<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3323</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211207">December 7, 2021</action-date><action-desc><sponsor name-id="S398">Mr. Cramer</sponsor> (for himself and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Veterans Affairs to make certain improvements to the Veterans Justice Outreach Program, and for other purposes.</official-title></form><legis-body style="OLC"><section id="HAB4D12FEE152448AAE9BAD2D0D867A5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Justice Outreach Improvement Act of 2021</short-title></quote>. </text></section><section id="HAAF20918B7FC499AB6B551511C31B46D"><enum>2.</enum><header>Improvements to Veterans Justice Outreach Program</header><subsection id="H69C6E72A53D04195A10DF70DAACD318B"><enum>(a)</enum><header>Outreach requirement</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall conduct outreach regarding the Veterans Justice Outreach Program to justice-involved veterans, military and veterans service organizations, and relevant stakeholders in the criminal justice community, including officials from local law enforcement, court, and jail systems and others as determined appropriate by the Secretary. Such outreach—</text><paragraph id="HC9F13A3DD8304A669146FE0D00E06FDC"><enum>(1)</enum><text>shall be designed—</text><subparagraph id="H430992225BF7451595B7E1B226AC9C16"><enum>(A)</enum><text>to spread awareness and understanding of the Program;</text></subparagraph><subparagraph id="H94F8A3BB61F942AAB7EB34C5DBCE2DE8"><enum>(B)</enum><text>to spread awareness and understanding of veteran eligibility for the Program, including the eligibility of veterans who were discharged from service in the Armed Forces under conditions other than honorable; and</text></subparagraph><subparagraph id="H5EF630CAB3B04800AEC226428138C315"><enum>(C)</enum><text>to improve the identification of justice-involved veterans; and</text></subparagraph></paragraph><paragraph id="HD540C23C9789440C9D51EEBC535281DE"><enum>(2)</enum><text>may be conducted in person, virtually, or through other means, including by the dissemination of informational materials and contact information.</text></paragraph></subsection><subsection id="H8587126046FA4F09A061299BF1E54038"><enum>(b)</enum><header>Strategic plan</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall develop a strategic plan for the Veterans Justice Outreach Program. In developing such plan, the Secretary shall conduct—</text><paragraph id="H05514E6ED5214EC2ADE5A1CD9550EEB9"><enum>(1)</enum><text>an assessment of barriers to working with justice-involved veterans in rural, remote, and underserved areas, including potential steps to address such barriers; and</text></paragraph><paragraph id="H931E074FCBF248D7BD361822552535F5"><enum>(2)</enum><text>a workforce gap analysis for the Program.</text></paragraph></subsection><subsection id="HDAC6FA5FE5504FCF84365C742BE2FE67"><enum>(c)</enum><header>Increase in number of VJO specialists</header><paragraph id="HD3D9AE515C2B47B8A9C4FD96CB0B6ED6"><enum>(1)</enum><header>Increase</header><text>The Secretary of Veterans Affairs shall increase the number of Veterans Justice Outreach specialists responsible for supporting justice-involved veterans in rural, remote, or underserved areas, including areas located far from Department of Veterans Affairs medical centers, as determined by the Secretary, through—</text><subparagraph id="H6D6FE56C0F1B44D7ADA1AC6150410F9A"><enum>(A)</enum><text display-inline="yes-display-inline">the hiring of additional Veterans Justice Outreach specialists;</text></subparagraph><subparagraph id="HF494CE5161C249E79A890640DDE52A7F"><enum>(B)</enum><text>the reallocation of existing Veterans Justice Outreach specialists; or</text></subparagraph><subparagraph id="H4D67DBA545C34E768B1FDBCC39F8BFD6"><enum>(C)</enum><text>such other means as may be determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="H455E45BB72264C82953C3867524CA170"><enum>(2)</enum><header>Determination</header><text display-inline="yes-display-inline">The Secretary shall determine the number of Veterans