<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3332</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211207">December 7, 2021</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S401">Mr. Romney</cosponsor>, <cosponsor name-id="S391">Mr. Young</cosponsor>, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, and <cosponsor name-id="S407">Mr. Hagerty</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XI of the Social Security Act to allow States to promote Medicaid objectives through work or community engagement requirements.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let States Innovate Under Medicaid Act</short-title></quote>.</text></section><section id="id535FE6999B4C4308985B883D977DD020"><enum>2.</enum><header>Promoting Medicaid objectives through work or community engagement requirements</header><text display-inline="no-display-inline">Section 1115(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315(d)</external-xref>) is amended—</text><paragraph id="id5783DD5123894633A8BE1BEF0E2E26BA"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>(which may include the objective to reduce dependence on medical assistance by conditioning the receipt of medical assistance on the satisfaction of a work or community engagement requirement (as defined in paragraph (4))</quote> after <quote>the objectives of title XIX or XXI</quote>; and</text></paragraph><paragraph id="idD44EEF101F2746EB915715028FCBE35C"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="id87A60BA62A064BB1A77DB9651FEF4544" style="OLC" act-name=""><paragraph id="idF114ED34037C421B8D071093893CCA82"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA546E78C2230439D879BAF12E90634AD"><enum>(A)</enum><text>For purposes of this subsection, the term <term>work or community engagement requirement</term> means, with respect to an individual, the individual’s participation in work activities (as defined in section 407(d)) for such period of time as determined by the State, and as directed and administered by the State.</text></subparagraph><subparagraph id="id738ACFB0ADBE4D4CB9D5017955CEF634" indent="up1"><enum>(B)</enum><text>Such term shall not include any requirement that applies with respect to any of the following categories of individuals:</text><clause id="id1003F5A51E3848B886DA239390E046B7"><enum>(i)</enum><text>Individuals who are age 65 or older.</text></clause><clause id="idFD24A21106CB4757B816EC30384A1EAA"><enum>(ii)</enum><text>Individuals who are age 19 or younger.</text></clause><clause id="id8AC1084230E744FCA3807AAEA8AE8898"><enum>(iii)</enum><text>Individuals who are eligible for benefits or assistance under the Temporary Assistance for Needy Families program under part A of title IV or the Supplemental Nutrition Assistance Program established under the Food and Nutrition Act of 2008.</text></clause><clause id="id125B19CF2944477595471CB2C251D862"><enum>(iv)</enum><text>Individuals who are medically frail (as defined in section 1937(a)(2)(B)(vi)).</text></clause><clause id="id4FCB983EE1B041158B47BB892256217B"><enum>(v)</enum><text>Individuals during pregnancy and the 60-day postpartum period beginning on the last day of pregnancy.</text></clause><clause id="id6C1668AAA33244BEA9E410C4C140766D"><enum>(vi)</enum><text>Individuals suffering from a temporary illness or incapacity that an appropriate professional has certified prevents their participation in work activities.</text></clause><clause id="id86DFAD08373340B297078EABCAB30776"><enum>(vii)</enum><text>Individuals who are engaged in treatment for a substance use disorder. </text></clause><clause id="idC42CD91B06684C4890B3ACDCF6F6CE12"><enum>(viii)</enum><text>Individuals whose participation in work activities is subject to any other good cause exemption established by the State and approved by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
