<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3402</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211215">December 15, 2021</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S323">Mr. Risch</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S317">Mr. Barrasso</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 54, United States Code, and the Federal Lands Recreation Enhancement Act to prohibit medical discrimination relating to applications for commercial use authorizations and special recreation permits, and to clarify the status of the holders of commercial use authorizations and special recreation permits, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Guides and Outfitters from Coronavirus Vaccine Mandates in the Great Outdoors Act</short-title></quote>.</text></section><section id="idD41E99B826C04DDA8BC320F986438099"><enum>2.</enum><header>National Park Service commercial use authorizations</header><text display-inline="no-display-inline">Section 101925(b) of title 54, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCAF7D2C6C67E4B0ABFCC66D526892FF0"><paragraph id="id5c6be0955582445c9196cbe94428c7b6"><enum>(3)</enum><header>Prohibition of medical discrimination</header><text>The Secretary shall not deny an application for a commercial use authorization under this section for any reason relating to the coronavirus vaccination status of an applicant or an employee of an applicant.</text></paragraph><paragraph id="idcb2a6ba1b0d34384999204bb3ffbbbb1"><enum>(4)</enum><header>Status of holder of commercial use authorization</header><text>A holder of a commercial use authorization issued under this section shall not be considered to be an employee, contractor, or subcontractor of the Federal Government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id805C60F906E3458C8E67DE19874F8C01"><enum>3.</enum><header>Federal land management agency permitting</header><text display-inline="no-display-inline">Section 803(h) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)</external-xref>) is amended—</text><paragraph id="idE7F79DDBF972421C9353E43CA603541C"><enum>(1)</enum><text>by striking <quote>The Secretary may</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDD51228BFF1E4C3B98C68A14541A7BB3"><paragraph id="id0D05D1D95D9643CABFBDA9464831A0F8"><enum>(1)</enum><header>In general</header><text>The Secretary may</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id13285A942F9B4C209C7E24A31831BAF7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2D4042860EC747A689650E77DA4ADB25"><paragraph id="id0314F392BD6E4B42BCEC0C19FB97943D"><enum>(2)</enum><header>Prohibition of medical discrimination</header><text>The Secretary shall not deny an application for a special recreation permit under paragraph (1) for any reason relating to the coronavirus vaccination status of an applicant or an employee of an applicant.</text></paragraph><paragraph id="id1F0626DBB6D24F83A7AE3DFAF26A5803"><enum>(3)</enum><header>Status of holder of special recreation permit</header><text>A holder of a special recreation permit issued under paragraph (1) shall not be considered to be an employee, contractor, or subcontractor of the Federal Government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