Justice Outreach specialists required, and the locations of such specialists, under paragraph (1) by taking into account—</text><subparagraph id="H705EFAEE830549A1A344FA3BDD82D8FB"><enum>(A)</enum><text display-inline="yes-display-inline">such number and locations needed to achieve the mission and strategic goals of the Veterans Justice Outreach Program;</text></subparagraph><subparagraph id="HF6EEB7BC54754DAE87A4A0A67730B442"><enum>(B)</enum><text>any gaps in the workforce of the Program, including such gaps identified pursuant to subsection (b)(2); and</text></subparagraph><subparagraph id="HD9FE8A95A0BB4779A038F2DDA759644A"><enum>(C)</enum><text>strategies to address such gaps.</text></subparagraph></paragraph><paragraph id="H86ECB279E9E3477F8CD01EE7600C38C5"><enum>(3)</enum><header>Use of technology</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall consider the use of virtual technology.</text></paragraph></subsection><subsection id="H94923E2CCF6D49B2ACA5FB2C2A3195A4"><enum>(d)</enum><header>Performance goals and implementation plans</header><paragraph id="H9BEAC3AB15974523906C578B9EF2B81D"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Veterans Affairs shall establish performance goals and implementation plans for—</text><subparagraph id="HDC61BBED71444D6498B0CBC298C5B3A2"><enum>(A)</enum><text>the Veterans Justice Outreach Program;</text></subparagraph><subparagraph id="H5953612AD87549B69DAC46569BA4B45A"><enum>(B)</enum><text>Veterans Justice Outreach Specialists; and</text></subparagraph><subparagraph id="HCFDADF52AE3A4B73947B3B80AA80F7C4"><enum>(C)</enum><text>providing support for research regarding justice-involved veterans.</text></subparagraph></paragraph><paragraph id="H59D84F6F799D47B88EC04A38D22D7029"><enum>(2)</enum><header>Consistency with strategic plan</header><text display-inline="yes-display-inline">The Secretary shall ensure that the performance goals and implementation plans under paragraph (1) are consistent with the strategic plan under subsection (b) and include—</text><subparagraph id="H9436890BBC0F427EBC3C0E8F40D7FD2C"><enum>(A)</enum><text display-inline="yes-display-inline">qualitative and quantitative milestones, measures, and metrics, and associated timelines for completion of the plans under paragraph (1) and barriers to such completion;</text></subparagraph><subparagraph id="H4791B72A95854F1BBF61718E8EBF14C6"><enum>(B)</enum><text>an identification of relevant staff; and</text></subparagraph><subparagraph id="HADA0118468A34F15B0B3B352F13A31B2"><enum>(C)</enum><text>an estimate of resource needs and sources.</text></subparagraph></paragraph><paragraph id="H547D337512824F2D97E33C764A37A816"><enum>(3)</enum><header>Performance data</header><text display-inline="yes-display-inline">The Secretary shall establish a process to regularly collect and analyze performance data to assess the efficiency and effectiveness of implementing the plans under paragraph (1).</text></paragraph></subsection><subsection id="H107D299EF027433490022DB59B1AB2BA"><enum>(e)</enum><header>Training requirement</header><text>The Secretary shall ensure that all Veterans Justice Outreach Specialists receive training not less frequently than annually on—</text><paragraph id="H54E1259BFC914FFE8F58A1965D4ECC70"><enum>(1)</enum><text>best practices for identifying and conducting outreach to justice-involved veterans and relevant stakeholders in the criminal justice community; and</text></paragraph><paragraph id="H053F3083802F49A495EE05041E82D67F"><enum>(2)</enum><text display-inline="yes-display-inline">veteran eligibility for the Veterans Justice Outreach Program, including with respect to consistently communicating changes regarding eligibility (including through the use of a script or other reference materials). </text></paragraph></subsection><subsection id="HAC0535F233244021A72D2B10A994E322" commented="no"><enum>(f)</enum><header>Reports on implementation</header><paragraph id="H367C1A67FB064680AF89E8D089B40208"><enum>(1)</enum><header>First report</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall submit to Congress a report on the following:</text><subparagraph