which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide liability protection for the sharing of information regarding suspected fraudulent, abusive, or unlawful robocalls, illegally spoofed calls, and other illegal calls by or with the registered consortium that conducts private-led efforts to trace back the origin of suspected unlawful robocalls, and for the receipt of such information by that registered consortium, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Robocall Trace Back Enhancement Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id295E1A4457B347C7979D613D9635C457"><enum>2.</enum><header>Registered consortium conducting private-led efforts to trace back the origin of suspected unlawful robocalls</header><subsection id="idDF708322B30B47A2B179CDE86E014879"><enum>(a)</enum><header>Immunity for receiving, sharing, and publishing trace back information</header><text display-inline="yes-display-inline">Section 13(d) of the Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/105">Public Law 116–105</external-xref>; 133 Stat. 3287) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC23014F6CDA041F0B64DB07A18B6D938"><paragraph id="id116A6E4E0C484EC19811A1C2C8F7E158"><enum>(3)</enum><header>Immunity for receiving, sharing, and publishing trace back information</header><subparagraph id="id837C911C62174D99AD1210FDDB871BE6"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <term>covered information</term>—</text><clause id="id735B9ACD06F9414B8706B71AF2A415C9"><enum>(i)</enum><text>means information regarding suspected—</text><subclause id="idFB0266F731714FA48EF9C8458D5A08F1"><enum>(I)</enum><text>fraudulent, abusive, or unlawful robocalls;</text></subclause><subclause id="id622B40AF49C941CBACE988C542C1E524"><enum>(II)</enum><text>illegally spoofed calls; and</text></subclause><subclause id="id3EBD009CE4DD4DEF821FAC37EAF21833"><enum>(III)</enum><text>other illegal calls; and</text></subclause></clause><clause id="id20E31083C98E4F29A6D36493D2F5225A"><enum>(ii)</enum><text>includes—</text><subclause id="id90EC6EFC5EA640F4869852851AE50EB1"><enum>(I)</enum><text>call detail records of calls described in clause (i);</text></subclause><subclause id="id28235AFBF27F4BB48793E1392AC75E10"><enum>(II)</enum><text>the names of, and other identifying information concerning, the voice service providers that originated, carried, routed, and transmitted calls described in clause (i); and</text></subclause><subclause id="id96DD5F7596314F049C34BB243B775C3E"><enum>(III)</enum><text>information about the entities that made calls described in clause (i), including any contact information of individuals that such an entity provided to the voice service provider that originated the call.</text></subclause></clause></subparagraph><subparagraph id="idF59DDACCC1F945C9AA7AD22E0B7C4A5D"><enum>(B)</enum><header>Trace back immunity</header><text>No cause of action shall lie or be maintained in any court against—</text><clause id="id3B30F9B640694A109D686A2DF0D5BC4D"><enum>(i)</enum><text>the registered consortium for receiving, sharing, or publishing covered information or information derived from covered information; or</text></clause><clause id="id66E02F9144C74D34B17AF819FD313A27"><enum>(ii)</enum><text>any voice service provider or other person or entity for sharing covered information with the registered consortium.</text></clause></subparagraph><subparagraph id="idFD9B27B451FB4C9992CF244BD008E2A1"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in subparagraph (B)(ii) shall be construed to provide immunity for any act other than the act of sharing covered information with the registered consortium.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id273012240A9947F08BFDF6659AE1C5DF"><enum>(b)</enum><header>Publication of list of voice service providers</header><text>Section 13(e) of the Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/105">Public Law 116–105</external-xref>; 133 Stat. 3287) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF391179A4D474DC8AE01DD01EC2B4EFF"><subsection id="id3f42a34bdcdd419b8b67a737eb716725"><enum>(e)</enum><header>List of voice service providers</header><paragraph id="id536A04FA99E247F7B0986333F775FB98"><enum>(1)</enum><header>Publication of list</header><text>The Commission, or the registered consortium in consultation with the Commission, may publish a list of voice service providers based on—</text><subparagraph id="id73D3FADCD5C84DCCBCE25FB692AB5119"><enum>(A)</enum><text>information obtained by the consortium about voice service providers that refuse to participate in private-led efforts to trace back the origin of suspected unlawful robocalls; and</text></subparagraph><subparagraph id="id6FFF1F38222C43A1B3160A52255CF6C3"><enum>(B)</enum><text>other information the Commission or the consortium may collect about voice service providers that are found to originate or transmit substantial amounts of unlawful robocalls.</text></subparagraph></paragraph><paragraph id="id90188D07762C4CE3AAED6C87E29CE93A"><enum>(2)</enum><header>Enforcement</header><text>The Commission may take enforcement action based on the information described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
