<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3359</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211209">December 9, 2021</action-date><action-desc><sponsor name-id="S309">Mr. Casey</sponsor> (for himself, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, and <cosponsor name-id="S308">Mr. Cardin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To award grants to States to support efforts at institutions of higher education to increase degree attainment, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Correctly Recognizing Educational Achievements To Empower Graduates Act</short-title></quote> or the <quote><short-title>CREATE Graduates Act</short-title></quote>.</text></section><section id="idf1b5726812c1493cb25038b45f4cbf83"><enum>2.</enum><header>Create graduates</header><text display-inline="no-display-inline">Title VII of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1133">20 U.S.C. 1133 et seq.</external-xref>) is amended by inserting after part B the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1cedf2aaeb314ec79ecc28034ab0f414"><part id="id270CEFCD0673442AAD4D2D3FB9A5368E" style="OLC"><enum>C</enum><header>Create graduates</header><section id="idea60c5531fc441a9a45bf4d9ce0d3941"><enum>751.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this part is to award grants to States to support efforts at institutions of higher education or within systems of higher education to increase postsecondary degree attainment by—</text><paragraph id="id6e95895649aa4315af4d21e6d720d50a"><enum>(1)</enum><text>locating, and conferring degrees to, students who have accumulated sufficient applicable postsecondary credits and maintained a sufficient grade point average to earn an associate degree but did not receive one;</text></paragraph><paragraph id="idbee9e4d5fbc4413b9bf61f9c4ccbe16b"><enum>(2)</enum><text>providing outreach to those students who are within 12 credits of earning an associate degree; and</text></paragraph><paragraph id="id46fca0e4871c43949a861f89eb562a63"><enum>(3)</enum><text>establishing partnerships between 2-year and 4-year institutions of higher education in States, in order to strengthen the transition pathways into 4-year institutions of higher education for transfer students.</text></paragraph></section><section id="id53be9aa3736a474b84eb518e2ef0359c"><enum>752.</enum><header>Grants to increase degree attainment</header><subsection id="ida480fd8e39ba4a6395910162de61dcb4"><enum>(a)</enum><header>Definition of institution of higher education</header><text>In this part, the term <term>institution of higher education</term> has the meaning given the term in section 101(a).</text></subsection><subsection id="id844e81cc02824e2581de6864b0d18f5c"><enum>(b)</enum><header>Program authorized</header><paragraph id="id6f08674260b64e3187fd85b5910ebf93"><enum>(1)</enum><header>In general</header><text>From amounts appropriated under subsection (j), the Secretary shall award grants, on a competitive basis, to States to enable the States to carry out the activities described in subsections (e) and (f) in order to support efforts at institutions of higher education to increase degree attainment.</text></paragraph><paragraph id="idd1a282a9441b421e91946c308fdb7960"><enum>(2)</enum><header>Partnerships allowed</header><text>A State may apply for a grant under this section in partnership with a nonprofit organization. In any such partnership, the State higher education agency or other State agency described in subsection (c)(1) shall serve as the fiscal agent for purposes of the grant.</text></paragraph></subsection><subsection id="idaede93a1985c4cd68bb43d82d498e0f1"><enum>(c)</enum><header>Submission and contents of application</header><paragraph id="id7232c78dc9d74f3aa3baf520c7be2aa8"><enum>(1)</enum><header>In general</header><text>The State, acting through the State higher education agency or other State agency determined appropriate by the Governor or chief executive officer of the State, shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="id6ef499d80207482c8bb29429643503fc"><enum>(2)</enum><header>Contents</header><text>An application submitted under paragraph (1) shall include the following:</text><subparagraph id="idb76e63f6251f41d188cc0be75a0dcdf0"><enum>(A)</enum><text>A description of the State's capacity to administer the grant under this section and report annually to the Secretary on the progress of the activities and services described in subsection (e).</text></subparagraph><subparagraph id="idb943a4d0b5904d818510c1a128121a62"><enum>(B)</enum><text>A description of how the State will meet the purposes of the grant program under this part through outreach and memoranda of understanding with institutions of higher education, including the State's plan for using grant funds to meet the requirements of subsections (e) and (g) and, if the State elects to use grant funds under such subsection to create strong articulation agreements, subsection (f)(2).