which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Indian Civil Rights Act of 1968 to extend the jurisdiction of tribal courts to cover crimes involving sexual violence, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id63BE59DAE83F4CAEA41DBC4948E62BBE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Native Survivors of Sexual Violence Act</short-title></quote>.</text></section><section commented="no" id="idACE4CE7763A049F0B0D37FBF83AC5646"><enum>2.</enum><header>Tribal jurisdiction over covered crimes</header><text display-inline="no-display-inline">Section 204 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1304">25 U.S.C. 1304</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>) is amended—</text><paragraph id="ide7b485849e784477bdd52c259ddd435c"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">crimes of domestic violence</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">covered crimes</header-in-text></quote>;</text></paragraph><paragraph id="id83F274D601D04950AAD404BA792DA8BA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="idC5C01392D87D415688153F7A789E84DB"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="id2C6A99AFCBD844B0A947CCFB7AAE68C3"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (3), (4), (5), (6), and (7) as paragraphs (3), (5), (7), (8), (11), and (12), respectively; </text></subparagraph><subparagraph id="idF54542F4C25E49979E4108EE32AA5F9D"><enum>(C)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id416D5C9A89054599B73479B4BED96688"><paragraph id="id9354fa248eb1453a9917d28ac45b1dac"><enum>(1)</enum><header>Coercion; commercial sex act</header><text>The terms <term>coercion</term> and <term>commercial sex act</term> have the meanings given the terms in section 1591(e) of title 18, United States Code.</text></paragraph><paragraph id="id0e26f6babc1e46508b20f747073d651f"><enum>(2)</enum><header>Covered crime</header><text>The term <term>covered crime</term> means—</text><subparagraph id="id3a9fd5b5ea934565ba9da0486b425e0c"><enum>(A)</enum><text>dating violence;</text></subparagraph><subparagraph id="id3dc94e4699ec4c76a25979d44ba37e5d"><enum>(B)</enum><text>domestic violence;</text></subparagraph><subparagraph id="idFCD76139507645BFB34F9EECCFD4125D"><enum>(C)</enum><text>obstruction of justice;</text></subparagraph><subparagraph id="id5599aa02099046b783fac629fada0ed0"><enum>(D)</enum><text>sexual violence;</text></subparagraph><subparagraph id="id9552a8d1347f4021814fb9400277b263"><enum>(E)</enum><text>sex trafficking; </text></subparagraph><subparagraph id="id411f6b4606c34aa6a312edddd16798ba"><enum>(F)</enum><text>stalking; and</text></subparagraph><subparagraph id="id6A0BF47C93A54143A27EC7FACC5A1796" commented="no"><enum>(G)</enum><text>a violation of a protection order.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="id7f76f0cd191c4d8baa775639feadad80"><enum>(D)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>violence committed</quote> and inserting <quote>any violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that is committed</quote>; </text></subparagraph><subparagraph commented="no" id="id65C0F6631F824F4CA32B9E6EA6DDEB3A"><enum>(E)</enum><text>by inserting after paragraph (3) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="id69fb7ee133c94d1ab989bb5663698014" style="OLC"><paragraph id="id0c775b3bb6244c28a21e0011ad5f1965"><enum>(4)</enum><header>Domestic violence</header><text>The term <term>domestic violence</term> means any violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that is committed by—</text><subparagraph id="id805b23194e5e42409d5970aad457e11c"><enum>(A)</enum><text>a current or former spouse or intimate partner of the victim;</text></subparagraph><subparagraph id="idf57311d01bc3486f9d40eba62b8fa6d6"><enum>(B)</enum><text>a person with whom the victim shares a child in common;</text></subparagraph><subparagraph id="id6866f8d710174224b3dd7fa88bc3d9ae"><enum>(C)</enum><text>a person who is cohabitating with or has cohabitated with the victim as a spouse or intimate partner;</text></subparagraph><subparagraph id="id8c471a8aca3043b6ae56eec5ba680e1d"><enum>(D)</enum><text>a person similarly situated to a spouse of the victim under the domestic- or family-violence laws of the Indian tribe that has jurisdiction over the Indian country where the violation occurs; or</text></subparagraph><subparagraph id="id16a2bb679cf44798bb38c532db2da953"><enum>(E)</enum><text>a person against an adult or child victim who is protected from the acts of that person under the domestic- or family-violence laws of the Indian tribe that has jurisdiction over the Indian country where the violation occurs.