80/100, tenant surveys shall be made available to a sampling of not less than 20 percent of residents of each structure under a housing assistance payments contract, and will be required on the next inspection, and ongoing for each inspection until the property receives a score that is more than 80/100.</text></paragraph><paragraph id="id9976123a7cee4f3fa14a3af317547358"><enum>(2)</enum><text>For properties receiving a uniform physical condition standards inspection score of not more than 59/100, tenant surveys shall be made available for 100 percent of tenants of each structure covered under a housing assistance payments contract for the purpose of identifying consistent or persistent problems with the physical condition of the structure or performance of the manager of the structure.</text></paragraph><paragraph id="ide5e2e943f5bb46dba3ab70085ad12e6d"><enum>(3)</enum><text>The tenant surveys shall be reviewed by the Performance Based Contract Administrator and included as graded factors in uniform physical condition standards inspections, with priority provided for health and safety deficiencies.</text></paragraph></section><section id="idAF3257978BE84FD3A82AC40A58E3FAE4"><enum>7.</enum><header>Contact information</header><text display-inline="no-display-inline">Each owner of a property receiving assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) shall, on an annual basis, provide to tenants contact information for the applicable—</text><paragraph id="id28B400786B524CCABA546233FED214AE"><enum>(1)</enum><text>regional office of the Department;</text></paragraph><paragraph id="id99697E8A1798403E94563B49226BC155"><enum>(2)</enum><text>local field office of the Department;</text></paragraph><paragraph id="id2BA849F7D22C4F68A5ED56F3D4DD429A"><enum>(3)</enum><text> public housing agency, as defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>); and</text></paragraph><paragraph id="id36100E52B49F41B693045A6F0E2632A1"><enum>(4)</enum><text>Performance Based Contract Administrator.</text></paragraph></section><section id="idA2B28A71B26942DFB493947F6BF5EB54"><enum>8.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report that—</text><paragraph id="idb6f5ce0f59744f53a64562d756d412ad"><enum>(1)</enum><text>examines the capital reserves of each structure under a housing assistance payment contract under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) with a uniform physical condition standards inspection score of 59/100 or below, including the use of funds derived from the housing assistance payment contract for purposes unrelated to the maintenance and capitalization of the structure, and the remediation of health and safety issues outlined in uniform physical condition standards inspections, demands for corrective actions, and notices of default; </text></paragraph><paragraph id="idedb347b8fbf647c0969d2ac7daa35ee5"><enum>(2)</enum><text>includes a list of each structure under a housing assistance payment contract under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) that has received a demand for corrective action from the Department but has not complied with compliance or remediation requirements; </text></paragraph><paragraph id="idd924f9dc966b4297952ddb1b7e2a841f"><enum>(3)</enum><text>a list of each structure under a housing assistance payment contract under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) that has not received a uniform physical condition standards inspection according to the applicable timeline requirements under section 200.857(b) of title 24, Code of Federal Regulations (or any successor regulation) during the 5-year period preceding the date of the report, and a detailed explanation for why each such structure was not inspected in according to the applicable timelines;</text></paragraph><paragraph id="id3b5be46fa32a4e48b83ef476535d0acd"><enum>(4)</enum><text>a detailed list of all crimes of violence (as defined in section 16 of title 18, United States Code) that have taken place at each structure under a housing assistance payment contract under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) during the 5-year period preceding the date of the report, and recommendations for improving safety and precautionary security efforts to keep tenants safe from crimes of violence; and</text></paragraph><paragraph id="idde1ce0edad694428922f78a0c4bb51d3"><enum>(5)</enum><text>a detailed list of programmatic recommendations regarding assistance provided under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), including—</text><subparagraph id="idea09c5aae8bf486cbf3f2f12169cc76f"><enum>(A)</enum><text>improving health, sanitation, and safety conditions;</text></subparagraph><subparagraph id="id3e4d073087e140828ada398ab160efe0"><enum>(B)</enum><text>physical rehabilitation of properties for long-term sustainability; and</text></subparagraph><subparagraph id="ide87e8a03d1f646fc990bb8eb55762c4f"><enum>(C)</enum><text>improving enforcement mechanisms on both property owners and contracted managers to remediate deficiencies. </text></subparagraph></paragraph></section></legis-body></bill>