</text></subparagraph><subparagraph id="id113a5d17cf564291a61cff86dc7f1340"><enum>(C)</enum><text>A description of how the State will coordinate with appropriate stakeholders, including institutions of higher education, data-sharing agencies within the State, and other States.</text></subparagraph><subparagraph id="idaf1823401c874194968ed9a07e3d9645"><enum>(D)</enum><text>A description of—</text><clause id="idea179f71bb6f4acf8cb487cab460f456"><enum>(i)</enum><text>the structure that the State has in place to administer the activities and services described in subsection (e), including—</text><subclause id="ide43a238b2b3b499691dea06a9c1585b5"><enum>(I)</enum><text>the capacity of the State's longitudinal data system to—</text><item id="idb4e3f38125c6447ca7abb9de19fcc4a6"><enum>(aa)</enum><text>be clean of record duplication and ensure alignment of State and institutional credit completion records;</text></item><item id="id1ff5bcc2bb124d2b9bf58ef11843ed64"><enum>(bb)</enum><text>include transfer flags and course and credit data to allow the State to run initial degree audits for institutions;</text></item><item id="id6f41e759d68348cd9cb28bc3bee7f3ef"><enum>(cc)</enum><text>include all institutions of higher education in the State; and</text></item><item id="idca6e73162a4f4f4191d3378936026574"><enum>(dd)</enum><text>have in place mechanisms to share data across institutions, systems, and States;</text></item></subclause><subclause id="id879e0412e42448cb9ad0e6ac0dfd43fa"><enum>(II)</enum><text>the capacity of the agency governing the State's longitudinal system to respond to data requests accurately and in a timely manner; and</text></subclause><subclause id="id861eb04606eb4133ad2f5c2017cc7657"><enum>(III)</enum><text>the State's plan to protect student privacy with respect to data in the State longitudinal data system and comply with section 444 of the General Education Provisions Act (commonly referred to as the <quote>Family Educational Rights and Privacy Act of 1974</quote>); or</text></subclause></clause><clause id="idab8134592479444d8c5dc17d491d80e0"><enum>(ii)</enum><text>the State's plan to develop such administrative capacity as part of the activities carried out under the grant.</text></clause></subparagraph></paragraph></subsection><subsection id="id3f744ce0a6c040b5add1435e25b51491"><enum>(d)</enum><header>Award basis and priority</header><text>The Secretary shall award grants under this section to States based on the quality of the applications submitted under subsection (c). In awarding grants under this section, the Secretary shall give priority to applications from States—</text><paragraph id="id87c66adbb888456fbb103a7dd81451c3"><enum>(1)</enum><text>that do not have, as of the time of the application, statewide policies or statewide initiatives in place to retroactively award associate degrees to students; or</text></paragraph><paragraph id="id2ce5b41be7154fb5b5c6081914f9612e"><enum>(2)</enum><text>that have a commitment to initiatives regarding the retroactive awarding of associate degrees that will continue after the period of the grant.</text></paragraph></subsection><subsection id="id48ce078deee64e88b2659edcc9e96443"><enum>(e)</enum><header>Mandatory use of funds</header><paragraph id="idb6b18b41f8fa4c41959ed46fcfe51cc2"><enum>(1)</enum><header>Subgrants</header><text>A State that receives a grant under this section shall use not less than 80 percent of the grant funds provided to award subgrants, on a competitive basis, to institutions of higher education or systems of higher education. Each institution of higher education or system of higher education receiving a subgrant shall carry out all of the following activities and services, pursuant to the conditions under subsection (g):</text><subparagraph id="idab80ed5691a74cd29fce0584c1136163"><enum>(A)</enum><text>Identify the group of students enrolled at the institution of higher education on the date of the identification and former students who were enrolled at the institution of higher education, or at the institutions of higher education within the system of higher education, as the case may be, that, based on the data held by the institution or system, meet both of the following requirements:</text><clause id="id7d6839cbbe7e4da79bdc15ef66162900"><enum>(i)</enum><text>Each individual had completed, or is expected to complete by the end of the semester, trimester, or quarter, not less than 45 postsecondary credit hours (or the minimum required by the State to earn an associate degree)—</text><subclause id="id8BAF4C2DAF7C4B0D8E994D4D28A82DB8"><enum>(I)</enum><text>in the case of former students who were enrolled at the institution of higher education or at the institutions of higher education within the system of higher education, as the case may be, at the institution or institutions; and</text></subclause><subclause id="id7D1B7879DA854C7698DE349372EA3506"><enum>(II)</enum><text>in the case of students enrolled at the institution of higher education or at the institutions of higher education within the system of higher education, as the case may be, on the date of the identification, at another institution of higher education.