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="id15B77B31E2844417ACAC6FB676020750"><enum>(F)</enum><text>by inserting after paragraph (5) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idce5ea3f9f3fe4ede84789fcd21159ad9"><paragraph id="idab7f22281ad849e5a13553af5fc1860b"><enum>(6)</enum><header>Obstruction of justice</header><text>The term <term>obstruction of justice</term> means any violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that involves interfering with the administration or due process of the laws of the Indian tribe, including any tribal criminal proceeding or investigation of a crime.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id427A8E828B0D4FFC9004DFAF39AF90EA"><enum>(G)</enum><text>in paragraph (7) (as so redesignated), by striking <quote>domestic violence</quote> and inserting <quote>tribal</quote>;</text></subparagraph><subparagraph id="idC51A476F77E442199D4959AAB89B694B"><enum>(H)</enum><text>by inserting after paragraph (8) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="idFDE83E30CB6744C2B9386947D410A1C8" style="OLC"><paragraph commented="no" id="id0afe3697218444ca85af6dd4e1c213a1"><enum>(9)</enum><header>Sex trafficking</header><text>The term <term>sex trafficking</term> means conduct—</text><subparagraph commented="no" id="id5d86f4b21c344ecb86557313a7d99242"><enum>(A)</enum><text>consisting of—</text><clause commented="no" id="id142693274ae447bcae89ed1a3b99d8d9"><enum>(i)</enum><text>recruiting, enticing, harboring, transporting, providing, obtaining, advertising, maintaining, patronizing, or soliciting by any means a person; or</text></clause><clause commented="no" id="idfd3d5c6d9b824024a8f97dd625985a28"><enum>(ii)</enum><text>benefitting, financially or by receiving anything of value, from participation in a venture that has engaged in an act described in clause (i); and</text></clause></subparagraph><subparagraph commented="no" id="id285e2db879ad44599fd6df7b5841ad7a"><enum>(B)</enum><text>carried out with the knowledge, or, except if the act constituting the violation of subparagraph (A)(i) is advertising, in reckless disregard of the fact, that—</text><clause commented="no" id="idbe120da9d545460091fdae8f28926bde"><enum>(i)</enum><text>means of force, threats of force, fraud, coercion, or any combination of such means will be used to cause the person to engage in a commercial sex act; or</text></clause><clause commented="no" id="id564858c15bf0410b8cfcdfe968774627"><enum>(ii)</enum><text>the person has not attained the age of 18 years and will be caused to engage in a commercial sex act.</text></clause></subparagraph></paragraph><paragraph id="idbbfbec114b2a4099be5e7b4a85e14445"><enum>(10)</enum><header>Sexual violence</header><text>The term <term>sexual violence</term> means any nonconsensual sexual act of contact proscribed by the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs, including in any case in which the victim lacks the capacity to consent to the act.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id0268016DB1184B439371604B81D2E940"><enum>(I)</enum><text>in paragraph (11) (as so redesignated)—</text><clause id="idF29EB2BA01A14726A95F71E9B3746F9D"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">domestic violence</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">tribal</header-in-text></quote>; and</text></clause><clause id="idC7871AD35BD44958A8000777DE603CDF"><enum>(ii)</enum><text>by striking <quote>domestic violence</quote> and inserting <quote>tribal</quote>; and</text></clause></subparagraph><subparagraph id="id973006A92FC4484DB3B6D1A5BBDB8D34"><enum>(J)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0A34EF3D3F1449AE960366F5744BBDE0"><paragraph id="id03a50f249a37464babc64663756657f5"><enum>(13)</enum><header>Stalking</header><text>The term <term>stalking</term> means engaging in a course of conduct directed at a specific person proscribed by the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that would cause a reasonable person—</text><subparagraph id="id0b83d115b02742b9bd8a50043924dc58"><enum>(A)</enum><text>to fear for the safety of the person or the safety of others; or</text></subparagraph><subparagraph id="idba9c09c2cb3949b398874853ec7abe55"><enum>(B)</enum><text>to suffer substantial emotional distress.