which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Veterans Affairs to submit to Congress periodic reports on the costs, performance metrics, and outcomes of the Department of Veterans Affairs Electronic Health Record Modernization program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Electronic Health Record Transparency Act of 2021</short-title></quote>.</text></section><section id="H8B53664EF6D447A8A9FE817857D6FEEE" changed="not-changed"><enum>2.</enum><header>Reports on costs, performance metrics, and outcomes of Department of Veterans Affairs Electronic Health Record Modernization program</header><subsection id="H586E5F6519DF49E18375088220A546F6" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 503 of the Veterans Benefits and Transition Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/407">Public Law 115–407</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5701">38 U.S.C. 5701</external-xref> note prec.) is amended—</text><paragraph id="HD3F0C7B9734344188E8DEE7DB8512218" changed="not-changed"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f);</text></paragraph><paragraph id="H91029A2D23DD4CA6A23B32DE219206B8" changed="not-changed"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection (e):</text><quoted-block id="HB82B1B4DDA7E45E68E5D0902D38AF7BF" style="USC" changed="not-changed"><subsection id="H418A53B203C748BAA0531A9F9B1A72D1" changed="not-changed"><enum>(e)</enum><header>Quarterly reports</header><paragraph id="HFEEA577CEC684565B478EEF9FB6C3A50" changed="not-changed"><enum>(1)</enum><header>Reports on costs of program</header><subparagraph changed="not-changed" id="id7243F33FF8594B37997A3F61A0093B4A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>VA Electronic Health Record Transparency Act of 2021</short-title>, and not later than the date that is 30 days after the last day of each fiscal quarter thereafter until the termination date specified in paragraph (3), the Secretary shall submit to the appropriate congressional committees a report on the costs of the Electronic Health Record Modernization Program.</text></subparagraph><subparagraph changed="not-changed" id="id6BB42F201C9B4625A836AD55666895AF"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report under subparagraph (A) shall include, for the period covered by the report and for the total period beginning on the date of the enactment of the <short-title>VA Electronic Health Record Transparency Act of 2021</short-title> and ending on the date of the submittal of the report, a description of all actual expenses of, and driven by, the Electronic Health Record Modernization Program, including any such expenses paid using—</text><clause id="H6736A62CB82D44878B2FD14AE5567D98" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">any funds appropriated for the Department of Veterans Affairs, for any source or account, expended by any organizational element of the Department or by the Federal Electronic Health Record Modernization Office for the Electronic Health Record Modernization Program;</text></clause><clause id="H69592DD829E947FB91AF82722713BD91" changed="not-changed"><enum>(ii)</enum><text>any funds, from any source or account, expended by any organizational element of the Department for physical or technology infrastructure modifications, enhancements, improvements, or expansions at a facility of the Department necessitated by, or related or pertaining to, the Electronic Health Record Modernization Program; and</text></clause><clause id="H888D41FB5CB14ECB869C438DA09D48DA" changed="not-changed"><enum>(iii)</enum><text>any funds, from any source or account, expended by any organizational element of the Department or by the Federal Electronic Health Record Modernization Office for consultants, support contractors, or experts related or pertaining to the Electronic Health Record Modernization Program.</text></clause></subparagraph></paragraph><paragraph id="H5BAAE8A32B504E9B997384D3D72BEF78" changed="not-changed"><enum>(2)</enum><header>Reports on performance metrics and outcomes</header><subparagraph changed="not-changed" id="idE6DC71A93F1E4CE2BA6449CA6D180EB2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>VA Electronic Health Record Transparency Act of 2021</short-title>, and not later than the date that is 30 days after the last day of each fiscal quarter thereafter until the termination date specified in paragraph (3), the Secretary shall submit to the appropriate congressional committees a report on the performance metrics and outcomes of the Electronic Health Record Modernization Program.</text></subparagraph><subparagraph changed="not-changed" id="idC4E2A0EB8A9E4724A2646A3BEDFEC0A5"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report under subparagraph (A) shall include, for the period covered by the report—</text><clause id="HB273C2653986467691D275A103B907B2" changed="not-changed"><enum>(i)</enum><text>a list of the quality, performance, safety, or value metrics, key performance indicators, and other diagnostic or evaluation criteria in use to assess the Electronic Health Record Modernization Program and the electronic health record system, in general and at individual facilities, with respect to veterans, employees of the Department, and operations of the Department;</text></clause><clause id="H09445E30AFD74B7BB3E1041C32F3F7AD" changed="not-changed"><enum>(ii)</enum><text>an explanation of any change to any of such metrics, indicators, and criteria compared to the metrics, indicators, and criteria included in any previous report submitted under subparagraph (A);</text></clause><clause id="H441E840B8DAB4DB79D5547373E1F4C33" changed="not-changed"><enum>(iii)</enum><text>the data supporting or demonstrating each such metric, indicator, and criteria compared to the data supporting or demonstrating such metric, indicator, or criteria as included in the previous report submitted under subparagraph (A); and</text></clause><clause id="HF0549819B19941EC934AC2D3A79311A0" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">a list of patient safety reports, incidents, alerts, or disclosures at each facility of the Department where the electronic health record system has been implemented.</text></clause></subparagraph></paragraph><paragraph id="H10CCEC97EF0C48C9B9FD3191ADA2B3E2" changed="not-changed"><enum>(3)</enum><header>Termination date</header><text>The requirements to submit reports under paragraphs (1) and (2) shall terminate on the date that is 90 days after the date on which the Secretary submits to the appropriate congressional committees a certification that the Electronic Health Record Modernization Program has been fully implemented.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE6913E58490442CA83EE4FF4F6A06DCD" changed="not-changed"><enum>(3)</enum><text>in subsection (f), as redesignated by paragraph (1), by adding at the end the following new paragraphs:</text><quoted-block id="HAB3EF432E6C3480BAF1B954DBD439E0A" changed="not-changed" display-inline="no-display-inline" style="USC"><paragraph id="H24B4D5BFA56B429E9666C999C156665B" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>electronic health record system</term> means the electronic health record system implemented pursuant to the Electronic Health Record Modernization Program.</text></paragraph><paragraph id="H49263739376C4919B4EA1DB806963323" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>The term <term>facility of the Department</term> includes a joint facility of the Department of Veterans Affairs and the Department of Defense. </text></paragraph><paragraph id="H2E1C8A8631F64081AD3CAF231113E479" changed="not-changed"><enum>(5)</enum><text>The term <term>Federal Electronic Health Record Modernization Office</term> means the office established under section 1635(b) of the Wounded Warrior Act (title XVI of <external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1071">10 U.S.C. 1071</external-xref> note).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