</text></subclause></clause><clause id="idfffe3b66d043484ea224082da08e4d5c"><enum>(ii)</enum><text>Each individual has not had any postsecondary degree or certificate, at the associate degree level or higher, issued to the student by an institution of higher education.</text></clause></subparagraph><subparagraph id="idadce17a2bd1340d183d356a8ce74da70"><enum>(B)</enum><text>Perform a degree audit on each student described in subparagraph (A), and identify each such student as one of the following:</text><clause id="id4c4f8005738941f2a90f81b49f825a12"><enum>(i)</enum><text>Eligible to obtain an associate degree.</text></clause><clause id="id5cd31c38940047998a3c618cbced6882"><enum>(ii)</enum><text>Eligible to obtain an associate degree upon the completion of 12 or fewer postsecondary credit hours (or the equivalent).</text></clause><clause id="idad815275ff7d4de48e1f3d3b1a85241f"><enum>(iii)</enum><text>Not eligible under either clause (i) or (ii).</text></clause></subparagraph><subparagraph id="id4ef3fa6dbd9f4f5a91da27cbcc3f6642"><enum>(C)</enum><text>Provide outreach to each student identified in subparagraph (B)(i), and award the earned associate degree to such student, unless such student declines through a written or oral declaration.</text></subparagraph><subparagraph id="id31332396f305408a9cf8a9a91f8bfc04"><enum>(D)</enum><text>Provide outreach to each student identified in subparagraph (B)(ii) that includes information regarding next steps toward degree attainment, including financial aid options.</text></subparagraph></paragraph><paragraph id="idf029448595604a498bbf39a6f472522a"><enum>(2)</enum><header>Application process</header><text>An institution of higher education or system of higher education desiring a subgrant under this subsection shall submit an application to the State at such time, in such manner, and containing such information as the State may require. Such application shall include a written commitment from the institution or system that, if the institution or system receives a grant, the institution or system will carry out all of the activities described in paragraph (1).</text></paragraph><paragraph id="idd155ddade4c340c083ffedb41c285a76"><enum>(3)</enum><header>Priority</header><text>Each State awarding subgrants under this part shall give priority to applications from institutions of higher education or systems of higher education that—</text><subparagraph id="ida3cdac9d91b743868f6e3c5123fa9a81"><enum>(A)</enum><text>have up-to-date degree audit software or systems to increase automation of degree audits and transcript exchange, or a plan to invest and develop such software or systems;</text></subparagraph><subparagraph id="id1243442c62a74e16ae7e6417f12e5cce"><enum>(B)</enum><text>if such policy is permissible under applicable accreditation or State standards, use a policy that awards associate degrees to any candidate identified in paragraph (1)(B)(i) and provides candidates with a process to opt out of such award program;</text></subparagraph><subparagraph id="ide1e946e3fa37449da604ed89fd24e6fd"><enum>(C)</enum><text>waive nonacademic barriers to graduation, such as an application, swimming test, library fine, transcript exchange fee, graduation fee, parking ticket, or any other nominal fee;</text></subparagraph><subparagraph id="idf9c626c88f334990959240927a1d172b"><enum>(D)</enum><text>waive or amend residency and recency requirements to prevent earned credits from expiring, if such action is permissible under accreditation or State standards;</text></subparagraph><subparagraph id="id9af91c2edbba49a0b16e92913ec39bd5"><enum>(E)</enum><text>provide students with tuition waivers, reduced tuition, or prior learning assessments for those who need to earn remaining credits; and</text></subparagraph><subparagraph id="id9046b31446134a988c785cb50b4a19ec"><enum>(F)</enum><text>agree that, after the conclusion of the activities described in paragraph (1) and continuing after the end of the grant period, the institution or system will—</text><clause id="id21d38907a6d4418a8ac41b022d71fdbf"><enum>(i)</enum><text>conduct degree audits for all enrolled students once the students enroll in 45 postsecondary credit hours; and</text></clause><clause id="idd485de1af30c408ab7ec7aa3ac5f5abb"><enum>(ii)</enum><text>provide information about graduation deadlines to remind students of relevant requirements at least 4 months before the students graduate and again 1 month before graduation.