</text></subparagraph></paragraph><paragraph id="idb015fbd469d344afadde0858472459e7" commented="no"><enum>(14)</enum><header>Violation of a protection order</header><text>The term <term>violation of a protection order</term> means an act that—</text><subparagraph id="id1f64668a0a8140a6a9954df99e83e9a7" commented="no"><enum>(A)</enum><text>occurs in the Indian country of the participating tribe; and</text></subparagraph><subparagraph id="id3a8e80adbbd34e718a6c8c89cfab247b" commented="no"><enum>(B)</enum><text>violates a provision of a protection order that—</text><clause id="id908ca2a81b2a4fa28243eee675b12525" commented="no"><enum>(i)</enum><text>prohibits or provides protection against violent or threatening acts or harassment against, sexual violence against, contact or communication with, or physical proximity to, another person;</text></clause><clause id="id71f4fae831a0484a8991c6e569f7f183" commented="no"><enum>(ii)</enum><text>was issued against the defendant;</text></clause><clause id="id901185867a4542ca90dfa053f78552d4" commented="no"><enum>(iii)</enum><text>is enforceable by the participating tribe; and</text></clause><clause id="id2817525a8aad449b96090c6da16a8064" commented="no"><enum>(iv)</enum><text>is consistent with section 2265(b) of title 18, United States Code.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idBAE8DE9B76EE4268BA2E02D0D2C87D40"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="id35A3D821DC5F4000B7D8C72DADDCE21A"><enum>(A)</enum><text>by striking <quote>domestic violence</quote> each place the term appears and inserting <quote>tribal</quote>;</text></subparagraph><subparagraph id="id67BE2FE448884D228C94595E54C09A5C"><enum>(B)</enum><text>in paragraph (1), by inserting <quote>, including any participating tribe in the State of Maine,</quote> before <quote>include</quote>; and</text></subparagraph><subparagraph id="id877E055E98284B9E9D59CB1F968F6DEF"><enum>(C)</enum><text>in paragraph (4)—</text><clause id="idCB7C278E152B466BB8D0C961CA323FB4"><enum>(i)</enum><text>by striking subparagraph (B);</text></clause><clause id="idC795289AE4124652B52A60AFA025CDB5"><enum>(ii)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>A participating</quote> in clause (i) of subparagraph (A) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id47F88DC0B036481D8F7E596EE83CA129"><paragraph id="id5ECCF53921684932AAF7561326E2B41C"><enum>(4)</enum><header>Exception for non-Indian victim and defendant</header><subparagraph id="id89C22C00D7E0489FAB754E2EB4246610"><enum>(A)</enum><header>In general</header><text>A participating</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id32098A3D3A0649948B90971C5E64B8F8"><enum>(iii)</enum><text>in clause (ii), by striking the clause designation and heading and all that follows through <quote>In this subparagraph</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id28D13BBD7FD6479A93D5F723FF83CA3B"><subparagraph id="id3B73127D44114C95AF1E282771702BFD"><enum>(B)</enum><header>Definition of victim</header><text>In this paragraph</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id4cb457b303f64b8a970b57a60c46f301"><enum>(4)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id241f962966c2421992adbab28f15a56e" style="OLC"><subsection id="id711dc50058ac4c99b6de3352401ff70d"><enum>(c)</enum><header>Criminal conduct</header><text>A participating tribe may exercise special tribal criminal jurisdiction over a defendant for a covered crime that occurs in the Indian country of the participating tribe.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id712F6D03A11A453E825017568CB5037D"><enum>(5)</enum><text>in subsection (d), by striking <quote>domestic violence</quote> each place the term appears and inserting <quote>tribal</quote>; and</text></paragraph><paragraph id="idB3584F19995A4C979A9AC69E6B81C9FB"><enum>(6)</enum><text>by striking subsections (f) through (h) and inserting the following:</text><quoted-block id="id343776547F3742A89A6A0F656595E857" display-inline="no-display-inline" style="OLC"><subsection id="idd052071bc603477c8fa5eecee33d6b1c"><enum>(f)</enum><header>Grants and reimbursement to Tribal governments</header><paragraph id="id62e8c76467144eda88ab30ddab02d413"><enum>(1)</enum><header>Reimbursement</header><subparagraph id="id5d5fcc31cf1f4afa90b43ec7dce61302"><enum>(A)</enum><header>In general</header><text>The Attorney General may reimburse governments of Indian tribes (or authorized designees of those governments) for expenses incurred in exercising special tribal criminal jurisdiction.</text></subparagraph><subparagraph id="idf926b918d96a472a8b674ba9213e9edd"><enum>(B)</enum><header>Eligible expenses</header><text>Eligible expenses for reimbursement shall include—</text><clause id="id577d48b9234b412c8507788f3806f1b5"><enum>(i)</enum><text>expenses incurred to arrest or prosecute offenders and to detain inmates, including costs associated with providing health care;</text></clause><clause id="id1900ecf93fa1488ba6e3f59957fe6ad1"><enum>(ii)</enum><text>expenses relating to indigent defense services; and</text></clause><clause id="id47c2d1270e474392bcc2e001177ea632"><enum>(iii)</enum><text>costs associated with probation and rehabilitation services.