which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Small Business Administration to provide applicants for certain loans and grants with updates with respect to those applications, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Streamlining EIDL Act</short-title></quote>.</text></section><section id="id4659DB88E5D04017A7362381C782409E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="id966370E56DCA4920A67DA16B78E4A5AF"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Administration</term> means the Small Business Administration;</text></paragraph><paragraph id="idB903C20CCF674941A5BC1A38C0FB08EC"><enum>(2)</enum><text>the term <term>Administrator</term> means the Administrator of the Administration;</text></paragraph><paragraph id="id0D65CBFC37354980A5912F6488E6FF9C"><enum>(3)</enum><text>the terms <term>compliance</term> and <term>improper payment</term> have the meanings given the terms in section 3351 of title 31, United States Code; </text></paragraph><paragraph id="id45EE6A909FD442DA9009A0948BC5A622"><enum>(4)</enum><text>the term <term>covered application</term>— </text><subparagraph id="id2A8571DEDAA54141AA1415BE80FF3DB8"><enum>(A)</enum><text>means an application that is— </text><clause id="id455A7637C8344A56B09E439F6D7DE3EC"><enum>(i)</enum><text>for any assistance provided under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>), including any loan or grant made under section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>); and </text></clause><clause id="idFF83DC90028844FF8119E3CE74AF53C7" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>submitted to the Administrator on or after the date of enactment of this Act; and</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id36BD0B5B7AF146F282FAAFFED9F11015"><enum>(B)</enum><text>includes an application that is— </text><clause display-inline="no-display-inline" commented="no" id="id0D77A928CB0F4D21AE22A3002C7B38B6"><enum>(i)</enum><text>for an increase with respect to assistance that is—</text><subclause display-inline="no-display-inline" commented="no" id="id3A5719A977E94BA2B065B0C7BCF900A7"><enum>(I)</enum><text>described in subparagraph (A)(i); and </text></subclause><subclause display-inline="no-display-inline" commented="no" id="id71F9E9DA40AE4710BF8FC5012556D1EF"><enum>(II)</enum><text>provided to the applicant before the date of enactment of this Act; and</text></subclause></clause><clause display-inline="no-display-inline" commented="no" id="id4ACA2D2B88EE4127A20399DA51F2D398"><enum>(ii)</enum><text>submitted to the Administrator on or after the date of enactment of this Act; and</text></clause></subparagraph></paragraph><paragraph id="id535650472B034DBD95A85F1D72CA4E36"><enum>(5)</enum><text>the term <term>covered assistance</term> means a loan or grant made under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>), including under section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>), related to COVID–19.</text></paragraph></section><section id="idE70C447F97294234BE44BFAFC533C72A"><enum>3.</enum><header>EIDL loans</header><subsection id="id7165CC51971A4FC099FC054C4C9AB5DF"><enum>(a)</enum><header>Requirements</header><text>The Administrator shall—</text><paragraph id="id616ED8D5165949EABB06D08C7D2F211B"><enum>(1)</enum><text>not later than 7 days after the date on which the Administrator receives a covered application, provide the applicant with— </text><subparagraph id="idD85942553DE34C73998E965391F3B27C"><enum>(A)</enum><text>notice that the Administrator has received the application; and</text></subparagraph><subparagraph id="id0F8D85F565F9409FA68926F45E5E1030"><enum>(B)</enum><text>information regarding an office or official of the Administration that the applicant may contact in the event that the applicant has questions regarding the application;</text></subparagraph></paragraph><paragraph id="id39F0213B9610422C963948A278FFDF23"><enum>(2)</enum><text>not later than 21 days after the date on which the Administrator receives a covered application, provide the applicant with— </text><subparagraph id="idD3331B0E1A144822A51A3156179EF9B4"><enum>(A)</enum><text>a written report detailing the status of the application and any requirements for completion of the application, including any external or internal delays; and</text></subparagraph><subparagraph id="id810D7C636AEF4AA6BCD916FAE12E0D2F"><enum>(B)</enum><text>an explanation regarding the appeals process with respect to a covered application that the Administrator disapproves; and</text></subparagraph></paragraph><paragraph id="id17025252B337429B863881809E3D3580"><enum>(3)</enum><text>not later than 45 days after the date on which the Administrator receives a completed covered application that is in accordance with all applicable requirements, including such requirements as the Administrator may prescribe by regulation—</text><subparagraph id="id1366A7FC736A486CACD89CAC8B7A3384"><enum>(A)</enum><text>review the application in its entirety; and</text></subparagraph><subparagraph id="idD82029432B1D4001B70D206D54236EE1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idFF2794F519CC4418A23DC2AD272C55A0"><enum>(i)</enum><text>approve the application and make the loan (or the increase in the loan amount) that is the subject of the covered application if all applicable requirements with respect to the applicable loan are satisfied; or</text></clause><clause indent="up1" id="id4ED09E0B76E747D4AE75DFC4F154F5C8"><enum>(ii)</enum><text>disapprove the application and notify the applicant in writing of the disapproval.