</text></clause></subparagraph></paragraph></subsection><subsection id="id5f10358e39304356ad2d587109d8e6d1"><enum>(f)</enum><header>Permissive use of funds</header><text>A State receiving a grant under this section may use—</text><paragraph id="idc105e4d1b61e431bb2bfa436680c43bc"><enum>(1)</enum><text>not more than 15 percent of the total amount received under this section for administrative purposes relating to the grant under this section, including technology needed to carry out the purposes of this part; and</text></paragraph><paragraph id="idd36aad4720054abb977c76a0f63ff540"><enum>(2)</enum><text>not more than 5 percent of the total amount received under this section to create articulation agreements between 2-year and 4-year institutions of higher education, in order to enhance collaboration and strengthen the transition pathways between such institutions for transfer students.</text></paragraph></subsection><subsection id="idfec7501226174ea4a8529e2e0266797b"><enum>(g)</enum><header>Special conditions and prohibitions</header><paragraph id="id549ecc87b7a74e48b4ba2ae8e4b9df4e"><enum>(1)</enum><header>Availability to students</header><text>A State, institution of higher education, or system of higher education receiving a grant or subgrant, as the case may be, under this section shall not charge any student an additional fee or charge to participate in the activities or services supported under this section.</text></paragraph><paragraph id="idec5394d6fee449089bcaac4294a4c2eb"><enum>(2)</enum><header>Prohibited uses</header><text>A State, institution of higher education, or system of higher education receiving a grant or subgrant, as the case may be, under this section shall not use any grant or subgrant funds for tuition, fees, room and board, or any other purpose outside the goals of the grant.</text></paragraph><paragraph id="idc3cf1d67f87b4446a71ed7a7678a1901"><enum>(3)</enum><header>FERPA requirements</header><text>Each State, institution of higher education, or system of higher education receiving a grant or subgrant, respectively, under this section that enters into a contract or other agreement with any outside entity to assist in carrying out the activities or services under such grant or subgrant, shall ensure that the outside entity complies with all requirements of section 444 of the General Education Provisions Act (commonly referred to as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) that would apply to the State, institution, or system.</text></paragraph><paragraph id="id723033ed68c64bc898449737ea76a4cf"><enum>(4)</enum><header>Coordination</header><text>A State receiving a grant under this section shall ensure the coordination of the activities and services carried out under this section with any other activities carried out in the State that are similar to the goals of this program, and with any other entities that support the existing activities in the State, with the goal of minimizing duplication.</text></paragraph></subsection><subsection id="id3a8482b7226b4a39808ada8807eeaaa1"><enum>(h)</enum><header>Report</header><paragraph id="id87c54a0c67ab48afb6db4d177633aaa1"><enum>(1)</enum><header>In general</header><text>A State receiving a grant under this section shall prepare and submit an annual report to the Secretary on the activities and services carried out under this section, and on the implementation of such activities and services. The report shall include, for each institution of higher education or system of higher education receiving a subgrant, the following information:</text><subparagraph id="id2121c000163d42f1a68ad8cd4142af31"><enum>(A)</enum><text>The number of students who were first identified in the group described in subsection (e)(1)(A)(i).</text></subparagraph><subparagraph id="id7bcc734a7e74426682b6aa6982a2098c"><enum>(B)</enum><text>The number of students who were removed from such group because the students had received a degree elsewhere, in accordance with subsection (e)(1)(A)(ii).</text></subparagraph><subparagraph id="idd4807146b3394c3db2d6a2a9e51e8074"><enum>(C)</enum><text>The number of degree audits performed under subsection (e)(1)(B).</text></subparagraph><subparagraph id="idc1ef2c181342412a83b1abb3e446f47b"><enum>(D)</enum><text>The number of students identified under subsection (e)(1)(B)(i) as eligible to obtain an associate degree.</text></subparagraph><subparagraph id="iddcd1dc6b1f594900b772f6b4bfe4d1af"><enum>(E)</enum><text>The number of students identified under subsection (e)(1)(B)(ii) as eligible to obtain an associate degree upon the completion of 12 or fewer credits.</text></subparagraph><subparagraph id="id4d49464a978c42e58986314052890da1"><enum>(F)</enum><text>The number of students identified under subsection (e)(1)(B)(iii) as ineligible to obtain an associate degree and ineligible to obtain such a degree upon the completion of 12 or fewer credits.