id="HE29594C3013A44F39D9186A0BDE1A874" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">An assessment of implementing subsection (c), including—</text><clause id="H3075AB61DC774734B5B470B9B4F2DA99" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">strategies to increase Veterans Justice Outreach specialists responsible for supporting justice-involved veterans in rural, remote, or underserved areas; and</text></clause><clause id="H393FC021C7CE48538A5EA9E4AD0E7F5E" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the progress of the Secretary in addressing gaps in the workforce of the Veterans Justice Outreach Program identified pursuant to paragraph (2) of such subsection.</text></clause></subparagraph><subparagraph id="HC35268A45034429D86F02109AE8D3CD5" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The performance goals and implementation plans established under subsection (d)(1).</text></subparagraph></paragraph><paragraph id="HB01D9A497685490AB7315E450C4F568F"><enum>(2)</enum><header>Subsequent report</header><text display-inline="yes-display-inline">Not later than three years after the date on which the first report is submitted under paragraph (1), the Secretary shall submit to Congress a report on the progress of the Secretary in meeting the performance goals and carrying out activities under the implementation plans established under subsection (d)(1).</text></paragraph></subsection><subsection id="HE624B16AF2144394B45F0C2E8AE06228"><enum>(g)</enum><header>Report on veterans treatment courts</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary, in consultation with the Attorney General, shall submit to Congress a report on the engagement of the Department of Veterans Affairs with veterans treatment courts, including—</text><paragraph id="H584A2538F4354ADEA766CC122DFC05B2"><enum>(1)</enum><text display-inline="yes-display-inline">the availability and efficacy of veterans treatment courts in meeting the needs of justice-involved veterans;</text></paragraph><paragraph id="HEDF682B2CB984477B77A4A33585342AC"><enum>(2)</enum><text>best practices for Department of Veterans Affairs staff and justice-involved veterans in working with veterans treatment courts; and</text></paragraph><paragraph id="H86C2392DE6184652A5CFD333B1DC9E30"><enum>(3)</enum><text>the ability of justice-involved veterans to access veterans treatment courts, including any barriers that exist to increasing such access.</text></paragraph></subsection><subsection id="H54A89B23E28A4A2DB9192EC7C5B7F599"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HAF71531D978344CC957C3A0A6F0A53E0"><enum>(1)</enum><header>Justice-involved veteran</header><text display-inline="yes-display-inline">The term <term>justice-involved veteran</term> means a veteran with active, ongoing, or recent contact with some component of a local criminal justice system. </text></paragraph><paragraph id="HA4316D4E55A3433993556DA5CDA2DDD5"><enum>(2)</enum><header>Veterans Justice Outreach Program</header><text>The term <term>Veterans Justice Outreach Program</term> means the program through which the Department of Veterans Affairs identifies justice-involved veterans and provides such veterans with access to Department services.</text></paragraph><paragraph id="HF8FAB512DF3F40309B7FD269C4CE5704"><enum>(3)</enum><header>Veterans Justice Outreach Specialist</header><text>The term <term>Veterans Justice Outreach Specialist</term> means an employee of the Department of Veterans Affairs who serves as a liaison between the Department and the local criminal justice system on behalf of a justice-involved veteran.</text></paragraph><paragraph id="H91512DADD2EC4FA785B9BB94E209174D"><enum>(4)</enum><header>Veterans treatment court</header><text display-inline="yes-display-inline">The term <term>veterans treatment court</term> means a State or local court that is participating in the veterans treatment court program (as defined in section 2991(i)(1) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797aa">42 U.S.C. 3797aa(i)(1)</external-xref>)).</text></paragraph></subsection></section></legis-body></bill>
