which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To promote the general health and well-being of individuals accessing work through digital marketplace companies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Gig Economy Workers Act of 2021</short-title></quote>.</text></section><section id="idE379F70180464EEE8BCE8560347ABC79"><enum>2.</enum><header>Digital marketplace company safe harbor</header><subsection id="idBBF604B887CF49BCA967507C006A85A8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id51b394d8ee364105b71c27cbe8b31c80"><enum>(1)</enum><header>COVID–19 emergency period</header><text>The term <term>COVID–19 emergency period</term> means the period beginning March 15, 2020, and ending on the later of—</text><subparagraph id="id440498572E4D4F8890DBA6B9A8CE0AF6"><enum>(A)</enum><text>December 31, 2021; or</text></subparagraph><subparagraph id="idf8fe154e842d4fc18b67dbf07f2cce8a"><enum>(B)</enum><text>the date of expiration of the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19.</text></subparagraph></paragraph><paragraph id="idBBF7C581C63440A3A0F531D728AC4FFB"><enum>(2)</enum><header>Digital marketplace company</header><text>The term <term>digital marketplace company</term> means a business entity affecting commerce that—</text><subparagraph id="id3D3219C3A22241429F2675E74A76AD79"><enum>(A)</enum><text>maintains an online-enabled application or platform to facilitate the exchange of goods or services by users of the online-enabled application or platform;</text></subparagraph><subparagraph id="idA20BA845983A465DBDE62CA0132D9A8A"><enum>(B)</enum><text>licenses access to an online-enabled application or platform to facilitate the exchange of goods or services; and </text></subparagraph><subparagraph id="id22E09E257AC04446B7AC5E61CDEFD49E"><enum>(C)</enum><text>does not require a licensee using the online-enabled application or platform to generate business to accept any specific job request as a condition of maintaining access to the entity's online-enabled application or platform. </text></subparagraph></paragraph><paragraph id="id22f3f833cbdd456aaa132d999407550d"><enum>(3)</enum><header>Individual accessing work through a digital marketplace company</header><text>The term <term>individual accessing work through a digital marketplace company</term> means an individual who—</text><subparagraph id="id67097114a7744f8d871d5eb33801d405"><enum>(A)</enum><text>is provided with the option to accept or reject job requests through an online-enabled application or platform maintained by a digital marketplace company; and</text></subparagraph><subparagraph id="id5c6cb83368e64d76bb5d817a601bbb12"><enum>(B)</enum><text>provides services to digital platform consumers upon connection through a digital network maintained by the digital marketplace company in exchange for compensation or payment of a fee. </text></subparagraph></paragraph></subsection><subsection id="id1CE9C9BBFBCE4A80921AB632104B0FB6"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in order to promote the general health and well-being of individuals accessing work through digital marketplace companies and to facilitate financial assistance during public health emergencies, actions described in subsection (c) taken by a digital marketplace company during the COVID–19 emergency period shall not be used under any Federal, State, or local law, ordinance, or regulation as evidence for the purposes of—</text><paragraph id="id58a843e509824d2ebeda6ff6de375e06"><enum>(1)</enum><text>determining whether an individual accessing work through the digital marketplace company is an employee or independent contractor; or</text></paragraph><paragraph id="id0A4D5FE33D664E4BA442B2F958D37CB7"><enum>(2)</enum><text>determining whether the digital marketplace company is the joint employer of an individual who is providing services on behalf of another company.</text></paragraph></subsection><subsection id="idD61947458A4A432C84C387034D04A540"><enum>(c)</enum><header>Protected actions</header><text>The actions described in this subsection are—</text><paragraph id="idf8266c94d6864e92be55a6d4444879ca"><enum>(1)</enum><text>providing financial assistance to individuals who previously accessed work through the digital marketplace company but are unable to work because of health or safety concerns; </text></paragraph><paragraph id="id4bca4336b8fa447c8416cdcd813ddcbb"><enum>(2)</enum><text>directly providing benefits that are related to the health or safety of individuals accessing work through the digital marketplace company;</text></paragraph><paragraph id="idfdc3133532614e48ac7323685d8bcdaa"><enum>(3)</enum><text>providing training or information related to the health or safety of such individuals or the public; </text></paragraph><paragraph id="id6a5d0fd4c8424616a90fe5c5ce62403c"><enum>(4)</enum><text>providing medical or cleaning supplies to such individuals;</text></paragraph><paragraph id="id8f7defc5a9a44a36b6c48a6d9f2f1de4"><enum>(5)</enum><text>performing health checks on such individuals;</text></paragraph><paragraph id="id42cb45cb4d254b4c8bb6225da43a4b2b"><enum>(6)</enum><text>providing medical testing to such individuals; and</text></paragraph><paragraph id="idf3715a53c8ca4e568fa4dc2f0dc8ca95"><enum>(7)</enum><text>taking any action, including those required or suggested by any Federal, State, or local law, ordinance, order, or directive of any type, that is intended to protect public health and safety. </text></paragraph></subsection></section></legis-body></bill>