</text></clause></subparagraph><subparagraph id="ida492b9d30bad4abebf15e03c6ae8dd84"><enum>(C)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of the <short-title>Justice for Native Survivors of Sexual Violence Act</short-title>, the Attorney General shall, after consultation with Indian tribes, promulgate regulations to carry out this paragraph that set the maximum allowable reimbursements under this paragraph.</text></subparagraph></paragraph><paragraph id="id3ef92fef88a047859fe315a038c07f49"><enum>(2)</enum><header>Grants</header><text>The Attorney General may award grants to the governments of Indian tribes (or to authorized designees of those governments)—</text><subparagraph id="idb5dfdf74453846d19c94007b2285269d"><enum>(A)</enum><text>to strengthen tribal criminal justice systems to assist Indian tribes in exercising special tribal criminal jurisdiction, including—</text><clause id="id631f441ada7a4e4ca3f03644ddf7ddcd"><enum>(i)</enum><text>law enforcement, including the capacity of law enforcement, court personnel, or other non-law enforcement entities that have no Federal or State arrest authority but have been designated by an Indian tribe as responsible for maintaining public safety within its territorial jurisdiction, to enter information into and obtain information from national crime information databases;</text></clause><clause id="id1776663cde1e4b20b03a9db7a90189b6"><enum>(ii)</enum><text>prosecution;</text></clause><clause id="id0fda6b027e5e4c06be8594b9930058f8"><enum>(iii)</enum><text>trial and appellate courts, including facilities construction;</text></clause><clause id="id28b069c00a13402d8b98c13091434a55"><enum>(iv)</enum><text>probation systems;</text></clause><clause id="id34bd1dce3f5f42dda9665fd8c77e1a61"><enum>(v)</enum><text>detention and correctional facilities, including facilities construction;</text></clause><clause id="id65b2e6a4dfae433c81752c313d739d75"><enum>(vi)</enum><text>alternative rehabilitation centers;</text></clause><clause id="id9fceb4210117470c93cc4937c09e1d54"><enum>(vii)</enum><text>culturally appropriate services and assistance for victims and their families; and</text></clause><clause id="idd9662b1d36b54dda8cd8e129ecef606f"><enum>(viii)</enum><text>criminal codes and rules of criminal procedure, appellate procedure, and evidence;</text></clause></subparagraph><subparagraph id="ida5e72f4374fb4446ab1d973045410388"><enum>(B)</enum><text>to provide indigent criminal defendants with the effective assistance of licensed defense counsel, at no cost to the defendant, in criminal proceedings in which a participating tribe prosecutes covered crimes;</text></subparagraph><subparagraph id="id0807782d4a85459b86a238ec2280d9fa"><enum>(C)</enum><text>to ensure that, in criminal proceedings in which a participating tribe exercises special tribal criminal jurisdiction, jurors are summoned, selected, and instructed in a manner consistent with all applicable requirements; and</text></subparagraph><subparagraph id="idc61ad2ed90e2404e8947edc7fa008abe"><enum>(D)</enum><text>to accord victims of covered crimes rights that are similar to the rights of a crime victim described in section 3771(a) of title 18, United States Code, consistent with tribal law and custom.</text></subparagraph></paragraph></subsection><subsection id="id2bccfc7f098b47d59fb3112a965639f9"><enum>(g)</enum><header>Supplement, not supplant</header><text>Amounts made available under subsection (f)(2) shall supplement and not supplant any other Federal, State, or local government amounts made available to carry out activities described in this section.</text></subsection><subsection id="id8cb8b4f6db604433a30bf2961299d0f2"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $15,000,000 for each of fiscal years 2022 through 2026 to carry out subsection (f) and to provide training, technical assistance, data collection, and evaluation of the criminal justice systems of participating tribes.</text></subsection><subsection id="id634be8e469c24b77a6c2844d2b8ca084"><enum>(i)</enum><header>Use of funds</header><text>Of the funds appropriated under this section for each fiscal year—</text><paragraph id="id0AFA386FD7AF4E52A3825C4997B18BA8"><enum>(1)</enum><text>not less than 25 percent shall be used for the purposes described in subsection (f)(1); and</text></paragraph><paragraph id="idEDA7137115FA454495CA753EF9665FD8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>not less than 25 percent shall be used for the purposes described in subsection (f)(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
