<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3396</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211215">December 15, 2021</action-date><action-desc><sponsor name-id="S381">Mr. Rounds</sponsor> (for himself and <cosponsor name-id="S338">Mr. Manchin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the position of the Principal Cyber Advisor, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Defense Principal Cyber Advisor Empowerment Act of 2021</short-title></quote>.</text></section><section id="id9564F9490E3F4617952087ACC90828F8"><enum>2.</enum><header>Modification of position of Principal Cyber Advisor</header><subsection id="idb72d9f47abf44f8781f88ef0db2d2b7f"><enum>(a)</enum><header>Designation of Principal Cyber Advisor</header><text>Paragraph (1) of section 932(c) of the National Defense Authorization Act for Fiscal Year 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2224">10 U.S.C. 2224</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd4d86122d6e54b4a8dac4dc8f72e2bad"><paragraph id="idcd989902e70341fcb872e11a2793860e"><enum>(1)</enum><header>Designation</header><subparagraph commented="no" display-inline="yes-display-inline" id="id3A83206928EF49F7A4BBB97DE392B4C4"><enum>(A)</enum><text>The Secretary shall designate, from among the personnel of the Office of the Under Secretary of Defense for Policy, a Principal Cyber Advisor to act as the principal advisor to the Secretary on military cyber forces and activities.</text></subparagraph><subparagraph id="id6501A047645E4A889F696ED919E18B9F" indent="up1"><enum>(B)</enum><text>The Secretary may only designate an official under this paragraph if such official was appointed to the position in which such official serves by and with the advice and consent of the Senate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id311d80f9e58e4b4da941c415251b9377"><enum>(b)</enum><header>Designation of Deputy Principal Cyber Advisor</header><text>Section 905(a)(1) of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/391">10 U.S.C. 391</external-xref> note) is amended by striking <quote>Secretary of Defense</quote> and inserting <quote>Under Secretary of Defense for Policy</quote>.</text></subsection><subsection id="idd1aaa3e5ffb6465ea45a279028e87b20"><enum>(c)</enum><header>Briefing</header><text>Not later than 90 days after the date of the enactment of this Act, the Deputy Secretary of Defense shall brief the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives on such recommendations as the Deputy Secretary may have for alternate reporting structures for the Principal Cyber Advisor and the Deputy Principal Cyber Advisor within the Office of the Secretary of Defense.</text></subsection></section></legis-body></bill>