</text></clause></subparagraph></paragraph></subsection><subsection id="id442E8F9126A84C74A53A34DE8493E419"><enum>(b)</enum><header>Review and reporting</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator shall—</text><paragraph id="idD8573641FA0E430D9DC1B9CE24DB1C3C"><enum>(1)</enum><text>conduct a comprehensive review of the process for submitting a covered application, which shall focus on ways to ensure that applicants submitting covered applications—</text><subparagraph id="id713ADBAB9023499EBFCC86573A72045C"><enum>(A)</enum><text>are not asked to submit materials with respect to such an application more than once;</text></subparagraph><subparagraph id="idD57EAA8E7F2D4A40B4C8FAAEF07EF7E4"><enum>(B)</enum><text>receive timely responses and updates from the Administrator with respect to those covered applications, including the information required under paragraphs (1) and (2) of subsection (a); and</text></subparagraph><subparagraph id="idE652DFCA54F540E0827EFD99D69A27AF"><enum>(C)</enum><text>receive the loans (or loan increases) sought in those covered applications in a manner that complies with subsection (a)(3); and</text></subparagraph></paragraph><paragraph id="id440B06413E604A029BFAAF03CA2AA847"><enum>(2)</enum><text>submit to Congress a report regarding the review conducted under paragraph (1). </text></paragraph></subsection></section><section id="id38EF095126AC41EEA620A7639302D3A1"><enum>4.</enum><header>Reports</header><subsection id="id64A92E1897864B798F7E71477B03238B"><enum>(a)</enum><header>Report on implementation of Inspector General recommendations</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator shall submit to Congress a report on the specific steps that the Administration has taken to meet the recommendations provided by the Inspector General of the Administration in the report issued on May 6, 2021, entitled <quote>SBA’s Handling of Identity Theft in the COVID–19 Economic Injury Disaster Loan Program</quote>, which shall include a description of—</text><paragraph id="idb6fa3127590d471fbd605a881913a3c9"><enum>(1)</enum><text>the system that the Administration has developed to maintain and track all identity theft complaints related to covered assistance;</text></paragraph><paragraph id="id11ecbd10f28740f79b64e50c73ce2569"><enum>(2)</enum><text>how the Administration is providing guidance, assistance, and status updates to complainants that allege their identity has been stolen; </text></paragraph><paragraph id="id104f14ed41254d71ad90bad92ef2643d"><enum>(3)</enum><text>how the Administration is restoring identity theft victims to their condition prior to fraud, including details on how the Administration will file collateral releases and specify if the Administration or the complainant is paying for costs to file Uniform Commercial Code lien release documents;</text></paragraph><paragraph id="id9a0b31c0c0df402d966e4f7452e1049e"><enum>(4)</enum><text>the process of the Administration for removing fraudulent covered assistance, and related Uniform Commercial Code filing fees, from the financial records of the Administration, including how—</text><subparagraph id="idE1FF298AF0DE480B8E32052655D18BF3"><enum>(A)</enum><text>the system described in paragraph (1)—</text><clause id="idC740286E0F37438085250704FBE5A204"><enum>(i)</enum><text>will charge off and remove partially or fully disbursed covered assistance from the financial records; and</text></clause><clause id="id9FBFBAD54EC548C48648D20640AE1F5C"><enum>(ii)</enum><text>addresses charge off or removal of related Uniform Commercial Code filing fees; and</text></clause></subparagraph><subparagraph id="id083EE5DCE0324EA9A3731CFC2E6208CA"><enum>(B)</enum><text>the Administration is differentiating between— </text><clause id="idAEE19021E8A5400B82F7A1D74D288B41"><enum>(i)</enum><text>routine defaults in covered assistance that— </text><subclause id="idE3CC2F24313146CAA2E9378298A092EC"><enum>(I)</enum><text>have been or will be charged off; and </text></subclause><subclause id="idE944BB1ACD2F46899A489479EC39E254"><enum>(II)</enum><text>are required to be submitted to the Department of the Treasury for collection; and </text></subclause></clause><clause id="idB9CDEECFF6EB482795C14D331EA1EC15"><enum>(ii)</enum><text>identity theft-related covered assistance that the Administration is required to charge off without being sent to the Department of the Treasury for collection;</text></clause></subparagraph></paragraph><paragraph id="ide6e91ec4ecd34e16ae29012762970d4b"><enum>(5)</enum><text>the process of the Administration for tracking the recovery of funds from fraudsters to offset the outstanding identity theft-related covered assistance before any charge off action; and</text></paragraph><paragraph id="id4302149ad693484f87fafea7b706f9dc"><enum>(6)</enum><text>actions the Administration has taken to recover improper payments related to identity theft-related covered assistance and how the Administration is taking steps to be in compliance.</text></paragraph></subsection><subsection id="id9e669e93b28d47968bf34bf192394326"><enum>(b)</enum><header>Regular reports</header><text>The Administrator shall submit to Congress—</text><paragraph id="idD393CEC4E98E40E4AD8CAAC22E8B8F59"><enum>(1)</enum><text>a monthly report that, in order to identify individual allegations of identity theft that have not been refiled, reconciles—</text><subparagraph id="idC7C7BB7EDA6948429E973F0BA8551D68"><enum>(A)</enum><text>applications submitted during the period beginning on March 1, 2020, and ending on January 31, 2021, for covered assistance based on identity theft allegations; and</text></subparagraph><subparagraph id="id7A5AFC30484D4E89934AF4B3966C4DB5"><enum>(B)</enum><text>applications based on refiled allegations of identity theft relating to the covered assistance described in subparagraph (A); and </text></subparagraph></paragraph><paragraph id="id93370479F7694CBC82384E029FDB63F2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>not later than 180 days after the date on which the first report under paragraph (1) is submitted, a detailed plan on how the Administration will attempt, or has attempted, to contact the remaining individuals whose identity theft allegations have not been refiled.</text></paragraph></subsection></section></legis-body></bill>
