which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the Iraq and Afghanistan Service Grant and the Children of Fallen Heroes Grant.</official-title></form><legis-body><section id="idB0EC32A3981C4295BBF6309CEA50A8B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Gold Star Families Education Act</short-title></quote>.</text></section><section id="idDC8A55552A5C457E8229DBE68FC560DC"><enum>2.</enum><header>Improving Iraq and Afghanistan Service Grant and Children of Fallen Heroes Grant</header><subsection id="id6742026a660d42b29a602d70f8c4a023"><enum>(a)</enum><header>Technical amendment relating to Iraq and Afghanistan Service Grant and Children of Fallen Heroes Grant</header><text>Part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>), as amended by section 703 of the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), is amended—</text><paragraph id="id68c877fd2bbf43698268d61663760a82"><enum>(1)</enum><text>in section 401—</text><subparagraph id="idf5ee188dde1f4b16841a1a11c15f259f"><enum>(A)</enum><text>in subsection (c)—</text><clause id="idc00e19921417441689f75c6701cb67d5"><enum>(i)</enum><text>in paragraph (2)—</text><subclause id="id7569e390581549ea914b5c77f78e3d1d"><enum>(I)</enum><text>by striking subparagraph (A); and</text></subclause><subclause id="id05430d4a624045d6ac05f7afbc1a697a"><enum>(II)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (A) and (B), respectively;</text></subclause></clause><clause id="id99696996d9394bfb8d360d4ad026b1f2"><enum>(ii)</enum><text>in paragraph (3)(A), by striking <quote>(2)(B)(i)</quote> and inserting <quote>(2)(A)(i)</quote>;</text></clause><clause id="idf544f767df0a4961a09ac683d7cb0efb"><enum>(iii)</enum><text>by redesignating paragraph (5) as paragraph (7); and</text></clause><clause id="ida5383f4f0e4545b7a4f614ef500d31ff"><enum>(iv)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf94db955893f4083930147635e4a0825"><paragraph id="id43babfe6f9674dc79e8bea0ae8cfbc39"><enum>(5)</enum><header>Prevention of double benefits</header><text>No eligible student described in paragraph (2) may concurrently receive a grant under both this subsection and subsection (b).</text></paragraph><paragraph id="idc5393ab676ce4596849cb56266e78c38"><enum>(6)</enum><header>Terms and conditions</header><text>The Secretary shall award grants under this subsection in the same manner and with the same terms and conditions, including the length of the period of eligibility, as the Secretary awards Federal Pell Grants under subsection (b), except that—</text><subparagraph id="id8f9f4660b17949d1b6334ec7bd7850fe"><enum>(A)</enum><text>the award rules and determination of need applicable to the calculation of Federal Pell Grants under subsection (b)(1) shall not apply to grants made under this subsection; and</text></subparagraph><subparagraph id="id70cc128f9f5648a0ad4426826d810bcb"><enum>(B)</enum><text>the maximum period determined under subsection (d)(5) shall be determined by including all grants made under this section received by the eligible student and all grants so received under subpart 10 before the effective date of this subsection.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id30692f1046ab44f7a6469a5ec6af2d7b"><enum>(2)</enum><text>by striking section 420R (<external-xref legal-doc="usc" parsable-cite="usc/20/1070h">20 U.S.C. 1070h</external-xref>).</text></paragraph></subsection><subsection id="id5383e692bb2c49a981443007e224e4bc"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect as if included in section 703 of the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) and subject to the effective date of section 701(b) of such Act.</text></subsection><subsection id="id3a86625393264615a3132df6a07586a0"><enum>(c)</enum><header>Transition</header><text>The Secretary shall take such steps as are necessary to transition from the Iraq and Afghanistan Service Grant program under subpart 10 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070h">20 U.S.C. 1070h</external-xref>), as in effect on the day before the effective date of this section, and the provision of Federal Pell Grants under section 401(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a(c)</external-xref>), as amended by the FAFSA Simplification Act and this Act.</text></subsection></section></legis-body></bill>
