which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to strengthen benefits for children of Vietnam veterans born with spina bifida, and for other purposes. </official-title></form><legis-body><section id="id85796C31219041F8860243F82876F028" section-type="section-one"><enum>1.</enum><header>Benefits for certain children of Vietnam veterans and certain other veterans</header><subsection id="id941185FAB6DB4508848EF031556D20C3"><enum>(a)</enum><header>Definitions</header><text>Section 1831 of title 38, United States Code, is amended—</text><paragraph id="id21C4DDC3F30C4AFD92988DDE13DE2E0C"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (4) and (5), respectively; and </text></paragraph><paragraph id="id0B3E7D1E7DE248158DFFFE3B2F31B2A5"><enum>(2)</enum><text>by inserting after paragraph (1) the following new paragraphs: </text><quoted-block id="idB1C6B6C2C317454388834917E096B0A6" display-inline="no-display-inline" style="USC" act-name=""><paragraph id="idDD4B99232E3445BCA91B0F35BF37B222"><enum>(2)</enum><text>The term <term>covered child</term> means a child who is eligible for health care and benefits under this chapter.</text></paragraph><paragraph id="id807CE5D14D3D4102B504BF37E2E1C5F0"><enum>(3)</enum><text>The term <term>covered veteran</term> means an individual whose children are eligible for health care and benefits under this chapter.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="idE60C998FF1804480AA78065A88C20B4C"><enum>(b)</enum><header>In general</header><text>Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/18">chapter 18</external-xref> of title 38, United States Code, is amended by adding at the end the following new sections:</text><quoted-block id="idEC5329AC019049AF85909C4395D1621B" style="USC" act-name=""><section id="id7D77B01045F24FB0B3C5E2D6B07DB249" section-type="subsequent-section"><enum>1835.</enum><header>Advisory council</header><subsection id="idD35EE54A0BC94B75B4AD70525261A45D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish an advisory council on health care and benefits for covered children.</text></subsection><subsection id="id10A6CA58F0824FBBAC50FC6384100EA8"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The advisory council established under subsection (a) shall solicit feedback from covered children and covered veterans on the health care and benefits provided under this chapter and communicate such feedback to the Secretary. </text></subsection></section><section id="id4A34FD6F63424A62827B1F8D8318D2A8"><enum>1836.</enum><header>Care and coordination teams</header><subsection id="idB211BDCA6014485990D9F9F1A93015DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish care and coordination teams for covered children.</text></subsection><subsection id="idEED95155D1D24E77845F1C3D34F76D1C"><enum>(b)</enum><header>Outreach</header><text display-inline="yes-display-inline">A care and coordination team established under subsection (a) shall contact each covered child—</text><paragraph id="id4B08A680CB8D43F8A724FC2D214562D5"><enum>(1)</enum><text display-inline="yes-display-inline">not less frequently than once every 180 days, to ensure the continued care of the child and assist with any changes in care needed due to a changed situation of the child; and </text></paragraph><paragraph id="id91139A8A11374905B53B14349FAA6826"><enum>(2)</enum><text>as soon as practicable after the identification of a condition listed in the report required by subsection (c). </text></paragraph></subsection><subsection id="idADF28EE7F5064FA5A7978C8E697D2317"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report setting forth a list of conditions that will trigger outreach to covered children under subsection (b)(2).</text></subsection></section><section id="id188C305D24E44A4AB16AC90EE8EB9BB8"><enum>1837.</enum><header>Duration of health care and benefits provided</header><text display-inline="no-display-inline">The Secretary shall provide a covered child with health care and benefits under this chapter—</text><paragraph id="id57FD8A015ABE446CBE915D7490FDA117"><enum>(1)</enum><text display-inline="yes-display-inline">for the duration of the life of the child; and </text></paragraph><paragraph id="id9CE3DED701A34880A7FC3342A94D087A"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding any death of a parent of the child that precedes the death of the child.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idF157A54D63BA447CB9FCEF0C7BA27C11"><enum>(c)</enum><header>Memorandum of understanding</header><text>Not later than 90 days after the date of the enactment of this Act, the Under Secretary for Benefits of the Department of Veterans Affairs and the Under Secretary for Health of the Department shall enter into a memorandum of understanding—</text><paragraph id="id22AC5942769F4E7699B15E413509B8A1"><enum>(1)</enum><text>to better assist covered children (as defined in section 1831 of title 38, United States Code, as amended by subsection (a)); and </text></paragraph><paragraph id="idF358005B4DAD4B18A62C01E21FAFAC19"><enum>(2)</enum><text>to establish conditions to be included in the report required by section 1836(c) of title 38, United States Code, as added by subsection (b). </text></paragraph></subsection><subsection id="id7856B6EB6058407095E58FAF735D15F3"><enum>(d)</enum><header>Implementation</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish—</text><paragraph id="idF259C7A9700B4473B77B6A8AAA5A3648"><enum>(1)</enum><text>the advisory council required under section 1835 of title 38, United States Code, as added by subsection (b); and</text></paragraph><paragraph id="idA8CE9F9055D84F50AF9E4A6567038F41"><enum>(2)</enum><text>the care and coordination teams required under section 1836 of such title, as so added.</text></paragraph></subsection><subsection id="id5795184CC2DC47B081AA22BF945F5E99"><enum>(e)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/18">chapter 18</external-xref> of title 38, United States Code, is amended by adding at the end the following new items: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idE9531C0AD967468A8A975CD6175CBB6E"><toc><toc-entry level="section" bold="off">1835.
