Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Senior Scams Prevention Advisory Council.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" changed="not-changed" id="id8c62b9de-c5ff-47f7-928c-77e231b6440c"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Senior Scams Act</short-title></quote>.</text></section><section changed="not-changed" id="id1c01431f-7e64-464a-81de-308bb949042d"><enum>2.</enum><header>Senior Scams Prevention Advisory Group</header><subsection changed="not-changed" id="id0568cbc5-0b3e-4b9b-a9a7-f96fb2bb148d"><enum>(a)</enum><header>Establishment</header><text>There is established a Senior Scams Prevention Advisory Group (referred to in this Act as the <term>Advisory Group</term>).</text></subsection><subsection changed="not-changed" id="id85ad68fe-15c0-4757-a819-6e4f351c60ff"><enum>(b)</enum><header>Members</header><text>The Advisory Group shall be composed of stakeholders such as the following individuals or the designees of those individuals:</text><paragraph id="id3f56c5cf-06e4-4266-aff9-3b15473640c6" changed="not-changed"><enum>(1)</enum><text>The Chairman of the Federal Trade Commission.</text></paragraph><paragraph id="id429ff631-6cdf-4d70-ae4c-80e01093e927" changed="not-changed"><enum>(2)</enum><text>The Secretary of the Treasury.</text></paragraph><paragraph id="id4f55d16a-5c7d-46fa-b308-f5be5c8dee6e" changed="not-changed"><enum>(3)</enum><text>The Attorney General.</text></paragraph><paragraph id="id0df9922e-e4b5-477b-a9f2-3f4a2494588b" changed="not-changed"><enum>(4)</enum><text>The Director of the Bureau of Consumer Financial Protection.</text></paragraph><paragraph id="id73533dcb-30ef-40b4-b207-828380d04fe0" changed="not-changed"><enum>(5)</enum><text>Representatives from each of the following sectors, including trade associations, to be selected by Federal Trade Commission:</text><subparagraph id="idab792005-0eef-43da-97c8-07672859dd88" changed="not-changed"><enum>(A)</enum><text>Retail.</text></subparagraph><subparagraph id="id0c65f47c-1397-47e4-8d78-260ba875448b" changed="not-changed"><enum>(B)</enum><text>Gift cards.</text></subparagraph><subparagraph id="id83b80efd-ff8e-4e84-843c-334e5f786929" changed="not-changed"><enum>(C)</enum><text>Telecommunications.</text></subparagraph><subparagraph id="id7985a91d-65c8-440f-a60e-f909e7d4d4d4" changed="not-changed"><enum>(D)</enum><text>Wire-transfer services.</text></subparagraph><subparagraph id="id685a4b2b-a300-4bf8-a370-126514701044" changed="not-changed"><enum>(E)</enum><text>Senior peer advocates.</text></subparagraph><subparagraph id="ide2b93c1f-16c8-409c-8137-0c7a7b24e0a0" changed="not-changed"><enum>(F)</enum><text>Consumer advocacy organizations with efforts focused on preventing seniors from becoming the victims of scams.</text></subparagraph><subparagraph id="ida539dd55-22fd-4cab-8eb8-548582e88c02" changed="not-changed"><enum>(G)</enum><text>Financial services, including institutions that engage in digital currency.</text></subparagraph><subparagraph id="id3fd72fbb-f230-416b-a693-becb646637a9" changed="not-changed"><enum>(H)</enum><text>Prepaid cards.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c1bf793-9331-497a-bb03-868501714091" changed="not-changed"><enum>(6)</enum><text>A member of the Board of Governors of the Federal Reserve System.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38b6295c-8497-4b35-a18b-60de8038e4b7" changed="not-changed"><enum>(7)</enum><text>A prudential regulator, as defined in section 1002 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3fc92963-3935-4000-b46d-d1af3888c058" changed="not-changed"><enum>(8)</enum><text>The Director of the Financial Crimes Enforcement Network.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide212882a-5a68-460c-9b60-27bda878661b" changed="not-changed"><enum>(9)</enum><text>Any other Federal, State, or local agency, industry representative, consumer advocate, or entity, as determined by the Federal Trade Commission.</text></paragraph></subsection><subsection changed="not-changed" id="id57FF97AE83E04DB789FCD9E481B381D4"><enum>(c)</enum><header>No compensation for members</header><text>A member of the Advisory Group shall serve without compensation in addition to any compensation received for the service of the member as an officer or employee of the United States, if applicable.</text></subsection><subsection changed="not-changed" id="idd05c8e7c-ac52-4549-b798-3c5ec056c488"><enum>(d)</enum><header>Duties</header><paragraph id="id3ccc6e1c-60da-4dec-88b3-229ad21dbb46" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Advisory Group shall—</text><subparagraph id="idb5ce3534-a8df-43a7-b0fb-5124a8d006e9" changed="not-changed"><enum>(A)</enum><text>collect information on the existence, use, and success of educational materials and programs for retailers, financial services, and wire-transfer companies, which—</text><clause id="id588e802e-ef95-4fb6-acc5-3f28d9194e5c" changed="not-changed"><enum>(i)</enum><text>may be used as a guide to educate employees on how to identify and prevent scams that affect seniors; and</text></clause><clause id="id8e7070c3-296a-424b-bedb-192f82f95ef8" changed="not-changed"><enum>(ii)</enum><text>include—</text><subclause