</text></subparagraph><subparagraph id="id9fc065b3037a457ebc22ed0605eedd3b"><enum>(G)</enum><text>The number of students awarded an associate degree under subsection (e)(1)(C).</text></subparagraph><subparagraph id="id05690d094d3b45c6b76154f4b8be4701"><enum>(H)</enum><text>The number of students identified in subsection (e)(1)(B)(ii) who are returning to an institution of higher education after receiving outreach described in subsection (e)(1)(D).</text></subparagraph><subparagraph id="id8829e9a474bb4e91b7d745ee23cd5024"><enum>(I)</enum><text>The average amount of credit hours previously earned by students described in subsection (e)(1)(B)(i) when the associate degrees are awarded.</text></subparagraph><subparagraph id="idbf8007d5901142cea691a9d8398f9366"><enum>(J)</enum><text>The number of students who received outreach described in subsection (e)(1)(C) and who decline to receive the associate degree.</text></subparagraph><subparagraph id="id599746c16d74476ca3545632c18e6b09"><enum>(K)</enum><text>The number of students who could not be located or reached as part of the process.</text></subparagraph><subparagraph id="ide93d9b41cafc4e199dda2fc6dce08102"><enum>(L)</enum><text>The reasons why students identified in subsection (e)(1)(B)(ii) did not return to an institution of higher education to receive a degree.</text></subparagraph><subparagraph id="id90094a07175b4683a00fc7cd636d3588"><enum>(M)</enum><text>Details of any policy changes implemented as a result of implementing this program and conducting the required degree audits.</text></subparagraph></paragraph><paragraph id="id9b66a003415a43c4a33a01f88b257cd3"><enum>(2)</enum><header>Disaggregation</header><text>The report shall include the information described in subparagraphs (A) through (L) of paragraph (1) in the aggregate and disaggregated by age, gender, race or ethnicity, status as an individual with a disability, and socioeconomic status (including status as a Federal Pell Grant recipient), except that such disaggregation shall not be required in a case in which the number of students in a category is insufficient to yield statistically reliable information or the results would reveal personally identifiable information about an individual student. </text></paragraph></subsection><subsection id="id747ab9a02ce8462b9f793511c1399dbf"><enum>(i)</enum><header>Enforcement provisions</header><paragraph id="id08c3fae9dc61429c90af3e00ec33bdd1"><enum>(1)</enum><header>Recovery or withholding</header><text>The Secretary may, after notice and an opportunity for a hearing in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code—</text><subparagraph id="id80e523338a3a4d5a8e49d42830a80f7e"><enum>(A)</enum><text>withhold funds provided under a grant or subgrant under this section if a State or institution of higher education is failing to comply substantially with the requirements of this section; or</text></subparagraph><subparagraph id="id905a42327d2043b6928567b87a741a08"><enum>(B)</enum><text>take actions to recover funds provided under a grant or subgrant under this section, if the State or institution made an unallowable expense, or otherwise failed to discharge its responsibility to properly account for funds.</text></subparagraph></paragraph><paragraph id="ide0ec7f87d1844357baab4f4a8fc530d7"><enum>(2)</enum><header>Use of recovered or unused funds</header><text>Any funds recovered or withheld under paragraph (1) shall—</text><subparagraph id="idc48bf6083d62402092d2a9a795438a8c"><enum>(A)</enum><text>be credited to the appropriations account from which amounts are available to make grants or enter cooperative agreements under this section; and</text></subparagraph><subparagraph id="id6a9c05387dab46acbaa53bd41a39e0de"><enum>(B)</enum><text>remain available until expended for any purpose of that account authorized by law that relates to the program under this section.</text></subparagraph></paragraph></subsection><subsection id="idbb574ee1ba0f4fb998d8260897de9c83"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2022 and each of the 2 subsequent fiscal years.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id0AEE86574E25482E8611A47A8C44116A"><enum>3.</enum><header>Release of education records to facilitate the award of a recognized postsecondary credential</header><text display-inline="no-display-inline">Section 444(b) of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g(b)</external-xref>) is amended—</text><paragraph id="id4653A044F7624B408C7F3EF5DB2CCF81"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="idB46211F09C67424AAB3BDC132983D594"><enum>(A)</enum><text>in subparagraph (K)(ii), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="idB5938160C2794B079E30948082644DB0"><enum>(B)</enum><text>in subparagraph (L), by striking the period at the end and inserting <quote>;