id="id5013e87a-44ac-4150-81ec-a765951af872" changed="not-changed"><enum>(I)</enum><text>useful information for retailers, financial services, and wire transfer companies for the purpose described in clause (i);</text></subclause><subclause id="idf4495146-de8e-4c41-b332-9cd54ffbfe0a" changed="not-changed"><enum>(II)</enum><text>training for employees on ways to identify and prevent senior scams;</text></subclause><subclause id="id228f3880-d1e8-43d9-8803-2e62f5298cd5" changed="not-changed"><enum>(III)</enum><text>best practices for keeping employees up to date on current scams;</text></subclause><subclause id="id7b2d7a72-8bea-42a7-b239-14916f5b16e6" changed="not-changed"><enum>(IV)</enum><text>the most effective signage and placement in retail locations to warn seniors about scammers’ use of gift cards, prepaid cards, and wire transfer services;</text></subclause><subclause id="id16b3642f-f3be-4ce0-b8e8-8ab78d5bae5c" changed="not-changed"><enum>(V)</enum><text>suggestions on effective collaborative community education campaigns;</text></subclause><subclause id="idd8438f13-9a64-4102-a52b-430442b77727" changed="not-changed"><enum>(VI)</enum><text>available technology to assist in identifying possible scams at the point of sale; and</text></subclause><subclause id="id4ef3dc6e-2f2a-48f5-aa83-80bdec284075" changed="not-changed"><enum>(VII)</enum><text>other information that would be helpful to retailers, wire transfer companies, financial institutions, and their employees as they work to prevent fraud affecting seniors; and</text></subclause></clause></subparagraph><subparagraph id="id640d2530-0357-4a70-9e36-a0a128071047" changed="not-changed"><enum>(B)</enum><text>based on the findings in subparagraph (A)—</text><clause id="id6f892283-16ae-4c29-872c-5014501cddcf" changed="not-changed"><enum>(i)</enum><text>identify inadequacies, omissions, or deficiencies in those educational materials and programs for the categories listed in subparagraph (A) and their execution in reaching employees to protect older adults; and</text></clause><clause id="id0a7174d8-547a-4262-a3f2-debd96e96913" changed="not-changed"><enum>(ii)</enum><text>create model materials, best practices guidance, or recommendations to fill those inadequacies, omissions, or deficiencies that may be used by industry and others to help protect older adults from scams.</text></clause></subparagraph></paragraph><paragraph id="idcbf81e61-17f7-42d7-b79c-863cf99ba7ec" changed="not-changed"><enum>(2)</enum><header>Encouraged use</header><text>The Chairman of the Federal Trade Commission shall—</text><subparagraph id="idb2af52bb-3766-4342-a6b1-95759764b1ee" changed="not-changed"><enum>(A)</enum><text>make the materials or guidance created by the Federal Trade Commission described in paragraph (1) publicly available; and</text></subparagraph><subparagraph id="id1c5a2402-f64c-4658-b4af-1ba5bcdf9fc9" changed="not-changed"><enum>(B)</enum><text>encourage the use and distribution of the materials created under this subsection to prevent scams affecting seniors by governmental agencies and the private sector.</text></subparagraph></paragraph></subsection><subsection changed="not-changed" id="idd962d507-df33-4fed-9c85-99fc90219880"><enum>(e)</enum><header>Reports</header><text>Section 101(c)(2) of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21711">34 U.S.C. 21711(c)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HD7AD23F36E3A4BAD84F21593D9CB19FF"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(iv), by striking the period at the end and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H065126D7F1B24E74AFB8E7A4C54FA6EE"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H210D069390444E75A3DFA24A8942E7D2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" changed="not-changed" id="id14d3e2e7-06bc-497e-bbfa-faa03591c20c"><subparagraph id="id49097dd2-32c8-48b3-b5c5-b76f85769885" changed="not-changed"><enum>(C)</enum><text>for the Federal Trade Commission, in relevant years, information on—</text><clause id="id27689a1c-1537-4d3f-ba1e-48dfafb2d757" changed="not-changed"><enum>(i)</enum><text>the newly created materials, guidance, or recommendations of the Senior Scams Prevention Advisory Group established under section 2 of the <short-title>Stop Senior Scams Act</short-title>, and any relevant views or considerations made by members of the Advisory Group that were not included in the Advisory Group’s model materials or considered an official recommendation by the Advisory Group;</text></clause><clause id="id393168e2-e6f1-477f-b1de-dfe7b2d2e3d3" changed="not-changed"><enum>(ii)</enum><text>the Senior Scams Prevention Advisory Group’s findings about senior scams and industry educational materials and programs; and</text></clause><clause id="id80ed4bcc-00f3-48e4-beb9-303c14cf85ee" changed="not-changed"><enum>(iii)</enum><text>any recommendations on ways stakeholders can continue to work together to reduce scams affecting seniors.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection changed="not-changed" id="id881a92ba-475c-48ed-a44c-a1a35d5324bc"><enum>(f)</enum><header>Termination</header><text>This Act, and the amendments made by this Act, ceases to be effective on the date that is 5 years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
